3ofsuchjurisdictions,andwhoseworkexperienceinvolvedthepracticeofanoccupation 4orprofessionforwhichalicenseisnotrequiredinthejurisdictionorjurisdictionsin 5whichthepersonworkedbutisrequiredinthisstate,maysubmitanapplicationfora 6one-timenonrenewabletwo-yeartemporarylicenseinthisstateintheoccupationor 7profession,alongwithproofofatleastthreeyearsofworkexperienceintheoccupation HB478 6 8orprofessionandafeeassetbyregulationoftheoversightbody,totherelevant 9oversightbodyinthisstate.Theoversightbodyshallmakeadeterminationof 10qualificationwithinforty-fivedaysofreceivingacompletedapplication. 11 2.Theoversightbodyshallrequireanapplicantunderthissectiontotakeand 12passtheprofession-specificexaminationrequiredforlicensurebythoseapplying 49underthissectionshallbevalidonlyinthisstateandshallnotmakealicenseeeligibleto 50bepartofaninterstatecompact.Anapplicantwhoislicensedinanotherstatepursuant 51toaninterstatecompactshallnotbeeligibleforlicensurebyanoversightbodyunder 52theprovisionsofthissection. 53 9.Notwithstandinganyotherprovisionoflawtothecontrary,alicenseissued 54underthissectionshallbevalidonlyinthisstateandshallnotmakealicenseeeligibleto 55obtainalicensebyreciprocityinanotherstate. 56 10.Asusedinthissection,theterm"oversightbody"meansanyboard, 57department,agency,orofficeofajurisdictionthatissuesoccupationalorprofessional 58licenses. 59 11.Thedivisionofprofessionalregistrationmaypromulgaterulestoimplement 60theprovisionsofthissection.Anyruleorportionofarule,asthattermisdefinedin 61section536.010,thatiscreatedundertheauthoritydelegatedinthissectionshall 62becomeeffectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter 63536and,ifapplicable,section536.028.Thissectionandchapter536arenonseverable [(5)](6)"Residentmilitaryorlawenforcementspouse",aspouseofanactiveduty 30memberoftheArmedForcesoftheUnitedStateswhohasbeentransferredorisscheduledto 31betransferredtothestateofMissourioranadjacentstateandwhoisapermanentresidentof 32thestateofMissouri,whoisdomiciledinthestateofMissouri,orwhohasMissouriashisor 33herhomeofrecordoraspouseofaMissourilawenforcementofficer. 34 2.Anypersonwhoholdsavalidcurrentlicenseissuedbyanotherstate,abranchor 35unitofthemilitary,aterritoryoftheUnitedStates,ortheDistrictofColumbia,andwhohas 36beenlicensedforatleastoneyearinsuchotherjurisdiction,maysubmitanapplicationfora 37licenseinMissouriinthesameoccupationorprofession,andatthesamepracticelevel,for 38whichheorsheholdsthecurrentlicense,alongwithproofofcurrentlicensureandproofof 39licensureforatleastoneyearintheotherjurisdiction,totherelevantoversightbodyinthis 40state. 41 3.Theoversightbodyinthisstateshall: 42 (1)Withinsixmonthsofreceivinganapplicationdescribedinsubsection2ofthis 43section,waiveanyexamination,educational,orexperiencerequirementsforlicensureinthis 44statefortheapplicantifitdeterminesthattherewereminimumeducationrequirementsand,if 45applicable,workexperienceandclinicalsupervisionrequirementsineffectandtheotherstate 46verifiesthatthepersonmetthoserequirementsinordertobelicensedorcertifiedinthatstate. 