161.670.1.Notwithstandinganyotherlaw,priortoJuly1,2007,thestateboardof
2educationshallestablishthe"MissouriCourseAccessandVirtualSchoolProgram"toserve
3school-agestudentsresidinginthestate.TheMissouricourseaccessandvirtualschool
4programshalloffernonclassroom-basedinstructioninavirtualsettingusingtechnology,
5intranet,orinternetmethodsofcommunication.Anystudentundertheageoftwenty-onein
6gradeskindergartenthroughtwelvewhoresidesinthisstateshallbeeligibletoenrollinthe
7Missouricourseaccessandvirtualschoolprogrampursuanttosubsection3ofthissection.
8 2.(1)Forpurposesofcalculationanddistributionofstateschoolaid,students
9enrolledintheMissouricourseaccessandvirtualschoolprogramshallbeincludedinthe
10studentenrollmentoftheschooldistrictinwhichthestudentisenrolledundertherelevant
11provisionsofsubsection3ofthissectionforsuchenrollment.Studentattendanceforfull-
12timevirtualprogramstudentsshallonlybeincludedinanydistrictpupilattendance
13calculationunderchapter163usingcurrent-yearpupilattendanceforsuchfull-timevirtual
14programpupils.Forthepurposeofcalculatingaveragedailyattendanceinfull-timevirtual
15programsunderthissection,averagedailyattendanceshallbedefinedasthequotientorthe
16sumofthequotientsobtainedbydividingthetotalnumberofhoursattendedinatermby
17enrolledpupilsbetweentheagesoffiveandtwenty-onebytheactualnumberofhoursthat
18theprogramwasinsessioninthatterm,andtheprovisionsofsection162.1250shallnot
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 19applytosuchfundingcalculation.Suchcalculationshallbegeneratedbythevirtualprovider
20andprovidedtothehostdistrictforsubmissiontothedepartmentofelementaryand
21secondaryeducation.Suchstudentsmaycompletetheirinstructionalactivities,asdefinedin
22subsection4ofthissection,duringanyhourofthedayandduringanydayoftheweek.The
23hoursattendedforeachenrolledpupilshallbedocumentedbythepupil'sweeklyprogressin
24theeducationalprogramaccordingtoaprocessdeterminedbythevirtualprogramand
25publishedannuallyinthevirtualprogram'senrollmenthandbookorpolicy.Totheaverage
26dailyattendanceofthefollowingschooltermshallbeaddedthefull-timeequivalentaverage
27dailyattendanceofsummerschoolstudents.Inthecaseofahostschooldistrictenrollingone
28ormorefull-timevirtualschoolstudents,suchenrollingdistrictshall,aspartofitsmonthly
29stateallocation,receivenolessunderthestateaidcalculationforsuchstudentsthanan
30amountequaltothestateadequacytargetmultipliedbytheweightedaveragedailyattendance
31ofsuchfull-timestudents.StudentsresidinginMissouriandenrolledinafull-timevirtual
32schoolprogramoperatedbyapublicinstitutionofhighereducationinthisstateshallbe
33countedforastateaidcalculationbythedepartment,andthedepartmentshallpay,from
34fundsdedicatedtostateschoolaidpaymentsmadeundersection163.031,tosuchinstitution
35anamountequaltothestateadequacytargetmultipliedbytheweightedaveragedaily
36attendanceofsuchfull-timestudents.
37 (2)TheMissouricourseaccessandvirtualschoolprogramshallreporttothedistrict
38ofresidencethefollowinginformationabouteachstudentservedbytheMissouricourse
39accessandvirtualschoolprogram:name,address,eligibilityforfreeorreduced-pricelunch,
40limitedEnglishproficiencystatus,specialeducationneeds,andthenumberofcoursesin
41whichthestudentisenrolled.TheMissouricourseaccessandvirtualschoolprogramshall
42promptlynotifytheresidentdistrictwhenastudentdiscontinuesenrollment.A"full-time
43equivalentstudent"isastudentwhoisenrolledintheinstructionalequivalentofsixcredits
44perregularterm.EachMissouricourseaccessandvirtualschoolprogramcourseshallcount
45asoneclassandshallgeneratethatportionofafull-timeequivalentthatacomparablecourse
46offeredbytheschooldistrictwouldgenerate.
47 (3)Pursuanttoaneducationservicesplanandcollaborativeagreementunder
48subsection3ofthissection,full-timeequivalentstudentsmaybeallowedtouseaphysical
49locationoftheresidentschooldistrictforallorsomeportionofongoinginstructionalactivity,
50andtheenrollmentplanshallprovideforreimbursementofcostsoftheresidentdistrictfor
51providingsuchaccesspursuanttorulespromulgatedunderthissectionbythedepartment.
52 (4)Innocaseshallmorethanthefull-timeequivalencyofaregulartermof
53attendanceforasinglestudentbeusedtoclaimstateaid.Full-timeequivalentstudentcredit
54completedshallbereportedtothedepartmentofelementaryandsecondaryeducationinthe
55mannerprescribedbythedepartment.Nothinginthissectionshallprohibitstudentsfrom
HCSHB220	2 56enrollinginadditionalcoursesunderaseparateagreementthatincludestermsforpaying
57tuitionorcoursefees.
58 (5)Afull-timevirtualschoolprogramservingfull-timeequivalentstudentsshallbe
59consideredanattendancecenterinthehostschooldistrictandshallparticipateinthe
60statewideassessmentsystemasdefinedinsection160.518.Theacademicperformanceof
61studentsenrolledinafull-timevirtualschoolprogramshallbeassignedtothedesignated
62attendancecenterofthefull-timevirtualschoolprogramandshallbeconsideredinlike
63mannertootherattendancecenters.Theacademicperformanceofanystudentwhodisenrolls
64fromafull-timevirtualschoolprogramandenrollsinapublicschoolorcharterschoolshall

