1212 162.700.1.Theboardofeducationofeachschooldistrictinthisstate,exceptschool
1313 2districtswhicharepartofaspecialschooldistrict,andtheboardofeducationofeachspecial
1414 3schooldistrictshallprovidespecialeducationalservicesforchildrenwithdisabilitiesthree
1515 4yearsofageormoreresidinginthedistrictasrequiredbyP.L.99-457,ascodifiedandasmay
1616 5beamended.Anychild,determinedtobeachildwithdisabilities,shallbeeligibleforsuch

2121 10forchildrenwithdisabilitiesthreeandfouryearsofagemaybedelayeduntilsuchtimeas
2222 11fundsareappropriatedtomeetsuchlevel.Eachlocalschooldistrictandeachspecialschool
2323 12districtshallberesponsibletoengageinaplanningprocesstodesigntheservicedelivery
2424 13systemnecessarytoprovidespecialeducationandrelatedservicesforchildrenthreeandfour
2525 14yearsofagewithdisabilities.Theplanningprocessshallincludepublic,private,andprivate
2626 15not-for-profitagencieswhichhaveprovidedsuchservicesforthispopulation.Theschool
2727 16district,orschooldistricts,orspecialschooldistrict,shallberesponsiblefordesigningan
2828 17efficientservicedeliverysystemwhichusesthepresentresourcesofthelocalcommunity

3737 25disabilities[child] priortoassignmentinaspecialprogram.Theserecordsmaybeobtained
3838 26withparentalpermissionfrompreviousmedicalorpsychologicalevaluation,maybe
3939 27providedbycompetentpersonnelofsuchdistrictorspecialdistrict,ormaybesecuredby
4040 28suchdistrictfromcompetentandqualifiedmedical,psychological,orotherprofessional
4141 29personnel.
4242 30 3.Evaluationsofprivateschoolstudentssuspectedofhavingadisabilityunderthe
4343 31IndividualsWithDisabilitiesEducationActwillbeconductedasappropriatebytheschool
4444 32districtinwhichtheprivateschoolislocatedoritscontractor.
4545 33 4.Wherespecialdistrictshavebeenformedtoservechildrenwithdisabilitiesunder
4646 34theprovisionsofsections162.670to[162.995] 162.974, suchchildrenshallbeeducatedin
