24notwithstanding,anyoffenderwhohasbeenfoundguiltyofafelonyotherthana
25dangerousfelonyasdefinedinsection556.061andiscommittedtothedepartmentof
26correctionsshallberequiredtoservethefollowingminimumprisonterms:
27 (1)[Iftheoffenderhasonepreviousprisoncommitmenttothedepartmentof
28correctionsforafelonyoffense,theminimumprisontermwhichtheoffendermustserveshall
29befortypercentofhisorhersentenceoruntiltheoffenderattainsseventyyearsofage,and
30hasservedatleastthirtypercentofthesentenceimposed,whicheveroccursfirst;
31 (2)Iftheoffenderhastwopreviousprisoncommitmentstothedepartmentof
32correctionsforfeloniesunrelatedtothepresentoffense,theminimumprisontermwhichthe
33offendermustserveshallbefiftypercentofhisorhersentenceoruntiltheoffenderattains
34seventyyearsofage,andhasservedatleastfortypercentofthesentenceimposed,whichever
35occursfirst;
36 (3)Iftheoffenderhasthreeormorepreviousprisoncommitmentstothedepartment
37ofcorrectionsforfeloniesunrelatedtothepresentoffense,theminimumprisontermwhich
38theoffendermustserveshallbeeightypercentofhisorhersentenceoruntiltheoffender

46 3.Otherprovisionsofthelawtothecontrarynotwithstanding,anyoffenderwhohas
47beenfoundguiltyofadangerousfelonyasdefinedinsection556.061andiscommittedtothe
48departmentofcorrectionsshallberequiredtoserveaminimumprisontermofeighty-five
49percentofthesentenceimposedbythecourt[oruntiltheoffenderattainsseventyyearsof
50age,andhasservedatleastfortypercentofthesentenceimposed,whicheveroccursfirst].
51 4.Forthepurposeofdeterminingtheminimumprisontermtobeserved,the
52followingcalculationsshallapply:
53 (1)Asentenceoflifeshallbecalculatedtobethirtyyears;
HB314	2 54 (2)Anysentenceeitheraloneorintheaggregatewithotherconsecutivesentencesfor
55offensescommittedatornearthesametimewhichisoverseventy-fiveyearsshallbe
56calculatedtobeseventy-fiveyears.
57 5.Forpurposesofthissection,theterm"minimumprisonterm"shallmeantime
58requiredtobeservedbytheoffenderbeforeheorsheiseligibleforparole,conditional
59releaseorotherearlyreleasebythedepartmentofcorrections.
60 6.Anoffenderwhowasconvictedof,orpledguiltyto,afelonyoffenseotherthan
61thoseoffenseslistedinsubsection2ofthissectionpriortoAugust28,[2019] 2025, shallno
62longerbesubjecttotheminimumprisontermprovisionsundersubsection2ofthissection,
63andshallbeeligibleforparole,conditionalrelease,orotherearlyreleasebythedepartmentof
64correctionsaccordingtotherulesandregulationsofthedepartment.
65 7.(1)Asentencingadvisorycommissionisherebycreatedtoconsistofeleven
66members.Onemembershallbeappointedbythespeakerofthehouse.Onemembershallbe
67appointedbythepresidentprotemofthesenate.Onemembershallbethedirectorofthe
68departmentofcorrections.Sixmembersshallbeappointedbyandserveatthepleasureofthe
69governorfromamongthefollowing:thepublicdefendercommission;privatecitizens;a
70privatememberoftheMissouriBar;theboardofprobationandparole;andaprosecutor.
71Twomembersshallbeappointedbythesupremecourt,onefromametropolitanareaandone
72fromaruralarea.Allmembersshallbeappointedtoafour-yearterm.Allmembersofthe
73sentencingcommissionappointedpriortoAugust28,1994,shallcontinuetoserveonthe
74sentencingadvisorycommissionatthepleasureofthegovernor.
