302.520.1.Wheneverthechemicaltestresultsareavailabletothelawenforcement
2officerwhilethearrestedpersonisstillincustody,andwheretheresultsshowanalcohol
3concentrationofeight-hundredthsofonepercentormorebyweightofalcoholinsuch
4person'sbloodorwheresuchpersonislessthantwenty-oneyearsofageandtheresultsshow
5thatthereistwo-hundredthsofonepercentormoreofalcoholintheperson'sblood,the
6officer,actingonbehalfofthedepartment,shallservethenoticeofsuspensionorrevocation
7personallyonthearrestedperson.
8 2.Whenthelawenforcementofficerservesthenoticeofsuspensionorrevocation,
9[theofficershalltakepossessionofanydriver'slicenseissuedbythisstatewhichisheldby
10theperson.Whentheofficertakespossessionofavaliddriver'slicenseissuedbythisstate,]
11theofficer,actingonbehalfofthedepartment,shallissueatemporarypermitwhichisvalid
12forfifteendaysafteritsdateofissuanceandshallalsogivethepersonarrestedanoticewhich
13shallinformthepersonofallrightsandresponsibilitiespursuanttosections302.500to
14302.540.Thenoticeshallbeinsuchformsothatthearrestedpersonmaysigntheoriginalas
15evidenceofreceiptthereof.Thenoticeshallalsocontainadetachableformpermittingthe
16arrestedpersontorequestahearing.Signingthehearingrequestformandmailingsuch
17requesttothedepartmentshallconstituteaformalapplicationforahearing.

23 4.Thedepartmentshallprovideformsfornoticeofsuspensionorrevocation,for
24noticeofrightsandresponsibilities,forrequestforahearingandfortemporarypermitstolaw
25enforcementagencies.
302.530.1.Anypersonwhohasreceivedanoticeofsuspensionorrevocationmay
2makearequestwithinfifteendaysofreceiptofthenoticeforareviewofthedepartment's
3determinationatahearing.[Iftheperson'sdriver'slicensehasnotbeenpreviously
4surrendered,itmaybesurrenderedatthetimetherequestforahearingismade.]
5 2.Atthetimetherequestforahearingismade,ifitappearsfromtherecordthatthe
6personistheholderofavaliddriver'slicenseissuedbythisstate,[andthatthedriver'slicense
7hasbeensurrendered,] thedepartmentshallissueatemporarypermitwhichshallbevalid
8untilthescheduleddateforthehearing.Thedepartmentmaylaterissueanadditional
9temporarypermitorpermitsinordertostaytheeffectivedateofthesuspensionorrevocation
10untilthefinalorderisissuedfollowingthehearing,asrequiredbysection302.520.
11 3.Thehearingmaybeheldbytelephone,orifrequestedbytheperson,suchperson's
12attorneyorrepresentative,ataregionallocationasdesignatedbythedirector.Thehearing
13shallbeconductedbyexaminerswhoarelicensedtopracticelawinthestateofMissouriand
14whoareemployedbythedepartmentonapart-timeorfull-timebasisasthedepartmentmay
15determine.
16 4.Thesoleissueatthehearingshallbewhetherbyapreponderanceoftheevidence
17thepersonwasdrivingavehiclepursuanttothecircumstancessetoutinsection302.505.
18Theburdenofproofshallbeonthestatetoadducesuchevidence.Ifthedepartmentfindsthe
19affirmativeofthisissue,thesuspensionorrevocationordershallbesustained.Ifthe
20departmentfindsthenegativeoftheissue,thesuspensionorrevocationordershallbe
21rescinded.
22 5.Theprocedureatsuchhearingshallbeconductedinaccordancewithchapter536,
23withsections302.500to302.540.Areportcertifiedundersubsection2ofsection302.510
24shallbeadmissibleinalikemannerasaverifiedreportasevidenceofthefactsstatedtherein
25andanyprovisionofchapter536tothecontraryshallnotapply.
26 6.Thedepartmentshallpromptlynotifythepersonofitsdecisionincludingthe
27reasonsforthatdecision.Suchnotificationshallincludeanoticeadvisingthepersonthatthe
28department'sdecisionshallbefinalwithinfifteendaysfromthedatesuchnoticewasmailed
HCSHB273	2 29unlessthepersonchallengesthedepartment'sdecisionwithinthattimeperiodbyfilingan
30appealinthecircuitcourtinthecountywherethearrestoccurred.
31 7.Unlesstheperson,withinfifteendaysafterbeingnotifiedofthedepartment's
32decision,filesanappealforjudicialreviewpursuanttosection302.535,thedecisionofthe
33departmentshallbefinal.
34 8.Thedirectormayadoptanyrulesandregulationsnecessarytocarryoutthe
35provisionsofthissection.
