BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section610.026,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection610.026,toreadasfollows:
610.026.1.Exceptasotherwiseprovidedbylaw,eachpublicgovernmentalbody
2shallprovideaccesstoand,uponrequest,furnishcopiesofpublicrecordssubjecttothe
3following:
4 (1)Feesforcopyingpublicrecords,exceptthoserecordsrestrictedundersection
532.091,shallnotexceedtencentsperpageforapapercopynotlargerthanninebyfourteen
6inches,withthehourlyfeeforduplicatingtimenottoexceedtheaveragehourlyrateofpay
7forclericalstaffofthepublicgovernmentalbody.Researchtimerequiredforfulfilling
8recordsrequestsmaybechargedattheactualcostofresearchtime.Basedonthescopeofthe
9request,thepublicgovernmentalbodyshallproducethecopiesusingemployeesofthebody
10thatresultinthelowestamountofchargesforsearch,research,andduplicationtime.Priorto
11producingcopiesoftherequestedrecords,thepersonrequestingtherecordsmayrequestthe
12publicgovernmentalbodytoprovideanestimateofthecosttothepersonrequestingthe
13records.Documentsmaybefurnishedwithoutchargeoratareducedchargewhenthepublic
14governmentalbodydeterminesthatwaiverorreductionofthefeeisinthepublicinterest
15becauseitislikelytocontributesignificantlytopublicunderstandingoftheoperationsor
16activitiesofthepublicgovernmentalbodyandisnotprimarilyinthecommercialinterestof
17therequester;
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18 (2)Feesforprovidingaccesstopublicrecordsmaintainedoncomputerfacilities,
19recordingtapesordisks,videotapesorfilms,pictures,maps,slides,graphics,illustrationsor
20similaraudioorvisualitemsordevices,andforpapercopieslargerthanninebyfourteen
21inchesshallincludeonlythecostofcopies,stafftime,whichshallnotexceedtheaverage
22hourlyrateofpayforstaffofthepublicgovernmentalbodyrequiredformakingcopiesand
23programming,ifnecessary,andthecostofthedisk,tape,orothermediumusedforthe
24duplication.Feesformaps,blueprints,orplatsthatrequirespecialexpertisetoduplicatemay
25includetheactualrateofcompensationforthetrainedpersonnelrequiredtoduplicatesuch
26maps,blueprints,orplats.Ifprogrammingisrequiredbeyondthecustomaryandusuallevel
27tocomplywitharequestforrecordsorinformation,thefeesforcompliancemayincludethe
28actualcostsofsuchprogramming;
29 (3)Membersofthegeneralassemblyshallbeexemptfrompayingallfeesin
30subdivisions(1)and(2)ofthissubsection,exceptthatapublicgovernmentalbodymay
31imposeafeeforthematerialcostofpapercopiesofrecordsifpapercopiesare
32requested.
33 2.Paymentofsuchcopyingfeesmayberequestedpriortothemakingofcopies.
34 3.Exceptasotherwiseprovidedbylaw,eachpublicgovernmentalbodyofthestate
35shallremitallmoneysreceivedbyorforitfromfeeschargedpursuanttothissectiontothe
36directorofrevenuefordeposittothegeneralrevenuefundofthestate.
37 4.Exceptasotherwiseprovidedbylaw,eachpublicgovernmentalbodyofapolitical
38subdivisionofthestateshallremitallmoneysreceivedbyitorforitfromfeescharged
39pursuanttosections610.010to610.028totheappropriatefiscalofficerofsuchpolitical
40subdivisionfordeposittothegovernmentalbody'saccounts.
41 5.Theterm"tax,licenseorfees"asusedinSection22ofArticleXofthe
42ConstitutionoftheStateofMissouridoesnotincludecopyingchargesandrelatedfeesthatdo
43notexceedthelevelnecessarytopayortocontinuetopaythecostsforprovidingaservice,
44program,oractivitywhichwasinexistenceonNovember4,1980,orwhichwasapprovedby
45avoteofthepeoplesubsequenttoNovember4,1980.
