2enactedinlieuthereof,tobeknownassection208.024,toreadasfollows:
208.024.1.Eligiblerecipientsoftemporaryassistanceforneedyfamilies(TANF)or
2[supplementary] supplementalnutritionassistanceprogram(SNAP)benefitsshallnotuse
3suchfundsinanyelectronicbenefittransfertransactioninany[liquorstore,casino,gambling
4casino,orgamingestablishment,anyretailestablishmentwhichprovidesadult-oriented
5entertainmentinwhichperformersdisrobeorperforminanunclothedstateforentertainment]
6prohibitedestablishment, orinanyplacefor[thepurchaseofalcoholicbeverages,lottery
7tickets,ortobaccoproductsorforanyitemthedepartmentdeterminesbyruleisprimarily
8marketedfororusedbyadultseighteenorolderandisnotinthebestinterestsofthechildor
9household] aprohibitedpurchase. AneligiblerecipientofTANForSNAPassistancewho
10makesapurchaseinviolationofthissectionshallreimbursethedepartmentofsocialservices
11forsuchpurchase.Foranyoffenseunderthissubsection,aTANFrecipientshalllosehis
12orherTANFbenefitsasfollows:
13 (1)Forthefirstoccurrenceofnoncompliance,theindividualshallbe
14disqualifiedforthreemonths;
15 (2)Forthesecondoccurrenceofnoncompliance,theindividualshallbe
16disqualifiedforsixmonths;and
17 (3)Foranythirdorsubsequentoccurrenceofnoncompliance,theindividual
18shallbedisqualifiedforaperiodoffiveyears.

22 2.Anindividual,storeownerorproprietorofanestablishmentshallnotknowingly
23acceptTANFcashassistanceor[supplementarynutritionassistanceprogram(SNAP)] SNAP
24fundsheldonelectronicbenefittransfercardsfor[thepurchaseofalcoholicbeverages,lottery
25tickets,ortobaccoproducts] aprohibitedpurchaseor[foruseinanyelectronicbenefit
26transfertransaction] inany[liquorstore,casino,gamblingcasino,orgamingestablishment,
27anyretailestablishmentwhichprovidesadult-orientedentertainmentinwhichperformers
28disrobeorperforminanunclothedstateforentertainment,orinanyplaceforthepurchaseof
29alcoholicbeverages,lotterytickets,ortobaccoproductsorforanyitemthedepartment
30determinesbyruleisprimarilymarketedfororusedbyadultseighteenorolderandisnotin
31thebestinterestsofthechildorhousehold] prohibitedestablishment. Nostoreowneror
32proprietorofany[liquorstore,casino,gamblingcasino,gamingestablishment,oranyretail
33establishmentwhichprovidesadult-orientedentertainmentinwhichperformersdisrobeor
34performinanunclothedstateforentertainment] prohibitedestablishmentshalladoptany
35policy,eitherexplicitlyorimplicitly,whichencourages,permits,oracquiescesinits
36employeesknowinglyacceptingelectronicbenefittransfercardsinviolationofthissection.
37Thissectionshallnotbeconstruedtorequireanystoreownerorproprietorofan
38establishmentwhichisnota[liquorstore,casino,gamblingcasino,gamingestablishment,or
39retailestablishmentwhichprovidesadult-orientedentertainmentinwhichperformersdisrobe
40orperforminanunclothedstateforentertainment] prohibitedestablishmenttocheckthe
41sourceofpaymentfromeveryindividualwho[purchasesalcoholicbeverages,lotterytickets,
42tobaccoproducts,oranyitemthedepartmentdeterminesbyruleisprimarilymarketedforor
43usedbyadultseighteenorolderandisnotinthebestinterestsofthechildorhousehold]
44makesaprohibitedpurchase. Anindividual,storeownerorproprietorofanestablishment
45whoknowinglyacceptselectronicbenefittransfercardsinviolationofthissectionshallbe
46punishedbyafineofnotmorethanfivehundreddollarsforthefirstoffense,afineofnotless
47thanfivehundreddollarsnormorethanonethousanddollarsforthesecondoffense,anda
48fineofnotlessthanonethousanddollarsforthethirdorsubsequentoffense.
49 3.AnyrecipientofTANForSNAPbenefitswhodoesnotmakeatleastone
50electronicbenefittransfertransactionwithinthestateforaperiodofninetydaysshallhave
51hisorherbenefitpaymentstotheelectronicbenefitaccounttemporarilysuspended,pending
52aninvestigationbythedepartmentofsocialservicestodetermineiftherecipientisnolonger
53aMissouriresident.IfthedepartmentfindsthattherecipientisnolongeraMissouriresident,
54itshallclosetherecipient'scase.Closureofarecipient'scaseshalltriggertheautomated

