146onthecertificateassuch,whichtheapplicantshallsigninthepresenceofthesherifforthe 147sheriff'sdesignee.Thispermit,whencarriedwithavalidMissouridriver'sornondriver's 148licenseoravalidmilitaryidentification,shallpermittheapplicanttoexercisethesamerights 149inaccordancewiththesameconditionsaspertaintoaconcealedcarrypermitissuedunder 150thissection,providedthatitshallnotserveasanalternativetoannationalinstantcriminal 151backgroundcheckrequiredby18U.S.C.Section922(t).Theprovisionalpermitshallremain 152validuntilsuchtimeasthesheriffeitherissuesordeniesthecertificateofqualificationunder 153subsection6or7ofthissection.Thesheriffshallrevokeaprovisionalpermitissuedunder 154thissubsectionwithintwenty-fourhoursofreceiptofanyreportthatidentifiesadisqualifying 155record,andshallnotifytheconcealedcarrypermitsystemestablishedundersubsection5of 6.Thesheriffmayrefusetoapproveanapplicationforaconcealedcarrypermitifhe 160orshedeterminesthatanyoftherequirementsspecifiedinsubsection2ofthissectionhave 161notbeenmet,orifheorshehasasubstantialanddemonstrablereasontobelievethatthe 162applicanthasrenderedafalsestatementregardinganyoftheprovisionsofsections571.101 163to571.121.Iftheapplicantisfoundtobeineligible,thesheriffisrequiredtodenythe 164application,andnotifytheapplicantinwriting,statingthegroundsfordenialandinforming 185permitshallalsobeassignedaconcealedcarrypermitsystemcountycodeandshallbestored 186insequentialnumber. 187 9.(1)Thesheriffshallkeeparecordofallapplicationsforaconcealedcarrypermit 188oraprovisionalpermitandhisorheractionthereon.Anyrecordofanapplicationthatis 189incompleteordeniedforanyreasonshallbekeptforaperiodnottoexceedoneyear.Any 190recordofanapplicationthatwasapprovedshallbekeptforaperiodofoneyearafterthe 191expirationandnonrenewalofthepermit. 192 (2)Thesheriffshallreporttheissuanceofaconcealedcarrypermitorprovisional 193permittotheconcealedcarrypermitsystem.Allinformationonanysuchpermitthatis 194protectedinformationonanydriver'sornondriver'slicenseshallhavethesamepersonal 195protectionforpurposesofsections571.101to571.121.Anapplicant'sstatusasaholderofa 196concealedcarrypermit,provisionalpermit,oraconcealedcarryendorsementissuedpriorto 13.Forthepurposesofsections571.101to571.121,theterm"sheriff"shallinclude 227thesheriffofanycountyorcitynotwithinacountyorhisorherdesigneeandincountiesof 228thefirstclassificationthesheriffmaydesignatethechiefofpoliceofanycity,town,or 229municipalitywithinsuchcounty. 230 14.Forthepurposesofthischapter,"concealedcarrypermit"shallincludeany 231concealedcarryendorsementissuedbythedepartmentofrevenuebeforeJanuary1,2014, 232andanyconcealedcarrydocumentissuedbyanysherifforundertheauthorityofanysheriff 233afterDecember31,2013. 571.104.1.AconcealedcarryendorsementissuedpriortoAugust28,2013,shallbe 2suspendedorrevokediftheconcealedcarryendorsementholderbecomesineligibleforsuch 3endorsementunderthecriteriaestablishedinsubdivisions(2),(3),(4),[(5),(8),and(11)](7), 4and(10)ofsubsection2ofsection571.101orupontheissuanceofavalidfullorderof 5protection.Thefollowingproceduresshallbefollowed: 6 (1)Whenavalidfullorderofprotection,oranyarrestwarrant,discharge,or 7commitmentforthereasonslistedinsubdivision(2),(3),(4),[(5),(8),or(11)](7),or(10)of 8subsection2ofsection571.101,isissuedagainstapersonholdingaconcealedcarry 9endorsementissuedpriortoAugust28,2013,uponnotificationofsaidorder,warrant, 