2enactedinlieuthereof,tobeknownassections144.070and301.140,toreadasfollows:
144.070.1.Atthetimetheownerofanyneworusedmotorvehicle,trailer,boat,or
2outboardmotorwhichwasacquiredinatransactionsubjecttosalestaxundertheMissouri
3salestaxlawmakesapplicationtothedirectorofrevenueforanofficialcertificateoftitleand
4theregistrationofthemotorvehicle,trailer,boat,oroutboardmotorasotherwiseprovidedby
5law,theownershallpresenttothedirectorofrevenueevidencesatisfactorytothedirectorof
6revenueshowingthepurchasepriceexclusiveofanychargeincidenttotheextensionofcredit
7paidbyorchargedtotheapplicantintheacquisitionofthemotorvehicle,trailer,boat,or
8outboardmotor,orthatnosalestaxwasincurredinitsacquisition,andifsalestaxwas
9incurredinitsacquisition,theapplicantshallpayorcausetobepaidtothedirectorofrevenue
10thesalestaxprovidedbytheMissourisalestaxlawinadditiontotheregistrationfeesnowor
11hereafterrequiredaccordingtolaw,andthedirectorofrevenueshallnotissueacertificateof
12titleforanyneworusedmotorvehicle,trailer,boat,oroutboardmotorsubjecttosalestaxas
13providedintheMissourisalestaxlawuntilthetaxleviedforthesaleofthesameunder
14sections144.010to144.510hasbeenpaidasprovidedinthissectionorisregisteredunder
15theprovisionsofsubsection5ofthissection.
16 2.Asusedinsubsection1ofthissection,theterm"purchaseprice"shallmeanthe
17totalamountofthecontractpriceagreeduponbetweenthesellerandtheapplicantinthe

20 3.Intheeventthatthepurchasepriceisunknownorundisclosed,orthattheevidence
21thereofisnotsatisfactorytothedirectorofrevenue,thesameshallbefixedbyappraisement
22bythedirector.
23 4.Thedirectorofthedepartmentofrevenueshallendorseupontheofficialcertificate
24oftitleissuedbythedirectoruponsuchapplicationanentryshowingthatsuchsalestaxhas
25beenpaidorthatthemotorvehicle,trailer,boat,oroutboardmotorrepresentedbysuch
26certificateisexemptfromsalestaxandstatethegroundforsuchexemption.
27 5.Anyperson,company,orcorporationengagedinthebusinessofrentingorleasing
28motorvehicles,trailers,boats,oroutboardmotors,whicharetobeusedexclusivelyforrental
29orleasepurposes,andnotforresale,mayapplytothedirectorofrevenueforauthorityto
30operateasaleasingorrentalcompanyandpayanannualfeeoftwohundredfiftydollarsfor
31suchauthority.Anycompanyapprovedbythedirectorofrevenuemaypaythetaxdueon
32anymotorvehicle,trailer,boat,oroutboardmotorasrequiredinsection144.020atthetime
33ofregistrationthereoforinlieuthereofmaypayasalestaxasprovidedinsections144.010,
34144.020,144.070and144.440.Asalestaxshallbechargedtoandpaidbyaleasingcompany
35whichdoesnotexercisetheoptionofpayinginaccordancewithsection144.020,onthe
36amountchargedforeachrentalorleaseagreementwhilethemotorvehicle,trailer,boat,or
37outboardmotorisdomiciledinthisstate.Anymotorvehicle,trailer,boat,oroutboardmotor
38whichisleasedastheresultofacontractexecutedinthisstateshallbepresumedtobe
39domiciledinthisstate.
