19observestheeligibleadultbeingsubjectedtoconditionsorcircumstanceswhichwould
20reasonablyresultinabuseorneglect.Notwithstandinganyotherprovisionofthissection,a
21dulyordainedminister,clergy,religiousworker,orChristianSciencepractitionerwhile
22functioninginhisorherministerialcapacityshallnotberequiredtoreportconcerninga
23privilegedcommunicationmadetohimorherinhisorherprofessionalcapacity.
24 2.Anyotherpersonwhobecomesawareofcircumstancesthatmayreasonablybe
25expectedtobetheresultof,orresultin,abuseorneglectofaneligibleadultmayreporttothe
26department.
27 3.Thepenaltyforfailingtoreportasrequiredundersubdivision(2)ofsubsection1

29 4.Asusedinthissection,"firstresponder"meansanypersontrainedandauthorized
30bylaworruletorenderemergencymedicalassistanceortreatment.Suchpersonsmay

32deputysheriffs,firefighters,oremergencymedicaltechnicians.
192.2510.1.Allpersonsprovidingprotectiveservicestoeligibleadults,assuch
2termsaredefinedinsection192.2400,andwhohavedirectcontactwithsuchadults,
3shallberequiredtocompleteatleastonehouroftrainingwithinthefirstsixtydaysof
4employment.Thetrainingshallincludethefollowing:
5 (1)Requirementstoreportanimalabuseorneglectandthepenaltiesassociated
6withfailuretoreportundersection273.410;
7 (2)Howtoidentifyanimalabuseorneglect;
8 (3)Howtomakeareportofanimalabuseorneglect;and
9 (4)Therelationshipbetweeneligibleadultabuseorneglectandanimalabuseor
10neglect.
11 2.Thedepartmentofhealthandseniorservices,inconsultationwithanimal
12welfareassociations,shalldeveloporadaptanduseavailabletrainingmaterialsforthe
13trainingrequiredunderthissection.Personsrequiredtocompletetrainingunderthis
14sectionshallbeprovidedwithopportunitiestodosoduringregularworkinghours.

