7inamotorvehicleortrailermayattachthelicenseplatesfromthetraded-inmotorvehicleor 8trailertothenewlypurchasedmotorvehicleortrailer.Theoperationofamotorvehiclewith 9suchtransferredplatesshallbelawfulfornomorethanthirtydays,ornomorethanninety 10daysifthedealerissellingthemotorvehicleundertheprovisionsofsection301.213,orno 11morethansixtydaysifthedealerissellingthemotorvehicleundertheprovisionsof 12subsection5ofsection301.210.Asusedinthissubsection,theterm"trade-inmotorvehicle 13ortrailer"shallincludeanysinglemotorvehicleortrailersoldbythebuyerofthenewly 14purchasedvehicleortrailer,aslongasthelicenseplatesforthetrade-inmotorvehicleor 15trailerarestillvalid. 16 2.Inthecaseofatransferofownershiptheoriginalownermayregisteranother 17motorvehicleunderthesamenumber,uponthepaymentofafeeoftwodollars,ifthemotor 18vehicleisofhorsepower,grossweightor(inthecaseofapassenger-carryingcommercial 19motorvehicle)seatingcapacity,notinexcessofthatoriginallyregistered.Whensuchmotor 20vehicleisofgreaterhorsepower,grossweightor(inthecaseofapassenger-carrying 21commercialmotorvehicle)seatingcapacity,forwhichagreaterfeeisprescribed,the 22applicantshallpayatransferfeeoftwodollarsandaprorataportionforthedifferencein 23fees.Whensuchvehicleisoflesshorsepower,grossweightor(incaseofapassenger- 24carryingcommercialmotorvehicle)seatingcapacity,forwhichalesserfeeisprescribed,the 25applicantshallnotbeentitledtoarefund. 26 3.Licenseplatesmaybetransferredfromamotorvehiclewhichwillnolongerbe 27operatedtoanewlypurchasedmotorvehiclebytheownerofsuchvehicles.Theownershall 28payatransferfeeoftwodollarsifthenewlypurchasedvehicleisofhorsepower,grossweight 29or(inthecaseofapassenger-carryingcommercialmotorvehicle)seatingcapacity,notin 30excessofthatofthevehiclewhichwillnolongerbeoperated.Whenthenewlypurchased 31motorvehicleisofgreaterhorsepower,grossweightor(inthecaseofapassenger-carrying 32commercialmotorvehicle)seatingcapacity,forwhichagreaterfeeisprescribed,the 33applicantshallpayatransferfeeoftwodollarsandaprorataportionofthedifferenceinfees. 34Whenthenewlypurchasedvehicleisoflesshorsepower,grossweightor(inthecaseofa 35passenger-carryingcommercialmotorvehicle)seatingcapacity,forwhichalesserfeeis 36prescribed,theapplicantshallnotbeentitledtoarefund. 37 4.Thedirectorofthedepartmentofrevenueshallhaveauthoritytoproduceorallow 38otherstoproduceaweatherresistant,nontearingtemporarypermitauthorizingtheoperation 39ofamotorvehicleortrailerbyabuyerfornotmorethanthirtydays,ornomorethanninety 40daysifissuedbyadealersellingthemotorvehicleundertheprovisionsofsection301.213,or 41nomorethansixtydaysifissuedbyadealersellingthemotorvehicleundertheprovisionsof HB446 8 42subsection5ofsection301.210,fromthedateofpurchase.Thetemporarypermitauthorized 43underthissectionmaybepurchasedbythepurchaserofamotorvehicleortrailerfromthe 44centralofficeofthedepartmentofrevenueorfromanauthorizedagentofthedepartmentof 45revenueuponproofofpurchaseofamotorvehicleortrailerforwhichthebuyerhasno 46registrationplateavailablefortransferanduponproofoffinancialresponsibility,orfroma 47motorvehicledealeruponpurchaseofamotorvehicleortrailerforwhichthebuyerhasno 48registrationplateavailablefortransfer,orfromamotorvehicledealeruponpurchaseofa 49motorvehicleortrailerforwhichthebuyerhasregisteredandisawaitingreceiptof 50registrationplates.Thedirectorofthedepartmentofrevenueoraproducerauthorizedbythe 51directorofthedepartmentofrevenuemaymaketemporarypermitsavailabletoregistered 52dealersinthisstate,authorizedagentsofthedepartmentofrevenueorthedepartmentof 53revenue.Thepricepaidbyamotorvehicledealer,anauthorizedagentofthedepartmentof 54revenueorthedepartmentofrevenueforatemporarypermitshallnotexceedfivedollarsfor 55eachpermit.Thedirectorofthedepartmentofrevenueshalldirectmotorvehicledealersand 56authorizedagentstoobtaintemporarypermitsfromanauthorizedproducer.Amounts 