590.502.1.Forpurposesofthissection,thefollowingshallmean:
2 (1)"Administeringauthority",anyindividualorbodyauthorizedbyalaw
3enforcementagencytohearandmakefinaldecisionsregardingappealsofdisciplinary
4actionsissuedbysuchagency;
5 (2)"Coloroflaw",anyactbyalawenforcementofficer,whetherondutyoroffduty,
6thatisperformedinfurtheranceofhisorhersworndutytoenforcelawsandtoprotectand
7servethepublic;
8 (3)"Economicloss",anyeconomiclossincluding,butnotlimitedto,lossofovertime
9accrual,overtimeincome,sicktimeaccrual,sicktime,secondaryemploymentincome,
10holidaypay,andvacationpay;
11 (4)"Goodcause",sufficientevidenceorfactsthatwouldsupportaparty'srequestfor
12extensionsoftimeoranyotherrequestsseekingaccommodationsoutsidethescopeofthe
13rulessetoutherein;
14 (5)"Lawenforcementofficer",anycommissionedpeaceofficerwiththepowerto
15arrestforaviolationofthecriminalcodewhoisemployedbyanyunitofthestateorany
16county,chartercounty,city,chartercity,municipality,district,college,university,oranyother

19officerinthelawenforcementagency.
20 2.Wheneveralawenforcementofficerisunderadministrativeinvestigationoris
21subjectedtoadministrativequestioningthattheofficerreasonablybelievescouldleadto
22disciplinaryaction,demotion,dismissal,transfer,orplacementonastatusthatcouldleadto
23economicloss,theinvestigationorquestioningshallbeconductedunderthefollowing
24conditions:
25 (1)Thelawenforcementofficerwhoisthesubjectoftheinvestigationshallbe
26informed,inwriting,oftheexistenceandnatureoftheallegedviolationandtheindividuals
27whowillbeconductingtheinvestigation.Noticeshallbeprovidedtotheofficeralongwitha
28copyofthecomplaintatleasttwenty-fourhourspriortoanyinterrogationorinterviewofthe
29officer;
30 (2)Anyperson,includingmembersofthesameagencyordepartmentastheofficer
31underinvestigation,filingacomplaintagainstalawenforcementofficershallhavethe
32complaintsupportedbyawrittenstatementoutliningthecomplaintthatincludesthepersonal
33identifyinginformationofthepersonfilingthecomplaint.Allpersonalidentifying
34informationshallbeheldconfidentialbytheinvestigatingagency;
35 (3)Whenalawenforcementofficerisquestionedorinterviewedregardingmatters
36pertainingtohisorherlawenforcementdutiesoractionstakenwithinthescopeofhisorher
37employment,suchquestioningshallbeconductedforareasonablelengthoftimeandonly
38whiletheofficerisondutyunlessreasonablecircumstancesexistthatnecessitatequestioning
39theofficerwhileheorsheisoffduty;
40 (4)Anyinterviewsorquestioningshallbeconductedatasecurelocationatthe
41agencythatisconductingtheinvestigationorattheplacewheretheofficerreportstowork,
42unlesstheofficerconsentstoanotherlocation;
43 (5)Lawenforcementofficersshallbequestionedbyuptotwoinvestigatorsandshall
44beinformedofthename,rank,andcommandoftheinvestigatororinvestigatorsconducting
45theinvestigation;exceptthat,separateinvestigatorsshallbeassignedtoinvestigatealleged
46departmentpolicyviolationsandallegedcriminalviolations;
47 (6)Interviewsessionsshallbeforareasonableperiodoftime.Thereshallbetimes
48providedfortheofficertoallowforsuchpersonalnecessitiesandrestperiodsasare
49reasonablynecessary;
50 (7)Priortoaninterviewsession,theinvestigatororinvestigatorsconductingthe
51investigationshalladvisethelawenforcementofficeroftherulesetoutinGarrityv.New
52Jersey,385U.S.493(1967),specificallythatthelawenforcementofficerisbeingorderedto
