HB232 3 52 (13)"Ventricularfibrillation",themostcommonarrhythmiathatcausescardiac 53arrestandaconditioninwhichtheheart'selectricalimpulsessuddenlybecomechaotic, 54oftenwithoutwarning,causingtheheart'spumpingactiontostopabruptly. 55 2.Forthe2026-27schoolyearandallsubsequentschoolyears,eachpublic 56schoolshalldevelopandimplementacardiacemergencyresponseplanthataddresses 57theappropriateuseofschoolpersonneltorespondtoincidentsinvolvinganindividual 58experiencingsuddencardiacarrestorasimilarlife-threateningemergencywhileona 59schoolcampus. 60 3.Membersofeachpublicschool'sadministrationshallcoordinatedirectlywith 61localemergencyservicesproviderstointegratethepublicschool'scardiacemergency 62responseplanintothelocalemergencyservicesproviders'protocols.Acardiac 63emergencyresponseplanshallintegrateevidence-basedcoreelements,suchasthose 64recommendedbytheAmericanHeartAssociationguidelines,ProjectADAM,or 65anothersetofnationallyrecognized,evidence-basedstandardsorcoreelements. 66 4.Thecardiacemergencyresponseplanshallintegrate,ataminimum,the 67followingcoreelements: 68 (1)Establishmentofacardiacemergencyresponseteam; 69 (2)Activationoftheteaminresponsetoasuddencardiacarrest; 70 (3)ImplementationofAEDplacementandroutinemaintenancethroughoutthe 71schoolcampus; 72 (4)Disseminationoftheplanthroughouttheschoolcampus; 73 (5)MaintenanceofongoingstafftraininginCPRandAEDuse; 74 (6)Practiceofthecardiacemergencyresponseplanusingdrillsannually; 75 (7)Integrationoftheplanintothelocalemergencyservicesproviders'protocols; 76and 77 (8)Bothannualandcontinuousreviewsandevaluationsoftheplan. 78 5.AppropriateAEDplacementshallbedictatedbythecardiacemergency 79responseplanandinaccordancewithguidelinessetbytheAmericanHeartAssociation 80ornationallyrecognizedguidelinesfocusedonemergencycardiovascularcare.AnAED 81shouldbeidentifiedwithappropriatesignageandisonsiteorplacedandmadeavailable 82inanunlockedlocationonschoolproperty. 83 6.Forschoolswithanathleticdepartmentororganizedschoolathleticprogram, 84anAEDshallbeclearlymarkedandeasilyaccessibleinanunlockedlocationateach 85schoolathleticvenueandevent.TheAEDshallbeaccessibleduringtheschooldayand 86anyschool-sponsoredathleticeventorteampracticeinwhichpupilsoftheschoolare 87participating.Itisrecommended,totheextentpossible,thatthegoverningbodyofa HB232 4 88publicschoolmakethebestefforttoensurethattheAEDdescribedinthissubsectionis 89accessiblewithinthreeminutesofcardiacarrest. 90 7.Appropriateschoolpersonnelshallbecertifiedinfirstaid,CPR,andAEDuse 91thatfollowevidence-basedguidelinessetforthbytheAmericanHeartAssociationor 92nationallyrecognizedguidelinesfocusedonemergencycardiovascularcare.Theschool 93personnelrequiredtobecertifiedshallbedeterminedbythecardiacemergency 94responseplanandshallinclude,butnotbelimitedto,athleticscoaches,schoolnurses, 95andathletictrainers. 160.660.1.OnorbeforeJuly1,[2001] 2026, thestateboardofeducationshalladd 2toanyschoolfacilitiesandsafetycriteriadevelopedfortheMissourischoolimprovement 3programprovisionsthatrequire: 4 (1)Eachschooldistricttodesignateaprimaryandsecondaryschoolsafety 5coordinator; 6 (2)Eachschooldistrict's[designated] primaryandsecondarysafetycoordinatorto 7haveathoroughknowledgeofallfederal,stateandlocalschoolviolencepreventionprograms 8andresourcesavailabletostudents,teachersorstaffinthedistrict;and 9 [(2)](3)Eachschooldistricttofullyutilizeallsuchprogramsandresourcesthatthe 10localschoolboardoritsdesigneedeterminesarenecessaryandcost-effectivefortheschool 11district. 