47Anoversightbodythatadministersanexaminationonlawsofthisstateaspartofitslicensing 48applicationrequirementmayrequireanapplicanttotakeandpassanexaminationspecificto 49thelawsofthisstate;or HB478 9 50 (2)Withinthirtydaysofreceivinganapplicationdescribedinsubsection2ofthis 51sectionfromanonresidentmilitaryorlawenforcementspouseoraresidentmilitaryorlaw 52enforcementspouse,waiveanyexamination,educational,orexperiencerequirementsfor 53licensureinthisstatefortheapplicantandissuesuchapplicantalicenseunderthissectionif 54suchapplicantotherwisemeetstherequirementsofthissection. 55 4.(1)Theoversightbodyshallnotwaiveanyexamination,educational,or 56experiencerequirementsforanyapplicantwhohashadhisorherlicenserevokedbyan 57oversightbodyoutsidethestate;whoiscurrentlyunderinvestigation,whohasacomplaint 58pending,orwhoiscurrentlyunderdisciplinaryaction,exceptasprovidedinsubdivision(2) 59ofthissubsection,withanoversightbodyoutsidethestate;whodoesnotholdalicensein 60goodstandingwithanoversightbodyoutsidethestate;whohasacriminalrecordthatwould 61disqualifyhimorherforlicensureinMissouri;orwhodoesnotholdavalidcurrentlicensein 62theotherjurisdictiononthedatetheoversightbodyreceiveshisorherapplicationunderthis 63section. 64 (2)Ifanotherjurisdictionhastakendisciplinaryactionagainstanapplicant,the 65oversightbodyshalldetermineifthecausefortheactionwascorrectedandthematter 66resolved.Ifthematterhasnotbeenresolvedbythatjurisdiction,theoversightbodymay 67denyalicenseuntilthematterisresolved. 68 5.Nothinginthissectionshallprohibittheoversightbodyfromdenyingalicenseto 69anapplicantunderthissectionforanyreasondescribedinanysectionassociatedwiththe 70occupationorprofessionforwhichtheapplicantseeksalicense. 71 6.Anypersonwhoislicensedundertheprovisionsofthissectionshallbesubjectto 72theapplicableoversightbody'sjurisdictionandallrulesandregulationspertainingtothe 73practiceofthelicensedoccupationorprofessioninthisstate. 74 7.Thissectionshallnotbeconstruedtowaiveanyrequirementforanapplicantto 75payanyfees,postanybondsorsuretybonds,orsubmitproofofinsuranceassociatedwiththe 76licensetheapplicantseeks. 77 8.Thissectionshallnotapplytobusiness,professional,oroccupationallicenses 78issuedorrequiredbypoliticalsubdivisions. 79 9.Theprovisionsofthissectionshallnotimpedeanoversightbody'sauthorityto 80requireanapplicanttosubmitfingerprintsaspartoftheapplicationprocess. 81 10.[Theprovisionsofthissectionshallnotapplytoanoversightbodythathas 82enteredintoalicensingcompactwithanotherstatefortheregulationofpracticeunderthe 83oversightbody'sjurisdiction.] Theprovisionsofthissectionshallnotbeconstruedtoalter 84theauthoritygrantedby,oranyrequirementspromulgatedpursuantto,anyinterjurisdictional 85orinterstatecompactsadoptedbyMissouristatuteoranyreciprocityagreementswithother 86statesineffect[onAugust28,2018], andwheneverpossiblethissectionshallbeinterpreted HB478 10 87soastoimplynoconflictbetweenitandanycompact,oranyreciprocityagreementswith 88otherstatesineffect[onAugust28,2018]. 89 11.Notwithstandinganyotherprovisionoflaw,alicenseissuedunderthissection 90shallbevalidonlyinthisstateandshallnotmakealicenseeeligibletobepartofaninterstate 91compact.Anapplicantwhoislicensedinanotherstatepursuanttoaninterstatecompactshall 92notbeeligibleforlicensurebyanoversightbodyundertheprovisionsofthissection. 93 12.Theprovisionsofthissectionshallnotapplytoanyoccupationsetforthin 94subsection6ofsection290.257,oranyelectricalcontractorlicensedundersections324.900 95to324.945. 