BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows: SectionA.Section190.101,RSMo,isrepealedandonenewsectionenactedinlieu 2thereof,tobeknownassection190.101,toreadasfollows: 190.101.1.Thereisherebyestablisheda"StateAdvisoryCouncilonEmergency 2MedicalServices"whichshallconsistof[sixteen] nofewerthanthirteenmembers[, oneof 3whichshallbearesidentofacitynotwithinacounty]. Themembersofthecouncilshallbe 4appointed[bythegovernorwiththeadviceandconsentofthesenateand]asfollows: 5 (1)Onememberwithabackgroundinmobileintegratedhealthcareand 6communityparamedicineshallbeappointedbythedirectorofthedepartmentofhealth 7andseniorservicesfromtherecommendationsdescribedinsubdivision(4)ofthis 8subsection; 9 (2)OnemembershallbeappointedbyeachregionalEMSadvisorycommittee; 10 (3)Onemember,whoshallbeamemberofthetime-criticaldiagnosisadvisory 11committee,shallbeappointedbythetime-criticaldiagnosisadvisorycommittee;and 12 (4)Allothermembersshallbeappointedbythedirectorofthedepartmentof 13healthandseniorservicesfromrecommendationsprovidedby: 14 (a)Astatewideprofessionalassociationrepresentingambulanceservice 15managers; EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 16 (b)Astatewideprofessionalassociationrepresentingemergencymedical 17techniciansandparamedics; 18 (c)Astatewideprofessionalassociationrepresentingambulancedistricts; 19 (d)Astatewideprofessionalassociationrepresentingfirechiefs; 20 (e)Astatewideprofessionalassociationrepresentingfireprotectiondistricts; 21 (f)Astatewideprofessionalassociationrepresentingfirefighters; 22 (g)Astatewideprofessionalassociationrepresentingemergencynurses; 23 (h)Astatewideprofessionalassociationrepresentingtheairambulance 24industry; 25 (i)Astatewideprofessionalassociationrepresentingemergencymedicalservices 26physicians; 27 (j)Astatewideassociationrepresentinghospitals;and 28 (k)Astatewideassociationrepresentingpediatricemergencyprofessionals. 29 2.Themembersofthecouncilshallservetermsoffouryears.The[governor] 30councilshall[designate] annuallyelectoneof[the]itsmembersaschairpersonandmay 31electotherofficersasdeemednecessary. Thechairpersonmayappointsubcommitteesthat 32includenoncouncilmembers. 33 [2.]3.ThestateEMSmedicaldirectorsadvisorycommitteeandtheregionalEMS 34advisorycommitteeswillberecognizedassubcommitteesofthestateadvisorycouncilon 35emergencymedicalservices. 36 [3.]4.Thecouncilshallhavegeographicalrepresentationandrepresentationfrom 37appropriateareasofexpertiseinemergencymedicalservicesincludingvolunteers, 38professionalorganizationsinvolvedinemergencymedicalservices,EMT's,paramedics, 39nurses,firefighters,physicians,ambulanceserviceadministrators,hospitaladministratorsand 40otherhealthcareprovidersconcernedwithemergencymedicalservices.[TheregionalEMS 41advisorycommitteesshallserveasaresourcefortheidentificationofpotentialmembersof 42thestateadvisorycouncilonemergencymedicalservices. 43 4.]5.ThestateEMSmedicaldirector,asdescribedundersection190.103,shallserve 44asanexofficiomemberofthecouncil. 45 [5.]6.Themembersofthecouncilandsubcommitteesshallservewithout 46compensationexceptthatmembersofthecouncilshall,subjecttoappropriations,be 47reimbursedforreasonabletravelexpensesandmeetingexpensesrelatedtothefunctionsof 48thecouncil. 49 [6.]7.Thepurposeofthecouncilistomakerecommendationstothegovernor,the 50generalassembly,andthedepartmentonpolicies,plans,proceduresandproposedregulations 51onhowtoimprovethestatewideemergencymedicalservicessystem.Thecouncilshall HB313 2 52advisethegovernor,thegeneralassembly,andthedepartmentonallaspectsoftheemergency 53medicalservicessystem. 54 [7.]8.(1)Thereisherebyestablishedastandingsubcommitteeofthecouncilto 55monitortheimplementationoftherecognitionoftheEMSpersonnellicensureinterstate 56compactundersections190.900to190.939,theinterstatecommissionforEMSpersonnel 57practice,andtheinvolvementofthestateofMissouri.Thesubcommitteeshallmeetatleast 58biannuallyandreceivereportsfromtheMissouridelegatetotheinterstatecommissionfor 59EMSpersonnelpractice.Thesubcommitteeshallconsistofatleastsevenmembersappointed 60bythechairofthecouncil,toincludeatleasttwomembersasrecommendedbytheMissouri 61statecounciloffirefightersandonememberasrecommendedbytheMissouriAssociationof 62FireChiefs.Thesubcommitteemaysubmitreportsandrecommendationstothecouncil,the 63departmentofhealthandseniorservices,thegeneralassembly,andthegovernorregarding 64theparticipationofMissouriwiththerecognitionoftheEMSpersonnellicensureinterstate 65compact. 66 (2)Thesubcommitteeshallformallyrequestapublichearingforanyruleproposed 67bytheinterstatecommissionforEMSpersonnelpracticeinaccordancewithsubsection7of 68section190.930.Thehearingrequestshallincludetherequestthatthehearingbepresented 69livethroughtheinternet.TheMissouridelegatetotheinterstatecommissionforEMS 70personnelpracticeshallberesponsibleforensuringthatallhearings,noticesof,andrelated 71rulemakingcommunicationsasrequiredbythecompactbecommunicatedtothecounciland 72emergencymedicalservicespersonnelundertheprovisionsofsubsections4,5,6,and8of 73section190.930. 74 (3)Thedepartmentofhealthandseniorservicesshallnotestablishorincreasefees 75forMissouriemergencymedicalservicespersonnellicensureinaccordancewiththischapter 76forthepurposeofcreatingthefundsnecessaryforpaymentofanannualassessmentunder 77subdivision(3)ofsubsection5ofsection190.924. 78 [8.]9.Thecouncilshallconsultwiththetime-criticaldiagnosisadvisorycommittee, 79asdescribedundersection190.257,regardingtime-criticaldiagnosis. ✔ HB313 3