10dischargeorcommitmentoruponanorderofacourtofcompetentjurisdictioninacriminal 11proceeding,acommitmentproceedingorafullorderofprotectionproceedingrulingthata 12personholdingaconcealedcarryendorsementpresentsariskofharmtothemselvesorothers, 13thenuponnotificationofsuchorder,theholderoftheconcealedcarryendorsementshall 14surrenderthedriver'slicenseornondriver'slicensecontainingtheconcealedcarry 15endorsementtothecourt,officer,orotherofficialservingtheorder,warrant,discharge,or 16commitment.Theofficialtowhomthedriver'slicenseornondriver'slicensecontainingthe 17concealedcarryendorsementissurrenderedshallissueareceipttothelicenseeforthelicense 18uponaform,approvedbythedirectorofrevenue,thatservesasadriver'slicenseora 19nondriver'slicenseandclearlystatestheconcealedcarryendorsementhasbeensuspended. 20Theofficialshallthentransmitthedriver'slicenseoranondriver'slicensecontainingthe 21concealedcarryendorsementtothecircuitcourtofthecountyissuingtheorder,warrant, 22discharge,orcommitment.TheconcealedcarryendorsementissuedpriortoAugust28, HCSHB328 17 232013,shallbesuspendeduntiltheorderisterminatedoruntilthearrestresultsinadismissal 24ofallcharges.Theofficialtowhomtheendorsementissurrenderedshalladministratively 25suspendtheendorsementintheconcealedcarrypermitsystemestablishedundersubsection5 26ofsection650.350untilsuchtimeastheorderisterminatedoruntilthechargesare 27dismissed.Upondismissal,thecourtholdingthedriver'slicenseornondriver'slicense 28containingtheconcealedcarryendorsementshallreturnsuchlicensetotheindividual,andthe 29officialtowhomtheendorsementwassurrenderedshalladministrativelyreturnthe 30endorsementtogoodstandingwithintheconcealedcarrypermitsystem[.]; and 31 (2)Anyconviction,discharge,orcommitmentspecifiedinsections571.101to 32571.121shallresultinarevocation.Uponconviction,thecourtshallforwardanoticeof 33convictionoractionandthedriver'slicenseornondriver'slicensewiththeconcealedcarry 34endorsementtothedepartmentofrevenue.Thedepartmentofrevenueshallnotifythesheriff 35ofthecountywhichissuedthecertificateofqualificationforaconcealedcarryendorsement. 36ThesheriffwhoissuedthecertificateofqualificationpriortoAugust28,2013,shallreport 37thechangeinstatusoftheendorsementtotheconcealedcarrypermitsystemestablished 38undersubsection5ofsection650.350.Thedirectorofrevenueshallimmediatelyremovethe 39endorsementissuedpriortoAugust28,2013,fromtheindividual'sdrivingrecordwithin 40threedaysofthereceiptofthenoticefromthecourt.Thedirectorofrevenueshallnotifythe 41licenseethatheorshemustapplyforanewlicensepursuanttochapter302whichdoesnot 42containsuchendorsement.Thisrequirementdoesnotaffectthedrivingprivilegesofthe 43licensee.Thenoticeissuedbythedepartmentofrevenueshallbemailedtothelastknown 44addressshownontheindividual'sdrivingrecord.Thenoticeisdeemedreceivedthreedays 45aftermailing. 46 2.Aconcealedcarrypermitissuedpursuanttosections571.101to571.121after 47August28,2013,shallbesuspendedorrevokediftheconcealedcarrypermitholderbecomes 48ineligibleforsuchpermitorendorsementunderthecriteriaestablishedinsubdivisions(2), 49(3),(4),[(5),(8),and(11)](7),and(10)ofsubsection2ofsection571.101oruponthe 50issuanceofavalidfullorderofprotection.Thefollowingproceduresshallbefollowed: 51 (1)Whenavalidfullorderofprotectionoranyarrestwarrant,discharge,or 52commitmentforthereasonslistedinsubdivision(2),(3),(4),[(5),(8),or(11)](7),or(10)of 