4746 32preventtheboardofaldermenofacitynotwithinacountyfromadoptingordinancesto
4847 33governthepensioningoffirefightersandsuchfirefighters'covereddependentsinany
4948 34otherpensionplansimultaneouslyadministeredbytheboardoftrusteesofthe

5150 87.145.Theboardoftrusteesshallhaveexclusiveoriginaljurisdictioninallmatters
5251 2relatingtooraffectingthefundshereinprovidedfor,including,inadditiontoallother
5352 3matters,allclaimsforbenefitsandrefundsunderthislaw,anditsaction,decisionor
5453 4determinationinanymattershallbereviewableunderchapter536only,andanypartytothe
5554 5proceedingsshallhavearightofappealfromthedecisionofthereviewingcourt.Subjectto
5655 6thelimitationsofsections87.120to87.370,theboardoftrusteesshall,fromtimetotime,

6766 2necessaryforactuarialvaluationofthefundsoftheretirementsystemandforcheckingthe

6968 4 2.Theboardoftrusteesshallkeeparecordofallitsproceedingswhichshallbeopen
7069 5topublicinspection.Itshallpublishannuallyareportshowingthefiscaltransactionsofthe
7170 6retirementsystemfortheprecedingfiscalyear,theamountoftheaccumulatedcashand
7271 7securitiesofthesystem,andthelastbalancesheetshowingthefinancialconditionofthe
7372 8systembymeansofanactuarialvaluationoftheassetsandliabilitiesoftheretirement

7574 10 3.Totheextenttheboardoftrusteesadministersapensionplanotherthanthe
7675 11retirementsystem,theboardoftrusteesshallmaintainseparaterecordsofall
7776 12proceedingsofsuchotherpensionplan.
7877 87.260.Theboardoftrusteesofthefirefighters'retirementsystemshallhavethe
7978 2exclusiveauthorityanddiscretiontoinvestandreinvestthefundsinpropertyofanykind,real
8079 3orpersonal.Theboardoftrusteesshallinvestandmanagethefundasaprudentinvestor
8180 4would,byconsideringthepurposes,terms,distributionrequirements,andothercircumstances
8281 5ofthefirefighters'retirementsystem.Insatisfyingthisstandard,theboardoftrusteesshall
8382 6exercisereasonablecare,skill,andcaution.Notrusteeshallhaveanyinterestasatrusteein
8483 7thegainsorprofitsmadeonanyinvestment,exceptbenefitsfrominterestininvestments
8584 8commontoallmembersoftheplan,ifentitledthereto.Totheextenttheboardoftrustees
8685 9administersapensionplanotherthantheretirementsystem,theboardoftrusteesshall
8786 10alsohavetheauthorityanddiscretiontoinvestandreinvestthefundsofsuchother
8887 11pensionplaninpropertyofanykind,realorpersonal.Theboardoftrusteesmay
8988 12choosetoinvestthefundsoftheretirementsystemandthefundsoftheotherpension
9089 13planinthesameinvestmentssolongastheamountsinvestedandthegains,profits,or
9190 14lossesonsuchinvestmentsareaccountedforseparately.Nobenefitsduetothe
9291 15firefightersorsuchfirefighters'covereddependentsfromtheotherpensionplanshall
9392 16bepaidfromthefundsoftheretirementsystem.Nothinginthissectionshallprevent
9493 17theboardofaldermenofacitynotwithinacountyfromadoptingordinancestogovern
9594 18thepensioningoffirefightersandsuchfirefighters'covereddependentsinanyother

9897 87.350.Theexpensefundshallbethefundtowhichshallbecreditedallmoney
9998 2providedtopaytheadministrationexpensesoftheretirementsystemandfromwhichshallbe
10099 3paidalltheexpensesnecessaryinconnectionwiththeadministrationandoperationofthe
101100 4system.Annuallytheboardoftrusteesshallestimatetheamountofmoneynecessarytobe
102101 5paidintotheexpensefundduringtheensuingyeartoprovidefortheexpenseofoperationof