557.520.1.Forpurposesofthissection,thefollowingtermsshallmean:
2 (1)"Failedstart",anyattempttostartavehiclewithabreathalcohol
3concentrationexceedingtwenty-fivethousandthsofonepercentbyweightofalcoholin
4aperson'sbreath,unlessasubsequentretestperformedwithintenminutesregistersa
5breathalcoholconcentrationnotexceedingtwenty-fivethousandthsofonepercentby
6weightofalcoholinsuchperson'sbreath;
7 (2)"Runningretest",failuretotakeabreathtestperformedbyadriverupona
8certifiedignitioninterlockdeviceatrandomintervalsafteraninitialenginestartup
9breathtestandwhilethevehicle'smotorisrunningorfailuretotakeabreathretest
10withabreathalcoholconcentrationnotexceedingtwenty-fivethousandthsofone
11percentbyweightofalcoholinsuchdriver'sbreath;
12 (3)"Vehicle",anymechanicaldeviceonwheels,designedprimarilyforuse,or
13used,onhighways.
14 2.Inanycriminalcaseinvolvinganintoxication-relatedtrafficoffense,the
15defendantmayrequesttodivertthecriminalcasetoadrivingwhileintoxicated(DWI)
16diversionprogramdescribedinthissectionbysubmittingarequesttotheprosecuting
17orcircuitattorneyandsendingacopyofsuchrequesttothedepartmentofrevenue
18withinfifteendaysofhisorherarrest.Theprosecutingorcircuitattorneymaydivert
19thecriminalcasetothisDWIdiversionprogrambyfilingamotionwiththecourttostay
20thecriminalproceeding,ifthedefendantmeetsthefollowingcriteriaforeligibilityfor
21entryintotheDWIdiversionprogram:
22 (1)Thedefendanthasnotpreviouslypledguiltytoorbeenconvictedofan
23intoxication-relatedtrafficoffenseinviolationofsection577.010,577.012,577.013,
24577.014,577.015,or577.016;
25 (2)Thedefendantisnotcurrentlyenrolledin,andhasnotinthepreviousfive
26yearscompleted,adiversionprogrampursuanttothissection;
27 (3)Thedefendantdoesnotholdacommercialdriver'slicense;
28 (4)Theoffensedidnotoccurwhileoperatingacommercialvehicle;
29 (5)Theoffensedidnotresultintheinjuryordeathofanotherperson;and

31section577.020.
32 3.Uponamotionfiledbytheprosecutingorcircuitattorney,thecourtmay
33continueadivertedcaseinvolvinganintoxication-relatedtrafficoffenseifthe
34prosecutingorcircuitattorneydeemsappropriatebasedonthespecificsituationof
35thedefendant.Thecaseshallbedivertedforaperiodnottoexceedtwenty-fourmonths
36andorderthedefendanttocomplywithterms,conditions,orrequirements.
37 4.TheDWIdiversionplanshallbeforaspecifiedperiodandbeinwriting.The
38prosecutingorcircuitattorneyhasthesoleauthoritytodevelopdiversionaryprogram
39requirements,butshallrequireinstallationofanignitioninterlockdeviceforaperiodof
40notlessthanoneyear,requirethedefendanttoparticipateinavictimimpactpanel
41sponsoredbyanonprofitorganization,andrequireothertermsdeemednecessaryby
42thecourt.
43 5.IfthecourtcontinuesthecriminalcasetodivertthedefendanttothisDWI
44diversionprogram,acopyofsuchordershallbesenttothedepartmentofrevenueand,
45uponreceipt,thedepartmentshallcontinueanyproceedingtosuspendorrevokea
46licensepursuanttochapter302foraperiodnottoexceedtwenty-fourmonths.After
47thedefendantsuccessfullycompletestherequirementsoftheDWIdiversionprogram,
48thedepartmentshalldismissanyproceedingagainstthedefendant.
49 6.Thecourtshallnotifythedefendantthatheorsheisrequiredtoinstalla
50functioning,certifiedignitioninterlockdeviceoneachvehiclethatthedefendant
51operatesandthedefendantisprohibitedfromoperatingamotorvehicleunlessthat
52vehicleisequippedwithafunctioning,certifiedignitioninterlockdevicepursuanttothis
53section.Theserequirementsshallbeinadditiontoanyotherprovisionsofthischapter
54orchapter302requiringinstallationandmaintenanceofanignitioninterlockdevice.
55Anypersonrequiredtouseanignitioninterlockdeviceshallcomplywithsuch
56requirementsubjecttothepenaltiesprovidedbysection577.599.