53answerquestionsunderthreatofdisciplinaryactionandthattheofficer'sanswerstothe
54questionswillnotbeusedagainsttheofficerincriminalproceedings;
HB303	2 55 (8)Lawenforcementofficersshallnotbethreatened,harassed,orpromisedrewards
56toinducethemintoansweringanyquestion;exceptthat,lawenforcementofficersmaybe
57compelledbytheiremployertogiveprotectedGarritystatementstoaninvestigatorunderthe
58directcontroloftheemployer,butsuchcompelledstatementsshallnotbeusedorderivatively
59usedagainsttheofficerinanyaspectofacriminalcasebroughtagainsttheofficer;
60 (9)Lawenforcementofficersunderinvestigationareentitledtohaveanattorneyor
61anydulyauthorizedrepresentativepresentduringanyquestioningthatthelawenforcement
62officerreasonablybelievesmayresultindisciplinaryaction.Theattorneyorrepresentative
63shallbepermittedtoconferwiththeofficerbutshallnotundulydisruptorinterferewiththe
64interview.Thequestioningshallbesuspendedforaperiodofuptotwenty-fourhoursifthe
65officerrequestsrepresentation;
66 (10)Priortothelawenforcementofficerbeinginterviewed,theofficerandhisorher
67attorneyorrepresentativeshallhavetheopportunitytoreviewthecomplaint;
68 (11)Thelawenforcementagencyconductingtheinvestigationshallhaveninetydays
69fromreceiptofacitizencomplainttocompletesuchinvestigation.Theagencyshall
70determinethedispositionofthecomplaintandrenderadisciplinarydecision,ifany,within
71ninetydays.Theagencymay,forgoodcause,petitiontheadministeringauthorityoverseeing
72theadministrationofdisciplineforanextensionoftimetocompletetheinvestigation.Ifthe
73administeringauthorityfindstheagencyhasshowngoodcauseforthegrantingofan
74extensionoftimetocompletetheinvestigation,theadministeringauthorityshallgrantan
75extensionofuptosixtydays.Theagencyislimitedtotwoextensionsperinvestigation;
76exceptthat,ifthereisanongoingcriminalinvestigationthereshallbenolimitationonthe
77amountofsixty-dayextensions.Forgoodcauseshown,theinternalinvestigationmaybe
78tolleduntiltheconclusionofaconcurrentcriminalinvestigationarisingoutofthesame
79allegedconduct.Absentconsentfromtheofficerbeinginvestigated,theadministering
80authorityoverseeingtheadministrationofdisciplineshallsetthematterforhearingandshall
81providenoticeofthehearingtothelawenforcementofficerunderinvestigation.Theofficer
82shallhavetherighttoattendthehearingandtopresentevidenceandargumentsagainst
83extension;
84 (12)Withinfivedaysoftheconclusionoftheadministrativeinvestigation,the
85investigatorshallinformtheofficer,inwriting,oftheinvestigativefindingsandany
86recommendationforfurtheraction,includingdiscipline;
87 (13)Acompleterecordoftheadministrativeinvestigationshallbekeptbythelaw
88enforcementagencyconductingsuchinvestigation.Uponcompletionoftheinvestigation,a
89copyoftheentirerecord,including,butnotlimitedto,audio,video,andtranscribed
90statements,shallbeprovidedtotheofficerortheofficer'srepresentativewithinfivebusiness
HB303	3 91daysoftheofficer'swrittenrequest.Theagencymayrequestaprotectiveordertoredactall
92personalidentifyingwitnessinformation;and
93 (14)Allrecordscompiledasaresultofanyinvestigationsubjecttotheprovisionsof
94thissectionshallbeheldconfidentialandshallnotbesubjecttodisclosureunderchapter610,
95exceptbylawfulsubpoenaorcourtorder,byreleaseapprovedbytheofficer,orasprovidedin
96section590.070.
