7 (3)Inaschooldistrictthathasbeenclassifiedasunaccreditedbythestateboardof
8education;
9 (4)Inaschooldistrictthathasbeenclassifiedasprovisionallyaccreditedbythestate
10boardofeducationandhasreceivedscoresonitsannualperformancereportconsistentwitha
11classificationofprovisionallyaccreditedorunaccreditedforthreeconsecutiveschoolyears
12beginningwiththe2012-13accreditationyearunderthefollowingconditions:
13 (a)Theeligibilityforcharterschoolsofanyschooldistrictwhoseprovisional

78expansioniscompletetotheextentofgradelevelsincomparableschoolsofthedistrictin

99 [10.]8.Acharterschoolmayaffiliatewithafour-yearcollegeoruniversity,including
100aprivatecollegeoruniversity,oracommunitycollegeasotherwisespecifiedinsubsection3

102communitycollege.Affiliationstatusrecognizesarelationshipbetweenthecharterschool
103andthecollegeoruniversityforpurposesofteachertrainingandstaffdevelopment,
104curriculumandassessmentdevelopment,useofphysicalfacilitiesownedbyorrentedon
105behalfofthecollegeoruniversity,andothersimilarpurposes.Auniversity,collegeor
106communitycollege[may] shallnotchargeoracceptafeeforaffiliationstatus.
107 [11.]9.Theexpensesassociatedwithsponsorshipofcharterschoolsshallbedefrayed
108bythedepartmentofelementaryandsecondaryeducationretainingoneandfive-tenths
109percentoftheamountofstateandlocalfundingallocatedtothecharterschoolundersection
110160.415,nottoexceedonehundredtwenty-fivethousanddollars,adjustedforinflation.The
111departmentofelementaryandsecondaryeducationshallremittheretainedfundsforeach
112charterschooltotheschool'ssponsor,providedthesponsorremainsingoodstandingby
113fulfillingitssponsorshipobligationsundersections160.400to160.425and167.349with
114regardtoeachcharterschoolitsponsors,includingappropriatedemonstrationofthe

4districtinwhichthecharterschoolistobelocatedandtothestateboardofeducation,within
5fivebusinessdaysofthedatetheapplicationisfiledwiththeproposedsponsor.Theschool
6boardmayfileobjectionswiththeproposedsponsor,and,ifacharterisgranted,theschool
7boardmayfileobjectionswiththestateboardofeducation.Thechartershallincludea
8legallybindingperformancecontractthatdescribestheobligationsandresponsibilitiesofthe

69 2.Proposedchartersshallbesubjecttothefollowingrequirements:
70 (1)Achartershallbesubmittedtothesponsor,andfollowthesponsor'spoliciesand
71proceduresforreviewandgrantingofacharterapproval,andbeapprovedbythestateboard
72ofeducationbyJanuarythirty-firstpriortotheschoolyearoftheproposedopeningdateof
73thecharterschool;
74 (2)Achartermaybeapprovedwhenthesponsordeterminesthattherequirementsof
75thissectionaremet,determinesthattheapplicantissufficientlyqualifiedtooperateacharter
76school,andthattheproposedcharterisconsistentwiththesponsor'schartersponsorship
77goalsandcapacity.Thesponsor'sdecisionofapprovalordenialshallbemadewithinninety
78daysofthefilingoftheproposedcharter;
79 (3)Ifthecharterisdenied,theproposedsponsorshallnotifytheapplicantinwriting
80astothereasonsforitsdenialandforwardacopytothestateboardofeducationwithinfive
81businessdaysfollowingthedenial;
82 (4)Ifaproposedcharterisdeniedbyasponsor,theproposedchartermaybe
83submittedtothestateboardofeducation,alongwiththesponsor'swrittenreasonsforits
84denial.Ifthestateboarddeterminesthattheapplicantmeetstherequirementsofthissection,
85thattheapplicantissufficientlyqualifiedtooperatethecharterschool,andthatgrantinga
86chartertotheapplicantwouldbelikelytoprovideeducationalbenefittothechildrenofthe
87district,thestateboardmaygrantacharterandactassponsorofthecharterschool.Thestate
88boardshallreviewtheproposedcharterandmakeadeterminationofwhethertodenyorgrant
89theproposedcharterwithinsixtydaysofreceiptoftheproposedcharter,providedthatany
90chartertobeconsideredbythestateboardofeducationunderthissubdivisionshallbe
91submittednolaterthanMarchfirstpriortotheschoolyearinwhichthecharterschoolintends
92tobeginoperations.Thestateboardofeducationshallnotifytheapplicantinwritingasthe
93reasonsforitsdenial,ifapplicable;and
94 (5)Thesponsorofacharterschoolshallgiveprioritytocharterschoolapplicantsthat