324.263.1.Theboardmayapplytotheadministrativehearingcommissionfor 2anemergencysuspensionorrestrictionofalicenseissuedundersections324.240to 3324.275if: 4 (1)Theholderofthelicenseisthesubjectofapendingcriminalindictment, 5criminalinformation,orothercriminalchargerelatedtothedutiesandresponsibilities 6ofthelicensedoccupation;and 7 (2)Thereisreasonablecausefortheboardtobelievethatthepublichealth, 8safety,orwelfareisatimminentriskofharmfromtheholderofthelicense. 9 2.Theboardshallsubmittotheadministrativehearingcommissionsupporting 10affidavitsandcertifiedcourtrecords,togetherwithacomplaintallegingthefactsin 11supportoftheboard'srequestforanemergencysuspensionorrestrictionofalicense, 7AmericanBoardofFuneralServiceEducation,anysuccessororganization,orother 8accreditingentityasapprovedbytheboardshallregisterwiththeboardasapracticum 9studentupontheform[provided] approvedbytheboard.[Aftersuchregistration,astudent 10mayassist,underthedirectsupervisionofMissourilicensedembalmersandfuneraldirectors, 11inMissourilicensedfuneralestablishments,whileservinghisorherpracticum.] Theform 12forregistrationasapracticumstudentshallbeaccompaniedbyafeeinanamountestablished 13bytheboard.Afterastudent'sregistrationhasbeenapprovedbytheboard,apracticum 14studentregistrantmayassist,underthedirectsupervisionofanembalmerlicensed 15underthischapter,inanestablishmentlicensedunderthischapter.Practicumstudent 16registrantsshallnotassistwhennotundersuchsupervision.Eachpracticumstudent 17registrantisauthorizedtoworkonlyatthelocationorlocationsregisteredwiththe 18boardandunderonlythosesupervisorsregisteredwiththeboard. 19 [3.Eachapplicantforalicensetopracticeembalmingshallfurnishevidenceto 20establishtothesatisfactionoftheboardthatheorshe: 21 (1)Isatleasteighteenyearsofage,andpossessesahighschooldiploma,ageneral 22equivalencydiploma,orequivalentthereof,asdetermined,atitsdiscretion,bytheboard; 23 (2)HascompletedafuneralserviceeducationprogramaccreditedbytheAmerican 24BoardofFuneralServiceEducation,anysuccessororganization,orotheraccreditingentityas 25approvedbytheboard.Ifanapplicantdoesnotcompleteallrequirementsforlicensure 26withinfiveyearsfromthedateofhisorhercompletionofanaccreditedprogram,hisorher HB478 14 27registrationasanapprenticeembalmershallbeautomaticallycancelled.Theapplicantshall 28berequiredtofileanewapplicationandpayapplicablefees.Nopreviousapprenticeship 29shallbeconsideredforthenewapplication; 30 (3)Upondueexaminationadministeredbytheboard,ispossessedofaknowledgeof 37officeofhisorherdesiretoretaketheexaminationatleastthirtydayspriortothedateofthe 38examination.Eachtimetheexaminationisretaken,theapplicantshallpayanew 45processinthefirstsixmonthsoftheapprenticeshipperiodandphysicallypresentatthe 46beginningoftheembalmingprocessandavailableforconsultationandpersonalinspection 47withinaperiodofnotmorethanonehourintheremainingsixmonthsoftheapprenticeship 48period.Alltranscriptsandotherrecordsfiledwiththeboardshallbecomeapartoftheboard 49files. 50 4.]2.Exceptasotherwiseprovidedinthissection,anapplicantnotentitledtoan 51embalmer'slicenseundersection333.051or324.009shallmakeapplicationforsuch 74embalmerandthedeadhumanbodyatthebeginningoftheembalmingprocessand 75availableforconsultationwithinonehourfortheremainderoftheembalmingprocess. 76Thelicensedembalmershallinspectallbodiesembalmedbytheapprenticeembalmer. 