226.006.1.Thedepartmentoftransportationshalllimitthemessagesdisplayed
2onroadsidedynamicmessagesignstothefewestnumberofcharactersnecessaryto
3practicallyconveytheintendedinformation.Messagesdisplayedonroadsidedynamic
4messagesignsgenerallyshallbelimitedtoinformationrelatedtotrafficconditions,
5weather,oremergencyalerts,andshallnotcontaincommercialadvertisements.
6 2.Forpurposesofthissection,"dynamicmessagesign"meansachangeable
7messagetrafficcontroldeviceusedfortrafficwarning,regulation,routing,and
8management.
226.510.Asusedinsections226.500to226.600,thefollowingwordsorphrases
2mean:
3 (1)"Freewayprimaryhighway",thatpartofafederal-aidprimaryhighwaysystem,as
4ofJune1,1991,whichhasbeenconstructedasdivided,duallanefullycontrolledaccess
5facilitieswithnoaccesstothethroughwaysexcepttheestablishedinterchanges.When
6existingtwo-lanehighwaysarebeingupgradedtofour-lanelimitedaccess,theregulationsfor

10locatedwithintheboundariesofMissouri,asofficiallydesignatedormaybehereafter
11designatedbythestatehighwaysandtransportationcommissionwiththeapprovalofthe
12SecretaryofTransportation,pursuanttoTitle23,UnitedStatesCode,asamended;
13 (3)"Outdooradvertising",anoutdoorsign,display,device,figure,painting,drawing,

16ofthetraveledwaysoftheinterstateorprimarysystems;exceptthatnoneofthepreceding
17itemsshallbedeemed"outdooradvertising"whenlocatedon,attachedto,orerectedas
18partof,afence,fences,orwallsthatenclose,inwholeorinpart,anathleticfieldthatis
19ownedorleasedbyaschooloranentitydescribedinsection501(c)(3)oftheInternal
20RevenueCode,asamended.Whentheaudienceofsuchsignsisintendedtobethe
21patrons,participants,orattendeesofaneventoccurringattheathleticfield,thesigns
22shallnotrequirepermittingfromtheMissouridepartmentoftransportation;
23 (4)"Primarysystem",thefederal-aidprimaryhighwaysasofJune1,1991,andall
24highwaysdesignatedaspartoftheNationalHighwaySystembytheNationalHighway
25SystemDesignationActof1995andthosehighwayssubsequentlydesignatedaspartofthe
26NationalHighwaySystem;
27 (5)"Restarea",anareaorsiteestablishedandmaintainedwithinoradjacenttothe
28highwayright-of-wayunderpublicsupervisionorcontrol,fortheconvenienceofthe

36andlocalofficialsandapprovedbytheSecretaryofTransportation.Theboundaryofthe
37urbanareashall,asaminimum,encompasstheentireurbanplaceasdesignatedbytheBureau

