4programshalloffernonclassroom-basedinstructioninavirtualsettingusingtechnology, 5intranet,orinternetmethodsofcommunication.Anystudentundertheageoftwenty-onein 6gradeskindergartenthroughtwelvewhoresidesinthisstateshallbeeligibletoenrollinthe 7Missouricourseaccessandvirtualschoolprogrampursuanttosubsection3ofthissection. 8 2.(1)Forpurposesofcalculationanddistributionofstateschoolaid,students 9enrolledintheMissouricourseaccessandvirtualschoolprogramshallbeincludedinthe 10studentenrollmentoftheschooldistrictinwhichthestudentisenrolledundertherelevant 11provisionsofsubsection3ofthissectionforsuchenrollment.Studentattendanceforfull- 12timevirtualprogramstudentsshallonlybeincludedinanydistrictpupilattendance 13calculationunderchapter163usingcurrent-yearpupilattendanceforsuchfull-timevirtual 14programpupils.Forthepurposeofcalculatingaveragedailyattendanceinfull-timevirtual 15programsunderthissection,averagedailyattendanceshallbedefinedasthequotientorthe 16sumofthequotientsobtainedbydividingthetotalnumberofhoursattendedinatermby 17enrolledpupilsbetweentheagesoffiveandtwenty-onebytheactualnumberofhoursthat 18theprogramwasinsessioninthatterm,andtheprovisionsofsection162.1250shallnot EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis 20andprovidedtothehostdistrictforsubmissiontothedepartmentofelementaryand 21secondaryeducation.Suchstudentsmaycompletetheirinstructionalactivities,asdefinedin 22subsection4ofthissection,duringanyhourofthedayandduringanydayoftheweek.The 23hoursattendedforeachenrolledpupilshallbedocumentedbythepupil'sweeklyprogressin 24theeducationalprogramaccordingtoaprocessdeterminedbythevirtualprogramand 25publishedannuallyinthevirtualprogram'senrollmenthandbookorpolicy.Totheaverage 26dailyattendanceofthefollowingschooltermshallbeaddedthefull-timeequivalentaverage 27dailyattendanceofsummerschoolstudents.Inthecaseofahostschooldistrictenrollingone 28ormorefull-timevirtualschoolstudents,suchenrollingdistrictshall,aspartofitsmonthly 29stateallocation,receivenolessunderthestateaidcalculationforsuchstudentsthanan 30amountequaltothestateadequacytargetmultipliedbytheweightedaveragedailyattendance 31ofsuchfull-timestudents.StudentsresidinginMissouriandenrolledinafull-timevirtual 32schoolprogramoperatedbyapublicinstitutionofhighereducationinthisstateshallbe 33countedforastateaidcalculationbythedepartment,andthedepartmentshallpay,from 34fundsdedicatedtostateschoolaidpaymentsmadeundersection163.031,tosuchinstitution 35anamountequaltothestateadequacytargetmultipliedbytheweightedaveragedaily 36attendanceofsuchfull-timestudents. 37 (2)TheMissouricourseaccessandvirtualschoolprogramshallreporttothedistrict 38ofresidencethefollowinginformationabouteachstudentservedbytheMissouricourse 39accessandvirtualschoolprogram:name,address,eligibilityforfreeorreduced-pricelunch, 40limitedEnglishproficiencystatus,specialeducationneeds,andthenumberofcoursesin 41whichthestudentisenrolled.TheMissouricourseaccessandvirtualschoolprogramshall 42promptlynotifytheresidentdistrictwhenastudentdiscontinuesenrollment.A"full-time 43equivalentstudent"isastudentwhoisenrolledintheinstructionalequivalentofsixcredits 44perregularterm.EachMissouricourseaccessandvirtualschoolprogramcourseshallcount 45asoneclassandshallgeneratethatportionofafull-timeequivalentthatacomparablecourse 46offeredbytheschooldistrictwouldgenerate. 