160.480.1.Theboardofeducationofeachschooldistrict[inthisstateisauthorized
2to]andthegoverningboardofeachcharterschoolshalladopt[an]acomprehensive
3emergency[preparedness] operationsplan[to]thatshalladdress[theuseofschool
4resources,includingschoolfacilities,commodityfoods,schoolbuses,andequipmentifa
5naturaldisasterorothercommunityemergencyoccurs]:
6 (1)Schoolsafety,crises,andemergencyoperations;
7 (2)Prevention,preparation,operations,andfollow-up;
8 (3)Collaborationwithlocallawenforcement,providersoffireprotection
9services,andemergencymanagement;and
10 (4)Considerationofsupportingmentalhealthneedsofallinvolvedinanycrisis.
11 2.Theemergencyoperationsplanshallbesharedwithlocallawenforcement,
12providersoffireprotectionservices,andemergencymanagement.

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 13 3.Theemergency[preparedness] operationsplanmayauthorizethesuperintendent
14orotherdesignatedschoolofficialstoapproveuseofschoolresourcestoproviderelieftothe
15communityifanemergencyoccurs.
16 [3.]4.FoodassistancemaybeprovidedusingcommoditiesdistributedbytheUnited
17StatesDepartmentofAgricultureconsistentwiththestandardsforemergencycongregate
18feedingundersuchprogram.
19 [4.]5.Theuseofschoolresourcesunderthissectionshallbesubjecttoreviewbythe
20boardofeducationorcharterschoolgoverningboardwithinthirtydaysofauthorizationor
21assoonasreasonablypossible.
22 6.Theboardofeducationofeachschooldistrictandthegoverningboardof
23eachcharterschoolshallensurethecompletionofaphysicalsecuritysiteassessmentat
24eachfacilityannually.
25 7.Thedepartmentofelementaryandsecondaryeducationshalldevelop
26standardsforemergencyoperationsplansdescribedinsubsection1ofthissectionand
27shallannuallyensurecompliancewiththeadoptionoftheemergencyoperationsplan
28describedinsubsection1ofthissection.
29 8.Thedepartmentofelementaryandsecondaryeducationshalldevelop
30standardsfortheannualphysicalsecuritysiteassessmentdescribedinsubsection6of
31thissectionusingnationallyacceptedmethodologyandshallensurecompliancewiththe
32completionoftheassessmentdescribedinsubsection6ofthissection.
160.482.1.Asusedinthissection,thefollowingtermsmean:
2 (1)"Automatedexternaldefibrillator"or"AED",alightweight,portabledevice
3that:
4 (a)Isusedtoadministeranelectricshockthroughthechestwalltotheheart;
5 (b)Hasbuilt-incomputerswithinthedevicetoassessthepatient'sheartrhythm,
6determinewhetherdefibrillationisneeded,andadministertheshock;
7 (c)Hasaudibleorvisualprompts,orboth,toguidetheuserthroughtheprocess;
8 (d)HasreceivedapprovalfromtheU.S.FoodandDrugAdministrationofits
9pre-marketmodificationfiledunder21U.S.C.Section360(k),asamended;
10 (e)Iscapableofrecognizingthepresenceorabsenceofventricularfibrillation
11andrapidventriculartachycardiaandiscapableofdeterminingwithoutintervention
12byanoperatorwhetherdefibrillationshouldbeperformed;and

14chargesanddeliversanelectricalimpulsetoanindividual'sheartorchargesand
15deliversanelectricalimpulseatthecommandoftheoperator;