75 (2)Thecommissionshallstudysentencingpracticesinthecircuitcourtsthroughout
76thestateforthepurposeofdeterminingwhetherandtowhatextentdisparitiesexistamong
77thevariouscircuitcourtswithrespecttothelengthofsentencesimposedandtheuseof
78probationforoffendersconvictedofthesameorsimilaroffensesandwithsimilarcriminal
79histories.Thecommissionshallalsostudyandexaminewhetherandtowhatextent
80sentencingdisparityamongeconomicandsocialclassesexistsinrelationtothesentenceof
81deathandifso,thereasonstherefor,ifsentencesarecomparabletootherstates,ifthelength
82ofthesentenceisappropriate,andtherateofrehabilitationbasedonsentence.Itshall
83compilestatistics,examinecases,drawconclusions,andperformotherdutiesrelevanttothe
84researchandinvestigationofdisparitiesindeathpenaltysentencingamongeconomicand
85socialclasses.
86 (3)Thecommissionshallstudyalternativesentences,prisonworkprograms,work
87release,home-basedincarceration,probationandparoleoptions,andanyotherprogramsand
88reportthefeasibilityoftheseoptionsinMissouri.
89 (4)Thegovernorshallselectachairpersonwhoshallcallmeetingsofthecommission
90asrequiredorpermittedpursuanttothepurposeofthesentencingcommission.
HB314	3 91 (5)Themembersofthecommissionshallnotreceivecompensationfortheirduties
92onthecommission,butshallbereimbursedforactualandnecessaryexpensesincurredinthe
93performanceofthesedutiesandforwhichtheyarenotreimbursedbyreasonoftheirother
94paidpositions.
95 (6)Thecircuitandassociatecircuitcourtsofthisstate,theofficeofthestatecourts
96administrator,thedepartmentofpublicsafety,andthedepartmentofcorrectionsshall
97cooperatewiththecommissionbyprovidinginformationoraccesstoinformationneededby
98thecommission.Theofficeofthestatecourtsadministratorwillprovideneededstaffing
99resources.
100 8.Courtsshallretaindiscretiontolowerorexceedthesentencerecommendedbythe
101commissionasotherwiseallowablebylaw,andtoorderrestorativejusticemethods,when
102applicable.
103 9.Iftheimpositionorexecutionofasentenceissuspended,thecourtmayorderany
104orallofthefollowingrestorativejusticemethods,oranyothermethodthatthecourtfinds
105justorappropriate:
106 (1)Restitutiontoanyvictimorastatutorilycreatedfundforcostsincurredasaresult
107oftheoffender'sactions;
108 (2)Offendertreatmentprograms;
109 (3)Mandatorycommunityservice;
110 (4)Workreleaseprogramsinlocalfacilities;and
111 (5)Community-basedresidentialandnonresidentialprograms.
112 10.Pursuanttosubdivision(1)ofsubsection9ofthissection,thecourtmayorderthe
113assessmentandpaymentofadesignatedamountofrestitutiontoacountylawenforcement
114restitutionfundestablishedbythecountycommissionpursuanttosection50.565.Such
115contributionshallnotexceedthreehundreddollarsforanychargedoffense.Anyrestitution
116moneysdepositedintothecountylawenforcementrestitutionfundpursuanttothissection
117shallonlybeexpendedpursuanttotheprovisionsofsection50.565.
118 11.Ajudgemayorderpaymenttoarestitutionfundonlyifsuchfundhadbeen
119createdbyordinanceorresolutionofacountyofthestateofMissouripriortosentencing.A
120judgeshallnothaveanydirectsupervisoryauthorityoradministrativecontroloveranyfund
121towhichthejudgeisorderingapersontomakepayment.
122 12.Apersonwhofailstomakeapaymenttoacountylawenforcementrestitution
123fundmaynothavehisorherprobationrevokedsolelyforfailingtomakesuchpayment
124unlessthejudge,afterevidentiaryhearing,makesafindingsupportedbyapreponderanceof
125theevidencethatthepersoneitherwillfullyrefusedtomakethepaymentorthattheperson
126willfully,intentionally,andpurposefullyfailedtomakesufficientbonafideeffortstoacquire
127theresourcestopay.