57receivedbythedirectorofthedepartmentofrevenuefortemporarypermitsshallconstitute 58staterevenue;however,amountsreceivedbyanauthorizedproducerotherthanthedirectorof 59thedepartmentofrevenueshallnotconstitutestaterevenueandanyamountsreceivedby 60motorvehicledealersorauthorizedagentsfortemporarypermitspurchasedfromaproducer 61otherthanthedirectorofthedepartmentofrevenueshallnotconstitutestaterevenue.Inno 62eventshallrevenuesfromthegeneralrevenuefundoranyotherstatefundbeutilizedto 63compensatemotorvehicledealersorotherproducersfortheirroleinproducingtemporary 64permitsasauthorizedunderthissection.Amountsthatdonotconstitutestaterevenueunder 65thissectionshallalsonotconstitutefeesforregistrationorcertificatesoftitletobecollected 66bythedirectorofthedepartmentofrevenueundersection301.190.Nomotorvehicledealer, 67authorizedagentorthedepartmentofrevenueshallchargemorethanfivedollarsforeach 68permitissued.Thepermitshallbevalidforaperiodofthirtydays,ornomorethanninety 69daysifissuedbyadealersellingthemotorvehicleundertheprovisionsofsection301.213,or 70nomorethansixtydaysifissuedbyadealersellingthemotorvehicleundertheprovisionsof 71subsection5ofsection301.210,fromthedateofpurchaseofamotorvehicleortrailer,or 72fromthedateofsaleofthemotorvehicleortrailerbyamotorvehicledealerforwhichthe 73purchaserobtainsapermitassetoutabove.Nopermitshallbeissuedforavehicleunderthis 74sectionunlessthebuyershowsproofoffinancialresponsibility.Eachtemporarypermit 75issuedshallbesecurelyfastenedtothebackorrearofthemotorvehicleinamannerand 76placeonthemotorvehicleconsistentwithregistrationplatessothatallpartsandqualitiesof 77thetemporarypermitthereofshallbeplainlyandclearlyvisible,reasonablycleanandarenot 78impairedinanyway. HB446 9 79 5.Thepermitshallbeissuedonaformprescribedbythedirectorofthedepartmentof 80revenueandissuedonlyfortheapplicant'stemporaryoperationofthemotorvehicleortrailer 81purchasedtoenabletheapplicanttotemporarilyoperatethemotorvehiclewhilepropertitle 82andregistrationplatesarebeingobtained,orwhileawaitingreceiptofregistrationplates,and 83shallbedisplayedonnoothermotorvehicle.Temporarypermitsissuedpursuanttothis 84sectionshallnotbetransferableorrenewable,shallnotbevaliduponissuanceofproper 85registrationplatesforthemotorvehicleortrailer,andshallbereturnedtothedepartmentorto 86thedepartment'sagentupontheissuanceofsuchproperregistrationplates.Anytemporary 87permitreturnedtothedepartmentortothedepartment'sagentshallbeimmediately 88destroyed.Theprovisionsofthissubsectionshallnotapplytotemporarypermitsissuedfor 89commercialmotorvehicleslicensedinexcessoftwenty-fourthousandpoundsgrossweight. 90Thedirectorofthedepartmentofrevenueshalldeterminethesize,material,design, 91numberingconfiguration,construction,andcolorofthepermit.Thedirectorofthe 92departmentofrevenue,athisorherdiscretion,shallhavetheauthoritytoreissue,andthereby 93extendtheuseof,atemporarypermitpreviouslyandlegallyissuedforamotorvehicleor 94trailerwhilepropertitleandregistrationarebeingobtained. 95 6.Everymotorvehicledealerthatissuestemporarypermitsshallkeep,forinspection 96byproperofficers,anaccuraterecordofeachpermitissuedbyrecordingthepermitnumber, 97themotorvehicledealer'snumber,buyer'snameandaddress,themotorvehicle'syear,make, 98andmanufacturer'svehicleidentificationnumber,andthepermit'sdateofissuanceand 99expirationdate.Upontheissuanceofatemporarypermitbyeitherthecentralofficeofthe 100departmentofrevenue,amotorvehicledealeroranauthorizedagentofthedepartmentof 101revenue,thedirectorofthedepartmentofrevenueshallmaketheinformationassociatedwith 102theissuedtemporarypermitimmediatelyavailabletothelawenforcementcommunityofthe 103stateofMissouri. 