55 2.Forthe2026-27schoolyearandallsubsequentschoolyears,eachpublic
56schoolshalldevelopandimplementacardiacemergencyresponseplanthataddresses
57theappropriateuseofschoolpersonneltorespondtoincidentsinvolvinganindividual
58experiencingsuddencardiacarrestorasimilarlife-threateningemergencywhileona
59schoolcampus.
60 3.Membersofeachpublicschool'sadministrationshallcoordinatedirectlywith
61localemergencyservicesproviderstointegratethepublicschool'scardiacemergency
62responseplanintothelocalemergencyservicesproviders'protocols.Acardiac
63emergencyresponseplanshallintegrateevidence-basedcoreelements,suchasthose
64recommendedbytheAmericanHeartAssociationguidelines,ProjectADAM,or
65anothersetofnationallyrecognized,evidence-basedstandardsorcoreelements.
66 4.Thecardiacemergencyresponseplanshallintegrate,ataminimum,the
67followingcoreelements:
68 (1)Establishmentofacardiacemergencyresponseteam;
69 (2)Activationoftheteaminresponsetoasuddencardiacarrest;
70 (3)ImplementationofAEDplacementandroutinemaintenancethroughoutthe
71schoolcampus;
72 (4)Disseminationoftheplanthroughouttheschoolcampus;
73 (5)MaintenanceofongoingstafftraininginCPRandAEDuse;
74 (6)Practiceofthecardiacemergencyresponseplanusingdrillsannually;
75 (7)Integrationoftheplanintothelocalemergencyservicesproviders'protocols;
76and
77 (8)Bothannualandcontinuousreviewsandevaluationsoftheplan.
78 5.AppropriateAEDplacementshallbedictatedbythecardiacemergency
79responseplanandinaccordancewithguidelinessetbytheAmericanHeartAssociation
80ornationallyrecognizedguidelinesfocusedonemergencycardiovascularcare.AnAED
81shouldbeidentifiedwithappropriatesignageandisonsiteorplacedandmadeavailable
82inanunlockedlocationonschoolproperty.
83 6.Forschoolswithanathleticdepartmentororganizedschoolathleticprogram,
84anAEDshallbeclearlymarkedandeasilyaccessibleinanunlockedlocationateach
85schoolathleticvenueandevent.TheAEDshallbeaccessibleduringtheschooldayand
86anyschool-sponsoredathleticeventorteampracticeinwhichpupilsoftheschoolare
87participating.Itisrecommended,totheextentpossible,thatthegoverningbodyofa

89accessiblewithinthreeminutesofcardiacarrest.
90 7.Appropriateschoolpersonnelshallbecertifiedinfirstaid,CPR,andAEDuse
91thatfollowevidence-basedguidelinessetforthbytheAmericanHeartAssociationor
92nationallyrecognizedguidelinesfocusedonemergencycardiovascularcare.Theschool
93personnelrequiredtobecertifiedshallbedeterminedbythecardiacemergency
94responseplanandshallinclude,butnotbelimitedto,athleticscoaches,schoolnurses,
95andathletictrainers.
160.660.1.OnorbeforeJuly1,[2001] 2026, thestateboardofeducationshalladd
2toanyschoolfacilitiesandsafetycriteriadevelopedfortheMissourischoolimprovement
3programprovisionsthatrequire:
4 (1)Eachschooldistricttodesignateaprimaryandsecondaryschoolsafety
5coordinator;
6 (2)Eachschooldistrict's[designated] primaryandsecondarysafetycoordinatorto
7haveathoroughknowledgeofallfederal,stateandlocalschoolviolencepreventionprograms
8andresourcesavailabletostudents,teachersorstaffinthedistrict;and
9 [(2)](3)Eachschooldistricttofullyutilizeallsuchprogramsandresourcesthatthe
10localschoolboardoritsdesigneedeterminesarenecessaryandcost-effectivefortheschool
11district.
12 2.Eachschooldistrictshallrequiretheschoolsafetycoordinatorsandother
13designatedpersonnel,asnecessary,tocompletewithinonecalendaryearofbeing
14designatedasaschoolsafetycoordinator,either:
15 (1)(a)TheFederalEmergencyManagementAdministration's(FEMA)IS-
16100.C:IntroductiontotheIncidentCommandSystem,ICS100,oritssuccessorcourse;
17and
18 (b)TheFederalEmergencyManagementAdministration's(FEMA)IS-200.C:
19BasicIncidentCommandSystemforInitialResponse,ICS-200,oritssuccessorcourse;
20or
21 (2)TheIncidentCommandSystem(ICS)forSchoolscourseprovidedbythe
22MissouriSchoolBoards'Association'sCenterforEducationSafety(CES),orits
23successorcoursecreatedbyCEStoreplacetheICSforSchoolscourse.
24 3.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis
25createdundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplies
26withandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028.
27Thissectionandchapter536arenonseverableandifanyofthepowersvestedwiththe
28generalassemblypursuanttochapter536toreview,todelaytheeffectivedateorto
29disapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof

27entrywaywithbullet-resistantwindowfilmunderthissectionunlessthegeneral
28assemblyspecificallyappropriatesmoneystocoverallcostsrelatedtoequippingsuch
29doororentrywaywithsuchlockorwindowfilm.

