Toamendchapter1,RSMo,byaddingtheretoonenewsectionrelatingtotheanti-redflag
gunseizureact,withpenaltyprovisionsandanemergencyclause.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Chapter1,RSMo,isamendedbyaddingtheretoonenewsection,tobe
2knownassection1.486,toreadasfollows:
1.486.1.Thissectionshallbeknownandmaybecitedasthe"Anti-RedFlag
2GunSeizureAct".
3 2.Asusedinthissection,"redflaglaw"means:
4 (1)Anyguncontrollaw,order,ormeasurethatdirectsthetemporaryor
5permanentseizureofanyfirearm,firearmaccessory,orammunitionofanindividual,
6exceptpersonslawfullyincustodyorpersonswhohavebeenreleasedafterthe
7executionofabailbondafterhavingbeenchargedwithadangerousfelony;or
8 (2)Anyfederalstatute,federalrule,federalexecutiveorder,orfederaljudicial
9orderorfinding,oranystatestatute,staterule,stateexecutiveorder,orstatejudicial
10orderorfinding,that:
11 (a)ProhibitsaMissouricitizenfromowning,possessing,transporting,
12transferring,orreceivinganyfirearm,firearmaccessory,orammunitionofan
13individual,exceptpersonslawfullyincustodyorpersonswhohavebeenreleasedafter
14theexecutionofabailbondafterhavingbeenchargedwithadangerousfelony;or
15 (b)Orderstheremovalorrequiresthesurrenderofanyfirearm,firearm
16accessory,orammunitionofanindividual,exceptpersonslawfullyincustodyorpersons
17whohavebeenreleasedaftertheexecutionofabailbondafterhavingbeencharged
18withadangerousfelony.
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 19 3.Anyfederalorderofprotection,otherjudicialorderissuedbyafederalcourt,
20orfederalexecutiveorderthatisaredflaglaworotherwisedirectstheconfiscationof
21anyfirearm,firearmaccessory,orammunitionfromanylaw-abidingcitizenwithinthe
22bordersofthisstateshallnotbeenforcedinthisstatebyanystateagency,political
23subdivision,orstateorlocallawenforcementagency.
24 4.Nostateagency,politicalsubdivision,orstateorlocallawenforcementagency
25shallreceiveanyfederalmoneysforthepurposeofenforcinganyfederalstatute,federal
26rule,federalexecutiveorder,orfederaljudicialorderorfindings,orforthepurposeof
27enforcinganystatestatute,staterule,stateexecutiveorder,orstatejudicialorderor
28findings,thatwouldhavetheeffectofenforcingaredflaglawagainstaMissouricitizen.
29 5.Nostateentityoremployeethereof,politicalsubdivisionoremployeethereof,
30orotherentityorpersonshallhavetheauthoritytoenforceorattempttoenforceared
31flaglawregardlessoftheredflaglaw'soriginortheauthorityoftheissuingentity.This
32subsectionshallnotapplytoanyagentofthefederalgovernmentenforcingafederal
33laworfederalorder.
34 6.Nothinginthissectionshallbeconstruedtopreventafirearm,firearm
35accessory,orammunitionfrombeingseizedasevidencebylawenforcementinthe
36courseofaninvestigation.
37 7.(1)Apoliticalsubdivisionorstateorlocallawenforcementagencythat
38employsalawenforcementofficerwhoknowinglyactstoviolatethissectionandenforce
39aredflaglawunderthecolorofanystateorfederalstatute,rule,executiveorder,or
40judicialorderorfindingshallbeliabletothepartyagainstwhomtheredflaglawwas
41enforcedinanactionatlaw,suitinequity,orotherproperproceedingforredressand
42shallbesubjecttoacivilpenaltyoffiftythousanddollarsperoccurrence.
43 (2)Anypersoninjuredunderthissectionshallhavestandingtopursueanaction
44forinjunctivereliefinthecircuitcourtofthecountyinwhichtheactionallegedly
45occurredorinthecircuitcourtofColeCounty.
46 (3)Thecourtshallholdahearingonanymotionforatemporaryrestraining
47orderorpreliminaryinjunctionwithinthirtydaysofserviceofapetitionforthesame.
48 (4)Inanactionbroughtunderthissectionbyapartyagainstwhomtheredflag
49lawwasenforced,acourtmayorderinjunctiveorotherequitablerelief,recoveryof
50damages,otherlegalremedies,andpaymentofreasonableattorney'sfees,costs,and
51expensesoftheparty.Thereliefandremediessetforthinthissectionshallnotbe
52deemedexclusiveandshallbeinadditiontoanyotherrelieforremediespermittedby
53law.Thecourtmayawardtheprevailingparty,ifnotthestateofMissouriorapolitical
54subdivisionthereof,reasonableattorney'sfeesandcosts.

56underthissection.
SectionB.Becauseimmediateactionisnecessarytolimitanyoverreachofthe
2federalgovernment'spowerandtoprotectcitizens'rightstobeararms,theenactmentof
3section1.486ofsectionAofthisactisdeemednecessaryfortheimmediatepreservationof
4thepublichealth,welfare,peace,andsafety,andisherebydeclaredtobeanemergencyact
5withinthemeaningoftheconstitution,andtheenactmentofsection1.486ofsectionAofthis
6actshallbeinfullforceandeffectuponitspassageandapproval.
