Thisbillestablishesthe"Anti-RedFlagGunSeizureAct".
Forpurposesofthebill,"redflaglaw"isdefinedasanygun
controllaw,order,ormeasurethatdirectstheseizureofany
firearmofanindividualwithouttheadjudicationofacontested
courtcase;oranyFederalorStaterule,statute,orjudicial
orderthatprohibitsaMissouricitizenfromowningorreceiving
anyfirearm;oranyorderofremovalforthesurrenderofany
firearm,unlesssuchcitizenisconvictedofaviolentfelonyoris
otherwisedisqualifiedpursuanttoanorderofprotectionorunder
Section571.070,RSMo.
Anyredflaglawthatdirectstheconfiscationofanyfirearmfrom
anylaw-abidingcitizenwithinMissourimustbeconsideredan
infringementonthepeople'srighttokeepandbeararmsas
guaranteedbytheStateandFederalconstitutionsandwillnotbe
enforcedwithinMissouri.
NoStateagency,politicalsubdivision,orStateorlocallaw
enforcementagencymayreceiveanyFederalfundsforthepurposeof
enforcinganyFederallaw,order,orjudicialfindingforthe
purposeofenforcinganyStatestatute,rule,order,orjudicial
findingthatwouldhavetheeffectofenforcingaredflaglaw
againstaMissouricitizen.
Noentityorperson,includingaStateentityoremployeethereof,
orpoliticalsubdivisionoremployeethereof,willhavethe
authoritytoenforceorattempttoenforcearedflaglaw
regardlessoftheredflaglaw'soriginortheauthorityofthe
issuingentity,exceptthatthisprohibitionmustnotapplytoany
agentoftheFederalgovernmentenforcingaFederallaworFederal
order.
ApoliticalsubdivisionorStateorlocallawenforcementagency
thatemploysalawenforcementofficerthatknowinglyviolatesthe
provisionsofthisbillmustbeliabletothepartyagainstwhoma
redflaglawwasenforcedandadditionallywillbesubjecttoa
civilpenaltyof$50,000peroccurrence. TheAttorneyGeneralwill
alsohavestandingtobringanactiontoenforcetheprovisionsof
thissection.
Inanyactionbroughtundertheprovisionsofthisbill,acourt
mayorderinjunctiveorotherequitablerelief,recoveryof
damages,otherlegalremedies,andpaymentofreasonableattorney's
fees,costs,andexpensesoftheparty.Suchreliefmustnotbe exclusiveandadditionalrelieforremediesmaybeawardedas
otherwisepermittedbylaw.
Thisbillcontainsanemergencyclause.
