210boardandstaffofthecharterschoolshalljointlyreviewtheschool'sperformance, 211managementandoperationsduringthefirstyearofoperationandtheneveryotheryearafter HB447 12 212themostrecentrevieworatanypointwheretheoperationormanagementofthecharter 213schoolischangedortransferredtoanotherentity,eitherpublicorprivate.Thegoverning 214boardofacharterschoolmayamendthecharter,ifthesponsorapprovessuchamendment,or 215thesponsorandthegoverningboardmayreachanagreementinwritingtoreflectthecharter a.Thecharterschoolprovidesahighschoolprogramwhichfailstomaintaina 237graduationrateofatleastseventypercentinthreeofthelastfourschoolyearsunlessthe 238schoolhasdropoutrecoveryasitsmission; 239 306160.425andsection167.349andtheschool'sperformancecontractincludingbutnotlimited 307tothoserequirementsspecifictoacademicperformance. 308 (b)Alongwithdatareflectingtheacademicperformancestandardsindicatedin 309paragraph(a)ofthissubdivision,thesponsorshallsubmitarevisedcharterapplicationtothe 310stateboardofeducationforreview. 311 (c)Usingthedatarequestedandtherevisedcharterapplicationunderparagraphs(a) 312and(b)ofthissubdivision,thestateboardofeducationshalldetermineifcompliancewithall 313standardsenumeratedinthissubdivisionhasbeenachieved.Thestateboardofeducationat 314itsnextregularlyscheduledmeetingshallvoteontherevisedcharterapplication. 315 (d)Ifacharterschoolsponsordemonstratestheobjectivesidentifiedinthis 316subdivision,thestateboardofeducationshallrenewtheschool'scharter. 317 10.Aschooldistrictmayenterintoaleasewithacharterschoolforphysical 318facilities. 319 11.Agoverningboardoraschooldistrictemployeewhohascontroloverpersonnel 320actionsshallnottakeunlawfulreprisalagainstanotheremployeeattheschooldistrictbecause 321theemployeeisdirectlyorindirectlyinvolvedinanapplicationtoestablishacharterschool. 322Agoverningboardoraschooldistrictemployeeshallnottakeunlawfulreprisalagainstan HB447 15 323educationalprogramoftheschoolortheschooldistrictbecauseanapplicationtoestablisha 324charterschoolproposestheconversionofalloraportionoftheeducationalprogramtoa 325charterschool.Asusedinthissubsection,"unlawfulreprisal"meansanactionthatistaken 326byagoverningboardoraschooldistrictemployeeasadirectresultofalawfulapplicationto 327establishacharterschoolandthatisadversetoanotheremployeeoraneducationalprogram. 328 12.Charterschoolboardmembersshallbesubjecttothesameliabilityforactswhile 329inofficeasiftheywereregularlyanddulyelectedmembersofschoolboardsinanyother 330publicschooldistrictinthisstate.Thegoverningboardofacharterschoolmayparticipate,to 331thesameextentasaschoolboard,intheMissouripublicentityriskmanagementfundinthe 332mannerprovidedundersections537.700to537.756. 333 13.Anyentity,eitherpublicorprivate,operating,administering,orotherwise 334managingacharterschoolshallbeconsideredaquasi-publicgovernmentalbodyandsubject 335totheprovisionsofsections610.010to610.035. 336 14.Thechieffinancialofficerofacharterschoolshallmaintain: 337 (1)Asuretybondinanamountdeterminedbythesponsortobeadequatebasedon 338thecashflowoftheschool;or 339 (2)Aninsurancepolicyissuedbyaninsurancecompanylicensedtodobusinessin 340Missourionallemployeesintheamountoffivehundredthousanddollarsormorethat 341providescoverageintheeventofemployeetheft. 342 15.Thedepartmentofelementaryandsecondaryeducationshallcalculateanannual 343performancereportforeachcharterschoolandshallpublishitinthesamemannerasannual 344performancereportsarecalculatedandpublishedfordistrictsandattendancecenters. 345 16.Thejointcommitteeoneducationshallcreateacommitteetoinvestigatefacility 346accessandaffordabilityforcharterschools.Thecommitteeshallbecomprisedofequal 347numbersofthecharterschoolsectorandthepublicschoolsectorandshallreportitsfindings 348tothegeneralassemblybyDecember31,2016. 160.422.1.Anycitynotwithinacountyshallnotadopt,enforce,impose,or 2administeranordinance,localpolicy,orlocalresolutionthatprohibitspropertysold, 3leased,ortransferredbythecitynotwithinacountyfrombeingusedforanylawful 4educationalpurposebyacharterschool. 5 2.Anycitynotwithinacountyshallnotimpose,enforce,orapplyanydeed 6restrictionthatexpressly,orbyitsoperation,prohibitspropertysold,leased,or 7transferredbythecitynotwithinacountyfrombeingusedforanylawfuleducational 8purposebyacharterschool.Anydeedrestrictionoraffirmative-usedeedrestriction 9thataffirmativelyallowsforonlyoneormorespecifiedusesorpurposesthatdonot 10includeanyeducationaluseorpurposeisprohibitedunderthissection.Anydeed 11restrictionoraffirmative-usedeedrestrictionineffectontheeffectivedateofthis HB447 16 12sectionthatprohibitsordoesnotpermitpropertypreviouslyusedforanyeducational 13purposefrombeingusedforanyfutureeducationalpurposeisvoid. 