210.115.1.Whenanyphysician,medicalexaminer,coroner,dentist,chiropractor,
2optometrist,podiatrist,resident,intern,nurse,hospitalorclinicpersonnelthatareengagedin
3theexamination,care,treatmentorresearchofpersons,andanyotherhealthpractitioner,
4psychologist,mentalhealthprofessional,socialworker,daycarecenterworkerorotherchild-
5careworker,juvenileofficer,probationorparoleofficer,jailordetentioncenterpersonnel,
6teacher,principalorotherschoolofficial,ministerasprovidedbysection352.400,peace
7officerorlawenforcementofficial,animalcontrolofficer,animalhumaneinvestigatoras
8definedinsection273.415,volunteerorpersonnelofacommunityserviceprogramthat
9offerssupportservicesforfamiliesincrisistoassistinthedelegationofanypowersregarding
10thecareandcustodyofachildbyaproperlyexecutedpowerofattorneypursuanttosections
11475.600to475.604,orotherpersonwithresponsibilityforthecareofchildrenhasreasonable
12causetosuspectthatachildhasbeenormaybesubjectedtoabuseorneglectorobservesa
13childbeingsubjectedtoconditionsorcircumstanceswhichwouldreasonablyresultinabuse
14orneglect,thatpersonshallimmediatelyreporttothedivisioninaccordancewiththe
15provisionsofsections210.109to210.183.Nointernalinvestigationshallbeinitiateduntil
16suchareporthasbeenmade.Asusedinthissection,theterm"abuse"isnotlimitedtoabuse
17inflictedbyapersonresponsibleforthechild'scare,custodyandcontrolasspecifiedin
18section210.110,butshallalsoincludeabuseinflictedbyanyotherperson.
19 2.Iftwoormoremembersofamedicalinstitutionwhoarerequiredtoreportjointly
20haveknowledgeofaknownorsuspectedinstanceofchildabuseorneglect,asinglereport
21maybemadebyadesignatedmemberofthatmedicalteam.Anymemberwhohas
22knowledgethatthememberdesignatedtoreporthasfailedtodososhallthereafter
23immediatelymakethereport.Nothinginthissection,however,ismeanttoprecludeany
24personfromreportingabuseorneglect.
25 3.Thereportingrequirementsunderthissectionareindividual,andnosupervisoror
26administratormayimpedeorinhibitanyreportingunderthissection.Nopersonmakinga
27reportunderthissectionshallbesubjecttoanysanction,includinganyadverseemployment
28action,formakingsuchreport.Everyemployershallensurethatanyemployeerequiredto
29reportpursuanttosubsection1ofthissectionhasimmediateandunrestrictedaccessto
30communicationstechnologynecessarytomakeanimmediatereportandistemporarily
31relievedofotherworkdutiesforsuchtimeasisrequiredtomakeanyreportrequiredunder
32subsection1ofthissection.
33 4.Notwithstandinganyotherprovisionofsections210.109to210.183,anychildwho
34doesnotreceivespecifiedmedicaltreatmentbyreasonofthelegitimatepracticeofthe
35religiousbeliefofthechild'sparents,guardian,orotherslegallyresponsibleforthechild,for
HB325	3 36thatreasonalone,shallnotbefoundtobeanabusedorneglectedchild,andsuchparents,
37guardianorotherpersonslegallyresponsibleforthechildshallnotbeenteredintothecentral
38registry.However,thedivisionmayacceptreportsconcerningsuchachildandmay
39subsequentlyinvestigateorconductafamilyassessmentasaresultofthatreport.Suchan
40exceptionshallnotlimittheadministrativeorjudicialauthorityofthestatetoensurethat
41medicalservicesareprovidedtothechildwhenthechild'shealthrequiresit.
42 5.Inadditiontothosepersonsandofficialsrequiredtoreportactualorsuspected
43abuseorneglect,anyotherpersonmayreportinaccordancewithsections210.109to210.183
44ifsuchpersonhasreasonablecausetosuspectthatachildhasbeenormaybesubjectedto
45abuseorneglectorobservesachildbeingsubjectedtoconditionsorcircumstanceswhich
46wouldreasonablyresultinabuseorneglect.
47 6.Anypersonorofficialrequiredtoreportpursuanttothissection,including
48employeesofthedivision,whohasprobablecausetosuspectthatachildwhoisormaybe
49undertheageofeighteen,whoiseligibletoreceiveacertificateoflivebirth,hasdiedshall
50reportthatfacttotheappropriatemedicalexaminerorcoroner.If,uponreviewofthe
51circumstancesandmedicalinformation,themedicalexaminerorcoronerdeterminesthatthe
52childdiedofnaturalcauseswhileundermedicalcareforanestablishednaturaldisease,the
53coroner,medicalexaminerorphysicianshallnotifythedivisionofthechild'sdeathandthat
54thechild'sattendingphysicianshallbesigningthedeathcertificate.Inallothercases,the
55medicalexaminerorcoronershallacceptthereportforinvestigation,shallimmediatelynotify
56thedivisionofthechild'sdeathasrequiredinsection58.452andshallreportthefindingsto
57thechildfatalityreviewpanelestablishedpursuanttosection210.192.
58 7.Anypersonorindividualrequiredtoreportmayalsoreportthesuspicionofabuse
59orneglecttoanylawenforcementagencyorjuvenileoffice.Suchreportshallnot,however,
60taketheplaceofreportingtothedivision.
61 8.Ifanindividualrequiredtoreportsuspectedinstancesofabuseorneglectpursuant
62tothissectionhasreasontobelievethatthevictimofsuchabuseorneglectisaresidentof
63anotherstateorwasinjuredasaresultofanactwhichoccurredinanotherstate,theperson
64requiredtoreportsuchabuseorneglectmay,inlieuofreportingtotheMissourichildren's
65division,makesuchareporttothechildprotectionagencyoftheotherstatewiththeauthority
66toreceivesuchreportspursuanttothelawsofsuchotherstate.Ifsuchagencyacceptsthe
67report,noreportisrequiredtobemade,butmaybemade,tothechildren'sdivision.
68 9.Forthepurposesofprovidingsupportiveservicesorverifyingthestatusofayouth
69asunaccompaniedorhomelessforthepurposesofaccessingsupportiveservices,thefactthat
70achildisanunaccompaniedyouthasdefinedin42U.S.C.Section11434a(6)isnot,inandof
71itself,asufficientbasisforreportingchildabuseorneglect,unlessthechildisundersixteen
72yearsofageorisanincapacitatedperson,asdefinedinsection475.010.Nothinginthis
HB325	4 73subsectionshalllimitamandatedreporterfrommakingareportunderthissectionifthe
74mandatedreporterknowsorhasreasonablecausetosuspectthatanunaccompaniedyouthhas
75beenormaybeavictimofabuseorneglect.
210.191.1.Allchildren'sdivisionemployees,andcontractorsforchildren's
2services,whohavedirectcontactwithchildrenthroughthestate'schildprotectionand
3welfaresystemshallberequiredtocompleteatleastonehouroftrainingwithinthefirst
4sixtydaysofemploymentorcontract.Thetrainingshallincludethefollowing:
5 (1)Requirementstoreportanimalabuseorneglectandthepenaltiesassociated
6withfailuretoreportundersection273.410;
7 (2)Howtoidentifyanimalabuseorneglect;
8 (3)Howtomakeareportofanimalabuseorneglect;and
9 (4)Therelationshipbetweenchildabuseorneglectandanimalabuseorneglect.
10 2.Thedivision,inconsultationwithanimalwelfareassociations,shalldevelopor
11adaptanduseavailabletrainingmaterialsforthetrainingrequiredunderthissection.
12Personsrequiredtocompletetrainingunderthissectionshallbeprovidedwith
13opportunitiestodosoduringregularworkinghours.

