187uponconductofsuchofficeroremployeearisingoutofandperformedinconnectionwithhis

230andchapter536arenonseverableandifanyofthepowersvestedwiththegeneralassembly

5 3.(1)Theclaimantshallestablishthefollowingbyapreponderanceofevidence:
6 (a)Theclaimantwasconvictedofafelonyoffenseandsubsequentlyimprisoned;
7 (b)Theclaimant'sjudgmentofconvictionwasreversedorvacatedandeither
8thechargesweredismissedoronretrialtheclaimantwasfoundtobenotguilty;
9 (c)Theclaimantdidnotcommittheoffenseoroffensesforwhichtheclaimant
10wasconvictedandwasnotanaccessoryoraccomplicetotheactsthatwerethebasisof
11theconvictionandresultedinareversalorvacationofthejudgmentofconviction,
12dismissalofthecharges,orfindingofnotguiltyonretrial;and
13 (d)Theclaimantdidnotcommitorsubornperjury,fabricateevidence,orbythe
14claimant'sownconductcauseorbringabouttheconviction.Neitheraconfessionor
15admissionlaterfoundtobefalsenoraguiltypleashallconstitutecommittingor
16suborningperjury,fabricatingevidence,orcausingorbringingabouttheconviction
17underthissubsection.
18 (2)Thecourt,inexercisingitsdiscretionaspermittedbylawregardingthe
19weightandadmissibilityofevidencesubmittedunderthissection,may,intheinterestof
20justice,givedueconsiderationtodifficultiesofproofcausedbythepassageoftime,the
21deathorunavailabilityofwitnesses,thedestructionofevidence,orotherfactorsnot
22causedbysuchpersonsorthoseactingontheirbehalf.
23 4.(1)Thesuit,accompaniedbyastatementofthefactsconcerningtheclaimfor
24damages,verifiedinthemannerprovidedfortheverificationofcomplaintsintherules
25ofcivilprocedure,shallbebroughtbytheclaimantwithinaperiodoftwoyearsafter

35 sectionshallnotbeconstruedasawaiverofsovereignimmunityforany
36 purposesotherthantherestitutionprovidedforherein.Thedepartmentof
37 correctionsshalldeterminetheaggregateamountofrestitutionowedduringa
38 fiscalyear.Ifinsufficientmoneysareappropriatedeachfiscalyeartopay