14 3.Ifanycitynotwithinacountyofferspropertyofthecitynotwithinacounty 15forsale,lease,orrent,thecitynotwithinacountyshallnotrefusetosell,lease,orrent 16thepropertytoacharterschoolsolelybecausethecharterschoolintendstousethe 17propertyforaneducationalpurpose,iftheintentofthecharterschoolistousethe 18propertyforalawfuleducationalpurpose.Ifthecitynotwithinacountyoffers 19propertyofthecitynotwithinacountyforsale,lease,orrent,thecitynotwithina 20countyisnotrequiredtosell,lease,orrentthepropertytoacharterschoolsolely 21becausethecharterschoolintendstousethepropertyforaneducationalpurpose. 22 4.Anyordinance,policy,regulation,deed,orcontractmadeinviolationofthis 23sectionshallbevoidfromitsinception. 160.425.1.The"MissouriCharterPublicSchoolCommission"isherebycreated 2withtheauthoritytosponsorhighqualitycharterschoolsthroughoutthestateofMissouri. 3 2.Thecommissionshallconsistofninemembersappointedbythegovernor,byand 4withtheadviceandconsentofthesenate.Nomorethanfiveofthemembersshallbeofthe 5samepoliticalparty.Nomorethantwomembersshallbefromthesamecongressional 6district.Thetermofofficeofeachmembershallbefouryears,exceptthoseofthemembers 7firstappointed,ofwhichthreeshallbeappointedforatermofoneyear,twoforatermoftwo 8years,twoforatermofthreeyears,andtwoforatermoffouryears.Attheexpirationofthe 9termofeachmember,thegovernor,byandwiththeadviceandconsentofthesenate,shall 10appointasuccessor. 11 3.Theappointeestothecommissionshallbeselectedasfollows: 12 4.Membersappointedtothecommissionshallcollectivelypossessstrongexperience 24andexpertiseingovernance,managementandfinance,schoolleadership,assessment, 25curriculumandinstruction,andeducationlaw.Allmembersofthecommissionshallhave HB447 17 26demonstratedunderstandingofandcommitmenttocharterschoolingasastrategyfor 27strengtheningpubliceducation. 28 5.Thecommissionshallannuallyelecta[chairperson] chairandvice[chairperson] 29chair, whoshallactas[chairperson] chairin[hisorher]thechair'sabsence.The 30commissionshallmeetatthecallofthe[chairperson] chair. The[chairperson] chairmay 31callmeetingsatsuchtimesas[heorshe]thechairdeemsadvisableandshallcallameeting 32whenrequestedtodosobythreeormoremembersofthecommission.Membersofthe 33commissionarenoteligibletoreceivecompensation. 34 6.Thecommissionmayapproveproposedchartersforitssponsorshipundersections 35160.400to160.425andshall: 36 (1)Complywithalloftherequirementsapplicabletosponsorsundersections 37160.400to160.425; 38 (2)Exercisesponsorshipoverchartersapprovedbythecommissionundersections 39160.400to160.425,includingreceiptofsponsorshipfundingundersubsection[11]9of 40section160.400.Sponsorshipfundingduetothecommissionshallbedepositedtothecredit 41ofthecharterpublicschoolcommissionrevolvingfundcreatedpursuanttothissection. 42 7.Charterschoolssponsoredbythecommissionshallcomplywithallofthe 43requirementsapplicabletocharterschoolsundersections160.400to160.425. 44 8.Thecommissionshallconductitsbusinessinaccordancewithchapter610. 45 9.Thedepartmentofelementaryandsecondaryeducationshallprovidestart-up 46fundingforthecommissiontooperate.Thecommissionshallreimbursethedepartment's 47costsfromanyfundsitreceivesassponsorundersection160.400. 48 10.Thecommissionisauthorizedtoreceiveandexpendgifts,grants,anddonations 49ofanykindfromanypublicorprivateentitytocarryoutthepurposesofsections160.400to 50160.425,subjecttothetermsandconditionsunderwhichtheyaregiven,providedthatall 51suchtermsandconditionsarepermissibleunderlaw. 52 11.Thereisherebycreatedinthestatetreasurythe"CharterPublicSchool 53CommissionRevolvingFund",whichshallconsistofmoneyscollectedunderthissection. 54Thestatetreasurershallbecustodianofthefund.Inaccordancewithsections30.170and 5530.180,thestatetreasurermayapprovedisbursements.Notwithstandingtheprovisionsof 56section33.080tothecontrary,anymoneysremaininginthefundattheendofthebiennium 57shallnotreverttothecreditofthegeneralrevenuefund.Thestatetreasurershallinvest 58moneysinthefundinthesamemannerasotherfundsareinvested.Subjecttoappropriation, 59moneysinthefundshallbeusedsolelyfortheadministrationofthissection. ✔ HB447 18
