SectionA.Sections168.025and168.036,RSMo,arerepealedandtwonewsections
2enactedinlieuthereof,tobeknownassections168.025and168.036,toreadasfollows:
168.025.1.Forpurposesofthissection,"teacherexternship"meansanexperiencein
2whichateacher,supervisedbyhisorherschoolorschooldistrict,gainspracticalexperience
3atabusinesslocatedinMissourithroughobservationandinteractionwithemployersand
4employees.
5 2.Thedepartmentofeconomicdevelopmentandthedepartmentofelementaryand
6secondaryeducationshalldevelopandrecommend:
7 (1)Requirementsforteacherexternshipsthatcanbeconsideredtheequivalentofthe
8completionofcredithoursingraduate-levelcoursesforpurposesofsalaryschedules;and
9 (2)Anequivalencyschedulethatsetsforththenumberofcredithoursingraduate-
10levelcoursesthatshallbeconsideredequivalenttoandawardedforeachtypeofteacher
11externship.Toclassifyteacherexternshipsanddeterminethenumberofcredithoursthat
12wouldbeappropriateforeachtype,thelengthoftheteacherexternship,thepractical
13experiencegained,oranyotherfactordeemedrelevantmaybeconsidered.
14 3.Thedepartmentofeconomicdevelopmentandthedepartmentofelementaryand
15secondaryeducationshalladoptandpublishontheirwebsites,beforeJuly1,2020,
16requirementsforteacherexternshipsthatcanbeconsideredtheequivalentofthecompletion
17ofcredithoursingraduate-levelcoursesforpurposesofsalaryschedulesandanequivalency
18scheduleasdescribedinsubsection2ofthissection.Anyteacherexternshipthatmeetsthe

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 19publishedrequirementsshallbeknownasandconsideredacertifiedteacherexternshipfor
20purposesofthissection.
21 4.Ifaschooldistrictorcharterschoolusesasalaryscheduleinwhichateacher
22receivesahighersalaryifheorshehasearnedcredithoursingraduate-levelcourses,the
23schooldistrictorcharterschoolshallconsideranyteacherwhohascompletedacertified
24teacherexternshiptohavecompletedcredithoursingraduate-levelcoursesonitssalary
25scheduleinthemannerprescribedbytheequivalencyscheduledevelopedunderthissection
26andcompensatetheteacheraccordingly.
27 5.Thedepartmentofelementaryandsecondaryeducationandthedepartmentof
28economicdevelopmentmaypromulgaterulestoimplementtheprovisionsofthissection.
29Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatiscreatedunder
30theauthoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplieswithandis
31subjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028.Thissection
32andchapter536arenonseverable,andifanyofthepowersvestedwiththegeneralassembly
33pursuanttochapter536toreview,todelaytheeffectivedate,ortodisapproveandannula
34rulearesubsequentlyheldunconstitutional,thenthegrantofrulemakingauthorityandany
35ruleproposedoradoptedafterAugust28,2019,shallbeinvalidandvoid.
36 [6.Undersection23.253oftheMissourisunsetact:
37 (1)Theprovisionsofthenewprogramauthorizedunderthissectionshall
38automaticallysunsetfiveyearsafterAugust28,2019,unlessreauthorizedbyanactofthe
39generalassembly;
40 (2)Ifsuchprogramisreauthorized,theprogramauthorizedunderthissectionshall
41automaticallysunsettenyearsaftertheeffectivedateofthereauthorizationofthissection;
42and
43 (3)ThissectionshallterminateonSeptemberfirstofthecalendaryearimmediately
44followingthecalendaryearinwhichtheprogramauthorizedunderthissectionissunset.]
168.036.1.Inadditiontograntingcertificatesoflicensetoteachinpublicschoolsof
2thestateundersection168.021,thestateboardofeducationshallgrantsubstituteteacher
3certificatesasprovidedinthissectiontoanyindividualseekingtosubstituteteachinany
4publicschoolinthisstate.
5 2.(1)Thestateboardshallnotgrantacertificateoflicensetoteachunderthissection
6toanyindividualwhohasnotcompletedabackgroundcheckasrequiredundersection
7168.021.
8 (2)Thestateboardmayrefusetoissueorrenew,suspend,orrevokeanycertificate
9soughtorissuedunderthissectioninthesamemannerandforthesamereasonsasunder
10section168.071.
HCSHB267	2 11 3.Thestateboardmaygrantacertificateunderthissectiontoanyindividualwhohas
12completed:
13 (1)Atleastthirty-sixsemesterhoursatanaccreditedinstitutionofhighereducation;
14or
15 (2)Thetwenty-houronlinetrainingprogramrequiredinthissectionandwho
16possessesahighschooldiplomaortheequivalentthereof.