40 6.Everyapplicanttobearegisteredfleetownerasdescribedinsubsections6to10of
41section301.032shallfurnishwiththeapplicationtooperateasaregisteredfleetownera
42corporatesuretybondorirrevocableletterofcredit,asdefinedinsection400.5-102,issued
43byanystateorfederalfinancialinstitutioninthepenalsumofonehundredthousanddollars,
44onaformapprovedbythedepartment.Thebondorirrevocableletterofcreditshallbe
45conditionedupontheregisteredfleetownercomplyingwiththeprovisionsofanystatutes
46applicabletoregisteredfleetowners,andthebondshallbeanindemnityforanyloss
47sustainedbyreasonoftheactsofthepersonbondedwhensuchactsconstitutegroundsforthe
48suspensionorrevocationoftheregisteredfleetownerlicense.Thebondshallbeexecutedin
49thenameofthestateofMissouriforthebenefitofallaggrievedpartiesortheirrevocable
50letterofcreditshallnamethestateofMissouriasthebeneficiary;exceptthat,theaggregate
51liabilityofthesuretyorfinancialinstitutiontotheaggrievedpartiesshall,innoevent,exceed
52theamountofthebondorirrevocableletterofcredit.Theproceedsofthebondorirrevocable
53letterofcreditshallbepaiduponreceiptbythedepartmentofafinaljudgmentfroma

55party.
56 7.Anycorporationmayhaveoneormoreofitsdivisionsseparatelyapplytothe
57directorofrevenueforauthorizationtooperateasaleasingcompany,providedthatthe
58corporation:
59 (1)Hasfiledawrittenconsentwiththedirectorauthorizinganyofitsdivisionsto
60applyforsuchauthority;
61 (2)IsauthorizedtodobusinessinMissouri;
62 (3)Hasagreedtotreatanysaleofamotorvehicle,trailer,boat,oroutboardmotor
63fromoneofitsdivisionstoanotherofitsdivisionsasasaleatretail;
64 (4)Hasregisteredunderthefictitiousnameprovisionsofsections417.200to417.230
65eachofitsdivisionsdoingbusinessinMissouriasaleasingcompany;and
66 (5)Operateseachofitsdivisionsonabasisseparatefromeachofitsotherdivisions.
67However,whenthetransferofamotorvehicle,trailer,boatoroutboardmotoroccurswithina
68corporationwhichholdsalicensetooperateasamotorvehicleorboatdealerpursuantto
69sections301.550to301.573theprovisionsinsubdivision(3)ofthissubsectionshallnot
70apply.
71 8.Iftheownerofanymotorvehicle,trailer,boat,oroutboardmotordesirestocharge
72andcollectsalestaxasprovidedinthissection,theownershallmakeapplicationtothe
73directorofrevenueforapermittooperateasamotorvehicle,trailer,boat,oroutboardmotor
74leasingcompany.Thedirectorofrevenueshallpromulgaterulesandregulationsdetermining
75thequalificationsofsuchacompany,andthemethodofcollectionandreportingofsalestax
76chargedandcollected.Suchregulationsshallapplyonlytoownersofmotorvehicles,trailers,
77boats,oroutboardmotors,electingtoqualifyasmotorvehicle,trailer,boat,oroutboard
78motorleasingcompaniesundertheprovisionsofsubsection5ofthissection,andnomotor
79vehiclerentingorleasing,trailerrentingorleasing,orboatoroutboardmotorrentingor
80leasingcompanycancomeundersections144.010,144.020,144.070and144.440unlessall
81motorvehicles,trailers,boats,andoutboardmotorsheldforrentingandleasingareincluded.
82 9.Anyperson,company,orcorporationengagedinthebusinessofrentingorleasing
83threethousandfivehundredormoremotorvehicleswhicharetobeusedexclusivelyfor
84rentalorleasingpurposesandnotforresale,andthathasappliedtothedirectorofrevenuefor
85authoritytooperateasaleasingcompanymayalsooperateasaregisteredfleetowneras
86prescribedinsection301.032.
