instructioninhumansexualityanddevelopment.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section170.015,RSMo,isrepealedandtwonewsectionsenactedinlieu
2thereof,tobeknownassections170.015and170.313,toreadasfollows:
170.015.1.Anycoursematerialsandinstructionrelatingtohumansexualityand
2sexuallytransmitteddiseasesshallbemedicallyandfactuallyaccurateandshall:
3 (1)Presentabstinencefromsexualactivityasthepreferredchoiceofbehaviorin
4relationtoallsexualactivityforunmarriedpupilsbecauseitistheonlymethodthatisone
5hundredpercenteffectiveinpreventingpregnancy,sexuallytransmitteddiseasesandthe
6emotionaltraumaassociatedwithadolescentsexualactivity,andadvisestudentsthatteenage
7sexualactivityplacesthematahigherriskofdroppingoutofschoolbecauseofthe
8consequencesofsexuallytransmitteddiseasesandunplannedpregnancy;
9 (2)Stressthatsexuallytransmitteddiseasesareserious,possible,healthhazardsof
10sexualactivity.Pupilsshallbeprovidedwiththelatestmedicalinformationregarding
11exposuretohumanimmunodeficiencyvirus,acquiredimmunedeficiencysyndrome(AIDS),
12humanpapillomavirus,hepatitisandothersexuallytransmitteddiseases;
13 (3)Presentstudentswiththelatestmedicallyfactualinformationregardingboththe
14possiblesideeffectsandhealthbenefitsofallformsofcontraception,includingthesuccess
15andfailureratesforthepreventionofpregnancyandsexuallytransmitteddiseases;orshall
16presentstudentswithinformationoncontraceptivesandpregnancyinamannerconsistent
17withtheprovisionsofthefederalabstinenceeducationlaw,42U.S.C.Section710;
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18 (4)Includeadiscussionofthepossibleemotionalandpsychologicalconsequencesof
19preadolescentandadolescentsexualactivityandtheconsequencesofadolescentpregnancy,
20aswellastheadvantagesofadoption,includingtheadoptionofspecialneedschildren,and
21theprocessesinvolvedinmakinganadoptionplan;
22 (5)Teachskillsofconflictmanagement,personalresponsibilityandpositiveself-
23esteemthroughdiscussionandrole-playingatappropriategradelevelstoemphasizethatthe
24pupilhasthepowertocontrolpersonalbehavior.Pupilsshallbeencouragedtobasetheir
25actionsonreasoning,self-discipline,senseofresponsibility,self-control,andethical
26considerations,suchasrespectforone'sselfandothers.Pupilsshallbetaughtnotto
27makeunwantedphysicalandverbalsexualadvancesorotherwiseexploitanotherperson.
28Pupilsshallbetaughttoresistunwantedsexualadvancesandothernegativepeerpressure;
29 (6)Advisepupilsofthelawspertainingtotheirfinancialresponsibilitytochildren
30borninandoutofwedlockandadvisepupilsoftheprovisionsofchapter566pertainingto
31statutoryrape;
32 (7)Teachpupilsaboutthedangersofsexualpredators,includingonlinepredators
33whenusingelectroniccommunicationmethodssuchastheinternet,cellphones,text
34messages,chatrooms,email,andinstantmessagingprograms.Pupilsshallbetaughthowto
35behaveresponsiblyandremainsafeontheinternetandtheimportanceofhavingopen
36communicationwithresponsibleadultsandreportinganyinappropriatesituation,activity,or
37abusetoaresponsibleadult,anddependingonintentandcontent,tolocallawenforcement,
38theFederalBureauofInvestigation,ortheNationalCenterforMissing&Exploited
39Children'sCyberTipline;
40 (8)Teachpupilsabouttheconsequences,bothpersonalandlegal,ofinappropriate
41textmessaging,evenamongfriends;[and]
42 (9)Teachpupilsaboutsexualharassment,sexualviolence,andconsent:
43 (a)Forthepurposesofthissubdivision,theterm"consent"shallmeanafreelygiven
44agreementtotheconductatissuebyacompetentperson.Anexpressionoflackofconsent
45throughwordsorconductmeansthereisnoconsent.Lackofverbalorphysicalresistanceor
46submissionresultingfromtheuseofforce,threatofforce,orplacinganotherpersoninfear
47doesnotconstituteconsent.Acurrentorpreviousdatingorsocialorsexualrelationshipby
48itselforthemannerofdressofthepersoninvolvedwiththeaccusedintheconductatissue
49shallnotconstituteconsent;
50 (b)Forthepurposesofthissubdivision,theterm"sexualharassment"shallmean
51uninvitedandunwelcomeverbalorphysicalbehaviorofasexualnatureespeciallybya
52personinauthoritytowardasubordinate;
HB461	2 53 (c)Forthepurposesofthissubdivision,theterm"sexualviolence"shallmean
54causingorattemptingtocauseanothertoengageinvoluntarilyinanysexualactbyforce,
55threatofforce,duress,orwithoutthatperson'sconsent; and
56 (10)Forthe2025-26schoolyearandallsubsequentschoolyears,includea
57humangrowthanddevelopmentdiscussion,whichshallinclude:
58 (a)Ahigh-definitionultrasoundvideoatleastthreeminutesindurationthat
59showsthedevelopmentofthebrain,heart,sexorgans,andothervitalorgansinearly
60fetaldevelopment;and
61 (b)The"MeetBabyOlivia"videodevelopedbyLiveAction,oritssuccessor
62video,thatshowstheprocessoffertilizationandeverystageofhumandevelopment
63insidetheuterusandnotessignificantmarkersincellgrowthandorgandevelopment
64foreverysignificantmarkerofpregnancyuntilbirth.
