571.060.1.Apersoncommitstheoffenseofunlawfultransferofweaponsifheor

3 (1)Knowinglysells,leases,loans,givesawayordeliversafirearmorammunitionfor
4afirearmtoanypersonwho,undertheprovisionsofsection571.070,isnotlawfullyentitled
5topossesssuch;
6 (2)Knowinglysells,leases,loans,givesawayordeliversablackjacktoapersonless
7thaneighteenyearsoldwithouttheconsentofthechild'scustodialparentorguardian,or
8recklessly,asdefinedinsection562.016,sells,leases,loans,givesawayordeliversany
9firearmtoapersonlessthaneighteenyearsoldwithouttheconsentofthechild'scustodial
10parentorguardian;provided,thatthisdoesnotprohibitthedeliveryofsuchweaponstoany
11peaceofficerormemberoftheUnitedStatesArmedForcesorNationalGuardwhile
12performinghisorherofficialduty;[or]
13 (3)Recklessly,asdefinedinsection562.016,sells,leases,loans,givesawayor
14deliversafirearmorammunitionforafirearmtoapersonwhoisintoxicated; or
15 (4)Knowingly,inacommercialtransaction,sells,leases,loans,ortradesafully
16automaticfirearmorsemi-automaticfirearmtoanypersonundertwentyyearsofage,
17providedthatthisdoesnotprohibitthedeliveryofsuchweaponstoanypeaceofficeror

20 2.Apersoncommitstheoffenseofunlawfultransferofweaponsifheorsheis
21undertwentyyearsofageandknowingly,inacommercialtransaction,buys,trades,or
22leasesafullyautomaticfirearmorsemi-automaticfirearm,providedthatthisdoesnot
23prohibittheacceptanceofsuchweaponsbyanypeaceofficerormemberoftheUnited
24StatesArmedForcesorNationalGuardwhileperforminghisorherofficialduty.
25 3.Forpurposesofthissection,theterm"semi-automaticfirearm"meansany
26repeatingfirearmwhoseactionmechanismautomaticallyloadsammunitionintothe
27chamberandpreparesitforsubsequentfiringbutrequiresashootertomanually
28dischargeeachshot.Theterm"semi-automaticfirearm"shallincludeanyfirearmin
29whichactuatingthetriggerorhammerrotatesanewchamberinlinewiththebarrel.
30 4.Unlawfultransferofweaponsundersubdivision(1)ofsubsection1ofthissection
31isaclassEfelony;unlawfultransferofweaponsunder[subdivisions] subdivision(2)[and],
32(3),or(4)ofsubsection1ofthissectionorundersubsection2ofthissectionisaclassA
33misdemeanor.
