visualobstructionsatrailroadcrossings.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section389.665,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection389.665,toreadasfollows:
389.665.1.Itshallbethedutyofeverycorporationorpersonowningoroperating
2anyrailroadorbranchthereofinthisstatetokeeptheright-of-wayreasonablyclearofbrush
3andhighweeds,bycutting,burning,chemicalspraying,plowingunder,orotherappropriate
4meansforthepurposeofpreventingthespreadoffire,andincasesuchcorporationorperson
5shallfailorneglecttodoso,anypersonowninglandadjoiningsuchrailroadishereby
6authorized,aftergivingthreedays'notice,inwriting,tosuchowneroroperatorofthe
7railroad,byserviceuponanypersonauthorizedtoreceiveserviceoflegalprocessonbehalf
8ofthecorporationwithinthisstatetocausesuchbrushandhighweedsupontheright-of-way
9occupiedbytherailroadcompanytobecutandremoved,burned,plowed,orsprayedwith
10chemicalmaterialforkillingsuchbrushandhighweedsinfrontofandadjoininghisland,
11andsuchlandownermaymaintainanactionagainstthecorporationorpersonsofailingto
12performthisduty,inanycourtofcompetentjurisdiction,andshallbeentitledtorecover
13doubletheamountofallexpensesanddamagesincurredandaccruingthereby,togetherwith
14costs.
15 2.Itshallbethedutyofeverycorporationorpersonowningoroperatinganyrailroad
16orbranchthereofinthisstatetomaintaintheright-of-wayatpublicgradecrossingssothatit
17willbereasonablyclearofvegetation,undergrowthorotherdebrisforadistanceoftwo

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18hundredfiftyfeeteachwayfromthenearedgeofsuchcrossingswheresuchthingswould
19materiallyobscureapproachingtrainsfromtheviewoftravelersonthehighway.
20 3.(1)Itshallbethedutyofeverycorporationorpersonowningoroperating
21anyrailroadorbranchthereofinthisstatetomaintaincertainminimumdistancesfrom
22thenearedgerailroadcrossingstorailroadrollingstockstoredonsidings.The
23minimumdistanceforstoredrollingstockshallbe:
24 (a)Twohundredfiftyfeetforcrossingswithagateorbarrierandelectricor
25mechanicaldevicesthatwarnoftheapproachofarailroadtrain;and
26 (b)Fivehundredfeetforallothercrossings

28unlessthedepartmentoftransportationdeterminesalesserorgreaterdistanceis
29necessaryataparticularlocationandpermitsorordersarailroadtomaintainthelesser
30orgreaterdistance.
31 (2)Notwithstandingsubdivision(1)ofthissubsection,ifphysicalconditions
32requiretheuseofatracktemporarilyorminimumdistancescannotbeobtained,the
33provisionsofthissectionshallnotapplyto:
34 (a)Carsplacedforloadingorunloadingorawaitingremovalafterloadingor
35unloading;and
36 (b)Carsidentifiedasneedingmechanicalattentionorrepairsduetodamage,
37defects,orsafetyissues,thataretakenoutofserviceforrepairs.
38 4.Forpurposesofthissection,"storedrollingstock"meansrollingstocknot
39usedforthepickupordeliveryoffreightandwhoseplacementonarailroad-owned
40sidingbyarailroadisforthesoleconvenienceoftherailroad.
41 5.Theprovisionsofthissectionshallnotapplytorollingstockstoredonyard
42tracksunlessthedepartmentoftransportationordersotherwise.