77 3.Uponwrittenrequesttotheboard,anypersonlicensedunderthissection 78may,athisorherelection,atanytime,sitfortheNationalBoardExamination-Arts 79administeredbytheInternationalConferenceofFuneralServiceExaminingBoards, 80anysuccessororganization,orotherorganizationapprovedbytheboardifsuchperson 81hasnotpreviouslypassedsuchexamination. 82 4.Iftheapplicantdoesnotcompletetheapplicationprocesswithinthefiveyears 83afterhisorhercompletionofanapprovedprogram,thenheorshemustfileanewapplication 84andnofeespaidpreviouslyshallapplytowardthelicensefee. 85 2.Ifapersonappliesforalimitedlicensetoworkonlyinafuneralestablishment 21whichislicensedonlyforcremation,includingtransportationofdeadhumanbodiestoand 22fromthefuneralestablishment,heorsheshallmakeapplication,paythecurrentapplication 23andexaminationfeeandsuccessfullycompletetheMissourilawexamination.Heorshe 24shallbeexemptfromthetwelve-monthapprenticeshiprequiredbysubsection1ofthis 25sectionandthepracticalexaminationbeforetheboard.Ifapersonhasalimitedlicense 35shallcomplywithalltherequirementsforlicensureasafuneraldirectorpursuantto 36subsection1ofsection333.041andsubsection1ofthissection;however,theindividualis HB478 26 28 2.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis 29createdundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplies 30withandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028. 31Thissectionandchapter536arenonseverableandifanyofthepowersvestedwiththe 32generalassemblypursuanttochapter536toreview,todelaytheeffectivedate,orto 33disapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof 34rulemakingauthorityandanyruleproposedoradoptedafterAugust28,2007,shallbeinvalid 35andvoid. 337.628.Asocialworkdegreeprogramofferingamaster'sdegreeinsocialwork 2thathasachievedcandidacyorprecandidacystatusintheaccreditationprocess 3establishedbytheCouncilonSocialWorkEducationshallnotreceiveautomatic 4recognitionandapprovalbythecommitteeduetothatstatusundertherulesadopted 5undersection337.627.Onlysuchprogramsmayapplytothecommitteeforrecognition 6andapproval,andthecommitteeshallrevieweachapplicationonanindividualized 7basistodeterminewhethertheprogramqualifiesforrecognitionandapproval. 337.644.1.Asusedinthissection,thefollowingtermsmean: 2 (1)"License",alicense,certificate,registration,permit,accreditation,ormilitary 3occupationalspecialtythatenablesapersontolegallypracticeanoccupationorprofessionin 4aparticularjurisdiction; 5 (2)"Military",theArmedForcesoftheUnitedStates,includingtheAirForce,Army, 6CoastGuard,MarineCorps,Navy,SpaceForce,NationalGuard,andanyothermilitary 7branchthatisdesignatedbyCongressaspartoftheArmedForcesoftheUnitedStates,and 8allreservecomponentsandauxiliaries.Theterm"military"alsoincludesthemilitary 9reservesandmilitiaofanyUnitedStatesterritoryorstate; 10 (3)"Nonresidentmilitaryspouse",anonresidentspouseofanactive-dutymemberof 11theArmedForcesoftheUnitedStateswhohasbeentransferredorisscheduledtobe 12transferredtothestateofMissouri,orwhohasbeentransferredorisscheduledtobe 13transferredtoanadjacentstateandisorwillbedomiciledinthestateofMissouri,orhas 14movedtothestateofMissourionapermanentchange-of-stationbasis; 15 (4)"Oversightbody",anyboard,department,agency,orofficeofajurisdictionthat 16issueslicenses; 17 (5)"Residentmilitaryspouse",aspouseofanactive-dutymemberoftheArmed 18ForcesoftheUnitedStateswhohasbeentransferredorisscheduledtobetransferredtothe 19stateofMissourioranadjacentstateandwhoisapermanentresidentofthestateofMissouri, 20whoisdomiciledinthestateofMissouri,orwhohasMissouriashisorherhomeofrecord. 