12 2.Eachschooldistrictshallrequiretheschoolsafetycoordinatorsandother 13designatedpersonnel,asnecessary,tocompletewithinonecalendaryearofbeing 14designatedasaschoolsafetycoordinator,either: 15 (1)(a)TheFederalEmergencyManagementAdministration's(FEMA)IS- 16100.C:IntroductiontotheIncidentCommandSystem,ICS100,oritssuccessorcourse; 6 (b)Planninganattackonaschool,otherstudents,faculty,staff,or 7administration;or 8 (c)Behaviorthatputsstudents,faculty,staff,oradministrationatriskforharm; 9 (2)"Homelesschild"or"homelessyouth"[shallmean],apersonlessthantwenty-one 10yearsofagewholacksafixed,regularandadequatenighttimeresidence,includingachildor 11youthwho: 12 [(1)] (a)Issharingthehousingofotherpersonsduetolossofhousing,economic 13hardship,orasimilarreason;islivinginmotels,hotels,orcampinggroundsduetolackof 14alternativeadequateaccommodations;islivinginemergencyortransitionalshelters;is 15abandonedinhospitals;orisawaitingfostercareplacement; 28 (b)Providesbenchmarksthatallowforthestudenttobereleasedfromthe 29personalsafetyplanovertime;and 30 (c)Providesimmediateaccesstoatrustedadultforthestudentwiththepersonal 31safetyplan. 32 2.Inordertoregisterapupil,theparentorlegalguardianofthepupilorthepupil 33himselforherselfshallprovide,atthetimeofregistration,oneofthefollowing: 34 (1)Proofofresidencyinthedistrict.Exceptasotherwiseprovidedinsection 35167.151,theterm"residency"shallmeanthatapersonbothphysicallyresideswithinaschool 36districtandisdomiciledwithinthatdistrictor,inthecaseofaprivateschoolstudent 37suspectedofhavingadisabilityundertheIndividualsWithDisabilitiesEducationAct,20 38U.S.C.Section[1412,] 1411etseq.,asamended,thatthestudentattendsprivateschool 39withinthatdistrict.Thedomicileofaminorchildshallbethedomicileofaparent,military 40guardianpursuanttoamilitary-issuedguardianshiporcourt-appointedlegalguardian.For 41instancesinwhichthefamilyofastudentlivinginMissourico-locatestolivewithother 42familymembersorliveinamilitaryfamilysupportcommunitybecauseoneorbothofthe 43child'sparentsarestationedordeployedoutofstateordeployedwithinMissouriunderactive 44dutyordersunderTitle10orTitle32oftheUnitedStatesCode,thestudentmayattendthe 45schooldistrictinwhichthefamilymember'sresidenceorfamilysupportcommunityis 46located.Iftheactivedutyordersexpireduringtheschoolyear,thestudentmayfinishthe 47schoolyearinthatdistrict; 48 (2)Proofthatthepersonregisteringthestudenthasrequestedawaiverunder 49subsection3ofthissectionwithinthelastforty-fivedays;or 50 (3)Proofthatoneorbothofthechild'sparentsarebeingrelocatedtothestateof 51Missouriundermilitaryorders. 52 53Ininstanceswherethereisreasontosuspectthatadmissionofthepupilwillcreatean 54immediatedangertothesafetyofotherpupilsandemployeesofthedistrict,the 55superintendentorthesuperintendent'sdesigneemayconveneahearingwithinfive 56workingdaysoftherequesttoregisteranddeterminewhetherornotthepupilmayregister. 