HB314	4 128 13.Nothinginthissectionshallbeconstruedtoallowthesentencingadvisory
129commissiontoissuerecommendedsentencesinspecificcasespendinginthecourtsofthis
130state.
566.030.1.Apersoncommitstheoffenseofrapeinthefirstdegreeifheorshehas
2sexualintercoursewithanotherpersonwhoisincapacitated,incapableofconsent,orlacksthe
3capacitytoconsent,orbytheuseofforciblecompulsion.Forciblecompulsionincludesthe
4useofasubstanceadministeredwithoutavictim'sknowledgeorconsentwhichrendersthe
5victimphysicallyormentallyimpairedsoastobeincapableofmakinganinformedconsent
6tosexualintercourse.
7 2.Theoffenseofrapeinthefirstdegreeoranattempttocommitrapeinthefirst
8degreeisafelonyforwhichtheauthorizedtermofimprisonmentislifeimprisonmentora
9termofyearsnotlessthanfiveyears,unless:
10 (1)Theoffenseisanaggravatedsexualoffense,inwhichcasetheauthorizedtermof
11imprisonmentislifeimprisonmentoratermofyearsnotlessthanfifteenyears;
12 (2)Thepersonisapersistentorpredatorysexualoffenderasdefinedinsection
13566.125andsubjectedtoanextendedtermofimprisonmentundersaidsection;
14 (3)Thevictimisachildlessthantwelveyearsofage,inwhichcasetherequiredterm
15ofimprisonmentislifeimprisonmentwithouteligibilityforprobationorparoleuntilthe
16offenderhasservednotlessthanthirtyyearsofsuchsentenceorunlesstheoffenderhas
17reachedtheageofseventy-fiveyearsandhasservedatleastfifteenyearsofsuchsentence,
18unlesssuchrapeinthefirstdegreeisdescribedundersubdivision(4)ofthissubsection;or
19 (4)Thevictimisachildlessthantwelveyearsofageandsuchrapeinthefirstdegree
20orattempttocommitrapeinthefirstdegreewasoutrageouslyorwantonlyvile,horribleor
21inhumane,inthatitinvolvedtortureordepravityofmind,inwhichcasetherequiredtermof
22imprisonmentislifeimprisonmentwithouteligibilityforprobation,paroleorconditional
23release.
24 3.Subsection4ofsection558.019shallnotapplytothesentenceofapersonwhohas
25beenfoundguiltyofrapeinthefirstdegreeorattempttocommitrapeinthefirstdegreewhen
26thevictimislessthantwelveyearsofage,and"lifeimprisonment"shallmeanimprisonment
27forthedurationofaperson'snaturallifeforthepurposesofthissection.
28 4.Nopersonfoundguiltyofrapeinthefirstdegreeoranattempttocommitrapein
29thefirstdegreeshallbegrantedasuspendedimpositionofsentenceorsuspendedexecutionof
30sentence.
31 5.Notwithstandinganyprovisionoflawtothecontrary,anypersonfoundguilty
32ofrapeinthefirstdegreeoranattempttocommitrapeinthefirstdegreeunderthis
33sectionshallberequiredtoserveonehundredpercentofthesentenceimposedbythe
34court.
HB314	5 566.151.1.Apersontwenty-oneyearsofageoroldercommitstheoffenseof
2enticementofachildifheorshepersuades,solicits,coaxes,entices,orlureswhetherby
3words,actionsorthroughcommunicationviatheinternetoranyelectroniccommunication,
4anypersonwhoislessthanfifteenyearsofageforthepurposeofengaginginsexualconduct.
5 2.Itisnotadefensetoaprosecutionforaviolationofthissectionthattheother
6personwasapeaceofficermasqueradingasaminor.