226.540.Notwithstandinganyotherprovisionsofsections226.500to226.600,
2outdooradvertisingshallbepermittedwithinsixhundredandsixtyfeetofthenearestedgeof
3theright-of-wayofhighwayslocatedontheinterstate,federal-aidprimarysystemasitexisted
4onJune1,1991,orthenationalhighwaysystemasamendedinareaszonedindustrial,
5commercialorthelikeandinunzonedcommercialandindustrialareasasdefinedinthis
HCSHB272	2 6section,subjecttothefollowingregulationswhichareconsistentwithcustomaryuseinthis
7state:
8 (1)Lighting:
9 (a)Norevolvingorrotatingbeamorbeaconoflightthatsimulatesanyemergency
10lightordeviceshallbepermittedaspartofanysign.Noflashing,intermittent,ormoving
11lightorlightswillbepermittedexceptscoreboardsandotherilluminatedsignsdesignating
12publicserviceinformation,suchastime,date,ortemperature,orsimilarinformation,willbe
13allowed;tri-vision,projection,andotherchangeablemessagesignsshallbeallowedsubject
14toMissourihighwaysandtransportationcommissionregulations;
15 (b)Externallighting,suchasfloodlights,thinlineandgooseneckreflectorsare
16permitted,providedthelightsourceisdirecteduponthefaceofthesignandiseffectively
17shieldedsoastopreventbeamsorraysoflightfrombeingdirectedintoanyportionofthe
18maintraveledwayofthefederal-aidprimaryhighwaysasofJune1,1991,andallhighways
19designatedaspartoftheNationalHighwaySystembytheNationalHighwaySystem
20DesignationActof1995andthosehighwayssubsequentlydesignatedaspartoftheNational
21HighwaySystemandthelightsarenotofsuchintensitysoastocauseglare,impairthevision
22ofthedriverofamotorvehicle,orotherwiseinterferewithadriver'soperationofamotor
23vehicle;
24 (c)Nosignshallbesoilluminatedthatitinterfereswiththeeffectivenessof,or
25obscures,anofficialtrafficsign,device,orsignal;
26 (2)Sizeofsigns:
27 (a)Themaximumareaforanyonesignshallbeeighthundredsquarefeetwitha
28maximumheightofthirtyfeetandamaximumlengthofseventy-twofeet,inclusiveofborder
29andtrimbutexcludingthebaseorapron,supports,andotherstructuralmembers.Thearea
30shallbemeasuredasestablishedhereinandinrulespromulgatedbythecommission.In
31determiningthesizeofaconformingornonconformingsignstructure,temporarycutoutsand
32extensionsinstalledforthelengthofaspecificdisplaycontractshallnotbeconsidereda
33substantialincreasetothesizeofthepermanentdisplay;providedtheactualsquarefootageof
34suchtemporarycutoutsorextensionsmaynotexceedthirty-threepercentofthepermanent
35displayarea.Signserectedinaccordancewiththeprovisionsofsections226.500to226.600
36priortoAugust28,2002,whichfailtomeettherequirementsofthisprovisionshallbe
37deemedlegallynonconformingasdefinedherein;
38 (b)Themaximumsizelimitationsshallapplytoeachsideofasignstructure,and
39signsmaybeplacedbacktoback,doublefaced,orinV-typeconstructionwithnotmorethan
40twodisplaystoeachfacing,butsuchsignstructureshallbeconsideredasonesign;
41 (c)AfterAugust28,1999,nonewsignstructureshallbeerectedinwhichtwoor
42moredisplaysarestackedoneabovetheother.Stackedstructuresexistingonorbefore

44nonconformingandmaybemaintainedinaccordancewiththeprovisionsofsections226.500
45to226.600.Structuresdisplayingmorethanonedisplayonahorizontalbasisshallbe
46allowed,providedthattotaldisplayareasdonotexceedthemaximumallowedsquarefootage
47forasignstructurepursuanttotheprovisionsofparagraph(a)ofthissubdivision;
48 (3)Spacingofsigns:
49 (a)Onallinterstatehighways,freeways,andnonfreewayfederal-aidprimary
50highwaysasofJune1,1991,andallhighwaysdesignatedaspartoftheNationalHighway
51SystembytheNationalHighwaySystemDesignationActof1995andthosehighways
52subsequentlydesignatedaspartoftheNationalHighwaySystem:
53 a.Nosignstructureshallbeerectedwithinonethousandfourhundredfeetofan
54existingsignonthesamesideofthehighway;
55 b.Outsideofincorporatedmunicipalities,nostructuremaybelocatedadjacenttoor
56withinfivehundredfeetofaninterchange,intersectionatgrade,orsafetyrestarea.Suchfive
57hundredfeetshallbemeasuredfromthebeginningorendingofthepavementwideningatthe
58exitfromorentrancetothemaintraveledway.Forpurposeofthissubparagraph,theterm
59"incorporatedmunicipalities"shallinclude"urbanareas",exceptthatsuch"urbanareas"shall
60notbeconsidered"incorporatedmunicipalities"ifitisfinallydeterminedthatsuchwould
61havetheeffectofmakingMissouribeinnoncompliancewiththerequirementsofTitle23,
62UnitedStatesCode,Section131;
63 (b)Thespacingbetweenstructureprovisionsofthissubdivisiondonotapplytosigns
64whichareseparatedbybuildings,naturalsurroundings,orotherobstructionsinsuchmanner
65thatonlyonesignfacinglocatedwithinsuchdistanceisvisibleatanyonetime.Directional
66orotherofficialsignsorthoseadvertisingthesaleorleaseofthepropertyonwhichtheyare
67located,orthosewhichadvertiseactivitiesonthepropertyonwhichtheyarelocated,
68includingproductssold,shallnotbecounted,norshallmeasurementsbemadefromthemfor
69thepurposeofcompliancewithspacingprovisions;
70 (c)Nosignshallbelocatedinsuchmannerastoobstructorotherwisephysically
71interferewiththeeffectivenessofanofficialtrafficsign,signal,ordeviceorobstructor
72physicallyinterferewithamotorvehicleoperator'sviewofapproaching,merging,or
73intersectingtraffic;
74 (d)Themeasurementsinthissectionshallbetheminimumdistancesbetween
75outdooradvertisingsignstructuresmeasuredalongthenearestedgeofthepavementbetween
76pointsdirectlyoppositethesignsalongeachsideofthehighwayandshallapplyonlyto
77outdooradvertisingsignstructureslocatedonthesamesideofthehighwayinvolved;
78 (4)Asusedinthissection,thewords"unzonedcommercialandindustrialland"shall
79bedefinedasfollows:thatareanotzonedbystateorlocallaworordinanceandonwhich