57 3.Anypersonsubjecttotherequirementsofsubsection2ofthissectionmayrequest 58awaiverfromthedistrictboardofanyofthoserequirementsonthebasisofhardshiporgood 59cause.Undernocircumstancesshallathleticabilitybeavalidbasisofhardshiporgoodcause HB232 8 60fortheissuanceofawaiveroftherequirementsofsubsection2ofthissection.Thedistrict 61boardorcommitteeoftheboardappointedbythepresidentandwhichshallhavefull 62authoritytoactinlieuoftheboardshallconveneahearingassoonaspossible,butnolater 63thanforty-fivedaysafterreceiptofthewaiverrequestmadeunderthissubsectionorthe 64waiverrequestshallbegranted.Thedistrictboardorcommitteeoftheboardmaygrantthe 65requestforawaiverofanyrequirementofsubsection2ofthissection.Thedistrictboardor 66committeeoftheboardmayalsorejecttherequestforawaiverinwhichcasethepupilshall 67notbeallowedtoregister.Anypersonaggrievedbyadecisionofadistrictboardor 68committeeoftheboardonarequestforawaiverunderthissubsectionmayappealsuch 69decisiontothecircuitcourtinthecountywheretheschooldistrictislocated. 70 4.Anypersonwhoknowinglysubmitsfalseinformationtosatisfyanyrequirementof 71subsection2ofthissectionisguiltyofaclassAmisdemeanor. 72 5.Inadditiontoanyotherpenaltiesauthorizedbylaw,adistrictboardmayfileacivil 73actiontorecover,fromtheparent,militaryguardianorlegalguardianofthepupil,thecostsof 74schoolattendanceforanypupilwhowasenrolledataschoolinthedistrictandwhoseparent, 75militaryguardianorlegalguardianfiledfalseinformationtosatisfyanyrequirementof 76subsection2ofthissection. 77 6.Subsection2ofthissectionshallnotapplytoapupilwhoisahomelesschildor 78youth,orapupilattendingaschoolnotinthepupil'sdistrictofresidenceasaparticipantinan 79interdistricttransferprogramestablishedunderacourt-ordereddesegregationprogram,a 80pupilwhoisawardofthestateandhasbeenplacedinaresidentialcarefacilitybystate 81officials,apupilwhohasbeenplacedinaresidentialcarefacilityduetoamentalillnessor 82developmentaldisability,apupilattendingaschoolpursuanttosections167.121and 83167.151,apupilplacedinaresidentialfacilitybyajuvenilecourt,apupilwithadisability 84identifiedunderstateeligibilitycriteriaifthestudentisinthedistrictforreasonsotherthan 85accessingthedistrict'seducationalprogram,orapupilattendingaregionalorcooperative 86alternativeeducationprogramoranalternativeeducationprogramonacontractualbasis. 87 7.Withintwobusinessdaysofenrollingapupil,theschoolofficialenrollingapupil, 88includinganyspecialeducationpupil,shallrequestthoserecordsrequiredbydistrictpolicy 89forstudenttransfer[andthose],disciplinerecordsrequiredbysubsection9ofsection160.261 90fromallschoolspreviouslyattendedbythepupilwithinthelasttwelvemonths, andrecords 91ofanybehavioralthreatassessmentsandpersonalsafetyplansofthepupilbythelocal 92educationagencyifthestudentiscurrentlysubjecttoanactivepersonalsafetyplanor 93hasbeensubjecttoapersonalsafetyplanintheprevioustwelvemonths. Anyschool 94districtthatreceivesarequestforsuchrecordsfromanotherschooldistrictenrollingapupil 95thathadpreviouslyattendedaschoolinsuchdistrictshallrespondtosuchrequestwithinfive 96businessdaysofreceivingtherequest.Schooldistrictsmayreportordiscloseeducation HB232 9 97recordstolawenforcementandjuvenilejusticeauthoritiesifthedisclosureconcernslaw 98enforcement'sorjuvenilejusticeauthorities'abilitytoeffectivelyserve,priortoadjudication, 99thestudentwhoserecordsarereleased.Theofficialsandauthoritiestowhomsuch 100informationisdisclosedmustcomplywithapplicablerestrictionssetforthin20U.S.C. 101Section1232g(b)(1)(E). 102 8.Ifoneorbothofachild'sparentsarebeingrelocatedtothestateofMissouriunder 105physicallyappearatalocationwithinthedistricttoregisterthestudent.Proofofresidency,as 106describedinthissection,shallnotberequiredatthetimeoftheremoteregistrationbutshall 107berequiredwithintendaysofthestudent'sattendanceintheschooldistrict. 