273.410.1.Whenanypsychologist,mentalhealthprofessional,socialworker,
2schoolcounselor,teacher,orotherschoolprofessional,orjuvenileofficer,law
3enforcementorpeaceofficer,probationorparoleofficer,homehealthaide,adultor
4childprotectiveservicesworker,orvolunteerorpersonnelofacommunityservice
5programthatofferssupportoradvocacyservicesforchildreninfostercarehas
6reasonablecausetosuspectthatananimalhasbeenormaybesubjectedtoabuseor
7neglectorobservesananimalbeingsubjectedtoconditionsorcircumstancesthatwould
8reasonablyresultinabuseorneglect,thatpersonshallmakeareporttothehotline
9establishedandoperatedbytheMissouriAnimalControlAssociation(MACA)within
10oneday.
11 2.Thehotlineworkershallrequestallofthefollowinginformationforthe
12report:
13 (1)Thenameanddescriptionoftheanimalinvolved,ifknown;
14 (2)Theaddressandtelephonenumberoftheownerorotherpersonresponsible
15forthecareoftheanimal,ifknown;
16 (3)Thenatureandextentofthesuspectedabuseorneglect;and
HB325	5 17 (4)Anyotherinformationthatthepersonmakingthereportbelievesmaybe
18usefulinestablishingtheexistenceofthesuspectedabuseorneglectortheidentityofthe
19personcausingtheabuseorneglect.
20 3.Uponreceivingareportofsuspectedabuseorneglect,MACAshallprovide
21thereporttoanyduly-authorizedlawenforcementofficial,countyormunicipalanimal
22controlofficer,oranyMissouripeaceofficerstandardsandtraining(POST)-certifiedor
23MACA-certifiedanimalcrueltyinvestigator.
24 4.Anypersonrequiredtoreportanimalabuseorneglectunderthissectionshall
25beimmunefromcivilandcriminalliabilityinconnectionwithmakinganyrequired
26reportsifthepersonactedingoodfaithwhenmakingsuchreport.
27 5.Notwithstandinganyprovisionoflawtothecontrary,anyinformation
28identifyingapersonwhoreportssuspectedanimalabuseorneglectunderthissection
29shallbeconfidentialandshallnotbedeemedapublicrecordandshallnotbesubjectto
30theprovisionsofsection109.180orchapter610.
31 6.Nopersonrequiredtomakeareportofanimalabuseorneglectunderthis
32sectionshallknowinglymakeafalsereport.Thepenaltyformakingafalsereportand
33thedefensestoprosecutionshallbethesameasundersection575.080.
34 7.Ifanagencyorpoliticalsubdivisionofthestatedeterminesthatanemployee
35whoisamandatedreporterunderthissectionhasfailedtomakeareportasrequiredby
36thissection,theagencyorpoliticalsubdivisionshallissueawrittennoticetosuch
37employeethatshallincludeafindingoffactsinsupportofthefailuretomakeareport
38andanexplanationofthereportingrequirement.Suchnoticeshallnotberetainedina
39permanentemploymentfileandshallberetainedinaseparatefileordatabase
40maintainedbytheagencyorpoliticalsubdivision.Suchnoticeshallbeconsidereda
41closedrecordundertheprovisionsofchapter610.
42 8.Anypersonrequiredtomakeareportunderthissectionwhoissubjectto
43professionallicensureandwhofailstomakeareportasrequiredbythissectionshallbe
44subjecttodisciplinebyhisorherrespectivelicensingboardasfollows:
45 (1)Forthefirstinstanceofafailuretoreport,thelicensingboardshallissuea
46writtennoticetosuchemployeethatshallincludeafindingoffactsinsupportofthe
47failuretomakeareportandanexplanationofthereportingrequirement;
48 (2)Forasecondinstanceofafailuretoreport,thelicensingboardshallimposea

11 2.Thechildren'sdivisionandthedepartmentofhealthandseniorservices,in
12consultationwithanimalwelfareassociations,shalldeveloporadaptanduseavailable
13trainingmaterialsforthetrainingrequiredunderthissection.Personsrequiredto
14completetrainingunderthissectionshallbeprovidedwithopportunitiestodosoduring
15regularworkinghours.

3 2.Thegeneralassemblyherebyoccupiesandpreemptstheentirefieldof
4legislationconcerningthepracticeoflicensedprofessionsregulatedunderchapters330,
5331,332,334,335,336,337,338,and340.Apoliticalsubdivisionispreemptedfrom
6enacting,maintaining,orenforcinganyorder,ordinance,rule,regulation,policy,or
7othersimilarmeasurethatprohibits,restricts,limits,regulates,controls,directs,or
8interfereswiththepracticeofsuchlicensedprofessions.
9 3.Nothinginthissectionshallprecludeorpreemptapoliticalsubdivisionfrom
10exercisingitslawfulauthoritytoregulatezoningorlanduse,toenforceabuildingor
11firecoderegulation,toimposeataxorlicensefeefortheprivilegeofcarryingona
12professiondescribedinsubsection2ofthissectionconsistentwiththelawsregulating
13suchtaxesorlicensefees,ortootherwiseregulateforthegeneralhealth,safety,
14sanitation,andwelfareaslongastheorder,ordinance,rule,regulation,policy,orother
15measuredoesnotinterferewith,restrict,orlimittheabilityofalawfullylicensed