21 2.Eachapplicantforlicensureasamastersocialworkershallfurnishevidencetothe 22committeethat: HB478 27 23 (1)Theapplicanthas: 24 (a)Amaster'sdegreeinsocialworkfromasocialworkdegreeprogram: 25 a.AccreditedbytheCouncilonSocialWorkEducation;or 26 b.Recognizedandapprovedbythecommitteeinaccordancewithrulesadopted 27bythecommitteeundersection337.627andinaccordancewiththeproceduresetforth 28insection337.628;or 29 (b)Adoctoratedegreeinsocialworkfromanaccreditedsocialworkdegreeprogram 30approvedbythe[councilofsocialworkeducation] CouncilonSocialWorkEducation; 31 (2)Theapplicanthasachievedapassingscore,asdefinedbythecommittee,onan 32examinationapprovedbythecommittee.Theeligibilityrequirementsforsuchexamination 33shallbedeterminedbythestatecommitteeforsocialworkers; 34 (3)Theapplicantisatleasteighteenyearsofage,isaUnitedStatescitizenorhas 35statusasalegalresidentalien,andhasnotbeenfinallyadjudicatedandfoundguilty,or 36enteredapleaofguiltyornolocontendere,inacriminalprosecutionunderthelawsofany 37state,oftheUnitedStates,orofanycountry,foranyoffensedirectlyrelatedtothedutiesand 38responsibilitiesoftheoccupation,assetforthinsection324.012,regardlessofwhetherornot 39sentenceisimposed; 40 (4)Theapplicanthassubmittedawrittenapplicationonformsprescribedbythestate 41board;and 42 (5)Theapplicanthassubmittedtherequiredlicensingfee,asdeterminedbythe 43committee. 44 3.Anyapplicantwhoanswersintheaffirmativetoanyquestionontheapplication 45thatrelatestopossiblegroundsfordenialoflicensureundersection337.630shallsubmita 46swornaffidavitsettingforthindetailthefactswhichexplainsuchanswerandcopiesof 47appropriatedocumentsrelatedtosuchanswer. 48 4.Thecommitteeshallissuealicensetoeachpersonwhofilesanapplicationandfee 49asrequiredbytheprovisionsofsections337.600to337.689andwhofurnishesevidence 50satisfactorytothecommitteethattheapplicanthascompliedwiththeprovisionsof 51subsection2ofthissection.Thelicenseshallrefertotheindividualasalicensedmaster 52socialworkerandshallrecognizethatindividual'srighttopracticelicensedmastersocial 53workasdefinedinsection337.600. 54 5.(1)Anypersonwhoholdsavalidcurrentmastersocialworklicenseissuedby 55anotherstate,abranchorunitofthemilitary,aterritoryoftheUnitedStates,ortheDistrictof 56Columbia,andwhohasbeenlicensedforatleastoneyearinsuchotherjurisdiction,may 57submittothecommitteeanapplicationforamastersocialworklicenseinMissourialong 58withproofofcurrentlicensureandproofoflicensureforatleastoneyearintheother 59jurisdiction. HB478 28 60 (2)Thecommitteeshall: 61 (a)Withinsixmonthsofreceivinganapplicationdescribedinsubdivision(1)ofthis 62subsection,waiveanyexamination,educational,orexperiencerequirementsforlicensurein 63thisstatefortheapplicantifitdeterminesthattherewereminimumeducationrequirements 64and,ifapplicable,workexperienceandclinicalsupervisionrequirementsineffectandthe 65otherjurisdictionverifiesthatthepersonmetthoserequirementsinordertobelicensedor 66certifiedinthatjurisdiction.Thecommitteemayrequireanapplicanttotakeandpassan 67examinationspecifictothelawsofthisstate;or 68 (b)Withinthirtydaysofreceivinganapplicationdescribedinsubdivision(1)ofthis 69subsectionfromanonresidentmilitaryspouseoraresidentmilitaryspouse,waiveany 70examination,educational,orexperiencerequirementsforlicensureinthisstateforthe 71applicantandissuesuchapplicantalicenseunderthissubsectionifsuchapplicantotherwise 72meetstherequirementsofthissubsection. 