57 7.Thedepartmentofrevenueshallinformthedefendantoftherequirementsof
58thissection,includingthetermforwhichthedefendantisrequiredtohaveacertified
59ignitioninterlockdeviceinstalledandshallnotifythedefendantthatinstallationofa
60functioning,certifiedignitioninterlockdeviceonavehicledoesnotallowthedefendant
61todrivewithoutavaliddriver'slicense.Thedepartmentshallrecordthemandatory
62useofthedeviceforthetermrequiredandthetimewhenthedeviceisrequiredtobe
63installedpursuanttothecourtorder.Adefendantwhoisnotifiedbythedepartment
64shalldoallofthefollowing:
HCSHB273	4 65 (1)Arrangeforeachvehicleoperatedbythedefendanttobeequippedwitha
66functioning,certifiedignitioninterlockdevicebyacertifiedignitioninterlockdevice
67providerasdeterminedbythedepartmentoftransportation;and
68 (2)Arrangeforeachvehiclewithafunctioning,certifiedignitioninterlock
69devicetobeservicedbytheinstalleratleastonceeverythirtydaysfortheinstallerto
70recalibrateandmonitortheoperationofthedevice.
71 8.Thecertifiedignitioninterlockdeviceprovidershallnotifythedepartment:
72 (1)Ifthedeviceisremovedorindicatesthatthedefendanthasattemptedto
73remove,bypassbyarunningretest,ortamperwiththedevice;
74 (2)Ifthedefendantfailsthreeormoretimestocomplywithanyrequirementfor
75themaintenanceorcalibrationoftheignitioninterlockdevice;or
76 (3)Ifthedeviceregistersafailedstart.

78Ifadefendanthasanyfailedstartthatoccurswithinthelastninetydaysoftherequired
79periodofinstallationoftheignitioninterlockdevice,thetermmaybeextendedfora
80periodofuptoninetydays.
81 9.AfterthecompletionoftheDWIdiversionprogramandifthedefendanthas
82compliedwithalltheimposedtermsandconditions,thecourtshalldismissthecriminal
83caseagainstthedefendant,recordthedismissal,andtransmittherecordtothecentral
84repositoryupondismissal.Anycourtautomationsystem,includinganypilotproject,
85thatprovidespublicaccesstoelectronicrecordontheinternetshallredactanypersonal
86identifyinginformationofthedefendant,includingname,address,andyearofbirth.
87Suchinformationshallbeprovidedinaconfidentialfilingsheetcontemporaneously
88filedwiththecourtorenteredbythecourt,whichshallnotbesubjecttopublic
89inspectionoravailability.
90 10.Intheeventofnoncompliancebythedefendantwiththetermsand
91conditionsoftheDWIdiversionprogram,theprosecutingorcircuitattorneymayfilea
92motiontoterminatethedefendantfromthediversionprogramandmayrecommendthe
93prosecutionoftheunderlyingcase.Uponthefilingofsuchmotion,afternoticetothe
94defendant,thecourtshallholdahearingtodeterminebypreponderanceoftheevidence
95whetherthedefendanthasfailedtocomplywiththetermsandconditionsofthe
96diversionprogram.Ifthecourtfindsthatthedefendanthasnotcompliedwiththe
97termsandconditionsofthediversionprogram,thecourtmayendthediversion
98programandsetthecaseonthenextavailablecriminaldocket.
99 11.Anydefendantwhoisfoundguiltyofanyintoxication-relatedtrafficoffense
100andwhohaspreviouslyutilizedtheDWIdiversionprogrampursuanttothissection
101shallbeconsideredaprioroffenderasdefinedinsection577.001,providedthatthe
HCSHB273	5 102prioroffenseoccurredwithinfiveyearsoftheintoxication-relatedoffenseforwhichthe
103personischarged,asprovidedinsubsection20ofsection577.001.
104 12.Forthelimitedpurposeofdeterminingwhetheradefendantisachronic,
105habitual,persistent,orprioroffenderundersection577.001,acriminalcasedivertedto
106aDWIdiversionprogramandsuccessfullycompletedbyadefendantshallbecountedas
107oneintoxication-relatedtrafficoffense.
108 13.Acertifiedignitioninterlockdeviceprovidershalladoptadiscountedfee
109schedulethatprovidesforthepaymentofthecostsofthecertifiedignitioninterlock
110devicebyoffenderswithanincomeatorbelowonehundredandfiftypercentofthe
111federalpovertylevel.Apersonwithanincomeatorbelowonehundredandfifty
112percentofthefederalpovertylevelwhoprovidesincomeverificationshallbe
113responsiblefortenpercentofthecostoftheignitioninterlockdevice.Anyadditional
114costsaccruedbythepersonfornoncompliancewithprogramrequirementsarenot
115subjecttodiscountedratesandarethesoleresponsibilityoftheperson.Thecertified
116ignitioninterlockprovidershallverifytheoffender'sincometodeterminethecostofthe
117ignitioninterlockdevicebyverifyingfromtheoffenderthepreviousyear'sfederal
118incometaxreturn,thepreviousthreemonthsofweeklyormonthlyincomestatements,
119oracourtorderdeclaringthepersonwithanincomeatorbelowonehundredandfifty
120percentofthefederalpovertylevel.
121 14.Nothinginthissectionshallprohibitaprosecutingorcircuitattorneyfrom
122divertingacriminalcasepursuanttosection557.014inanycriminalcaseinvolvingan
123intoxication-relatedtrafficoffense.