81activityoronwhichacommercialorindustrialactivityisactuallyconductedtogetherwith
82theareaalongthehighwayextendingoutwardlysevenhundredfiftyfeetfromandbeyondthe
83edgeofsuchactivity.Allmeasurementsshallbefromtheouteredgesoftheregularlyused
84improvements,buildings,parkinglots,landscaped,storageorprocessingareasofthe
85commercialorindustrialactivityandalongandparalleltotheedgeofthepavementofthe
86highway.Onnonfreewayprimaryhighwayswherethereisanunzonedcommercialor
87industrialareaononesideoftheroadinaccordancewiththissection,theunzoned
88commercialorindustrialareashallalsoincludethoselandslocatedontheoppositeside
89ofthehighwaytotheextentofthesamedimensions.Unzonedlandshallnotinclude:
90 (a)Landontheoppositesideofthehighwayfromanunzonedcommercialor
91industrialareaasdefinedinthissectionandlocatedadjacenttohighwayslocatedonthe
92interstate[, federal-aidprimarysystemasitexistedonJune1,1991,orthenationalhighway
93systemasamended,unlesstheoppositesideofthehighwayqualifiesasaseparateunzoned
94commercialorindustrialarea]orfreewayprimaryhighways; or
95 (b)Landzonedbyastateorlocallaw,regulation,orordinance;
96 (5)"Commercialorindustrialactivities"asusedinthissectionmeansthosewhichare
97generallyrecognizedascommercialorindustrialbyzoningauthoritiesinthisstate,except
98thatnoneofthefollowingshallbeconsideredcommercialorindustrial:
99 (a)Outdooradvertisingstructures;
100 (b)Agricultural,forestry,ranching,grazing,farming,andrelatedactivities,including

107 (6)Thewords"unzonedcommercialorindustrialland"shallalsoincludeallareasnot
108specifiedinthissectionwhichconstitutean"unzonedcommercialorindustrialarea"within
109themeaningofthepresentSection131ofTitle23oftheUnitedStatesCode,orassuch
110statutemaybeamended.Asusedinthissection,thewords"zonedcommercialorindustrial
111area"shallrefertothoseareaszonedcommercialorindustrialbythedulyconstitutedzoning
112authorityofamunicipality,county,orotherlawfullyestablishedpoliticalsubdivisionofthe