73 (3)(a)Thecommitteeshallnotwaiveanyexamination,educational,orexperience 74requirementsforanyapplicantwhohashadhisorherlicenserevokedbyanoversightbody 75outsidethestate;whoiscurrentlyunderinvestigation,whohasacomplaintpending,orwho 76iscurrentlyunderdisciplinaryaction,exceptasprovidedinparagraph(b)ofthissubdivision, 77withanoversightbodyoutsidethestate;whodoesnotholdalicenseingoodstandingwithan 78oversightbodyoutsidethestate;whohasacriminalrecordthatwoulddisqualifyhimorher 79forlicensureinMissouri;orwhodoesnotholdavalidcurrentlicenseintheotherjurisdiction 80onthedatethecommitteereceiveshisorherapplicationunderthis[section] subsection. 81 (b)Ifanotherjurisdictionhastakendisciplinaryactionagainstanapplicant,the 82committeeshalldetermineifthecausefortheactionwascorrectedandthematterresolved. 83Ifthematterhasnotbeenresolvedbythatjurisdiction,thecommitteemaydenyalicense 84untilthematterisresolved. 85 (4)Nothinginthissubsectionshallprohibitthecommitteefromdenyingalicenseto 86anapplicantunderthissubsectionforanyreasondescribedinsection337.630. 87 (5)Anypersonwhoislicensedundertheprovisionsofthissubsectionshallbe 88subjecttothecommittee'sjurisdictionandallrulesandregulationspertainingtothepractice 89asalicensedmastersocialworkerinthisstate. 90 (6)Thissubsectionshallnotbeconstruedtowaiveanyrequirementforanapplicant 91topayanyfees. 337.645.1.Eachapplicantforlicensureasanadvancedmacrosocialworkershall 2furnishevidencetothecommitteethat: 3 (1)Theapplicanthas: 4 (a)Amaster'sdegreefromacollegeoruniversityprogramofsocialwork: HB478 29 5 a.Accreditedbythe[councilofsocialworkeducation] CouncilonSocialWork 6Education;or 7 b.Recognizedandapprovedbythecommitteeinaccordancewithrulesadopted 8bythecommitteeundersection337.627andinaccordancewiththeproceduresetforth 9insection337.628;or 10 (b)Adoctoratedegreefromaschoolofsocialworkacceptabletothecommittee; 11 (2)Theapplicanthascompletedatleastthreethousandhoursofsupervisedadvanced 12macroexperiencewithaqualifiedadvancedmacrosupervisorasdefinedinsection337.600 13innolessthantwenty-fourmonthsandnomorethanforty-eightconsecutivecalendarmonths. 14Foranyapplicantwhohassuccessfullycompletedatleastfourthousandhoursofsupervised 15advancedmacroexperiencewithaqualifiedadvancedmacrosupervisor,asdefinedinsection 16337.600,withinthesametimeframeprescribedinthissubsection,theapplicantshallbe 17eligibleforapplicationoflicensureatthreethousandhoursandshallbefurnishedacertificate 18bythestatecommitteeforsocialworkersacknowledgingthecompletionofsaidadditional 19hours; 20 (3)Theapplicanthasachievedapassingscore,asdefinedbythecommittee,onan 21examinationapprovedbythecommittee.Theeligibilityrequirementsforsuchexamination 22shallbepromulgatedbyruleofthecommittee; 23 (4)Theapplicantisatleasteighteenyearsofage,isaUnitedStatescitizenorhas 24statusasalegalresidentalien,andhasnotbeenfinallyadjudicatedandfoundguilty,or 25enteredapleaofguiltyornolocontendere,inacriminalprosecutionunderthelawsofany 26state,oftheUnitedStates,orofanycountry,foranyoffensedirectlyrelatedtothedutiesand 27responsibilitiesoftheoccupation,assetforthinsection324.012,regardlessofwhetherornot 28sentenceisimposed. 