70 3.(1)AstudentwhoresidesinthisstatemayenrollinMissouricourseaccessand
71virtualschoolprogramcoursesofhisorherchoiceasapartofthestudent'sannualcourse
72loadeachschoolyear,withanycostsassociatedwithsuchcourseorcoursestobepaidbythe
73schooldistrictorcharterschoolif:
74 (a)Thestudentisenrolledfull-timeinapublicschool,includinganycharterschool;

76 (b)PriortoenrollinginanyMissouricourseaccessandvirtualschoolprogram
77course,astudenthasreceivedapprovalfromhisorherschooldistrictorcharterschool

79 (2)Eachschooldistrictorcharterschoolshalladoptapolicythatdelineatesthe

90causejustificationtodisapproveastudent'srequestforenrollmentinacourseshallbea
91determinationthatdoingsoisnotinthebesteducationalinterestofthestudent,andshallbe
92consistentwiththedeterminationthatwouldbemadeforsuchcourserequestunderthe

94districtandacharterschoolstudentwouldenrollinasimilarcourseofferedbythecharter
95school,exceptthatthedeterminationmayconsiderthesuitabilityofvirtualcoursesforthe
96studentbasedonpriorparticipationinvirtualcoursesbythestudent.Appealsofanycourse
97denialsunderthissubsectionshallbeconsideredunderapolicythatissubstantiallysimilarto
98thetypicalprocessbywhichappealswouldbeconsideredforastudentseekingtoenrollin
99coursesofferedbytheschooldistrictandacharterschoolstudentseekingtoenrollincourses

101 (3)ForstudentsenrolledinanyMissouricourseaccessandvirtualschoolprogram
102courseinwhichcostsassociatedwithsuchcoursearetobepaidbytheschooldistrictor
103charterschoolasdescribedunderthissubdivision,theschooldistrictorcharterschoolshall
104paythecontentproviderdirectlyonaproratamonthlybasisbasedonastudent'scompletion