167.022.Consistentwiththeprovisionsofsection167.020,withinforty-eighthours 2ofenrollinganonresidentpupilplacedpursuanttosections210.481to210.536,theschool 3officialenrollingapupil,includinganyspecialeducationpupil,shallrequestthoserecords 4requiredbydistrictpolicyforstudenttransfer[andthose], disciplinerecordsrequiredby 5subsection9ofsection160.261,andrecordsofanybehavioralthreatassessmentsand 6personalsafetyplansofthepupilcreatedbythelocaleducationagencyifthestudentis 7currentlysubjecttoanactivepersonalsafetyplanorhasbeensubjecttoapersonal 8safetyplanintheprevioustwelvemonthsfromallschoolsandotherfacilitiespreviously 9attendedbythepupilandfromotherstateagenciesasenumeratedinsection210.518andany 10entitiesinvolvedwiththeplacementofthestudentwithinthelasttwenty-fourmonths.Any 11requestforrecordsunderthissectionshallinclude,ifapplicabletothestudent,anyrecords 12relatingtoanactofviolenceasdefinedundersubsection7ofsection160.262. 167.115.1.Notwithstandinganyprovisionofchapter211orchapter610tothe 2contrary,theprosecutor,juvenileofficer,sheriff,chiefofpolice, 55informationtoteachersandotherschooldistrictemployeeswithaneedtoknowwhileacting 56withinthescopeoftheirassignedduties.Anyinformationreceivedbyschooldistrict 57officialspursuanttothissectionshallbereceivedinconfidenceandusedforthelimited 58purposeofassuringthatgoodorderanddisciplineismaintainedintheschool.This 59informationshallnotbeusedasthesolebasisfornotprovidingeducationalservicestoa 60publicschoolpupilunlesstheschooldistrictrequeststheattorneygeneral'sofficeorthe 61districtorcharterschool'sattorneytoseekaninjunctionfromacourtofcompetent 62jurisdictiontoexcludethepupilfromeducationalservicesifthereisasubstantial 63likelihoodofdangertothesafetyofpupilsoremployeesoftheschooldistrict.The 64informationmaybeusedtoprovidethepupileducationalservicesinanalternative 65environment. 66 4.Thesuperintendentshallnotifytheappropriatedivisionofthejuvenileorfamily 67courtuponanypupil'ssuspensionformorethantendaysorexpulsionofanypupilthatthe 68schooldistrictisawareisunderthejurisdictionofthecourt. 69 5.Thesuperintendentorthesuperintendent'sdesigneemaybecalledtoserveina 70consultantcapacityatanydispositionalproceedingspursuanttosection211.031whichmay 71involvereferencetoapupil'sacademictreatmentplan. 72 6.Uponthetransferofanypupildescribedinthissectiontoanyotherschooldistrict 73inthisstate,thesuperintendentorthesuperintendent'sdesigneeshallforwardthewritten 74notificationgiventothesuperintendentpursuanttosubsection2ofthissectiontothe 75superintendentofthenewschooldistrictinwhichthepupilhasenrolled.Suchwritten 76notificationshallberequiredagainintheeventofanysubsequenttransferbythepupil. 77 7.Asusedinthissection,theterms"school"and"schooldistrict"shallincludeany 78charter,privateorparochialschoolorschooldistrict,andtheterm"superintendent"shall 79includetheprincipalorequivalentchiefschoolofficerinthecasesofcharter,privateor 80parochialschools. 81 8.Thesuperintendentorthedesigneeofthesuperintendentorotherschoolemployee 82who,ingoodfaith,reportsinformationinaccordancewiththetermsofthissectionand 83section160.261shallnotbecivillyliableforprovidingsuchinformation. 