47 (3)Pursuanttoaneducationservicesplanandcollaborativeagreementunder 48subsection3ofthissection,full-timeequivalentstudentsmaybeallowedtouseaphysical 49locationoftheresidentschooldistrictforallorsomeportionofongoinginstructionalactivity, 50andtheenrollmentplanshallprovideforreimbursementofcostsoftheresidentdistrictfor 51providingsuchaccesspursuanttorulespromulgatedunderthissectionbythedepartment. 52 (4)Innocaseshallmorethanthefull-timeequivalencyofaregulartermof 53attendanceforasinglestudentbeusedtoclaimstateaid.Full-timeequivalentstudentcredit 59consideredanattendancecenterinthehostschooldistrictandshallparticipateinthe 60statewideassessmentsystemasdefinedinsection160.518.Theacademicperformanceof 61studentsenrolledinafull-timevirtualschoolprogramshallbeassignedtothedesignated 62attendancecenterofthefull-timevirtualschoolprogramandshallbeconsideredinlike 69schooldistrictwithrespecttoitsfull-timeequivalentstudents. 70 3.(1)AstudentwhoresidesinthisstatemayenrollinMissouricourseaccessand 71virtualschoolprogramcoursesofhisorherchoiceasapartofthestudent'sannualcourse 72loadeachschoolyear,withanycostsassociatedwithsuchcourseorcoursestobepaidbythe 73schooldistrictorcharterschoolif: 74 (a)Thestudentisenrolledfull-timeinapublicschool,includinganycharterschool; 75and 76 (b)PriortoenrollinginanyMissouricourseaccessandvirtualschoolprogram 77course,astudenthasreceivedapprovalfromhisorherschooldistrictorcharterschool 78throughtheproceduredescribedundersubdivision(2)ofthissubsection. 79 85shallensurethatavailableopportunitiesforin-personinstructionareconsideredpriorto 86movingastudenttovirtualcourses.Thepolicyshallallowforcontinuousenrollment 87throughouttheschoolyear.Iftheschooldistrictorcharterschooldisapprovesastudent's 88requesttoenrollinacourseorcoursesprovidedbytheMissouricourseaccessandvirtual 89schoolprogram,thereasonshallbeprovidedinwritinganditshallbeforgoodcause.Good 90causejustificationtodisapproveastudent'srequestforenrollmentinacourseshallbea 91determinationthatdoingsoisnotinthebesteducationalinterestofthestudent,andshallbe 92consistentwiththedeterminationthatwouldbemadeforsuchcourserequestunderthe HCSHB220 3 93processbywhichadistrictstudentwouldenrollinasimilarcourseofferedbytheschool 94districtandacharterschoolstudentwouldenrollinasimilarcourseofferedbythecharter 95school,exceptthatthedeterminationmayconsiderthesuitabilityofvirtualcoursesforthe 96studentbasedonpriorparticipationinvirtualcoursesbythestudent.Appealsofanycourse 102courseinwhichcostsassociatedwithsuchcoursearetobepaidbytheschooldistrictor 103charterschoolasdescribedunderthissubdivision,theschooldistrictorcharterschoolshall 104paythecontentproviderdirectlyonaproratamonthlybasisbasedonastudent'scompletion 105ofassignmentsandassessments.Ifastudentdiscontinuesenrollment,thedistrictorcharter (4)(a)Astudentwholivesinthisstatemayenrollinavirtualprogramoftheir 113choiceasprovidedinthissubdivision,andtheprovisionsofsubdivisions(1)to(3)ofthis 114subsectionshallnotapplytosuchenrollmentinafull-timevirtualprogram.Eachhostschool 115districtoperatingafull-timevirtualprogramunderthissectionshalladopt,operateand 116implementanenrollmentpolicyasspecifiedbytheprovisionsofthissubdivision.The 117student,thestudent'sparentorguardianifthestudentisnotconsideredhomeless,thevirtual 118program,thehostdistrict,andtheresidentdistrictshallcollaborateingoodfaithtoimplement 119theenrollmentpolicyregardingthestudent'senrollment,andtheresidentschooldistrictand 120thehostschooldistrictmaymutuallyagreethattheresidentdistrictshallofferorcontinueto 