53subsection2ofsection571.101isissuedagainstapersonholdingaconcealedcarrypermit, 54uponnotificationofsaidorder,warrant,discharge,orcommitmentoruponanorderofacourt 55ofcompetentjurisdictioninacriminalproceeding,acommitmentproceeding,orafullorder 56ofprotectionproceedingrulingthatapersonholdingaconcealedcarrypermitpresentsarisk 57ofharmtothemselvesorothers,thenuponnotificationofsuchorder,theholderofthe 58concealedcarrypermitshallsurrenderthepermittothecourt,officer,orotherofficialserving 59theorder,warrant,discharge,orcommitment.Thepermitshallbesuspendeduntiltheorder HCSHB328 18 60isterminatedoruntilthearrestresultsinadismissalofallcharges.Theofficialtowhomthe 61permitissurrenderedshalladministrativelysuspendthepermitintheconcealedcarrypermit 62systemuntiltheorderisterminatedorthechargesaredismissed.Upondismissal,thecourt 63holdingthepermitshallreturnsuchpermittotheindividualandtheofficialtowhomthe 64permitwassurrenderedshalladministrativelyreturnthepermittogoodstandingwithinthe 65concealedcarrypermitsystem;and 66 (2)Anyconviction,discharge,orcommitmentspecifiedinsections571.101to 67571.121shallresultinarevocation.Uponconviction,thecourtshallforwardanoticeof 68convictionoractionandthepermittotheissuingcountysheriff.Thesheriffwhoissuedthe 69concealedcarrypermitshallreportthechangeinstatusoftheconcealedcarrypermittothe 70concealedcarrypermitsystem. 71 3.Aconcealedcarrypermitshallberenewedforaqualifiedapplicantuponreceiptof 72theproperlycompletedrenewalapplicationandtherequiredrenewalfeebythesheriffofthe 73countyoftheapplicant'sresidence.Therenewalapplicationshallcontainthesamerequired 74informationassetforthinsubsection3ofsection571.101,exceptthatinlieuofthe 75fingerprintrequirementofsubsection5ofsection571.101andthefirearmssafetytraining, 76theapplicantneedonlydisplayhisorhercurrentconcealedcarrypermit.Aname-based 77inquiryoftheNationalInstantCriminalBackgroundCheckSystemshallbecompletedfor 78eachrenewalapplication.ThesheriffshallreviewtheresultsofthereportfromtheNational 79InstantCriminalBackgroundCheckSystem,andwhenthesheriffhasdeterminedthe 80applicanthassuccessfullycompletedallrenewalrequirementsandisnotdisqualifiedunder 81anyprovisionofsection571.101,thesheriffshallissueanewconcealedcarrypermitwhich 82containsthedatesuchpermitwasrenewed.Theprocessforrenewingaconcealedcarry 83endorsementissuedpriortoAugust28,2013,shallbethesameastheprocessforrenewinga 84permit,exceptthatinlieuofthefingerprintrequirementofsubsection5ofsection571.101 85andthefirearmssafetytraining,theapplicantneedonlydisplayhisorhercurrentdriver's 86licenseornondriver'slicensecontaininganendorsement.Uponsuccessfulcompletionofall 87renewalrequirements,thesheriffshallissueanewconcealedcarrypermitasprovidedunder 88thissubsection. 89 4.Apersonwhohasbeenissuedaconcealedcarrypermit,oracertificateof 90qualificationforaconcealedcarryendorsementpriortoAugust28,2013,whofailstofilea 91renewalapplicationforaconcealedcarrypermitonorbeforeitsexpirationdatemustpayan 92additionallatefeeoftendollarspermonthforeachmonthitisexpiredforuptosixmonths. 