40 b.Achildcomplaintinvestigation; 41 c.State-paidmediation; 42 d.Adueprocesscomplaintandhearing;or 43 e.Otherdisputeresolutionoptionsasoutlinedintheproceduralsafeguards 44noticeunder34CFR300.504. 45 (2)Alocaleducationalagencyshallnotproceedwithimplementingachild's 46individualizededucationprogramwithoutparentalconsentunlesstheLEAdocuments 47reasonableeffortsofattemptstoarrangeamutuallyagreed-upontimeandplace,in 48accordancewith34CFR300.322(d),andtheparenthasrefusedtoattendortheLEA 49obtainsapprovalthroughadueprocesscomplaintandhearinginwhichthehearing 50officerorcommissionerfindsthattheIEPwiththeproposedchangeorchanges 51providesforafreeappropriatepubliceducationforthestudentinaccordancewith34 52CFR300.507to300.513. 53 5.Parentshavetherighttovisitanyprogramorclassroomproposedfortheir 54childbeforeconsentingtoIEPchangesifthechildisidentifiedaseligibleforspecial 55educationservices.Avisitoccurringunderthissubsectionshallbescheduledbeforeor HCSHB477 2 56afterregularschoolhoursoratamutuallyagreed-upontimetoensurethatinstruction 57isnotinterrupted. 58 6.(1)Thedepartmentofelementaryandsecondaryeducationshallcreateor 59establishaparentalconsentmodelformthateachlocaleducationalagencyshallusefor 60anyactionrelatedtoachild'sindividualizededucationprogram.Suchformshallbe 61providedtotheparentintheparent'snativelanguage,asdescribedin34CFR300.503, 62andshallincludeatleastthefollowing: 63 (a)A"Doesconsent"box,signatureline,anddateline; 64 (b)A"DoesNOTconsent"box,signatureline,anddatelineaswellasabox 65accompanyingastatementthataparentwhodoesnotconsentunderstandsthatthe 66LEAisrelievedofanyfutureclaimsrelatedtononprovisionofanyservicesnot 67consentedtobytheparent;and 68 (c)A"Partialconsent"box,signatureline,dateline,andspaceforindicatingthe 69areasofagreement. 70 (2)(a)Aparentalconsentformshallnotberequiredinsituationswherea 71placement,removal,addition,change,orreductionofservicesintheIEPofachildwith 72disabilitiesoccursbecauseofaviolationofacodeofstudentconductinaccordancewith 7334CFR300.530. 74 (b)Onthedateonwhichsuchplacement,removal,addition,change,or 75reductionofservicesintheIEPofachildwithadisabilityoccursbecauseofaviolation 76ofacodeofstudentconduct,theLEAshallnotifytheparentofthatdecisionand 77providetheparentwithnoticeinaccordancewith34CFR300.504. 78 7.Thissectionshallnotbeconstruedtoabrogateanyparentalrightidentifiedin 79thefederalIndividualswithDisabilitiesEducationAct(IDEA)andsuchact's 80implementingregulations. 81 8.TheprovisionsofthissectionshallbecomeeffectiveonJuly1,2026. ✔ HCSHB477 3