48equippedwithmaterialthatprovidesconcealmentofstudentsandstaffinlockdown
49whilemaintainingsomelimitedvisibilityintotheroomforfirstresponders.
167.020.1.Asusedinthissectionandinsection167.022, the[term] following

3 (1)"Behavioralthreatassessment",recordsassociatedwithanevaluationofa
4studentwhohasshownordemonstrated:
5 (a)Homicidalorsuicidalideation;
6 (b)Planninganattackonaschool,otherstudents,faculty,staff,or
7administration;or
8 (c)Behaviorthatputsstudents,faculty,staff,oradministrationatriskforharm;
9 (2)"Homelesschild"or"homelessyouth"[shallmean],apersonlessthantwenty-one
10yearsofagewholacksafixed,regularandadequatenighttimeresidence,includingachildor
11youthwho:
12 [(1)] (a)Issharingthehousingofotherpersonsduetolossofhousing,economic
13hardship,orasimilarreason;islivinginmotels,hotels,orcampinggroundsduetolackof
14alternativeadequateaccommodations;islivinginemergencyortransitionalshelters;is
15abandonedinhospitals;orisawaitingfostercareplacement;
16 [(2)] (b)Hasaprimarynighttimeresidencethatisapublicorprivateplacenot
17designedfororordinarilyusedasaregularsleepingaccommodationforhumanbeings;
18 [(3)] (c)Islivingincars,parks,publicspaces,abandonedbuildings,substandard
19housing,busortrainstations,orsimilarsettings;and
20 [(4)](d)Isamigratorychildoryouthwhoqualifiesashomelessbecausethechildor

27 (a)Stipulatesrulesforattendanceattheschool;
28 (b)Providesbenchmarksthatallowforthestudenttobereleasedfromthe
29personalsafetyplanovertime;and
30 (c)Providesimmediateaccesstoatrustedadultforthestudentwiththepersonal
31safetyplan.
32 2.Inordertoregisterapupil,theparentorlegalguardianofthepupilorthepupil
33himselforherselfshallprovide,atthetimeofregistration,oneofthefollowing:
34 (1)Proofofresidencyinthedistrict.Exceptasotherwiseprovidedinsection
35167.151,theterm"residency"shallmeanthatapersonbothphysicallyresideswithinaschool
36districtandisdomiciledwithinthatdistrictor,inthecaseofaprivateschoolstudent
37suspectedofhavingadisabilityundertheIndividualsWithDisabilitiesEducationAct,20
38U.S.C.Section[1412,] 1411etseq.,asamended,thatthestudentattendsprivateschool
39withinthatdistrict.Thedomicileofaminorchildshallbethedomicileofaparent,military
40guardianpursuanttoamilitary-issuedguardianshiporcourt-appointedlegalguardian.For
41instancesinwhichthefamilyofastudentlivinginMissourico-locatestolivewithother
42familymembersorliveinamilitaryfamilysupportcommunitybecauseoneorbothofthe
43child'sparentsarestationedordeployedoutofstateordeployedwithinMissouriunderactive
44dutyordersunderTitle10orTitle32oftheUnitedStatesCode,thestudentmayattendthe
45schooldistrictinwhichthefamilymember'sresidenceorfamilysupportcommunityis
46located.Iftheactivedutyordersexpireduringtheschoolyear,thestudentmayfinishthe
47schoolyearinthatdistrict;
48 (2)Proofthatthepersonregisteringthestudenthasrequestedawaiverunder
49subsection3ofthissectionwithinthelastforty-fivedays;or
50 (3)Proofthatoneorbothofthechild'sparentsarebeingrelocatedtothestateof
51Missouriundermilitaryorders.