65 2.Policiesconcerningreferralsandparentalnotificationregardingcontraceptionshall
66bedeterminedbylocalschoolboardsorcharterschools,consistentwiththeprovisionsof
67section167.611.
68 3.Aschooldistrictorcharterschoolwhichprovideshumansexualityinstructionmay
69separatestudentsaccordingtogenderforinstructionalpurposes.
70 4.Exceptforthevideorequiredunderparagraph(b)ofsubdivision(10)of
71subsection1ofthissection,theboardofaschooldistrictorcharterschoolshalldetermine
72thespecificcontentofthedistrict'sorschool'sinstructioninhumansexuality,inaccordance
73withsubsections1to3ofthissection[, and].Theschoolboardofaschooldistrictorthe
74governingboardofacharterschoolshallensurethatallinstructioninhumansexualityis
75appropriatetotheageofthestudentsreceivingsuchinstruction.
76 5.Aschooldistrictorcharterschoolshallnotifytheparentorlegalguardianofeach
77studentenrolledinthedistrictorschoolof:
78 (1)Thebasiccontentofthedistrict'sorschool'shumansexualityinstructiontobe
79providedtothestudent;and
80 (2)Theparent'srighttoremovethestudentfromanypartofthedistrict'sorschool's
81humansexualityinstruction.
82 6.Aschooldistrictorcharterschoolshallmakeallcurriculummaterialsusedinthe
83district'sorschool'shumansexualityinstructionavailableforpublicinspectionpursuantto
84chapter610priortotheuseofsuchmaterialsinactualinstruction.
85 7.Noschooldistrictorcharterschool,oritspersonneloragents,shallprovide
86abortionservices,orpermitapersonorentitytooffer,sponsor,orfurnishinanymannerany
87coursematerialsorinstructionrelatingtohumansexualityorsexuallytransmitteddiseasesto
88itsstudentsifsuchpersonorentityisaproviderofabortionservices.
89 8.Asusedinthissection,thefollowingtermsmean:
HB461	3 90 (1)"Abortion",thesamemeaningassuchtermisdefinedinsection188.015;
91 (2)"Abortionservices":
92 (a)Performing,inducing,orassistingintheperformanceorinducingofanabortion
93whichisnotnecessarytosavethelifeofthemother;
94 (b)Encouragingapatienttohaveanabortionorreferringapatientforanabortion[,
95which] thatisnotnecessarytosavethelifeofthemother;or
96 (c)Developingordispensingdrugs,chemicals,ordevicesintendedtobeusedto
97induceanabortionwhichisnotnecessarytosavethelifeofthemother;
98 (3)"Humangrowthanddevelopmentdiscussion",anoral,written,ordigital
99lesson,lecture,orpresentationabouthumanbiologyrelatedtopregnancyandhuman
100developmentinsidethewomb.
101 9.Thegeneralassemblyherebyacknowledgesthestate'sinterestinsafeguarding
102thehealthandwell-beingofitsresidentsandcitizens.Infurtheranceofthis
103acknowledgment,theattorneygeneralofMissourishallhavestandingasparenspatriae
104tosuetoenforcethissectiononbehalfofanyorallresidentsorcitizensofMissouri.
105 10.TheattorneygeneralofMissourishallhaveacauseofactiontosuefor
106damagesorinjunctiverelief,orboth,onbehalfofanyorallresidentsorcitizensof
107Missouriagainstanypersonorentitythatviolatesthissection.
170.313.1.Forthe2025-26schoolyearandallsubsequentschoolyears,each
2schoolboardofaschooldistrictandgoverningboardofacharterschoolshallrequire
3instructioninhumangrowthanddevelopmentbeginningnolaterthangradethree.
4Suchinstructionshallbeaccomplishedbymeansofalesson,lecture,orpresentation
5abouthumanbiologyrelatedtopregnancyandhumandevelopmentinsidethewomb.
6Suchinstructionmaybepresentedinanoral,written,ordigitalformatorsome
7combinationofsuchformats.
8 2.Therequirementsofsection160.514shallnotapplytothissection.