87 10.BeginningJuly1,2010,anymotorvehicledealerlicensedundersection301.560
88engagedinthebusinessofsellingmotorvehiclesortrailersshallapplytothedirectorof
89revenueforauthoritytocollectandremitthesalestaxrequiredunderthissectiononallmotor
90vehiclessoldbythemotorvehicledealer.Amotorvehicledealerreceivingauthorityto

92motorvehicledealerauthorizedtocollectandremitsalestaxesonmotorvehiclesunderthis
93subsectionshallbeentitledtodeductandretainanamountequaltotwopercentofthemotor
94vehiclesalestaxpursuanttosection144.140.Anyamountofthetaxcollectedunderthis
95subsectionthatisretainedbyamotorvehicledealerpursuanttosection144.140shallnot
96constitutestaterevenue.Innoeventshallrevenuesfromthegeneralrevenuefundorany
97otherstatefundbeutilizedtocompensatemotorvehicledealersfortheirroleincollectingand
98remittingsalestaxesonmotorvehicles.Intheeventthissubsectionoranyportionthereofis
99heldtoviolateArticleIV,Section30(b)oftheMissouriConstitution,nomotorvehicledealer
100shallbeauthorizedtocollectandremitsalestaxesonmotorvehiclesunderthissection.No
101motorvehicledealershallseekcompensationfromthestateofMissourioritsagenciesifa
102courtofcompetentjurisdictiondeclaresthattheretentionoftwopercentofthemotorvehicle
103salestaxisunconstitutionalandordersthereturnofsuchrevenues.
104 11.(1)Everymotorvehicledealerlicensedundersection301.560,assoonas
105technologicallypossiblefollowingthedevelopmentandmaintenanceofamodernized,
106integratedsystemforthetitlingofvehicles,issuanceandrenewalofvehicleregistrations,
107issuanceandrenewalofdriver'slicensesandidentificationcards,andperfectionandrelease
108ofliensandencumbrancesonvehicles,tobefundedbythemotorvehicleadministration
109technologyfundascreatedinsection301.558,shallcollectandremitthesalestaxrequired
110underthissectiononallmotorvehiclesthatsuchdealersells.Incollectingandremittingthis
111salestax,motorvehicledealersshallbesubjecttoallapplicableprovisionsundersections

113 (2)Thedirectorofrevenuemaypromulgateallnecessaryrulesandregulationsforthe
114administrationofthissubsection.Anyruleorportionofarule,asthattermisdefinedin
115section536.010,thatiscreatedundertheauthoritydelegatedinthissubsectionshallbecome
116effectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter536and,if
117applicable,section536.028.Thissubsectionandchapter536arenonseverableandifanyof

147thissubsection,accrueduptoandafterthedateofapplication.
148 (3)Thedepartmentisencouragedtoworkwiththequalifiedpurchaserto
149establishanequitablepaymentplanthatisnotoverlyburdensomeandtotakeinto
150considerationthequalifiedpurchaser'sincomeandanyotherfinancialobligations.The
151departmentshallestablishthepaymentplanapplicationformsandprocedure,the
152mannerinwhichthepaymentplanmaybeestablishedwiththequalifyingpurchaser,
153andguidelinesforsubmissionofanyadditionalinformationnecessarytoestablisha
154paymentplan,includingproofofincome,proofofpurchase,identificationdocuments,

162anopportunitytoestablishandbeginapaymentplanbeforeDecember31,2026.New
163paymentplanapplicationsshallnotbeacceptedbythedepartmentunderthissection
164afterSeptember30,2026.
HB446	5 165 (5)Uponenteringintoapaymentplan,thequalifiedpurchasershallpayadown
166paymentequaltoonemonth'spayment.Oncethepaymentisreceived,verified,and
167deposited,thedepartmentmayissueanewninety-daytemporarypermittothequalified
168purchaser.Onorbeforetheexpirationoftheninety-daytemporarypermit,the
169qualifiedpurchasermayreceiveanotherninety-daytemporarypermitprovidedthatthe
170qualifiedpurchaseriscurrentonhisorherpaymentplan,andmaycontinuetoreceive
171additionaltemporarypermitsunderthesameconditionsuntileitherthepaymentplan
172iscompletedandthevehicleisproperlyregisteredorthequalifiedpurchaserisno
173longereligibleundertheprovisionsofthissubsection.