93Aftersixmonths,thesheriffwhoissuedtheexpiredconcealedcarrypermitorcertificateof 94qualificationshallnotifytheconcealedcarrypermitsystemthatsuchpermitisexpiredand 95cancelled.IfthepersonhasaconcealedcarryendorsementissuedpriortoAugust28,2013, 96thesheriffwhoissuedthecertificateofqualificationfortheendorsementshallnotifythe HCSHB328 19 97directorofrevenuethatsuchcertificateisexpiredregardlessofwhethertheendorsement 98holderhasappliedforaconcealedcarrypermitundersubsection3ofthissection.The 99directorofrevenueshallimmediatelyremovesuchendorsementfromtheindividual'sdriving 100recordandnotifytheindividualthathisorherdriver'slicenseornondriver'slicensehas 101expired.Thenoticeshallbeconductedinthesamemannerasdescribedinsubsection1of 102thissection.Anypersonwhohasbeenissuedaconcealedcarrypermitpursuanttosections 103571.101to571.121,oraconcealedcarryendorsementissuedpriortoAugust28,2013,who 104failstorenewhisorherapplicationwithinthesix-monthperiodmustreapplyforanew 105concealedcarrypermitandpaythefeeforanewapplication. 106 5.Anypersonissuedaconcealedcarrypermitpursuanttosections571.101to 107571.121,oraconcealedcarryendorsementissuedpriortoAugust28,2013,shallnotifythe 108sheriffofthenewjurisdictionofthepermitorendorsementholder'schangeofresidence 109withinthirtydaysafterthechangingofapermanentresidencetoalocationoutsidethecounty 110ofpermitissuance.Thepermitorendorsementholdershallfurnishprooftothesheriffinthe 111newjurisdictionthatthepermitorendorsementholderhaschangedhisorherresidence.The 112sheriffinthenewjurisdictionshallnotifythesheriffintheoldjurisdictionofthepermit 113holder'schangeofaddressandthesheriffintheoldjurisdictionshalltransferanyinformation 114onfileforthepermitholdertothesheriffinthenewjurisdictionwithinthirtydays.The 115sheriffofthenewjurisdictionmaychargeaprocessingfeeofnotmorethantendollarsfor 116anycostsassociatedwithnotificationofachangeinresidence.Thesheriffshallreportthe 117residencechangetotheconcealedcarrypermitsystem,takepossessionanddestroytheold 118permit,andthenissueanewpermittothepermitholder.Thenewaddressshallbeaccessible 119bytheconcealedcarrypermitsystemwithinthreedaysofreceiptoftheinformation.Ifthe 120personhasaconcealedcarryendorsementissuedpriortoAugust28,2013,theendorsement 121holdershallalsofurnishprooftothedepartmentofrevenueofhisorherresidencechange.In 122suchcases,thechangeofresidenceshallbemadebythedepartmentofrevenueontothe 123individual'sdrivingrecord. 124 6.Anypersonissuedaconcealedcarrypermitpursuanttosections571.101to 125571.121,oraconcealedcarryendorsementissuedpriortoAugust28,2013,shallnotifythe 126sherifforhisorherdesigneeofthepermitorendorsementholder'scountyorcityofresidence 127withinsevendaysafteractualknowledgeofthelossordestructionofhisorherpermitor 128driver'slicenseornondriver'slicensecontainingaconcealedcarryendorsement.Thepermit 129orendorsementholdershallfurnishastatementtothesheriffthatthepermitordriver'slicense 130ornondriver'slicensecontainingtheconcealedcarryendorsementhasbeenlostordestroyed. 131Afternotificationofthelossordestructionofapermitordriver'slicenseornondriver's 132licensecontainingaconcealedcarryendorsement,thesheriffmaychargeaprocessingfeeof 133tendollarsforcostsassociatedwithreplacingalostordestroyedpermitordriver'slicenseor HCSHB328 20 134nondriver'slicensecontainingaconcealedcarryendorsementandshallreissueanew 135concealedcarrypermitwithinthreeworkingdaysofbeingnotifiedbytheconcealedcarry 136permitorendorsementholderofitslossordestruction.Thenewconcealedcarrypermitshall 137containthesamepersonalinformation,includingexpirationdate,astheoriginalconcealed 138carrypermit. 