BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Chapter570,RSMo,isamendedbyaddingtheretoonenewsection,tobe
2knownassection570.036,toreadasfollows:
570.036.1.Apersoncommitstheoffenseoforganizedretailtheftifheorshe,
2whilealoneorwithanyotherpersonorpersons,commitsaseriesoftheftsofretail
3merchandiseagainstoneormorepersonseitheronthepremisesofamerchantor
4throughtheuseofaninternetornetworksiteinthisstatewiththeintentto:
5 (1)Returnthemerchandisetothemerchantforvalue;or
6 (2)Resell,trade,orbarterthemerchandiseforvalueinanymannerincluding,
7butnotlimitedto,throughtheuseofaninternetornetworksite.
8 2.TheoffenseoforganizedretailtheftisaclassCfelonyiftheaggregatedvalue
9ofthepropertyorservicesinvolvedinalltheftscommittedinthisstateduringaperiod
10ofonehundredtwentydaysisnolessthanonethousandfivehundreddollarsandno
11morethantenthousanddollars.
12 3.TheoffenseoforganizedretailtheftisaclassBfelonyiftheaggregatedvalue
13ofthepropertyorservicesinvolvedinalltheftscommittedinthisstateduringaperiod
14ofonehundredtwentydaysismorethantenthousanddollars.
15 4.Inadditiontoanyotherpenalty,thecourtshallorderapersonwhoviolates
16thissectiontopayrestitution.
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17 5.Forthepurposesofthissection,indeterminingtheaggregatedvalueofthe
18propertyorservicesinvolvedinalltheftscommittedinthisstateduringaperiodofone
19hundredtwentydays:
20 (1)Theamountinvolvedinasingletheftshallbedeemedtobethehighestvalue,
21byanyreasonablestandard,ofthepropertyorservicesthatareobtained;and
22 (2)Theamountsinvolvedinalltheftscommittedbyallparticipantsinthe
23organizedretailtheftshallbeaggregated.
24 6.Inanyprosecutionforaviolationofthissection,theviolationshallbedeemed
25tohavebeencommittedandmaybeprosecutedinanyjurisdictioninthisstateinwhich
26anytheftcommittedbyanyparticipantintheorganizedretailtheftwascommitted
27regardlessofwhetherthedefendantwaseverphysicallypresentinsuchjurisdiction.
