53importantforanyrecommendationsofthecouncil.Statedepartmentsandcouncilmembers 54shallproviderelevantdataasrequestedbythecounciltofulfillthecouncil'sduties;and 55 (2)Collectfeedbackfromstakeholders,practitioners,andleadershipthroughoutthe 56stateinordertodevelopbestpracticesandproceduresregardingtheresponsetosex 57traffickingandsexualexploitationofchildren,includingidentificationandassessmentof 58victims;responseandtreatmentcoordinationandcollaborationacrosssystems;trauma- 59informed,culturallycompetentvictim-centeredservices;trainingforprofessionalsinall 60systems;andinvestigatingandprosecutingperpetrators. 61 4.Thedepartmentofsocialservicesshallprovideadministrativesupporttothe 62council. 63 5.OnorbeforeDecember31,2023,thecouncilshallsubmitareportofthecouncil's 64activitiestothegovernorandgeneralassemblyandthejointcommitteeonchildabuseand 65neglectundersection21.771.Thereportshallincluderecommendationsforpriorityneeds 66andactions,includingstatutoryorregulatorychangesrelatingtotheresponsetosex 67traffickingandsexualexploitationofchildrenandservicesforchildvictims. 68 6.ThecouncilshallexpireonDecember31,2023] Thereshallbeanexecutive 69directorwhoshallbeappointedbytheattorneygeneralwhoshallfixhisorher 70compensationandprovideforsuchotheradministrativepersonnelasnecessarywithin HCSHB224 8 78disbursements.Thefundshallbeadedicatedfundand,uponappropriation,moneys 79inthisfundshallbeusedsolelytopayforthepositionoftheexecutivedirectorofthe 80statewidecouncilagainstadulttraffickingandthecommercialsexualexploitationof 81children,educationandawarenessregardinghumantrafficking,andanti-trafficking 82effortsthroughoutthestateofMissouri. 83 (2)Notwithstandingtheprovisionsofsection33.080tothecontrary,anymoneys 84remaininginthefundattheendofthebienniumshallnotreverttothecreditofthe 85generalrevenuefund. 86 (3)Thestatetreasurershallinvestmoneysinthefundinthesamemanneras 87otherfundsareinvested.Anyinterestandmoneysearnedonsuchinvestmentsshallbe 88creditedtothefund. 324.035.1.Noboard,commission,orcommitteewithinthedivisionofprofessional 2registrationshallutilizeoccupationalfees,oranyotherfeesassociatedwithlicensing 3requirements,orcontractorpartnerwithanyoutsidevendororagencyforthepurposeof 4offeringcontinuingeducationclassesunlessthecontinuingeducationprogramis 4ofcontinuingeducationforrenewalofalicenseissuedpursuanttosections337.600to 5337.689,includingtwohoursofsuicideassessment,referral,treatment,andmanagement 6training.Thecommitteeshallrenewanylicenseuponapplicationforarenewal,completion 7oftherequiredcontinuingeducationhoursanduponpaymentofthefeeestablishedbythe 8committeepursuanttotheprovisionsofsection337.612.Asprovidedbyrule,theboardmay 9waiveorextendthetimerequirementsforcompletionofcontinuingeducationforreasons 15evidencerequiringcorroborationofstatements,admissionsorconfessionsofthedefendant, 16andnotwithstandinganyprohibitionofhearsayevidence,astatementbyachildwhenunder 17theageof[fourteen] eighteen, oravulnerableperson,whoisallegedtobevictimofan 18offenseunderchapter565,566,568or573issufficientcorroborationofastatement, 19admissionorconfessionregardlessofwhetherornotthechildorvulnerablepersonis 20availabletotestifyregardingtheoffense. 21 3.Astatementmaynotbeadmittedunderthissectionunlesstheprosecutingattorney 22makesknowntotheaccusedortheaccused'scounselhisorherintentiontoofferthe 23statementandtheparticularsofthestatementsufficientlyinadvanceoftheproceedingsto 24providetheaccusedortheaccused'scounselwithafairopportunitytopreparetomeetthe 25statement. 26 4.Nothinginthissectionshallbeconstruedtolimittheadmissibilityofstatements, 27admissionsorconfessionsotherwiseadmissiblebylaw. 28 5.Forthepurposesofthissection,"vulnerableperson"shallmeanapersonwho,asa 29resultofaninadequatelydevelopedorimpairedintelligenceorapsychiatricdisorderthat 30materiallyaffectsabilitytofunction,lacksthementalcapacitytoconsent,orwhose 31developmentalleveldoesnotexceedthatofanordinarychildof[fourteen] seventeenyears 32ofage. 491.641.1.