BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section160.263,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection160.263,toreadasfollows:
160.263.1.Asusedinthissection,thefollowingtermsmean:
2 (1)"Mechanicalrestraint",theuseofanydeviceorequipmenttorestrictastudent's
3freedomofmovement.Mechanicalrestraintshallnotincludedevicesimplementedbytrained
4personnelorusedbyastudentwithaprescriptionforsuchdevicesfromanappropriate
5medicalorrelatedservicesprofessionalandthatareusedforspecificandapprovedpurposes
6forwhichsuchdevicesweredesigned,suchasthefollowing:
7 (a)Adaptivedevicesormechanicalsupportsusedtoachieveproperbodyposition,
8balance,oralignmenttoallowgreaterfreedomofmobilitythanwouldbepossiblewithoutthe
9useofsuchdevicesormechanicalsupports;
10 (b)Vehiclesafetyrestraintswhenusedasintendedduringthetransportofastudentin
11amovingvehicle;
12 (c)Restraintsformedicalimmobilization;or
13 (d)Orthopedicallyprescribeddevicesthatpermitastudenttoparticipateinactivities
14withoutrisk;
15 (2)"Physicalrestraint",apersonalrestrictionsuchasperson-to-personphysical
16contactthatimmobilizes,reduces,orrestrictstheabilityofastudenttomovethestudent's
17torso,arms,legs,orheadfreely.Physicalrestraintshallnotinclude:

19arm,shoulder,orbackforthepurposeofinducingastudenttowalktoasafelocation;
20 (b)Comfortingorcalmingastudent;
21 (c)Holdingastudent'shandtotransportthestudentforsafetypurposes;
22 (d)Interveninginafight;or
23 (e)Usinganassistiveorprotectivedeviceprescribedbyanappropriatelytrained
24professionalorprofessionalteam;
25 (3)"Pronerestraint",usingmechanicalorphysicalrestraintorbothtorestricta
26student'smovementwhilethestudentislyingwiththestudent'sfrontorfacedownward;
27 (4)"Restraint"includes,butisnotlimitedto,mechanicalrestraint,physicalrestraint,
28andpronerestraint;
29 (5)"Seclusion",theinvoluntaryconfinementofastudentaloneinaroomorareathat
30thestudentisphysicallypreventedfromleavingandthatcomplieswiththebuildingcodein
31effectintheschooldistrict.Seclusionshallnotincludethefollowing:
32 (a)Atimeout,whichisabehaviormanagementtechniquethatispartofanapproved
33program,involvesthemonitoredseparationofthestudentinanonlockedsetting,andis
34implementedforthepurposeofcalming;
35 (b)In-schoolsuspension;
36 (c)Detention;or
37 (d)Otherappropriatedisciplinarymeasures.
38 2.[Theschooldisciplinepolicyundersection160.261shallreserveconfininga
39studentinseclusionforsituationsorconditionsinwhichthereisimminentdangerofphysical
40harmtoselforothers.
41 3.]ForallschoolyearsbeginningonorafterJuly1,2022,noschooldistrict,charter
42school,orpubliclycontractedprivateprovidershalluseanymechanical,physical,orprone
43restrainttechniquethat:
44 (1)Obstructsviewsofthestudent'sface;
45 (2)Obstructsthestudent'srespiratoryairway,impairsthestudent'sbreathingor
46respiratorycapacity,orrestrictsthemovementrequiredfornormalbreathingtocause
47positionalorposturalasphyxia;
48 (3)Placespressureorweightonorcausesthecompressionofthestudent'schest,
49lungs,sternum,diaphragm,back,abdomen,orgenitals;
50 (4)Obstructsthestudent'scirculationofblood;
51 (5)Involvespushingonorintothestudent'smouth,nose,eyes,oranypartoftheface
52orinvolvescoveringthefaceorbodywithanythingincluding,butnotlimitedto,softobjects
53suchaspillows,blankets,orwashcloths;

55condition;
56 (7)Ispurposelydesignedtoinflictpain;
57 (8)Restrictsthestudentfromcommunicating.Ifanemployeephysicallyrestrainsa
58studentwhousessignlanguageoranaugmentativemodeofcommunicationasthestudent's
59primarymodeofcommunication,thestudentshallbepermittedtohavethestudent'shands
60freeofrestraintforbriefperiodsunlessanemployeedeterminesthatsuchfreedomappears
61likelytoresultinharmtoselforothers.