167.117.1.Inanyinstancewhenanypersonisbelievedtohavecommittedanact 2whichifcommittedbyanadultwouldbeassaultinthefirst,secondorthirddegree,sexual 3assault,ordeviatesexualassaultagainstapupilorschoolemployee,whileonschool 4property,includingaschoolbusinserviceonbehalfofthedistrict,orwhileinvolvedin HB232 12 5schoolactivities,theprincipalshallimmediatelyreportsuchincidenttotheappropriatelocal 6lawenforcementagencyandtothesuperintendent,exceptinanyinstancewhenanypersonis 7believedtohavecommittedanactwhichifcommittedbyanadultwouldbeassaultinthe 8thirddegreeandawrittenagreementastotheprocedureforthereportingofsuchincidentsof 9thirddegreeassaulthasbeenexecutedbetweenthesuperintendentoftheschooldistrictand 10theappropriatelocallawenforcementagency,theprincipalshallreportsuchincidenttothe 11appropriatelocallawenforcementagencyinaccordancewithsuchagreement. 12 2.Inanyinstancewhenapupilisdiscoveredtohaveonoraboutsuchpupil'sperson, 13oramongsuchpupil'spossessions,orplacedelsewhereontheschoolpremises,includingbut 14notlimitedtotheschoolplaygroundortheschoolparkinglot,onaschoolbusorataschool 15activitywhetheronoroffofschoolpropertyanycontrolledsubstanceasdefinedinsection 16195.010oranyweaponasdefinedinsubsection6ofsection160.261inviolationofschool 17policy,theprincipalshallimmediatelyreportsuchincidenttotheappropriatelocallaw 18enforcementagencyandtothesuperintendent. 19 3.Inanyinstancewhenateacherbecomesawareofanassaultassetforthin 20subsection1ofthissectionorfindsapupilinpossessionofaweaponorcontrolled 21substancesassetforthinsubsection2ofthissection,theteachershallimmediatelyreport 22suchincidenttotheprincipal. 23 4.Schooldistrictsandcharterschoolsmayenterintowrittenagreementswith 24lawenforcementagenciesastotheprocedureforreportingthecriminaloffenseslisted 25insubsection1ofthissection.Theagreementsmayauthorizetheschooldistrictor 26charterschooltoreportthecriminaloffensetothechildren'sdivisionratherthanlaw 27enforcementifapupilisunderelevenyearsofage. 28 5.Ifaschoolemployee,agent,orofficialbecomesawareofanoffensethatis 29requiredtobereportedinthissection,theemployee,agent,orofficialshallimmediately 30notifyaprincipalorotheradministratortomakethereport. 31 6.Aschoolemployee,[superintendentorsuchperson'sdesignee] agent,orofficial 32whoingoodfaithprovidesinformationtolawenforcement[orjuvenileauthoritiespursuant 33to]inaccordancewiththissectionorsection160.261shallnotbecivillyliableforproviding 34suchinformation. 35 [5.]7.Anyschoolemployee,agent,orofficialresponsibleforreportingpursuantto 36thissectionorsection160.261whowillfullyneglectsorrefusestoperformthisdutyshallbe 37subjecttothepenaltyestablishedpursuanttosection162.091. 167.167.Eachschooldistrictshallprohibit,innameandpractice,anyzero- 2tolerancedisciplinarypolicyorpracticeofdisciplinethatresultsinanautomatic 3disciplinaryconsequenceagainstapupilwithoutthediscretiontomodifysuch HB232 13 4disciplinaryconsequenceonacase-by-casebasis,suchasautomaticdetention, 5suspension,orexpulsionortheautomaticimpositionofotherdisciplinarymeasures. 167.624.Eachschoolboard[inthestate,iftheschooldistrictdoesnotpresentlyhave 2aprogramasdescribedbelow,maydevelopandimplementaprogramtotrainthestudents 3and]andcharterschoolgoverningboardshallprovidetrainingforallemployeesofthe 4districtorcharterschoolintheadministrationofcardiopulmonaryresuscitationandother 5lifesavingmethods,astheydeterminebest[,and].Suchboardmayconsultthedepartmentof 6publicsafety,thestatefiremarshal'soffice,thelocalfireprotectionauthorities,andothersas 7theboardseesfit.[Theboardmaymakecompletionoftheprogramarequirementfor 8graduation.] Anytrainedemployeeshallbeheldharmlessandimmunefromanycivil 9liabilityforadministeringcardiopulmonaryresuscitationandotherlifesavingmethodsin 10goodfaithandaccordingtostandardmedicalpractices. 170.315.1.