29 2.Anypersonholdingacurrentlicense,certificateofregistration,orpermitfrom 30anotherstateorterritoryoftheUnitedStatesortheDistrictofColumbiatopracticeadvanced 31macrosocialworkwhohashadnodisciplinaryactiontakenagainstthelicense,certificateof 32registration,orpermitfortheprecedingfiveyearsmaybegrantedalicensetopractice 33advancedmacrosocialworkinthisstateifthepersonmeetsoneofthefollowingcriteria: 34 (1)Has: 35 (a)Received: 36 a.Amaster'sdegreeinsocialworkfromasocialworkprogram: 37 (i)AccreditedbytheCouncilonSocialWorkEducation;or 38 (ii)Recognizedandapprovedbythecommitteeinaccordancewithrules 39adoptedbythecommitteeundersection337.627andinaccordancewiththeprocedure 40setforthinsection337.628;or HB478 30 41 b.Adoctoraldegreefromacollegeoruniversityprogramofsocialworkaccredited 42bythe[councilofsocialworkeducation] CouncilonSocialWorkEducation;and[has] 43 (b)Beenlicensedtopracticeadvancedmacrosocialworkfortheprecedingfive 44years;or 45 (2)Iscurrentlylicensedorcertifiedasanadvancedmacrosocialworkerinanother 46state,territoryoftheUnitedStates,ortheDistrictofColumbiahavingsubstantiallythesame 47requirementsasthisstateforadvancedmacrosocialworkers. 48 3.Thecommitteeshallissuealicensetoeachpersonwhofilesanapplicationandfee 49asrequiredbytheprovisionsofsections337.600to337.689andwhofurnishesevidence 50satisfactorytothecommitteethattheapplicanthascompliedwiththeprovisionsof 51subdivisions(1)to(4)ofsubsection1ofthissectionorwiththeprovisionsofsubsection2of 52thissection. 337.647.1.Thecommitteeshalldevelopaschoolsocialworkprogramverification 2andacknowledgmentofcompletionforindividualswhohavemettherequirementssetforth 3inthissection. 4 2.Thecommitteeshallissueadocumentsimilartothedocumentdescribedin 5subsection2ofsection173.1400toanyindividualwho: 6 (1)Submitsanapplicationtotheboard; 7 (2)Holdsacredentialinschoolsocialworkissuedbyanationallyrecognized 8credentialingorganizationinsocialwork,ordemonstratescompetencyinschoolsocialwork 9bysuccessfulpassageofaschoolsocialworkerexamapprovedbythecommittee; 10 (3)Holdsalicenseissuedbythecommittee;and 11 (4)Submitsthefeeasrequiredbyruleofthecommittee. 12 3.Thecommitteeshallpromulgaterulesandshallchargefeesnecessarytoimplement 13thissection.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis 14createdundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplies 15withandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028. 16Thissectionandchapter536arenonseverableandifanyofthepowersvestedwiththe 17generalassemblypursuanttochapter536toreview,todelaytheeffectivedate,orto 18disapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof 19rulemakingauthorityandanyruleproposedoradoptedafterAugust28,2012,shallbeinvalid 20andvoid. 21 4.Notwithstandinganyprovisionoflawtothecontrary,anyschoolsocialwork 22programverificationandacknowledgmentofcompletionissuedbythecommitteeunder 23subsection2ofthissectionshallnotbedeemedalicense,certificate,registrationorpermitfor 24anypurpose,andsuchdocumentsconveynoauthoritytopracticesocialworkinMissouriand 25conveynoauthoritytouseanysocialworktitleinMissouri.Eachschoolsocialwork HB478 31 26programverificationandacknowledgmentofcompletionissuedbythecommitteeunder 27subsection2ofthissectionshallstateonitsfacethatit: 28 (1)Isnotalicense,certificate,registrationorpermit; 29 (2)ConveysnoauthoritytopracticesocialworkinMissouri;and 30 (3)ConveysnoauthoritytouseanysocialworktitleinMissouri. 