catalyticconverters,withpenaltyprovisions.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section407.300,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection407.300,toreadasfollows:
407.300.1.Everypurchaserorcollectorof,ordealerin,junk,scrapmetal,orany
2secondhandpropertywhoobtainsitemsforresaleorprofitshallkeeparegistercontaininga
3writtenorelectronicrecordforeachpurchaseortradeinwhicheachtypeofmaterialsubject
4totheprovisionsofthissectionisobtainedforvalue.Thereshallbeaseparaterecordfor
5eachtransactioninvolvingany:
6 (1)Copper,brass,orbronze;
7 (2)Aluminumwire,cable,pipe,tubing,bar,ingot,rod,fitting,orfastener;
8 (3)Materialcontainingcopperoraluminumthatisknowinglyusedforfarming
9purposesasfarmingisdefinedinsection350.010;whatevermaybetheconditionorlengthof
10suchmetal;
11 (4)Detachedcatalyticconverter;or
12 (5)Motorvehicle,heavyequipment,ortractorbattery.
13 2.Therecordrequiredbythissectionshallcontainthefollowingdata:
14 (1)Acopyofthedriver'slicenseorphotoidentificationissuedbythestateorbythe
15UnitedStatesgovernmentoragencythereofofthepersonfromwhomthematerialis
16obtained;

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17 (2)Thecurrentaddress,gender,birthdate,andacolorphotographofthepersonfrom
18whomthematerialisobtainedifnotincludedoraredifferentfromtheidentificationrequired
19insubdivision(1)ofthissubsection;
20 (3)Thedate,time,andplaceofthetransaction;
21 (4)Thelicenseplatenumberofthevehicleusedbythesellerduringthetransaction;

23 (5)Afulldescriptionofthematerial,includingtheweightandpurchaseprice; and
24 (6)Ifthetransactioninvolvesacatalyticconverter,thevehicleidentification
25numberofthevehiclefromwhichthecatalyticconverterwasremoved.
26 3.Therecordsrequiredunderthissectionshallbemaintainedforaminimumof
27thirty-sixmonthsfromwhensuchmaterialisobtainedandshallbeavailableforinspectionby
28anylawenforcementofficer.
29 4.Notransactionthatincludesadetachedcatalyticconvertershalloccuratany
30locationotherthanthefixedplaceofbusinessofthepurchaserorcollectorof,ordealerin,
31junk,scrapmetal,oranysecondhandproperty.Nodetachedcatalyticconvertershallbe
32altered,modified,disassembled,ordestroyeduntilithasbeeninthepurchaser's,collector's,
33ordealer'spossessionforfivebusinessdays.
34 5.Anyonelicensedundersection301.218whoknowinglypurchasesastolen
35detachedcatalyticconvertershallbesubjecttothefollowingpenalties:
36 (1)Forafirstviolation,afineintheamountoffivethousanddollars;
37 (2)Forasecondviolation,afineintheamountoftenthousanddollars;and
38 (3)Forathirdviolation,revocationofthelicenseforabusinessdescribedunder
39section301.218.
40 6.Thissectionshallnotapplytoeitherofthefollowingtransactions:
41 (1)Anytransactionforwhichthesellerhasanexistingbusinessrelationshipwiththe
42scrapmetaldealerandisknowntothescrapmetaldealermakingthepurchasetobean
43establishedbusinessorpoliticalsubdivisionthatoperatesabusinesswithafixedlocationthat
44canbereasonablyexpectedtogenerateregulatedscrapmetalandcanbereasonablyidentified
45assuchabusiness,andforwhichthesellerispaidbycheckorbyelectronicfundstransfer,or
46thesellerproducesanacceptableidentification,whichshallbeacopyofthedriver'slicense
47orphotoidentificationissuedbythestateorbytheUnitedStatesgovernmentoragency
48thereof,andacopyisretainedbythepurchaser;or
49 (2)Anytransactionforwhichthetypeofmetalsubjecttosubsection1ofthissection
50isaminorpartofalargeritem,exceptforheatingandcoolingequipmentorequipmentused
51inthegenerationandtransmissionofelectricalpowerortelecommunications.