(1)ThereisherebyestablishedtheActiveShooterandIntruder 2ResponseTrainingforSchoolsProgram(ASIRT). 3 (2)ForeachschoolyearendingbeforeJuly1,2026,eachschooldistrictand 4charterschoolmay[, byJuly1,2014,] includeinitsteacherandschoolemployeetraininga 5componentonhowtoproperlyrespondtostudentswhoprovidethemwithinformationabout 6athreateningsituationandhowtoaddresssituationsinwhichthereisapotentiallydangerous 7orarmedintruderintheschool.Trainingmayalsoincludeinformationandtechniqueson 8howtoaddresssituationswhereanactiveshooterispresentintheschooloronschool 9property. 10 (3)Forthe2026-27schoolyearandallsubsequentschoolyears,eachschool 11districtandcharterschoolshallincludeinitsteacherandschoolemployeetraining 12componentson: 13 (a)Howtoproperlyrespondtostudentswhoprovideateacherorschool 14employeewithinformationaboutathreateningsituation; 15 (b)Howtoaddresssituationsinwhichthereisapotentiallydangerousorarmed 16intruderintheschool; 17 (c)Informationandtechniquesonhowtoaddresssituationswhereanactive 18shooterispresentintheschooloronschoolproperty; 19 (d)Howtoidentifypotentialthreatsorsafetyhazards;and 20 (e)Protocolsforemergenciesintheschoolincluding,butnotlimitedto: 21 a.Evacuations; 22 b.Severeweather; 23 c.Earthquakes; 24 d.Fire;and 25 e.Medical. HB232 14 26 2.Forthe2026-27schoolyearandallsubsequentyears,eachschooldistrictand 27charterschool[may] thatelectstoprovidesuchtrainingshallconductthetraining[onan 28annualbasis] asestablishedinsection168.331. [Ifnoformaltraininghaspreviously 29occurred,thelengthofthetrainingmaybeeighthours.] Thelengthof[annualcontinuing] 30training[may] shallbe[fourhours] determinedbytheschooldistrictorcharterschool 31electingtoprovidesuchtraining. 32 3.Allschoolpersonnel[shall] mayparticipateinasimulatedactiveshooterand 33intruderresponsedrillconductedandledbylawenforcementprofessionalsorschoolsafety 34professionals. Eachdrill[may] shallincludeanexplanationofitspurposeandasafety 35briefing.[Thetrainingdrillshallrequireeachparticipanttotoknowandunderstandhowto 36respondintheeventofanactualemergencyonschoolpropertyorataschoolevent.Thedrill 37mayinclude: 38 (1)Allowingschoolpersonneltorespondtothesimulatedemergencyinwhatever 39waytheyhavebeentrainedorinformed;and 40 (2)Allowingschoolpersonneltoattemptandimplementnewmethodsofresponding 41tothesimulatedemergencybaseduponpreviouslyusedunsuccessfulmethodsofresponse.] 42 4.Allinstructorsfortheprogramshallbecertifiedbythedepartmentofpublic 43safety'speaceofficersstandardstrainingcommission. 44 5.Schooldistrictsandcharterschoolsmayconsultandcollaboratewithlaw 45enforcementauthorities,emergencyresponseagencies,andotherorganizationsandentities 46trainedtodealwithactiveshootersorpotentiallydangerousorarmedintruders. 47 6.Publicschoolsshallactivelyfosteranenvironmentinwhichstudentsfeel 48comfortablesharinginformationtheyhaveregardingapotentiallythreateningordangerous 49situationwitharesponsibleadult.Aspartofeachpublicschool'seffortstoactivelyfoster 50suchenvironment,eachpublicschoolshallannuallyprovideage-appropriate 51informationandtrainingontheMissouristatehighwaypatrol'sCourage2ReportMO 52(C2R)reportingmechanismoritssuccessorreportingmechanism. 53 7.Forthe2026-27schoolyearandallsubsequentschoolyears,eachschool 54districtandcharterschoolshallholdanage-appropriateactiveshooterexercisein 55whichstudents,teachers,andotherschoolemployeesparticipateinandpracticethe 56proceduresforsafetyandprotectiontobeimplementedundersuchconditions. ✔ HB232 15