139 7.Ifapersonissuedaconcealedcarrypermit,orendorsementissuedpriortoAugust 14028,2013,changeshisorhername,thepersontowhomthepermitorendorsementwasissued 141shallobtainacorrectedornewconcealedcarrypermitwithachangeofnamefromthesheriff 142whoissuedtheoriginalconcealedcarrypermitortheoriginalcertificateofqualificationfor 143anendorsementuponthesheriff'sverificationofthenamechange.Thesheriffmaychargea 144processingfeeofnotmorethantendollarsforanycostsassociatedwithobtainingacorrected 145ornewconcealedcarrypermit.Thepermitorendorsementholdershallfurnishproofofthe 146namechangetothesheriffwithinthirtydaysofchanginghisorhernameanddisplayhisor 147herconcealedcarrypermitorcurrentdriver'slicenseornondriver'slicensecontaininga 148concealedcarryendorsement.Thesheriffshallreportthenamechangetotheconcealedcarry 149permitsystem,andthenewnameshallbeaccessiblebytheconcealedcarrypermitsystem 150withinthreedaysofreceiptoftheinformation. 151 8.Thepersonwithaconcealedcarrypermit,orendorsementissuedpriortoAugust 15228,2013,shallnotifythesheriffofanameoraddresschangewithinthirtydaysofthechange. 153Aconcealedcarrypermitand,ifapplicable,endorsementshallbeautomaticallyinvalidafter 154onehundredeightydaysifthepermitorendorsementholderhaschangedhisorhernameor 155changedhisorherresidenceandnotnotifiedthesheriffasrequiredinsubsections5and7of 156thissection.Thesheriffshallassessalatepenaltyoftendollarspermonthforeachmonth,up 157tosixmonthsandnottoexceedsixtydollars,forthefailuretonotifythesheriffofthechange 158ofnameoraddresswithinthirtydays. 159 9.(1)Asusedinthissubsection,theterm"activemilitarymember"meansany 160personwhoisonactivedutyintheUnitedStatesArmedForces,onactivestateduty,onfull- 161timeNationalGuarddutyunderTitle32oftheUnitedStatesCode. 162 (2)Notwithstandinganyprovisionofthissectiontothecontrary,ifaconcealedcarry 163permit,orendorsementissuedpriortoAugust28,2013,expireswhilethepersonissuedthe 164permitorendorsementisanactivemilitarymember,thepermitshallberenewediftheperson 165completestherenewalrequirementsundersubsection3ofthissectionwithintwomonthsof 166returningtoMissouriafterdischargefromsuchdutyorrecoveryfromsuchincapacitation. 167Oncethetwo-monthperiodhasexpired,theprovisionsofsubsection4ofthissectionshall 168applyexceptthepenaltiesshallbegintoaccrueupontheexpirationofthetwo-monthperiod 169describedinthissubsectionratherthanontheexpirationdateofthepermitorendorsement. HCSHB328 21 170 (3)BeginningAugust28,2020,anactivemilitarymembermaycompletetherenewal 171ofhisorherendorsementorpermitundersubdivision(2)ofthissubsectionbymail.To 172renewanendorsementorpermitbymail,anactivemilitarymembershallmailtothesheriff 173whoissuedhisorherpermitarenewalapplication,acopyofhisorhercurrentconcealed 174carrypermit,amilitaryidentificationacceptableforin-personrenewalofpermits,andthe 175renewalfee.Theactivemilitarymembermaypickuptherenewedpermitinpersonormay 176requestthepermitbemailedtoaprovidedaddressbycertifiedmail.Thesheriffmayrequire 177theactivemilitarymembertopaythepostageandinsurancecostsassociatedwithmailingthe 178permit,butthecostsshallnotexceedtendollars. 