174 (6)Paymentstowardstheestablishedpaymentplanmaybemadebymailtothe
175departmentcentralofficeorthequalifiedpurchaser'slocallicenseoffice,inpersonata
176locallicenseoffice,orbyanyothermethodthedepartmentestablishesbyruleorby
177noticeonthedepartmentwebsite.Thedepartmentshallestablishbyrulehowpayments
178aretobeprocessed,howupdatedpaymentcountswillbemadeaccessibletothe
179qualifiedpurchaser,andwhatformsordocumentsthequalifiedpurchaserwillneedto
180carryinhisorhermotorvehicleforpresentationtolawenforcementduringmotor
181vehiclestopsorotherentitiesrequestingverificationofthepaymentplanstatus.
182 (7)Thedepartmentshallissueareceiptuponcompletionofthepaymentplan
183forthequalifiedpurchasertopresenttothelicenseofficetoregisterandlicensethe
184motorvehicle.
185 (8)Ifaqualifiedpurchaserviolatesorfailstomeethisorherobligationsor
186ceasestopayonthepaymentplanestablishedwiththedepartmentbeforethequalified
187amounthasbeenpaidinfull,thepaymentplanshallbeterminated.Thequalified
188purchasershallbegivenfullcreditofallpriorpaymentstowardsthequalifiedamount.
189Ifthequalifiedpurchaserhasfailedtoregisterandlegallylicensethemotorvehicle
190afterterminationofthepaymentplanorafterthequalifiedamounthasbeenpaidin

193 (9)Thedepartmentofrevenuemaypromulgateallnecessaryrulesand
194regulationsfortheadministrationofthissubsection.Anyruleorportionofarule,as
195thattermisdefinedinsection536.010,thatiscreatedundertheauthoritydelegatedin
196thissubsectionshallbecomeeffectiveonlyifitcomplieswithandissubjecttoallofthe
197provisionsofchapter536and,ifapplicable,section536.028.Thissubsectionand
198chapter536arenonseverableandifanyofthepowersvestedwiththegeneralassembly

301.140.1.Uponthetransferofownershipofanymotorvehicleortrailer,the
2certificateofregistrationandtherighttousethenumberplatesshallexpireandthenumber
3platesshallberemovedbytheowneratthetimeofthetransferofpossession,anditshallbe
4unlawfulforanypersonotherthanthepersontowhomsuchnumberplateswereoriginally
HB446	7 5issuedtohavethesameinhisorherpossessionwhetherinuseornot,unlesssuchpossession
6issolelyforcharitablepurposes;exceptthatthebuyerofamotorvehicleortrailerwhotrades
7inamotorvehicleortrailermayattachthelicenseplatesfromthetraded-inmotorvehicleor
8trailertothenewlypurchasedmotorvehicleortrailer.Theoperationofamotorvehiclewith
9suchtransferredplatesshallbelawfulfornomorethanthirtydays,ornomorethanninety
10daysifthedealerissellingthemotorvehicleundertheprovisionsofsection301.213,orno
11morethansixtydaysifthedealerissellingthemotorvehicleundertheprovisionsof
12subsection5ofsection301.210.Asusedinthissubsection,theterm"trade-inmotorvehicle
13ortrailer"shallincludeanysinglemotorvehicleortrailersoldbythebuyerofthenewly
14purchasedvehicleortrailer,aslongasthelicenseplatesforthetrade-inmotorvehicleor
15trailerarestillvalid.
16 2.Inthecaseofatransferofownershiptheoriginalownermayregisteranother
17motorvehicleunderthesamenumber,uponthepaymentofafeeoftwodollars,ifthemotor
18vehicleisofhorsepower,grossweightor(inthecaseofapassenger-carryingcommercial
19motorvehicle)seatingcapacity,notinexcessofthatoriginallyregistered.Whensuchmotor
20vehicleisofgreaterhorsepower,grossweightor(inthecaseofapassenger-carrying
21commercialmotorvehicle)seatingcapacity,forwhichagreaterfeeisprescribed,the
22applicantshallpayatransferfeeoftwodollarsandaprorataportionforthedifferencein
23fees.Whensuchvehicleisoflesshorsepower,grossweightor(incaseofapassenger-
24carryingcommercialmotorvehicle)seatingcapacity,forwhichalesserfeeisprescribed,the
25applicantshallnotbeentitledtoarefund.
