HB462 2 54 (b)Iftheschoolboardorgoverningboarddeterminesthatthematerialis 55obsceneorharmfultominors,theboardshallpermanentlyremovethematerialfrom 56thepublicschool. 57 (c)Iftheschoolboardorgoverningboarddeterminesthatthematerialis 58appropriateforstudents,theboardshallreturnthematerialtoeachschoollibraryor 59teacherfromwhichthematerialwasremovedupontheboard'sdeterminationthatthe 60materialisappropriateforstudentsorattheendofthethirty-dayremovalperiod 61describedinsubdivision(2)ofthissubsection,whicheverisearlier. 62 (4)Thepolicyadoptedunderthissectionshallnotbeconstruedto: 63 (a)Betheexclusivemeanstoremovematerialfromaschool;or 64 (b)Precludeaschooldistrictorgoverningboardfromdevelopingor 65implementingadditionalpolicies,practices,orproceduresfortheremovalof 66materialsfromtheschool. 67 (5)Ifapublicschoolfailstocomplywithapolicyadoptedunderthissection,the 68departmentmaywithholdanamountofstatefunds,asdeterminedbythedepartment, 69fromthepublicschooluntilthepublicschoolisincompliancewiththepolicy. 70 (6)Eachpublicschoolshallannuallyreporttothedepartmentthematerialthat 71ispermanentlyremovedunderparagraph(b)ofsubdivision(3)ofthissubsection. 182.827.1.Apublicschoolthatprovidesapublicaccesscomputershallapplythe 2provisionsofsection162.116thatareapplicabletomaterialsmadeavailabletoachildin 3aschoollibrarytomaterialsaccessedbyminorsonsuchpublicaccesscomputeranddo 4oneorbothofthefollowing: 5 (1)Equipthecomputerwithsoftwarethatwilllimitminors'abilitytogainaccessto 6materialthatispornographicforminorsorpurchaseinternetconnectivityfromaninternet 7serviceproviderthatprovidesfilterservicestolimitaccesstomaterialthatispornographic 8forminors; 9 (2)DevelopandimplementbyJanuary1,2003,apolicythatisconsistentwith 10communitystandardsandestablishesmeasurestorestrictminorsfromgainingcomputer 11accesstomaterialthatispornographicforminors. 12 2.Thedepartmentofelementaryandsecondaryeducationshallestablishrulesand 13regulationsfortheenforcementofsubsection1ofthissection.Anyruleorportionofarule, 14asthattermisdefinedinsection536.010,thatiscreatedundertheauthoritydelegatedinthis 15sectionshallbecomeeffectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsof 16chapter536and,ifapplicable,section536.028.Thissectionandchapter536are 17nonseverableandifanyofthepowersvestedwiththegeneralassemblypursuanttochapter 18536toreview,todelaytheeffectivedateortodisapproveandannularulearesubsequently HB462 3 19heldunconstitutional,thenthegrantofrulemakingauthorityandanyruleproposedor 20adoptedafterAugust28,2002,shallbeinvalidandvoid. 21 3.Apubliclibrarythatprovidesapublicaccesscomputershalldooneorbothofthe 22following: 23 (1)Equipthecomputerwithsoftwarethatwilllimitminors'abilitytogainaccessto 24materialthatispornographicforminorsorpurchaseinternetconnectivityfromaninternet 25serviceproviderthatprovidesfilterservicestolimitaccesstomaterialthatispornographic 26forminors; 27 (2)DevelopandimplementbyJanuary1,2003,apolicythatisconsistentwith 28communitystandardsandestablishesmeasurestorestrictminorsfromgainingcomputer 29accesstomaterialthatispornographicforminors. 30 4.Thesecretaryofstateshallestablishrulesandregulationsfortheenforcementof 31subsection3ofthissection.Anyruleorportionofarule,asthattermisdefinedinsection 32536.010,thatiscreatedundertheauthoritydelegatedinthissectionshallbecomeeffective 33onlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter536and,ifapplicable, 34section536.028.Thissectionandchapter536arenonseverableandifanyofthepowers 35vestedwiththegeneralassemblypursuanttochapter536toreview,todelaytheeffectivedate 36ortodisapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof 37rulemakingauthorityandanyruleproposedoradoptedafterAugust28,2002,shallbeinvalid 38andvoid. 39 5.Anypublicschoolboardmember,officeroremployee,includinglibrarypersonnel, 40whowillfullyneglectsorrefusestoperformadutyimposedbythissectionshallbesubjectto 41thepenaltiesimposedpursuanttosection162.091. 42 6.Apublicschoolorpublicschoolboardmember,officeroremployee,including 43librarypersonnel,publiclibraryorpubliclibraryboardmember,officer,employeeortrustee 44thatcomplieswithsubsection1or3ofthissectionoraninternetserviceproviderproviding 45internetconnectivitytosuchpublicschoolorlibraryinordertocomplywiththissectionshall 46notbecriminallyliableorliableforanydamagesthatmightarisefromaminorgainingaccess 47tomaterialthatispornographicforminorsthroughtheuseofapublicaccesscomputerthatis 48ownedorcontrolledbythepublicschoolorpubliclibrary. ✔ HB462 4
