HB227 2 54 2.Atreatmentcourtdivisionshallbeestablished,priortoAugust28,2021,byany 55circuitcourtpursuanttosections478.001to478.009toprovideanalternativeforthejudicial 56systemtodisposeofcaseswhichstemfrom,orareotherwiseimpactedby,asubstanceuseor 57mentalhealthdisorder. Thetreatmentcourtdivisionmayinclude,butnotbelimitedto, 58casesassignedtoanadulttreatmentcourt,DWIcourt,familytreatmentcourt,juvenile 59treatmentcourt,mentalhealthcourt,veteranstreatmentcourt,oranycombinationthereof. 60Atreatmentcourtshallcombinejudicialsupervision,drugoralcoholtesting,andtreatmentof 61participants.Exceptforgoodcausefoundbythecourt,atreatmentcourtmakingareferralfor 62substanceuseormentalhealthdisordertreatment,whensuchprogramwillreceivestateor 63federalfundsinconnectionwithsuchreferral,shallreferthepersononlytoaprogramwhich 64iscertifiedbythedepartmentofmentalhealth,unlessnoappropriatecertifiedtreatment 65programislocatedwithinthesamecountyasthetreatmentcourt.Uponsuccessful 66completionofthetreatmentcourtprogram,thecharges,petition,orpenaltyagainsta 67treatmentcourtparticipantmaybedismissed,reduced,ormodified,unlessotherwisestated. 68Anyfeesreceivedbyacourtfromadefendantaspaymentforsubstanceormentalhealth 69treatmentprogramsshallnotbeconsideredcourtcosts,chargesorfines. 70 3.Anadulttreatmentcourtmaybeestablishedbyanycircuitcourt[undersections 71478.001to478.009] toprovideanalternativeforthejudicialsystemtodisposeofcaseswhich 72stemfromsubstanceuse. 73 4.[Undersections478.001to478.009,] ADWIcourtmaybeestablishedbyany 74circuitcourttoprovideanalternativeforthejudicialsystemtodisposeofcasesthatstem 75fromdrivingwhileintoxicated. 76 5.Afamilytreatmentcourtmaybeestablishedbyanycircuitcourt.Thejuvenile 77divisionofthecircuitcourtorthefamilycourt,ifoneisestablishedundersection487.010, 78mayreferoneormoreparentsorotherhouseholdmemberssubjecttoitsjurisdictiontothe 79familytreatmentcourtifheorshehasbeendeterminedtohaveasubstanceusedisorderor 80co-occurringdisorderthatimpactsthesafetyandwell-beingofthechildreninthefamily. 81 6.Ajuveniletreatmentcourtmaybeestablishedbythejuveniledivisionofany 82circuitcourt.Thejuveniledivisionmayreferajuveniletothejuveniletreatmentcourtifthe 83juvenileisdeterminedtohavecommittedactsthatviolatethecriminallawsofthestateor 84ordinancesofamunicipalityorcountyandasubstanceusedisorderorco-occurringdisorder 85contributedtothecommissionoftheoffense. 86 7.Thegeneralassemblyfindsanddeclaresthatitisthepublicpolicyofthisstateto 87encourageandprovideanalternativemethodforthedisposalofcasesformilitaryveterans 88andcurrentmilitarypersonnelwithsubstanceusedisorders,mentalhealthdisorders,orco- 89occurringdisorders.Inordertoeffectuatethispublicpolicy,aveteranstreatmentcourtmay 90beestablishedbyanycircuitcourt,orcombinationofcircuitcourtsuponagreementofthe HB227 3 91presidingjudgesofsuchcircuitcourts,toprovideanalternativeforthejudicialsystemto 92disposeofcasesthatstemfromasubstanceusedisorder,mentalhealthdisorder,orco- 93occurringdisorderofmilitaryveteransorcurrentmilitarypersonnel.Aveteranstreatment 94courtshallcombinejudicialsupervision,drugoralcoholtesting,andsubstanceuseand 95mentalhealthdisordertreatmenttoparticipantswhohaveservedorarecurrentlyservingthe 96UnitedStatesArmedForces,includingmembersoftheReservesorNationalGuard,with 97preferencegiventoindividualswhohavecombatservice.Forthepurposesofthissection, 98combatserviceshallbeshownthroughmilitaryservicedocumentationthatreflectsservicein 99acombattheater,receiptofcombatservicemedals,orreceiptofimminentdangerorhostile 100firepayortaxbenefits.Exceptforgoodcausefoundbythecourt,aveteranstreatmentcourt 101shallmakeareferralforsubstanceuseormentalhealthdisordertreatment,oracombination 102ofsubstanceuseandmentalhealthdisordertreatment,throughtheDepartmentofDefense 103healthcare,theVeteransAdministration,oracommunity-basedsubstanceusedisorder 104treatmentprogram.Community-basedprogramsutilizedshallreceivestateorfederalfunds 105inconnectionwithsuchreferralandshallonlyrefertheindividualtoaprogramcertifiedby 106thedepartmentofmentalhealth,unlessnoappropriatecertifiedtreatmentprogramislocated 107withinthesamecircuitastheveteranstreatmentcourt. 108 8.Amentalhealthcourtmaybeestablishedbyanycircuitcourttoprovidean 109alternativeforthejudicialsystemtodisposeofcasesthatstemfromamentalhealth 110disorderorco-occurringdisorder. ✔ HB227 4