62 [4.]3.(1)ByJuly1,2011,thelocalboardofeducationofeachschooldistrictshall
63adoptawrittenpolicythatcomprehensivelyaddressestheuseofrestrictivebehavioral
64interventionsasaformofdisciplineorbehaviormanagementtechnique.Thepolicyshallbe
65consistentwithprofessionallyacceptedpracticesandstandardsofstudentdiscipline,behavior
66management,healthandsafety,includingthesafeschoolsact.Thepolicyshallincludebut
67notbelimitedto:
68 (a)Definitionsofrestraint,seclusion,andtime-outandanyotherterminology
69necessarytodescribethecontinuumofrestrictivebehavioralinterventionsavailableforuse
70orprohibitedinthedistrict,consistentwiththeprovisionsofthissection;
71 (b)Descriptionofcircumstancesunderwhicharestrictivebehavioralinterventionis
72allowedandprohibited,consistentwiththeprovisionsofthissection,andanyunique
73applicationrequirementsforspecificgroupsofstudentssuchasdifferencesbasedonage,
74disability,orenvironmentinwhichtheeducationalservicesareprovided;
75 (c)Specificimplementationrequirementsassociatedwitharestrictivebehavioral
76interventionsuchastimelimits,facilityspecifications,trainingrequirementsorsupervision
77requirements;and
78 (d)Documentation,noticeandpermissionrequirementsassociatedwithuseofa
79restrictivebehavioralintervention.
80 (2)BeforeJuly1,2022,eachwrittenpolicyadoptedunderthissubsectionshallbe
81updatedtoprohibittheschooldistrict,charterschool,orpubliclycontractedprivateprovider
82fromusinganyrestraintthatemploysanytechniquelistedinsubsection3ofthissection.
83 (3)BeforeJuly1,2022,eachwrittenpolicyadoptedunderthissubsectionshallbe
84updatedtostatethattheschooldistrict,charterschool,orpubliclycontractedprivateprovider
85willreserverestraintorseclusionforsituationsorconditionsinwhichthereisimminent
86dangerofphysicalharmtoselforothers.
87 [5.]4.BeforeJuly1,2022,eachschooldistrict,charterschool,andpublicly
88contractedprivateprovidershallensurethatthepolicyadoptedundersubsection[4]3ofthis
89sectionrequiresthefollowing:
HB455	3 90 (1)Anystudentplacedinseclusionorrestraintshallberemovedfromsuchseclusion
91orrestraintassoonastheschooldistrict,charterschool,orpubliclycontractedprivate
92providerdeterminesthatthestudentisnolongeranimminentdangerofphysicalharmtoself
93orothers;
94 (2)Allschooldistrict,charterschool,andpubliclycontractedprivateprovider
95personnelshallannuallyreviewthepolicyandproceduresinvolvingtheuseofseclusionand
96restraint.Personnelwhouseseclusionorrestraintshallannuallycompletemandatory
97traininginthespecificseclusionandrestrainttechniquestheschooldistrict,charterschool,or
98publiclycontractedprivateproviderusesunderthissection;
99 (3)(a)Eachtimeseclusionorrestraintisusedforastudent,theincidentshallbe
100monitoredbyamemberoftheschooldistrict,charterschool,orpubliclycontractedprivate
101providerpersonnel,andareportshallbecompletedbytheschooldistrict,charterschool,or
102publiclycontractedprivateproviderthatcontains,ataminimum,thefollowing:
103 a.Thedate,timeofday,location,duration,anddescriptionoftheincidentand
104interventions;
105 b.Anyeventleadingtotheincidentandthereasonforusingseclusionorrestraint;
106 c.Adescriptionofthemethodsofseclusionorrestraintused;
107 d.Thenatureandextentofanyinjurytothestudent;
108 e.Thenames,roles,andcertificationsofeachemployeeinvolvedintheuseof
109seclusionorrestraint;
110 f.Thename,role,andsignatureofthepersonwhopreparedthereport;
111 g.Thenameofanemployeewhomtheparentorguardiancancontactregardingthe
112incidentanduseofseclusionorrestraint;
113 h.Thenameofanemployeetocontactiftheparentorguardianwishestofilea
114complaint;and
115 i.Astatementdirectingparentsandlegalguardianstoasociological,emotional,or
116behavioralsupportorganizationandahotlinenumbertoreportchildabuseandneglect.