57 4.Arecipientwhodoesnotmakeanelectronicbenefittransfertransactionwithinthe

59fundsifnoelectronicbenefittransfertransactionoccursinthestatewithinanotherthirtydays
60afterthedateofthenotice.
61 5.(1)ThedepartmentshallapplyforawaiverfromthefederalDepartmentof
62HealthandHumanServicesauthorizingtheimplementationofsubdivision(2)ofthis
63subsectionifthedepartmentdeterminesthatawaiverisnecessaryforsuch
64implementation.
65 (2)NorecipientofTANForSNAPbenefitsshallusehisorherelectronicbenefit
66transfer(EBT)cardatanyautomatedtellermachine(ATM),toreceivecashbackona
67purchase,ortootherwiseaccessthebenefitsascash.
68 6.Forpurposesofthissection:
69 (1)Thefollowingtermsshallmean:
70 (a)"Electronicbenefittransfertransaction",theuseofacreditordebitcardservice,
71automatedtellermachine,point-of-saleterminal,oraccesstoanonlinesystemforthe
72withdrawaloffundsortheprocessingofapaymentformerchandiseoraservice;and
73 (b)"Liquorstore",anyretailestablishmentwhichsellsexclusivelyorprimarily
74intoxicatingliquor.Suchtermdoesnotincludeagrocerystorewhichsellsbothintoxicating
75liquorandgroceriesincludingstaplefoodsasoutlinedundertheFoodandNutritionActof

77 (c)"Pornography",anyofthefollowing:
78 a.Anyobscenematerialorperformancedepictingsexualconduct,sexual
79contactasdefinedinsection566.010,orasexualperformance;or

[208.182.1.Thefamilysupportdivisionshallestablishpilotprojects
2 inSt.LouisCityandinanycountywithapopulationofsixhundredthousand
3 ormore,whichshallprovideforasystemofelectronictransferofbenefitsto
4 publicassistancerecipients.Suchsystemshallallowrecipientstoobtaincash
5 fromautomatedtellermachinesorpointofsaleterminals.Iflessthanthetotal
6 amountofbenefitsiswithdrawn,therecipientshallbegivenareceiptshowing
7 thecurrentstatusofhisorheraccount.
8 2.Thedisclosureofanyinformationprovidedtoafinancial
9 institution,businessorvendorbythefamilysupportdivisionunderthis
10 sectionisprohibited.Suchfinancialinstitution,businessorvendormaynot
11 useorsellsuchinformationandmaynotdivulgetheinformationwithouta
12 courtorder.ViolationofthissubsectionisaclassAmisdemeanor.
13 3.Subjecttoappropriationsandsubjecttoreceiptofwaiversfromthe
14 federalgovernmenttopreventthelossofanyfederalfunds,thedepartmentof
15 socialservicesshallrequiretheuseofphotographicidentificationon
16 electronicbenefittransfercardsissuedtorecipientsinthissystem.Such
17 photographicidentificationelectronicbenefittransfercardshallbeinaform
18 approvedbythedepartmentofsocialservices.
19 4.Thefamilysupportdivisionshallpromulgaterulesandregulations
20 necessarytoimplementtheprovisionsofthissectionpursuanttosection
21 660.017andchapter536.
22 5.Thedeliveryofelectronicbenefitsandtheelectroniceligibility
23 verification,including,butnotlimitedto,aidtofamilieswithdependent
24 children(AFDC),women,infantsandchildren(WIC),earlyperiodic
25 screeningdiagnosisandtreatment(EPSDT),foodstamps,supplemental
26 securityincome(SSI),includingMedicaid,childsupport,andotherprograms,
27 shallresideinonecardthatmaybeenabledbyfunctionfromtimetotimeina
28 convenientmanner.]