571.107.1.Aconcealedcarrypermitissuedpursuanttosections571.101to571.121, 2avalidconcealedcarryendorsementissuedpriortoAugust28,2013,oraconcealedcarry 3endorsementorpermitissuedbyanotherstateorpoliticalsubdivisionofanotherstateshall 4authorizethepersoninwhosenamethepermitorendorsementisissuedtocarryconcealed 5firearmsonorabouthisorherpersonorvehiclethroughoutthestate.Noconcealedcarry 6permitissuedpursuanttosections571.101to571.121,validconcealedcarryendorsement 7issuedpriortoAugust28,2013,oraconcealedcarryendorsementorpermitissuedbyanother 8stateorpoliticalsubdivisionofanotherstateshallauthorizeanypersontocarryconcealed 9firearmsinto: 10 (1)Anypolice,sheriff,orhighwaypatrolofficeorstationwithouttheconsentofthe 11chieflawenforcementofficerinchargeofthatofficeorstation.Possessionofafirearmina 12vehicleonthepremisesoftheofficeorstationshallnotbeacriminaloffensesolongasthe 13firearmisnotremovedfromthevehicleorbrandishedwhilethevehicleisonthepremises; 14 (2)Withintwenty-fivefeetofanypollingplaceonanyelectionday.Possessionofa 15firearminavehicleonthepremisesofthepollingplaceshallnotbeacriminaloffenseso 16longasthefirearmisnotremovedfromthevehicleorbrandishedwhilethevehicleisonthe 17premises; 18 (3)Thefacilityofanyadultorjuveniledetentionorcorrectionalinstitution,prisonor 19jail.Possessionofafirearminavehicleonthepremisesofanyadult,juveniledetention,or 20correctionalinstitution,prisonorjailshallnotbeacriminaloffensesolongasthefirearmis 21notremovedfromthevehicleorbrandishedwhilethevehicleisonthepremises; 22 (4)Anycourthousesolelyoccupiedbythecircuit,appellateorsupremecourt,orany 23courtrooms,administrativeoffices,librariesorotherroomsofanysuchcourtwhetherornot 24suchcourtsolelyoccupiesthebuildinginquestion.Thissubdivisionshallalsoinclude,but 25notbelimitedto,anyjuvenile,family,drug,orothercourtoffices,anyroomorofficewherein 26anyofthecourtsorofficeslistedinthissubdivisionaretemporarilyconductinganybusiness 27withinthejurisdictionofsuchcourtsoroffices,andsuchotherlocationsinsuchmanneras 28maybespecifiedbysupremecourtrulepursuanttosubdivision(6)ofthissubsection. (5)Anymeetingofthegoverningbodyofaunitoflocalgovernment;oranymeeting 38ofthegeneralassemblyoracommitteeofthegeneralassembly,exceptthatnothinginthis 45ConstitutionofMissouri,legislativeemployeesofthegeneralassemblyasdeterminedunder 46section21.155,orstatewideelectedofficialsandtheiremployees,holdingavalidconcealed 47carrypermitorendorsement,fromcarryingaconcealedfirearminthestatecapitolbuilding 48oratameetingwhetherofthefullbodyofahouseofthegeneralassemblyoracommittee 49thereof,thatisheldinthestatecapitolbuilding; 50 (6)Thegeneralassembly,supremecourt,countyormunicipalitymaybyrule, 51administrativeregulation,orordinanceprohibitorlimitthecarryingofconcealedfirearmsby 52permitorendorsementholdersinthatportionofabuildingowned,leasedorcontrolledby 53thatunitofgovernment.Anyportionofabuildinginwhichthecarryingofconcealed 54firearmsisprohibitedorlimitedshallbeclearlyidentifiedbysignspostedattheentranceto 55therestrictedarea.Thestatute,ruleorordinanceshallexemptanybuildingusedforpublic 56housingbyprivatepersons,highwaysorrestareas,firingranges,andprivatedwellings 57owned,leased,orcontrolledbythatunitofgovernmentfromanyrestrictiononthecarrying 58orpossessionofafirearm.Thestatute,ruleorordinanceshallnotspecifyanycriminal 59penaltyforitsviolationbutmayspecifythatpersonsviolatingthestatute,ruleorordinance 60maybedeniedentrancetothebuilding,orderedtoleavethebuildingandifemployeesofthe 61unitofgovernment,besubjectedtodisciplinarymeasuresforviolationoftheprovisionsof 62thestatute,ruleorordinance.Theprovisionsofthissubdivisionshallnotapplytoanyother 63unitofgovernment; 64 (7)Anyestablishmentlicensedtodispenseintoxicatingliquorforconsumptiononthe 65premises,whichportionisprimarilydevotedtothatpurpose,withouttheconsentofthe HCSHB328 23 66ownerormanager.Theprovisionsofthissubdivisionshallnotapplytothelicenseeofsaid 67establishment.Theprovisionsofthissubdivisionshallnotapplytoanybonafiderestaurant 68opentothegeneralpublichavingdiningfacilitiesfornotlessthanfiftypersonsandthat 69receivesatleastfifty-onepercentofitsgrossannualincomefromthediningfacilitiesbythe 70saleoffood.Thissubdivisiondoesnotprohibitthepossessionofafirearminavehicleonthe 71premisesoftheestablishmentandshallnotbeacriminaloffensesolongasthefirearmisnot 72removedfromthevehicleorbrandishedwhilethevehicleisonthepremises.Nothinginthis 73subdivisionauthorizesanyindividualwhohasbeenissuedaconcealedcarrypermitor 74endorsementtopossessanyfirearmwhileintoxicated; 75 (8)Anyareaofanairporttowhichaccessiscontrolledbytheinspectionofpersons 76andproperty.Possessionofafirearminavehicleonthepremisesoftheairportshallnotbea 77criminaloffensesolongasthefirearmisnotremovedfromthevehicleorbrandishedwhile 78thevehicleisonthepremises; 79 (9)Anyplacewherethecarryingofafirearmisprohibitedbyfederallaw; 80 (10)Anyhighereducationinstitutionorelementaryorsecondaryschoolfacility 81withouttheconsentofthegoverningbodyofthehighereducationinstitutionoraschool 82officialorthedistrictschoolboard,unlessthepersonwiththeconcealedcarryendorsementor 83permitisateacheroradministratorofanelementaryorsecondaryschoolwhohasbeen 84designatedbyhisorherschooldistrictasaschoolprotectionofficerandiscarryingafirearm 85inaschoolwithinthatdistrict,inwhichcasenoconsentisrequired.Possessionofafirearm 86inavehicleonthepremisesofanyhighereducationinstitutionorelementaryorsecondary 87schoolfacilityshallnotbeacriminaloffensesolongasthefirearmisnotremovedfromthe 88vehicleorbrandishedwhilethevehicleisonthepremises; 89 (1)IsavalidfirearmssafetyinstructorcertifiedbytheNationalRifleAssociation 86holdingaratingasapersonalprotectioninstructororpistolmarksmanshipinstructor;or 87 (2)Submitsaphotocopyofanotarizedcertificatefromafirearmssafetyinstructor's 88courseofferedbyalocal,state,orfederalgovernmentalagency;or 89 (3)Submitsaphotocopyofanotarizedcertificatefromafirearmssafetyinstructor 90courseapprovedbythedepartmentofpublicsafety;or HCSHB328 28 91 (4)Hassuccessfullycompletedafirearmssafetyinstructorcoursegivenbyorunder 92thesupervisionofanystate,county,municipal,orfederallawenforcementagency;or 93 (5)Isacertifiedpoliceofficerfirearmssafetyinstructor. 94 7.Anyfirearmssafetyinstructorqualifiedundersubsection6ofthissectionmay 95submitacopyofatraininginstructorcertificate,courseoutlinebearingthenotarized 96signatureoftheinstructor,andarecentphotographoftheinstructortothesheriffofthe 97countyinwhichtheinstructorresides.Thesheriffshallreviewthetraininginstructor 98certificatealongwiththecourseoutlineandverifythefirearmssafetyinstructorisqualified 99andthecoursemeetstherequirementsprovidedunderthissection.Ifthesheriffverifiesthe 100firearmssafetyinstructorisqualifiedandthecoursemeetstherequirementsprovidedunder 101thissection,thesheriffshallcollectanannualregistrationfeeoftendollarsfromeach 102qualifiedinstructorwhochoosestosubmitsuchinformationandsubmittheregistrationtothe 103Missourisheriffmethamphetaminerelieftaskforce.TheMissourisheriffmethamphetamine 