140 (a)Nocountyormunicipalityshallissueapermittoallowaregulatedsigntobe
141newlyerectedwithoutapermitissuedbythestatehighwaysandtransportationcommission;
142 (b)Acountyormunicipalitymaychargeareasonableone-timepermitorinspection
143feetoassurecompliancewithlocalwindloadandelectricalrequirementswhenthesignis
144firsterected,butacountyormunicipalitymaynotchargeapermitorinspectionfeeforsuch
145signaftersuchinitialfee.Changingthedisplayfaceorperformingroutinemaintenanceshall
146notbeconsideredaserectinganewsign;
147 (8)Thestatehighwaysandtransportationcommissiononbehalfofthestateof
148Missouri,mayseekagreementwiththeSecretaryofTransportationoftheUnitedStatesunder
149Section131ofTitle23,UnitedStatesCode,asamended,thatsections226.500to226.600are
150inconformancewiththatSection131andprovideseffectivecontrolofoutdooradvertising
151signsassetforththerein.Ifsuchagreementcannotbereachedandthepenaltiesunder
152subsection(b)ofSection131areinvoked,theattorneygeneralofthisstateshallinstitute
153proceedingsdescribedinsubsection(1)ofthatSection131.
HCSHB272	6 226.550.1.Nooutdooradvertisingwhichisregulatedbysubdivision(1),(3)or(4)
2ofsection226.520orsubsection1ofsection226.527shallbeerectedormaintainedonor
3afterAugust28,1992,withoutaone-timepermanentpermitissuedbythestatehighwaysand
4transportationcommission.Applicationforpermitsshallbemadetothestatehighwaysand
5transportationcommissiononformsfurnishedbythecommissionandshallbeaccompanied
6byapermitfeeoftwohundreddollarsforallsigns;exceptthat,tax-exemptreligious
7organizationsasdefinedinsubdivision(11)ofsection313.005,serviceorganizationsas
8definedinsubdivision(12)ofsection313.005,veterans'organizationsasdefinedin
9subdivision(14)ofsection313.005,andfraternalorganizationsasdefinedinsubdivision(8)
10ofsection313.005shallbegrantedapermitforsignslessthanseventy-sixsquarefeetwithout
11paymentofthefee.Thepermitfeeoftwohundreddollarsshallbewaivedfor
12landowners,providedthatthelandowneristhepermitholderandownsboththeland
13uponwhichtheoutdooradvertisingisplacedandthebusinessbeingadvertisedonthe
14sign,solongasthebusinessbeingadvertisedislocatedwithinsevenhundredfiftyfeetof
15thesignlocation.Intheeventapermitholderfailstoerectasignstructurewithintwenty-
16fourmonthsofissuance,saidpermitshallexpireandanewpermitmustbeobtainedpriorto
17anyconstruction.
18 2.Nooutdooradvertisingwhichisregulatedbysubdivision(1),(3)or(4)ofsection
19226.520orsubsection1ofsection226.527whichwaserectedpriortoAugust28,1992,shall
20bemaintainedwithoutaone-timepermanentpermitforoutdooradvertisingissuedbythe
21statehighwaysandtransportationcommission.Ifaone-timepermanentpermitwasissuedby
22thestatehighwaysandtransportationcommissionafterMarch30,1972,andbeforeAugust
2328,1992,itisnotnecessaryforanewpermittobeissued.Ifaone-timepermanentpermit
24wasnotissuedforalawfullyerectedandlawfullyexistingsignbythestatehighwaysand
25transportationcommissionafterMarch30,1972,andbeforeAugust28,1992,aone-time
26permanentpermitshallbeissuedbythecommissionforeachsignwhichislawfullyin
27existenceonthedaypriortoAugust28,1992,uponapplicationandpaymentofapermitfee
28oftwohundreddollars.Allapplicationsandfeesduepursuanttothissubsectionshallbe
29submittedbeforeDecember31,1992.Thepermitfeeoftwohundreddollarsshallbe
30waivedforlandowners,providedthatthelandowneristhepermitholderandownsboth
31thelanduponwhichtheoutdooradvertisingisplacedandthebusinessbeingadvertised
32onthesign,solongasthebusinessbeingadvertisedislocatedwithinsevenhundredfifty
33feetofthesignlocation.
34 3.Forpurposesofsections226.500to226.600,theterminology"structurelawfullyin
35existence"or"lawfullyexisting"signoroutdooradvertisingshall,nevertheless,includethe
36followingsignsunlessthesignsviolatetheprovisionsofsubdivisions(3)to(7)ofsubsection
371ofsection226.580:

55that,tax-exemptreligiousorganizationsasdefinedinsubdivision(11)ofsection313.005,
56serviceorganizationsasdefinedinsubdivision(12)ofsection313.005,veterans'
57organizationsasdefinedinsubdivision(14)ofsection313.005,andfraternalorganizations
58asdefinedinsubdivision(8)ofsection313.005shallnotberequiredtopaysuchfee.The
59biennialinspectionfeeshallbewaivedforlandowners,providedthatthelandowneris
60thepermitholderandownsboththelanduponwhichtheoutdooradvertisingisplaced
61andthebusinessbeingadvertisedonthesign,solongasthebusinessbeingadvertisedis
62locatedwithinsevenhundredfiftyfeetofthesignlocation.
63 5.Inordertoeffectthemoreefficientcollectionofbiennialinspectionfees,thestate
64highwaysandtransportationcommissionisencouragedtoadoptarenewalsysteminwhich
65allpermitsinaparticularcountyarerenewedinthesamemonth.Inconjunctionwiththe
66conversiontothisrenewalsystem,thestatehighwaysandtransportationcommissionis
67specificallyauthorizedtoproraterenewalfeesbasedonchangesinrenewaldates.
68 6.Signownersorownersofthelandonwhichsignsarelocatedmustapplytothe
69statehighwaysandtransportationcommissionforbiennialinspectionandsubmitanyfeesas
70requiredbythissectiononorbeforeDecember31,1992.Forapermittedsignwhichdoesnot
71haveapermit,apermitshallbeissuedatthetimeofthenextbiennialinspection.
72 7.Thestatehighwaysandtransportationcommissionshalldepositallfeesreceived
73foroutdooradvertisingpermitsandinspectionfeesinthestateroadfund,keepingaseparate

75ofsections226.500to226.600.
226.1170.Thedepartmentoftransportation,inconsultationwiththeOzark
2HighlandDistillersGuild,shallerectandmaintainsuitablemarkingsandinformational
3signsdesignatingtheOzarkHighlandsSpiritsRegioninaccordancewiththemap
4producedpursuanttosubsection4ofsection311.028.Signsshallbelocatedalong
5highwaysapproachingorenteringtheregion,withthecoststobepaidbyprivate
6donation.
227.850.Notwithstandinganyprovisionoflawtothecontrary,thedepartment
2oftransportationshallnoterectanysigndesignatingahighwaynamedforanyperson
3whohasbeenconvictedofthekillingof,ortheattemptedkillingof,alawenforcement
4officerorpermitanysignageintheconvictedperson'smemory.Anysuchsigninplace
5priortoAugust28,2025,shallberemoved.
227.855.1.Thedepartmentoftransportationshallplaceasignatthecitylimits,
2orothersuitablelocationasdeterminedbythedepartmentoftransportation,ofthe

5devices,andimpactonroadwaysafety.Suchsignsshallbeerected,maintained,and
6paidforbythedepartmentoftransportationbyappropriationfromtheMissourimedal
7ofhonorrecipient'sfund,establishedundersection226.925.
8 2.Thesignsshallincludethewords"MedalofHonorRecipient",thenameof
9therecipient,andtheyearinwhichsuchpersonreceivedtheaward.Theoveralldesign
10ofthesign,includingsize,color,andlettering,shallbedesignatedbythedepartment
11basedonavailablespaceintheright-of-wayandtoconformwiththeguidelines
12providedintheDepartmentofTransportationManualonUniformTrafficControl
13Devices.
14 3.Forpurposesofthissection,"hometown"meansthecity,town,orvillagein
15whichtheawardrecipientresidedforamajorityofhisorherlifetime.Onlyonecity,
16town,orvillageshallbedesignatedasarecipient'shometownandsignshonoringsuch
17recipientshallbeplacedononlyoneroutethroughtherecipient'shometown.
18 4.Thedepartmentoftransportationmaypromulgaterulesandregulationsto
19implementandadministertheprovisionsofthissection.Anyruleorportionofarule,
20asthattermisdefinedinsection536.010,thatiscreatedundertheauthoritydelegated
21inthissectionshallbecomeeffectiveonlyifitcomplieswithandissubjecttoallofthe
22provisionsofchapter536and,ifapplicable,section536.028.Thissectionandchapter
23536arenonseverableandifanyofthepowersvestedwiththegeneralassembly
24pursuanttochapter536toreview,todelaytheeffectivedate,ortodisapproveandannul