17 4.Thedepartmentofelementaryandsecondaryeducationshalldevelopandmaintain
18anonlinetrainingprogramforindividuals,whichshallconsistoftwentyhoursoftraining
19relatedtosubjectsappropriateforsubstituteteachersasdeterminedbythedepartment.
20 5.Thestateboardmaygrantacertificateunderthissectiontoanyhighlyqualified
21individualwithexpertiseinatechnicalorbusinessfieldorwithexperienceintheArmed
22ForcesoftheUnitedStateswhohascompletedthebackgroundcheckrequiredinthissection
23butdoesnotmeetanyofthequalificationsundersubdivision(1)or(2)ofsubsection3ofthis
24sectionifthesuperintendentoftheschooldistrictinwhichtheindividualseekstosubstitute
25teachsponsorssuchindividualandtheschoolboardoftheschooldistrictinwhichthe
26individualseekstosubstituteteachvotestoapprovesuchindividualtosubstituteteach.
27 6.(1)Notwithstandinganyotherprovisionstocontrary,beginningonJune30,2022,
28andendingonJune30,[2025] 2030, anypersonwhoisretiredandcurrentlyreceivinga
29retirementallowanceundersections169.010to169.141orsections169.600to169.715,other
30thanfordisability,maybeemployedtosubstituteteachonapart-timeortemporarysubstitute
31basisbyanemployerincludedintheretirementsystemwithoutadiscontinuanceofthe
32person'sretirementallowance.Suchapersonshallnotcontributetotheretirementsystem,or
33tothepublicschoolretirementsystemestablishedbysections169.010to169.141ortothe
34publiceducationemployeeretirementsystemestablishedbysections169.600to169.715,
35becauseofearningsduringsuchperiodofemployment.
36 (2)Inadditiontotheconditionssetforthinsubdivision1ofthissubsection,any
37personretiredandcurrentlyreceivingaretirementallowanceundersections169.010to
38169.141,otherthanfordisability,whoisemployedbyathirdpartyorisperformingworkas
39anindependentcontractormaybeemployedtosubstituteteachonapart-timeortemporary
40substitutebasis,ifsuchpersonisperformingworkforanemployerincludedintheretirement
41systemwithoutadiscontinuanceoftheperson'sretirementallowance.
42 (3)Ifapersonisemployedpursuanttothissubsectiononaregular,full-timebasisthe
43personshallnotbeentitledtoreceivetheperson'sretirementallowanceforanymonthduring
44whichthepersonissoemployed.Theretirementsystemmayrequiretheemployer,thethird-
45partyemployer,theindependentcontractor,andtheretireesubjecttothissubsectionto
46providedocumentationshowingcompliancewiththissubsection.Ifsuchdocumentationis
HCSHB267	3 47notprovided,theretirementsystemmaydeemtheretireetohaveexceededthelimitations
48providedinthissubsection.
49 7.Acertificategrantedunderthissectionshallbevalidforfouryears.Acertificate
50grantedunderthissectionshallexpireattheendofanycalendaryearinwhichtheindividual
51failstosubstituteteachforatleastfivedaysorfortyhoursofin-seatinstruction.
52 8.(1)Anindividualtowhomthestateboardgrantsacertificateunderthissection
53maybeasubstituteteacherinapublicschoolinthestateiftheschooldistrictagreesto
54employtheindividualasasubstituteteacherandsuchindividualhascompletedabackground
55checkasrequiredinsubsection10ofthissection.
56 (2)Noindividualtowhomthestateboardgrantsacertificateunderthissectionand
57whoisundertwentyyearsofageshallbeasubstituteteacheringradesninetotwelve.
58 9.Eachschooldistrictmaydevelopanorientationforindividualstowhomthestate
59boardgrantsacertificateunderthissectionforsuchindividualsemployedbytheschool
60districtandmayrequiresuchindividualstocompletesuchorientation.Suchorientationshall
61containatleasttwohoursofsubjectsappropriateforsubstituteteachersandshallcontain
62instructionontheschooldistrict'sbestpracticesforclassroommanagement.
63 10.BeginningJanuary1,2023,anysubstituteteachermay,atthetimesuchsubstitute
64teachersubmitsthefingerprintsandinformationrequiredforthebackgroundcheckrequired
65undersection168.021,designateuptofiveschooldistrictstowhichsuchsubstituteteacher
66hassubmittedanapplicationforsubstituteteachingtoreceivetheresultsofthesubstitute
67teacher'scriminalhistorybackgroundcheckandfingerprintcollection.Thetotalamountof
68anyfeesfordisseminatingsuchresultstouptofiveschooldistrictsunderthissubsectionshall
69notexceedfiftydollars.
70 11.Thestateboardmayexercisetheboard'sauthorityunderchapter161to
71promulgateallnecessaryrulesandregulationsnecessaryfortheadministrationofthissection.