112 (4)(a)Astudentwholivesinthisstatemayenrollinavirtualprogramoftheir
113choiceasprovidedinthissubdivision,andtheprovisionsofsubdivisions(1)to(3)ofthis
114subsectionshallnotapplytosuchenrollmentinafull-timevirtualprogram.Eachhostschool
115districtoperatingafull-timevirtualprogramunderthissectionshalladopt,operateand
116implementanenrollmentpolicyasspecifiedbytheprovisionsofthissubdivision.The
117student,thestudent'sparentorguardianifthestudentisnotconsideredhomeless,thevirtual
118program,thehostdistrict,andtheresidentdistrictshallcollaborateingoodfaithtoimplement
119theenrollmentpolicyregardingthestudent'senrollment,andtheresidentschooldistrictand
120thehostschooldistrictmaymutuallyagreethattheresidentdistrictshallofferorcontinueto
121offerservicesforthestudentunderanagreementthatincludesfinancialtermsfor
122reimbursementbythehostschooldistrictforthenecessarycostsoftheresidentschooldistrict
123providingsuchservices.Anenrollmentpolicyspecifiedunderthissubsectionshall:
124 a.Requireastudent'sparentorguardian,ifthestudentisnotconsideredhomeless,to
125applyforenrollmentinafull-timevirtualprogramdirectlywiththevirtualprogram;
126 b.Specifytimelinesfortimelyparticipationbythevirtualprogram,thehostdistrict,
127andresidentdistrict;providedthattheresidentdistrictshallprovideanyrelevantinformation
128andinputontheenrollmentwithintenbusinessdaysofnoticefromthevirtualprogramofthe
129enrollmentapplication;

147 (b)Thedepartmentshallpublishanannualreportbasedontheenrollmentsand
148enrollmentsurveysconductedunderthissubdivisionthatprovidesdataatthestatewideand
149districtlevelsofsufficientdetailtoallowanalysisoftrendsregardingthereasonsfor
150participationinthevirtualprogramatthestatewideanddistrictlevels;providedthatnosuch
151surveyresultswillbepublishedinamannerthatrevealsindividualstudentinformation.The
152departmentshallalsoinclude,intheannualreport,dataatthestatewideanddistrictlevelsof
153sufficientdetailtoallowdetectionandanalysisoftheracial,ethnic,andsocio-economic
154balanceofvirtualprogramparticipationamongschoolsanddistrictsatthestatewideand
155districtlevels,providedthatnosuchsurveyresultswillbepublishedinamannerthatreveals
156individualstudentinformation.
157 (5)InthecaseofastudentwhoisacandidateforA+tuitionreimbursementand
158takingavirtualcourseunderthissection,theschoolshallattributenolessthanninety-five
159percentattendancetoanysuchstudentwhohascompletedsuchvirtualcourse.
160 (6)TheMissouricourseaccessandvirtualschoolprogramshallensurethat
161individuallearningplansdesignedbycertifiedteachersandprofessionalstaffaredeveloped

225 (2)Afull-timevirtualschoolshallsubmitanotificationtotheparentorguardianof
226anystudentwhoisnotconsistentlyengagedininstructionalactivitiesandshallprovide
227regularstudentprogressreportsforeachstudentatleastfourtimesperschoolyear.
228 (3)Eachfull-timevirtualschoolshalldevelop,adopt,andpostontheschool'swebsite
229apolicysettingforththeconsequencesforastudentwhofailstocompletetherequired
230instructionalactivities.Suchpolicyshallstate,ataminimum,thatifastudentfailsto
231completetheinstructionalactivitiesafterreceivinganotificationundersubdivision(2)ofthis
232subsection,andafterreasonableinterventionstrategieshavebeenimplemented,thatthe
233studentshallbesubjecttocertainconsequenceswhichmayincludedisenrollmentfromthe
234school.Priortoanydisenrollment,theparentorguardianshallhavetheopportunityto
235presentanyinformationthattheparentdeemsrelevant,andsuchinformationshallbe
236consideredpriortoanyfinaldecision.
237 (4)Ifafull-timevirtualschooldisenrollsastudentundersubdivision(3)ofthis

283governor,thechairandrankingmemberofthesenateeducationcommittee,andthechairand
284rankingmemberofthehouseofrepresentativeselementaryandsecondaryeducation

11anyschooldistrictswhichhaveanoperatinglevyforschoolpurposesinthecurrentyearless

13subdivision(4)ofsubsection5ofsection137.073.Atax-rate-weightedaveragedaily