104 7.Uponthetransferofownershipofanycurrentlyregisteredmotorvehiclewherein 105theownercannottransferthelicenseplatesduetoachangeofmotorvehiclecategory,the 106ownermaysurrenderthelicenseplatesissuedtothemotorvehicleandreceivecreditforany 107unusedportionoftheoriginalregistrationfeeagainsttheregistrationfeeofanothermotor 108vehicle.Suchcreditshallbegrantedbaseduponthedatethelicenseplatesaresurrendered. 109Norefundsshallbemadeontheunusedportionofanylicenseplatessurrenderedforsuch 110credit. 111 8.Anadditionaltemporarylicenseplateproducedinamannerandofmaterials 112determinedbythedirectortobethemostcost-effectivemeansofproductionwitha 113configurationthatmatchesanexistingornewlyissuedplatemaybepurchasedbyamotor 114vehicleownertobeplacedintheinteriorofthevehicle'srearwindowsuchthatthedriver's 115viewoutoftherearwindowisnotobstructedandtheplateconfigurationisclearlyvisible HB446 10 116fromtheoutsideofthevehicletoserveasthevisibleplatewhenabicyclerackorotheritem 117obstructstheviewoftheactualplate.Suchtemporaryplateisonlyauthorizedforusewhen 118thematchingactualplateisaffixedtothevehicleinthemannerprescribedinsubsection5of 119section301.130.Thefeechargedforthetemporaryplateshallbeequaltothefeechargedfor 120atemporarypermitissuedundersubsection4ofthissection.Replacementtemporaryplates 121authorizedinthissubsectionmaybeissuedasneededuponthepaymentofafeeequaltothe 122feechargedforatemporarypermitundersubsection4ofthissection.Thenewlyproduced 123thirdplatemayonlybeusedonthevehiclewiththematchingplate,andtheadditionalplate 124shallbeclearlyrecognizableasathirdplateandonlyusedforthepurposespecifiedinthis 125subsection. 126 9.Notwithstandingtheprovisionsofsection301.217,thedirectormayissuea 127temporarypermittoanindividualwhopossessesasalvagemotorvehiclewhichrequiresan 128inspectionundersubsection9ofsection301.190.Theoperationofasalvagemotorvehicle 129forwhichthepermithasbeenissuedshallbelimitedtothemostdirectroutefromthe 130residence,maintenance,orstoragefacilityoftheindividualinpossessionofsuchmotor 131vehicletothenearestauthorizedinspectionfacilityandreturntotheoriginatinglocation. 132Notwithstandinganyotherrequirementsfortheissuanceofatemporarypermitunderthis 133section,anindividualobtainingatemporarypermitforthepurposeofoperatingamotor 134vehicletoandfromanexaminationfacilityasprescribedinthissubsectionshallalso 135purchasetherequiredmotorvehicleexaminationformwhichisrequiredtobecompletedfor 136anexaminationundersubsection9ofsection301.190andprovidesatisfactoryevidencethat 137suchvehiclehaspassedamotorvehiclesafetyinspectionforsuchvehicleasrequiredin 138section307.350. 139 10.BeginningonOctober1,2025,andendingonDecember31,2026, 140notwithstandingtheprovisionsofanyotherlawtothecontrary,thedirectormayissuea 141ninety-daytemporarypermittoanindividualwhoestablishesapaymentplanwiththe 142departmentofrevenueundersection144.070andmayissueadditionaltemporary 143permitstosuchindividualswhoremainincompliancewiththepaymentplanprovisions 144undersubsection12ofsection144.070,subjecttothesunsetprovisionsundersubsection 14512ofsection144.070. 146 11.Thedirectorofthedepartmentofrevenuemaypromulgateallnecessaryrulesand 147regulationsfortheadministrationofthissection.Anyruleorportionofarule,asthattermis 148definedinsection536.010,thatiscreatedundertheauthoritydelegatedinthissectionshall 149becomeeffectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter536 150and,ifapplicable,section536.028.Thissectionandchapter536arenonseverableandifany 151ofthepowersvestedwiththegeneralassemblypursuanttochapter536toreview,todelaythe 152effectivedate,ortodisapproveandannularulearesubsequentlyheldunconstitutional,then HB446 11 153thegrantofrulemakingauthorityandanyruleproposedoradoptedafterAugust28,2012, 154shallbeinvalidandvoid. 157revenuebeginsproducingtemporarypermitsdescribedinsubsection4ofsuchsection,oron 158July1,2013,whicheveroccursfirst.Ifthedirectorofrevenueoraproducerauthorizedby