26 3.Licenseplatesmaybetransferredfromamotorvehiclewhichwillnolongerbe
27operatedtoanewlypurchasedmotorvehiclebytheownerofsuchvehicles.Theownershall
28payatransferfeeoftwodollarsifthenewlypurchasedvehicleisofhorsepower,grossweight
29or(inthecaseofapassenger-carryingcommercialmotorvehicle)seatingcapacity,notin
30excessofthatofthevehiclewhichwillnolongerbeoperated.Whenthenewlypurchased
31motorvehicleisofgreaterhorsepower,grossweightor(inthecaseofapassenger-carrying
32commercialmotorvehicle)seatingcapacity,forwhichagreaterfeeisprescribed,the
33applicantshallpayatransferfeeoftwodollarsandaprorataportionofthedifferenceinfees.
34Whenthenewlypurchasedvehicleisoflesshorsepower,grossweightor(inthecaseofa
35passenger-carryingcommercialmotorvehicle)seatingcapacity,forwhichalesserfeeis
36prescribed,theapplicantshallnotbeentitledtoarefund.
37 4.Thedirectorofthedepartmentofrevenueshallhaveauthoritytoproduceorallow
38otherstoproduceaweatherresistant,nontearingtemporarypermitauthorizingtheoperation
39ofamotorvehicleortrailerbyabuyerfornotmorethanthirtydays,ornomorethanninety
40daysifissuedbyadealersellingthemotorvehicleundertheprovisionsofsection301.213,or
41nomorethansixtydaysifissuedbyadealersellingthemotorvehicleundertheprovisionsof
HB446	8 42subsection5ofsection301.210,fromthedateofpurchase.Thetemporarypermitauthorized
43underthissectionmaybepurchasedbythepurchaserofamotorvehicleortrailerfromthe
44centralofficeofthedepartmentofrevenueorfromanauthorizedagentofthedepartmentof
45revenueuponproofofpurchaseofamotorvehicleortrailerforwhichthebuyerhasno

49motorvehicleortrailerforwhichthebuyerhasregisteredandisawaitingreceiptof
50registrationplates.Thedirectorofthedepartmentofrevenueoraproducerauthorizedbythe
51directorofthedepartmentofrevenuemaymaketemporarypermitsavailabletoregistered
52dealersinthisstate,authorizedagentsofthedepartmentofrevenueorthedepartmentof
53revenue.Thepricepaidbyamotorvehicledealer,anauthorizedagentofthedepartmentof
54revenueorthedepartmentofrevenueforatemporarypermitshallnotexceedfivedollarsfor
55eachpermit.Thedirectorofthedepartmentofrevenueshalldirectmotorvehicledealersand
56authorizedagentstoobtaintemporarypermitsfromanauthorizedproducer.Amounts
57receivedbythedirectorofthedepartmentofrevenuefortemporarypermitsshallconstitute
58staterevenue;however,amountsreceivedbyanauthorizedproducerotherthanthedirectorof
59thedepartmentofrevenueshallnotconstitutestaterevenueandanyamountsreceivedby
60motorvehicledealersorauthorizedagentsfortemporarypermitspurchasedfromaproducer
61otherthanthedirectorofthedepartmentofrevenueshallnotconstitutestaterevenue.Inno
62eventshallrevenuesfromthegeneralrevenuefundoranyotherstatefundbeutilizedto
63compensatemotorvehicledealersorotherproducersfortheirroleinproducingtemporary
64permitsasauthorizedunderthissection.Amountsthatdonotconstitutestaterevenueunder
65thissectionshallalsonotconstitutefeesforregistrationorcertificatesoftitletobecollected
66bythedirectorofthedepartmentofrevenueundersection301.190.Nomotorvehicledealer,
67authorizedagentorthedepartmentofrevenueshallchargemorethanfivedollarsforeach
68permitissued.Thepermitshallbevalidforaperiodofthirtydays,ornomorethanninety
69daysifissuedbyadealersellingthemotorvehicleundertheprovisionsofsection301.213,or
70nomorethansixtydaysifissuedbyadealersellingthemotorvehicleundertheprovisionsof
71subsection5ofsection301.210,fromthedateofpurchaseofamotorvehicleortrailer,or
72fromthedateofsaleofthemotorvehicleortrailerbyamotorvehicledealerforwhichthe
73purchaserobtainsapermitassetoutabove.Nopermitshallbeissuedforavehicleunderthis
74sectionunlessthebuyershowsproofoffinancialresponsibility.Eachtemporarypermit
75issuedshallbesecurelyfastenedtothebackorrearofthemotorvehicleinamannerand
76placeonthemotorvehicleconsistentwithregistrationplatessothatallpartsandqualitiesof
77thetemporarypermitthereofshallbeplainlyandclearlyvisible,reasonablycleanandarenot
78impairedinanyway.