7 3.Enticementofachildoranattempttocommitenticementofachildisafelonyfor
8whichtheauthorizedtermofimprisonmentshallbenotlessthanfiveyearsandnotmorethan
9thirtyyears.Nopersonconvictedunderthissectionshallbeeligibleforparole,probation,
10conditionalrelease,orsuspendedimpositionorexecutionofsentence[foraperiodoffive
11calendaryears].
12 4.Notwithstandinganyprovisionoflawtothecontrary,anypersonconvictedof
13enticementofachildoranattempttocommitenticementofachildunderthissection
14shallberequiredtoserveonehundredpercentofthesentenceimposedbythecourt.
571.015.1.Anypersonwhocommitsanyfelonyunderthelawsofthisstateby,with,
2orthroughtheuse,assistance,oraidofadangerousinstrumentordeadlyweaponisalso
3guiltyoftheoffenseofarmedcriminalaction;theoffenseofarmedcriminalactionshallbean
4unclassifiedfelonyand,uponconviction,shallbepunishedbyimprisonmentbythe
5departmentofcorrectionsforatermofnotlessthanthreeyearsandnottoexceedfifteen
6years,unlessthepersonisunlawfullypossessingafirearm,inwhichcasethetermof
7imprisonmentshallbeforatermofnotlessthanfiveyears.Thepunishmentimposed
8pursuanttothissubsectionshallbeinadditiontoandconsecutivetoanypunishmentprovided
9bylawforthecrimecommittedby,with,orthroughtheuse,assistance,oraidofadangerous
10instrumentordeadlyweapon.Nopersonconvictedunderthissubsectionshallbeeligiblefor
11parole,probation,conditionalrelease,orsuspendedimpositionorexecutionofsentence[fora
12periodofthreecalendaryears]. Notwithstandinganyprovisionoflawtothecontrary,any
13personconvictedunderthissubsectionshallberequiredtoserveonehundredpercentof
14thesentenceimposedbythecourt.
15 2.Anypersonconvictedofasecondoffenseofarmedcriminalactionunder
16subsection1ofthissectionshallbepunishedbyimprisonmentbythedepartmentof
17correctionsforatermofnotlessthanfiveyearsandnottoexceedthirtyyears,unlessthe
18personisunlawfullypossessingafirearm,inwhichcasethetermofimprisonmentshallbefor
19atermnotlessthanfifteenyears.Thepunishmentimposedpursuanttothissubsectionshall
20beinadditiontoandconsecutivetoanypunishmentprovidedbylawforthecrimecommitted
21by,with,orthroughtheuse,assistance,oraidofadangerousinstrumentordeadlyweapon.
22Nopersonconvictedunderthissubsectionshallbeeligibleforparole,probation,conditional
23release,orsuspendedimpositionorexecutionofsentence[foraperiodoffivecalendar
HB314	6 24years]. Notwithstandinganyprovisionoflawtothecontrary,anypersonconvicted
25underthissubsectionshallberequiredtoserveonehundredpercentofthesentence
26imposedbythecourt.
27 3.Anypersonconvictedofathirdorsubsequentoffenseofarmedcriminalaction
28undersubsection1ofthissectionshallbepunishedbyimprisonmentbythedepartmentof
29correctionsforatermofnotlessthantenyears,unlessthepersonisunlawfullypossessinga
30firearm,inwhichcasethetermofimprisonmentshallbenolessthanfifteenyears.The
31punishmentimposedpursuanttothissubsectionshallbeinadditiontoandconsecutivetoany
32punishmentprovidedbylawforthecrimecommittedby,with,orthroughtheuse,assistance,
33oraidofadangerousinstrumentordeadlyweapon.Nopersonconvictedunderthis
34subsectionshallbeeligibleforparole,probation,conditionalrelease,orsuspendedimposition
35orexecutionofsentence[foraperiodoftencalendaryears]. Notwithstandingany
36provisionoflawtothecontrary,anypersonconvictedunderthissubsectionshallbe