(1)Thereisherebycreatedinthestatetreasurythe"PretrialWitness 2ProtectionServicesFund",whichshallconsistofmoneyscollectedunderthissection.The 3statetreasurershallbecustodianofthefund.Inaccordancewithsections30.170and30.180, 4thestatetreasurermayapprovedisbursements.Thefundshallbeadedicatedfundandmoney 5inthefundshallbeusedsolelybythedepartmentofpublicsafetyforthepurposesofwitness 6protectionservicespursuanttothissection. 7 (2)Notwithstandingtheprovisionsofsection33.080tothecontrary,anymoneys 8remaininginthefundattheendofthebienniumshallnotreverttothecreditofthegeneral 9revenuefund. HCSHB224 14 10 (3)Thestatetreasurershallinvestmoneysinthefundinthesamemannerasother 11fundsareinvested.Anyinterestandmoneysearnedonsuchinvestmentsshallbecreditedto 12thefund. 13 2.Anylawenforcementagencyandanyprosecutingorcircuitattorney'soffice 14mayprovideforthesecurityofwitnesses,potentialwitnesses,andtheirimmediatefamiliesin 15criminalproceedingsinstitutedorinvestigationspendingagainstapersonallegedtohave 16engagedinaviolationofstatelaw.Providingforwitnessesmayincludeprovisionofhousing 17facilitiesandforthehealth,safety,andwelfareofsuchwitnessesandtheirimmediate 18families,iftestimonybysuchawitnessmightsubjectthewitnessoramemberofhisorher 19immediatefamilytodangerofbodilyinjury,andmaycontinuesolongassuchdangerexists. 20Subjecttoappropriationsfromthegeneralassemblyforthepurposesprovidedforinthis 21section,fundsmaybeappropriatedfromthepretrialwitnessprotectionservicesfund. 22 3.Thedepartmentofpublicsafetymayauthorizefundstobedisbursedtolaw 23enforcementagenciesandprosecutingorcircuitattorneys'officesforthepurchase,rental, 24ormodificationofprotectedhousingfacilitiesforthepurposeofthissection.Thelaw 25enforcementagencyorprosecutingorcircuitattorney'sofficemaycontractwithany 26departmentoffederalorstategovernmenttoobtainortoprovidethefacilitiesorservicesto 27carryoutthissection. 28 4.Thedepartmentofpublicsafetymayauthorizeexpendituresforlawenforcement 29agenciesandprosecutingorcircuitattorneys'officestoprovideforthehealth,safety,and 30welfareofwitnessesandvictims,andthefamiliesofsuchwitnessesandvictims,whenever 31testimonyfrom,orawillingnesstotestifyby,suchawitnessorvictimwouldplacethelifeof 32suchperson,oramemberofhisorherfamilyorhousehold,injeopardy.[Alawenforcement 33agencyshallsubmitanapplicationtothedepartmentofpublicsafetywhichshallinclude,but 34notnecessarilybelimitedto: 35 (1)Statementofconditionswhichqualifypersonsforprotection; 36 (2)Precisemethodstheoriginatingagencywillusetoprovideprotection,including 37relocationofpersonsandreciprocalagreementswithotherlawenforcementagencies; 38 (3)Statementoftheprojectedcostsoveraspecifiedperiodoftime; HCSHB224 19 610.131.1.Notwithstandingtheprovisionsofsection610.140tothecontrary,a 2personwho[atthetimeoftheoffensewasundertheageofeighteen,and]haspleadedguilty 3toorhasbeenconvicted[for]oftheoffenseofprostitutionundersection567.020mayapply 4tothecourtinwhichheorshepledguiltyorwassentencedforanordertoexpungefromall 5officialrecordsallrecordationsofhisorherarrest,plea,trial,orconviction.Ifthecourt 6determinesthatsuchperson[wasundertheageofeighteenor]wasactingunderthecoercion, 7asdefinedinsection566.200,ofanagentwhencommittingtheoffensethatresultedinaplea 8ofguiltyorconvictionundersection567.020,thecourtshallenteranorderofexpungement. 9 2.Upongrantingoftheorderofexpungement,therecordsandfilesmaintainedinany 10administrativeorcourtproceedinginanassociateorcircuitdivisionofthecircuitcourtunder 11thissectionshallbeconfidentialandonlyavailabletothepartiesorbyorderofthecourtfor 12goodcauseshown.Theeffectofsuchordershallbetorestoresuchpersontothestatusheor 13sheoccupiedpriortosucharrest,plea,orconvictionandasifsucheventhadnevertaken 14place.Nopersonastowhomsuchorderhasbeenenteredshallbeheldthereafterunderany 15provisionofanylawtobeguiltyofperjuryorotherwisegivingafalsestatementbyreasonof 16hisorherfailuretoreciteoracknowledgesucharrest,plea,trial,conviction,orexpungement 17inresponsetoanyinquirymadeofhimorherforanypurposewhatsoeverandnosuch 18inquiryshallbemadeforinformationrelatingtoanexpungementunderthissection. ✔ HCSHB224 20