HB446	9 79 5.Thepermitshallbeissuedonaformprescribedbythedirectorofthedepartmentof
80revenueandissuedonlyfortheapplicant'stemporaryoperationofthemotorvehicleortrailer
81purchasedtoenabletheapplicanttotemporarilyoperatethemotorvehiclewhilepropertitle
82andregistrationplatesarebeingobtained,orwhileawaitingreceiptofregistrationplates,and
83shallbedisplayedonnoothermotorvehicle.Temporarypermitsissuedpursuanttothis
84sectionshallnotbetransferableorrenewable,shallnotbevaliduponissuanceofproper
85registrationplatesforthemotorvehicleortrailer,andshallbereturnedtothedepartmentorto
86thedepartment'sagentupontheissuanceofsuchproperregistrationplates.Anytemporary
87permitreturnedtothedepartmentortothedepartment'sagentshallbeimmediately
88destroyed.Theprovisionsofthissubsectionshallnotapplytotemporarypermitsissuedfor
89commercialmotorvehicleslicensedinexcessoftwenty-fourthousandpoundsgrossweight.
90Thedirectorofthedepartmentofrevenueshalldeterminethesize,material,design,
91numberingconfiguration,construction,andcolorofthepermit.Thedirectorofthe
92departmentofrevenue,athisorherdiscretion,shallhavetheauthoritytoreissue,andthereby
93extendtheuseof,atemporarypermitpreviouslyandlegallyissuedforamotorvehicleor
94trailerwhilepropertitleandregistrationarebeingobtained.
95 6.Everymotorvehicledealerthatissuestemporarypermitsshallkeep,forinspection
96byproperofficers,anaccuraterecordofeachpermitissuedbyrecordingthepermitnumber,
97themotorvehicledealer'snumber,buyer'snameandaddress,themotorvehicle'syear,make,
98andmanufacturer'svehicleidentificationnumber,andthepermit'sdateofissuanceand
99expirationdate.Upontheissuanceofatemporarypermitbyeitherthecentralofficeofthe
100departmentofrevenue,amotorvehicledealeroranauthorizedagentofthedepartmentof
101revenue,thedirectorofthedepartmentofrevenueshallmaketheinformationassociatedwith
102theissuedtemporarypermitimmediatelyavailabletothelawenforcementcommunityofthe
103stateofMissouri.
104 7.Uponthetransferofownershipofanycurrentlyregisteredmotorvehiclewherein
105theownercannottransferthelicenseplatesduetoachangeofmotorvehiclecategory,the
106ownermaysurrenderthelicenseplatesissuedtothemotorvehicleandreceivecreditforany
107unusedportionoftheoriginalregistrationfeeagainsttheregistrationfeeofanothermotor
108vehicle.Suchcreditshallbegrantedbaseduponthedatethelicenseplatesaresurrendered.
109Norefundsshallbemadeontheunusedportionofanylicenseplatessurrenderedforsuch
110credit.
111 8.Anadditionaltemporarylicenseplateproducedinamannerandofmaterials
112determinedbythedirectortobethemostcost-effectivemeansofproductionwitha
113configurationthatmatchesanexistingornewlyissuedplatemaybepurchasedbyamotor
114vehicleownertobeplacedintheinteriorofthevehicle'srearwindowsuchthatthedriver's
115viewoutoftherearwindowisnotobstructedandtheplateconfigurationisclearlyvisible
