13	13	386.572.1.Nocorporation,person,publicutility,ormunicipalitythatownsanygas
14	14	2plantshallviolateanylaworanyorder,decision,decree,rule,direction,demand,or
15	15	3requirementofthecommissionoranypartorportionthereofrelatingtofederallymandated
16	16	4naturalgassafetystandards.Notwithstandingtheabove,amunicipalitythatownsanygas
17	17	5plantshallbesubjecttotheprovisionsofthissectiononlyforviolationsofnaturalgassafety
18	18	6laws,rules,ororders.
19	19	7 2.Themaximumpenaltiesforviolationsoffederallymandatednaturalgassafety

39	39	26 (3)Theeffectofthepenaltyontheentity'sabilitytocontinueoperation;
40	40	27 (4)Anygoodfaitheffortinattemptingtoachievecompliance;
41	41	28 (5)Abilitytopaythepenalty;and
42	42	29 (6)Suchothermattersasarerelevantinthecase.
43	43	30 3.Everyviolationofaspecificnaturalgassafetystandardorrulebyanycorporation,
44	44	31person,publicutility,ormunicipalitythatownsanygasplantisaseparateanddistinct
45	45	32offense,regardlessofwhethersuchviolationsrelatetothesameincident.Incaseofa
46	46	33continuingviolation,eachday'scontinuancethereofshallbeaseparateanddistinctoffense.
47	47	34 4.Inconstruingandenforcingtheprovisionsofthissection,theact,omission,or
48	48	35failureofanyofficer,agent,oremployeeofanycorporation,person,publicutility,or
49	49	36municipalitythatownsanygasplantactingwithinthescopeofofficialdutiesofemployment