53Ininstanceswherethereisreasontosuspectthatadmissionofthepupilwillcreatean
54immediatedangertothesafetyofotherpupilsandemployeesofthedistrict,the
55superintendentorthesuperintendent'sdesigneemayconveneahearingwithinfive
56workingdaysoftherequesttoregisteranddeterminewhetherornotthepupilmayregister.
57 3.Anypersonsubjecttotherequirementsofsubsection2ofthissectionmayrequest
58awaiverfromthedistrictboardofanyofthoserequirementsonthebasisofhardshiporgood
59cause.Undernocircumstancesshallathleticabilitybeavalidbasisofhardshiporgoodcause
HB232	8 60fortheissuanceofawaiveroftherequirementsofsubsection2ofthissection.Thedistrict
61boardorcommitteeoftheboardappointedbythepresidentandwhichshallhavefull
62authoritytoactinlieuoftheboardshallconveneahearingassoonaspossible,butnolater
63thanforty-fivedaysafterreceiptofthewaiverrequestmadeunderthissubsectionorthe
64waiverrequestshallbegranted.Thedistrictboardorcommitteeoftheboardmaygrantthe
65requestforawaiverofanyrequirementofsubsection2ofthissection.Thedistrictboardor
66committeeoftheboardmayalsorejecttherequestforawaiverinwhichcasethepupilshall
67notbeallowedtoregister.Anypersonaggrievedbyadecisionofadistrictboardor
68committeeoftheboardonarequestforawaiverunderthissubsectionmayappealsuch
69decisiontothecircuitcourtinthecountywheretheschooldistrictislocated.
70 4.Anypersonwhoknowinglysubmitsfalseinformationtosatisfyanyrequirementof
71subsection2ofthissectionisguiltyofaclassAmisdemeanor.
72 5.Inadditiontoanyotherpenaltiesauthorizedbylaw,adistrictboardmayfileacivil
73actiontorecover,fromtheparent,militaryguardianorlegalguardianofthepupil,thecostsof
74schoolattendanceforanypupilwhowasenrolledataschoolinthedistrictandwhoseparent,

77 6.Subsection2ofthissectionshallnotapplytoapupilwhoisahomelesschildor
78youth,orapupilattendingaschoolnotinthepupil'sdistrictofresidenceasaparticipantinan
79interdistricttransferprogramestablishedunderacourt-ordereddesegregationprogram,a
80pupilwhoisawardofthestateandhasbeenplacedinaresidentialcarefacilitybystate
81officials,apupilwhohasbeenplacedinaresidentialcarefacilityduetoamentalillnessor
82developmentaldisability,apupilattendingaschoolpursuanttosections167.121and
83167.151,apupilplacedinaresidentialfacilitybyajuvenilecourt,apupilwithadisability
84identifiedunderstateeligibilitycriteriaifthestudentisinthedistrictforreasonsotherthan
85accessingthedistrict'seducationalprogram,orapupilattendingaregionalorcooperative
86alternativeeducationprogramoranalternativeeducationprogramonacontractualbasis.
87 7.Withintwobusinessdaysofenrollingapupil,theschoolofficialenrollingapupil,
88includinganyspecialeducationpupil,shallrequestthoserecordsrequiredbydistrictpolicy
89forstudenttransfer[andthose],disciplinerecordsrequiredbysubsection9ofsection160.261
90fromallschoolspreviouslyattendedbythepupilwithinthelasttwelvemonths, andrecords
91ofanybehavioralthreatassessmentsandpersonalsafetyplansofthepupilbythelocal
92educationagencyifthestudentiscurrentlysubjecttoanactivepersonalsafetyplanor
93hasbeensubjecttoapersonalsafetyplanintheprevioustwelvemonths. Anyschool
94districtthatreceivesarequestforsuchrecordsfromanotherschooldistrictenrollingapupil
95thathadpreviouslyattendedaschoolinsuchdistrictshallrespondtosuchrequestwithinfive
96businessdaysofreceivingtherequest.Schooldistrictsmayreportordiscloseeducation
HB232	9 97recordstolawenforcementandjuvenilejusticeauthoritiesifthedisclosureconcernslaw
98enforcement'sorjuvenilejusticeauthorities'abilitytoeffectivelyserve,priortoadjudication,
99thestudentwhoserecordsarereleased.Theofficialsandauthoritiestowhomsuch
100informationisdisclosedmustcomplywithapplicablerestrictionssetforthin20U.S.C.

27charterschool[may] thatelectstoprovidesuchtrainingshallconductthetraining[onan
28annualbasis] asestablishedinsection168.331. [Ifnoformaltraininghaspreviously
29occurred,thelengthofthetrainingmaybeeighthours.] Thelengthof[annualcontinuing]
30training[may] shallbe[fourhours] determinedbytheschooldistrictorcharterschool
31electingtoprovidesuchtraining.