121offerservicesforthestudentunderanagreementthatincludesfinancialtermsfor 150participationinthevirtualprogramatthestatewideanddistrictlevels;providedthatnosuch 151surveyresultswillbepublishedinamannerthatrevealsindividualstudentinformation.The 152departmentshallalsoinclude,intheannualreport,dataatthestatewideanddistrictlevelsof 153sufficientdetailtoallowdetectionandanalysisoftheracial,ethnic,andsocio-economic 161individuallearningplansdesignedbycertifiedteachersandprofessionalstaffaredeveloped 162forallstudentsenrolledinmorethantwofull-timecourseaccessprogramcoursesorafull- 163timevirtualschool. 164 218 (b)Offlineactivities; 219 (c)Completedassignmentswithinaparticularprogram,curriculum,orclass; 220 (d)Testing; 221 (e)Face-to-facecommunicationsormeetingswithschoolstaff; 222 (f)Telephoneorvideoconferenceswithschoolstaff; 223 (g)School-sanctionedfieldtrips;or 224 (h)Orientation. 225 (2)Afull-timevirtualschoolshallsubmitanotificationtotheparentorguardianof 226anystudentwhoisnotconsistentlyengagedininstructionalactivitiesandshallprovide 227regularstudentprogressreportsforeachstudentatleastfourtimesperschoolyear. 228 (3)Eachfull-timevirtualschoolshalldevelop,adopt,andpostontheschool'swebsite 229apolicysettingforththeconsequencesforastudentwhofailstocompletetherequired 230instructionalactivities.Suchpolicyshallstate,ataminimum,thatifastudentfailsto 231completetheinstructionalactivitiesafterreceivinganotificationundersubdivision(2)ofthis 232subsection,andafterreasonableinterventionstrategieshavebeenimplemented,thatthe 233studentshallbesubjecttocertainconsequenceswhichmayincludedisenrollmentfromthe 234school.Priortoanydisenrollment,theparentorguardianshallhavetheopportunityto 235presentanyinformationthattheparentdeemsrelevant,andsuchinformationshallbe 236consideredpriortoanyfinaldecision. 237 (4)Ifafull-timevirtualschooldisenrollsastudentundersubdivision(3)ofthis 238subsection,theschoolshallimmediatelyprovidewrittennotificationtosuchstudent'sschool 239districtofresidence.Thestudent'sschooldistrictofresidenceshallthenprovidetothe HCSHB220 7 240parentsorguardianofthestudentawrittenlistofavailableeducationaloptionsandpromptly 241enrollthestudentintheselectedoption.Anystudentdisenrolledfromafull-timevirtual 242schoolshallbeprohibitedfromreenrollinginthesamevirtualschoolfortheremainderofthe 243schoolyear. 244 5.Schooldistrictsorcharterschoolsshallinformparentsoftheirchild'srightto 245participateintheprogram.Availabilityoftheprogramshallbemadeclearintheparent 246handbook,registrationdocuments,andfeaturedonthehomepageoftheschooldistrictor 247charterschool'swebsite. 248 6.Thedepartmentshall: 249 (1)Establishanauthorizationprocessforcourseorfull-timevirtualschoolproviders 250thatincludesmultipleopportunitiesforsubmissioneachyear; 327 (2)Theassessmentshallbeadministeredduringasynchronousassessment 328sessioninitiatedandmanagedbyanemployeeofthevirtualschoolorprogram; 329 (3)Thestudentshallbemonitoredbyanassessmentproctorviaacameraforthe 330durationoftheassessment.Iftheassessmentplatformdoesnotallowforintegrated 331cameraproctoring,thestudentshallusetwodevicesduringtheassessment.Thefirst 332deviceshallbeusedtotaketheassessmentandtheseconddeviceshallhavea 333functioningcameraandbeusedtomonitorthestudentduringtheassessment. 