117 (b)Theschooldistrict,charterschool,orpubliclycontractedprivateprovidershall
118maintainthereportasaneducationrecordofthestudent,provideacopytotheparentorlegal
119guardianwithinfiveschooldays,andacopyofeachincidentreportshallbegiventothe
120departmentofelementaryandsecondaryeducationwithinthirtydaysoftheincident;
121 (4)Theschooldistrict,charterschool,orpubliclycontractedprivateprovidershall
122attempttonotifytheparentsorlegalguardiansassoonaspossiblebutnolaterthanonehour
123aftertheendoftheschooldayonwhichtheuseofseclusionorrestraintoccurred.
124Notificationshallbeoralorelectronicandshallincludeastatementindicatingthattheschool
125district,charterschool,orpubliclycontractedprivateproviderwillprovidetheparentsor
HB455	4 126legalguardiansacopyofthereportdescribedinsubdivision(3)ofthissubsectionwithinfive
127schooldays;
128 (5)Anofficer,administrator,oremployeeofapublicschooldistrictorcharterschool
129shallnotretaliateagainstanypersonforhaving:
130 (a)Reportedaviolationofanypolicyestablishedunderthissectionorfailureofa
131districtorcharterschooltofollowanyprovisionsofthissectioninrelationtoincidentsof
132seclusionandrestraint;or
133 (b)Providedinformationregardingaviolationofthissectionbyapublicschool
134districtorcharterschooloramemberofthestaffofthepublicschooldistrictorcharter
135school.
136 [6.]5.Thedepartmentofelementaryandsecondaryeducationshallcompileand
137maintainallincidentsreportedunderthissectioninthedepartment'scoredatasystemand
138makesuchdataavailableontheMissouricomprehensivedatasystem.Nopersonally
139identifiabledatashallbeaccessibleonthedatabase.
140 6.Forthe2026-27schoolyearandallsubsequentschoolyears:
141 (1)Noschooldistrict,charterschool,orpubliclycontractedprivateprovider
142shalluseseclusiononanystudent;and
143 (2)Eachlocalboardofeducationandcharterschoolgoverningboardshall
144updatethedistrict'sandthecharterschool'spolicytoincorporatethedefinitionof
145seclusionasprovidedinthissectionandtoprohibittheschooldistrict,charterschool,or
146apubliclycontractedprivateproviderfromusingseclusiononanystudent.
147 7.Thedepartmentofelementaryandsecondaryeducationshall,incooperationwith
148appropriateassociations,organizations,agenciesandindividualswithspecializedexpertisein
149behaviormanagement[,]:
150 (1)Developamodelpolicythatsatisfiestherequirementsofsubsection2ofthis
151sectionasitexistedonAugust28,2009,byJuly1,2010,andshallupdatesuchmodelpolicy
152toincludetherequirementsofsubdivisions(2)and(3)ofsubsection[4]3andsubsection[5]
1534ofthissectionbyJuly1,2022; and
154 (2)Forthe2026-27schoolyearandallsubsequentschoolyears,updatethe
155modelpolicytoincorporatethedefinitionofseclusionasprovidedinthissectionandto
156prohibittheuseofseclusiononastudentasdescribedinsubsection6ofthissection.