97 3.Lawenforcementofficerswhoaresuspendedwithoutpay,demoted,terminated,
98transferred,orplacedonastatusresultingineconomiclossshallbeentitledtoafulldue
99processhearing.However,nothinginthissectionshallprohibitalawenforcementagency
100andtheauthorizedbargainingrepresentativeforalawenforcementofficeremployedbythat
101agencyfromreachingwrittenagreementsprovidingdisciplinaryproceduresmorefavorable
102thanthoseprovidedforthissection.Thecomponentsofthehearingshallinclude,ata
103minimum:
104 (1)Therighttoberepresentedbyanattorneyorotherindividualoftheirchoice
105duringthehearing;
106 (2)Sevendays'noticeofthehearingdateandtime;
107 (3)Anopportunitytoaccessandreviewdocuments,atleastsevendaysinadvanceof
108thehearing,thatareintheemployer'spossessionandthatwereusedasabasisforthe
109disciplinaryaction;
110 (4)Therighttorefusetotestifyatthehearingiftheofficerisconcurrentlyfacing
111criminalchargesinconnectionwiththesameincident.Alawenforcementofficer'sdecision
112nottotestifyshallnotresultinadditionalinternalchargesordiscipline;
113 (5)Acompleterecordofthehearingshallbekeptbytheagencyforpurposesof
114appeal.Therecordshallbeprovidedtotheofficerorhisorherattorneyuponwrittenrequest;
115 (6)Theentirerecordofthehearingshallremainconfidentialandshallnotbesubject
116todisclosureunderchapter610,exceptbylawfulsubpoenaorcourtorder.
117 4.Anydecision,order,oractiontakenfollowingthehearingshallbeinwritingand
118shallbeaccompaniedbyfindingsoffact.Thefindingsshallconsistofaconcisestatement
119uponeachissueinthecase.Acopyofthedecisionororderaccompanyingfindingsand
120conclusionsalongwiththewrittenactionandrightofappeal,ifany,shallbedeliveredor
121mailedpromptlytothelawenforcementofficerortotheofficer'sattorneyorrepresentativeof
122record.
123 5.Lawenforcementofficersshallhavetheopportunitytoprovideawrittenresponse
124toanyadversematerialsplacedintheirpersonnelfile,andsuchwrittenresponseshallbe
125permanentlyattachedtotheadversematerial.
126 6.Lawenforcementofficersshallhavetherighttocompensationforanyeconomic
127lossincurredduringaninvestigationiftheofficerisfoundtohavecommittednomisconduct.
HB303	4 128 7.Employersshalldefendandindemnifylawenforcementofficersfromandagainst
129civilclaimsmadeagainstthemintheirofficialandindividualcapacitiesiftheallegedconduct
130aroseinthecourseandscopeoftheirobligationsanddutiesaslawenforcementofficers.This
131includesanyactionstakenoffdutyifsuchactionsweretakenundercoloroflaw.Intheevent
132thelawenforcementofficerisconvictedof,orpleadsguiltyto,criminalchargesarisingoutof
133thesameconduct,theemployershallnolongerbeobligatedtodefendandindemnifythe
134officerinconnectionwithrelatedcivilclaims.
135 8.Lawenforcementofficersshallnotbedisciplined,demoted,dismissed,transferred,
136orplacedonastatusresultingineconomiclossasaresultoftheassertionoftheir
137constitutionalrightsinanyjudicialproceeding,unlesstheofficeradmitstowrongdoing,in
138whichcasetheprovisionsofthissectionshallnotapply.
139 9.Anyaggrievedlawenforcementofficerorauthorizedrepresentativemayseek
140judicialenforcementoftherequirementsofthissection.Suitstoenforcethissectionshallbe
141broughtinthecircuitcourtforthecountyinwhichthelawenforcementagencyor
142governmentalbodyhasitsprincipalplaceofbusiness.
143 10.Uponafindingbyapreponderanceoftheevidencethatalawenforcement
144agency,governmentalbody,ormemberofsamehasviolatedanyprovisionofthissection,a
145courtshallvoidanyactiontakeninviolationofthissection.Thecourtmayalsoawardthe
146lawenforcementofficerthecostsofbringingthesuitincluding,butnotlimitedto,attorneys'
147fees.Alawsuitforenforcementshallbebroughtwithinoneyearfromwhichtheviolationis
148ascertainable.
149 11.Nothinginthissectionshallapplytoanyinvestigationorotheractionbythe
150directorregardingalicenseissuedbythedirectorunderthischapter.
151 12.Alawenforcementagencythathassubstantiallysimilarorgreaterprocedures
152shallbedeemedincompliancewiththissection.
153 13.Nothinginthissectionshallapplytotheworkofanycivilianreviewboard
154organizedundersection590.653ororganizedbylocalordinance.