334However,iftheassessmentplatformallowsfortheproctortoviewthestudentand 335background,aseconddeviceshallnotberequired; 336 (4)Thevirtualschoolorprogramshallmaintainastudent-assessment-taker-to- 337assessment-proctorratiooftentooneorlower; 338 (5)Thestudentshallnotexittheassessmentplatformuntilinstructedtodosoby 339theassignedassessmentproctor;and 340 (6)Thestudent'ssubmissionofthecompletedassessmentshallbeverifiedbythe 341assessmentadministrator. 342 13.Thestateboardofeducationthroughtherulemakingprocessandthedepartment 343ofelementaryandsecondaryeducationinitspoliciesandproceduresshallensurethat 344multiplecontentprovidersandlearningmanagementsystemsareallowed,ensuredigital 345contentconformstoaccessibilityrequirements,provideaneasilyaccessiblelinkforproviders 346tosubmitcoursesorfull-timevirtualschoolsontheMissouricourseaccessandvirtualschool 347programwebsite,andallowanyperson,organization,orentitytosubmitcoursesorfull-time 348virtualschoolsforapproval.Nocontentprovidershallbeallowedthatisunwillingtoaccept 349paymentsintheamountandmannerasdescribedundersubdivision(3)ofsubsection3ofthis HCSHB220 10 350sectionordoesnotmeetperformanceorqualitystandardsadoptedbythestateboardof 351education. 352 [13.]14.Anyruleorportionofarule,asthattermisdefinedinsection536.010,that 353iscreatedundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifit 354complieswithandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,section 355536.028.Thissectionandchapter536arenonseverableandifanyofthepowersvestedwith 356thegeneralassemblypursuanttochapter536toreview,todelaytheeffectivedate,orto 357disapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof 358rulemakingauthorityandanyruleproposedoradoptedafterAugust28,2006,shallbeinvalid 359andvoid. 163.044.1.Beginningwiththe2007fiscalyearandeachsubsequentfiscalyear,the 2generalassemblyshallappropriatethirtymilliondollarstobedirectedinthefollowing 3mannertoschooldistrictswithanaveragedailyattendanceofthreehundredfiftystudentsor 4lessintheschoolyearprecedingthepaymentyear,providedthatnonresidentstudents 5enrolledinsuchschooldistrictsthroughsection161.670shallnotbeincludedinthetotal 6forpurposesofthissection: 7 (1)Twentymilliondollarsshallbedistributedtotheeligibledistrictsinproportionto 8theiraveragedailyattendance;and 9 (2)Tenmilliondollarsshallbedirectedtotheeligibledistrictsthathaveanoperating 10levyforschoolpurposesinthecurrentyearequaltoorgreaterthantheperformancelevyand 11anyschooldistrictswhichhaveanoperatinglevyforschoolpurposesinthecurrentyearless 12thantheperformancelevysolelyduetoamodificationofsuchdistrict'slevyrequiredunder 13subdivision(4)ofsubsection5ofsection137.073.Atax-rate-weightedaveragedaily 14attendanceshallbecalculatedforeacheligibledistrictinproportiontoitsoperatinglevyfor 15schoolpurposesforthecurrentyeardividedbytheperformancelevywiththatresult 16multipliedbythedistrict'saveragedailyattendanceintheschoolyearprecedingthepayment 17year.Thetotalappropriationpursuanttothissubdivisionshallthenbedividedbythesumof 18thetax-rate-weightedaveragedailyattendanceoftheeligibledistricts,andtheresulting 19amountpertax-rate-weightedaveragedailyattendanceshallbemultipliedbyeacheligible 20district'stax-rate-weightedaveragedailyattendancetodeterminetheamounttobepaidto 21eacheligibledistrict. 22 2.Thepaymentunderthissectionshallnotbetransferredtothecapitalprojectsfund. 23 3.Exceptasprovidedinsubsection2ofthissection,districtsreceivingpayments 24underthissectionmayusethemoneysfor,includingbutnotlimitedto,thefollowing: 25 (1)Distancelearning;
