11forthevaporproductfromtheUnitedStatesFoodandDrugAdministrationunder21

13 (b)ThevaporproductwasmarketedintheUnitedStatesasofAugust8,2016,
14themanufacturersubmittedapremarkettobaccoproductapplicationforthevapor
15producttotheUnitedStatesFoodandDrugAdministrationunder21U.S.C.Section
16387jonorbeforeSeptember9,2020,andtheapplicationeitherremainsunderreview

23suchproductmaybesoldinthisstate.
24 4.Amanufacturerrequiredtosubmitacertificationformundersubsection2of
25thissectionshallnotifytheattorneygeneralwithinthirtydaysofanymaterialchangeto
26theinformationonthecertificationform.
27 5.OnorbeforeJune1,2026,theattorneygeneralshallmaintainandmake
28publiclyavailableontheoffice'swebsiteadirectorythatlistsallvaporproduct
29manufacturersandvaporproductsforwhichcertificationformshavebeenreceivedand
30thathavebeendeterminedbytheattorneygeneraltomeettherequirementstosellsuch
31vaporproducts.
32 6.Theattorneygeneralshallprovidemanufacturersnoticeandanopportunity
33tocuredeficienciesbeforeremovingmanufacturersorproductsfromthedirectory.