104relieftaskforce,oritsdesignatedagent,shallcreateandmaintainastatewidedatabaseof 105qualifiedinstructors.Thisinformationshallbeaclosedrecordexceptforaccessbyany 106sheriff.Firearmssafetyinstructorsmayregisterannuallyandtheregistrationisonlyeffective 107forthecalendaryearinwhichtheinstructorregistered.Anysheriffmayaccessthestatewide 108databasemaintainedbytheMissourisheriffmethamphetaminerelieftaskforcetoverifythe 109firearmssafetyinstructorisqualifiedandthecourseofferedbytheinstructormeetsthe 110requirementsprovidedunderthissection.Unlessasheriffhasreasontobelieveotherwise,a 111sheriffshallpresumeafirearmssafetyinstructorisqualifiedtoprovidefirearmssafety 112instructionincountiesthroughoutthestateunderthissectioniftheinstructorisregisteredon 113thestatewidedatabaseofqualifiedinstructors. 114 8.Anyfirearmssafetyinstructorwhoknowinglyprovidesanysheriffwithanyfalse 12571.121orsections571.205to571.230,avalidconcealedcarryendorsementissuedprior 13toAugust28,2013,oravalidconcealedcarrypermitorendorsementissuedbyanother 14stateorapoliticalsubdivisionofanotherstateshallnotbeprohibitedorimpededfrom 15accessingorusinganypubliclyfundedtransportationsystemandshallnotbeharassed 16ordetainedforcarryingaconcealedfirearmontheproperty,vehicles,orconveyances 17owned,contracted,orleasedbysuchsystemsthatareaccessibletothepublic. 571.205.1.Uponrequestandpaymentoftherequiredfee,thesheriffshallissuea 2concealedcarrypermitthatisvalidthroughthestateofMissouriforthelifetimeofthepermit 3holdertoaMissouriresidentwhomeetstherequirementsofsections571.205to571.230, 4knownasaMissourilifetimeconcealedcarrypermit.Apersonmayalsorequest,andthe 5sheriffshallissueuponpaymentoftherequiredfee,aconcealedcarrypermitthatisvalid 6throughthestateofMissouriforaperiodofeithertenyearsortwenty-fiveyearsfromthe 7dateofissuanceorrenewaltoaMissouriresidentwhomeetstherequirementsofsections HCSHB328 33 8571.205to571.230.SuchpermitshallbeknownasaMissouriextendedconcealedcarry 9permit.ApersonissuedaMissourilifetimeorextendedconcealedcarrypermitshallbe 10requiredtocomplywiththeprovisionsofsections571.205to571.230.Iftheapplicantcan 11showqualificationasprovidedbysections571.205to571.230,thesheriffshallissuea 12Missourilifetimeorextendedconcealedcarrypermitauthorizingthecarryingofaconcealed 13firearmonorabouttheapplicant'spersonorwithinavehicle. 14 2.AMissourilifetimeorextendedconcealedcarrypermitshallbesuspendedifthe 15permitholderbecomesaresidentofanotherstate.Thepermitmaybereactivatedupon 16reestablishmentofMissouriresidencyiftheapplicantmeetstherequirementsofsections 17571.205to571.230,anduponsuccessfulcompletionofaname-basedinquiryoftheNational 18InstantBackgroundCheckSystem. 19 3.AMissourilifetimeorextendedconcealedcarrypermitshallbeissuedbythe 10.(1)ThesheriffshallkeeparecordofallapplicationsforaMissourilifetimeor 181extendedconcealedcarrypermitoraprovisionalpermitandhisorheractionthereon.Any 182recordofanapplicationthatisincompleteordeniedforanyreasonshallbekeptforaperiod 183nottoexceedoneyear. 184 (2)ThesheriffshallreporttheissuanceofaMissourilifetimeorextendedconcealed (6)Thegeneralassembly,supremecourt,county,ormunicipalitymaybyrule, 47administrativeregulation,orordinanceprohibitorlimitthecarryingofconcealedfirearmsby 48permitholdersinthatportionofabuildingowned,leased,orcontrolledbythatunitof 49government.Anyportionofabuildinginwhichthecarryingofconcealedfirearmsis