31 5.Notwithstandinganyprovisionoflawtothecontrary,schoolsocialworkprogram 32verificationandacknowledgmentofcompletionissuedbythecommitteeundersubsection2 33ofthissectionshallnot: 34 (1)Expire; 35 (2)Besubjecttorenewal; 36 (3)Besubjecttodenialordisciplineundersection337.630;or 37 (4)[Besubjecttosuspensionundersection324.010;or 38 (5)]Besubjecttoanyotheractiontowhichprofessionallicensesmaybesubjected. 338.010.1.The"practiceofpharmacy"includes: 2 (1)Theinterpretation,implementation,andevaluationofmedicalprescriptionorders, 3includinganylegenddrugsunder21U.S.C.Section353,andthereceipt,transmission,or 4handlingofsuchordersorfacilitatingthedispensingofsuchorders; 5 (2)Thedesigning,initiating,implementing,andmonitoringofamedication 6therapeuticplaninaccordancewiththeprovisionsofthissection; 7 (3)Thecompounding,dispensing,labeling,andadministrationofdrugsanddevices 8pursuanttomedicalprescriptionorders; 9 (4)TheorderingandadministrationofvaccinesapprovedorauthorizedbytheU.S. 10FoodandDrugAdministration,excludingvaccinesforcholera,monkeypox,Japanese 11encephalitis,typhoid,rabies,yellowfever,tick-borneencephalitis,anthrax,tuberculosis, 12dengue,Hib,polio,rotavirus,smallpox,chikungunya,andanyvaccineapprovedafter 13January1,[2023] 2025, topersonsatleastsevenyearsofageortheagerecommendedbythe 14CentersforDiseaseControlandPrevention,whicheverisolder,pursuanttojoint 15promulgationofrulesestablishedbytheboardofpharmacyandthestateboardof 16registrationforthehealingartsunlessrulesareestablishedunderastateofemergencyas 17describedinsection44.100; 18 (5)Theparticipationindrugselectionaccordingtostatelawandparticipationindrug 19utilizationreviews; 20 (6)Theproperandsafestorageofdrugsanddevicesandthemaintenanceofproper 21recordsthereof; 22 (7)Consultationwithpatientsandotherhealthcarepractitioners,andveterinarians 23andtheirclientsaboutlegenddrugs,aboutthesafeandeffectiveuseofdrugsanddevices; HB478 32 24 (8)Theprescribinganddispensingofanynicotinereplacementtherapyproductunder 25section338.665; 26 (9)ThedispensingofHIVpostexposureprophylaxispursuanttosection338.730;and 27 (10)Theofferingorperformingofthoseacts,services,operations,ortransactions 28necessaryintheconduct,operation,managementandcontrolofapharmacy. 29 2.Nopersonshallengageinthepracticeofpharmacyunlessheorsheislicensed 30undertheprovisionsofthischapter. 31 3.Thischaptershallnotbeconstruedtoprohibittheuseofauxiliarypersonnelunder 32thedirectsupervisionofapharmacistfromassistingthepharmacistinanyofhisorherduties. 33Thisassistanceinnowayisintendedtorelievethepharmacistfromhisorherresponsibilities 34forcompliancewiththischapterandheorshewillberesponsiblefortheactionsofthe 35auxiliarypersonnelactinginhisorherassistance. 36 4.Thischaptershallnotbeconstruedtoprohibitorinterferewithanylegally 37registeredpractitionerofmedicine,dentistry,orpodiatry,orveterinarymedicineonlyforuse 38inanimals,orthepracticeofoptometryinaccordancewithandasprovidedinsections 39195.070and336.220inthecompounding,administering,prescribing,ordispensingofhisor 40herownprescriptions. 41 5.Apharmacistwithacertificateofmedicationtherapeuticplanauthoritymay 42providemedicationtherapyservicespursuanttoawrittenprotocolfromaphysicianlicensed 43underchapter334topatientswhohaveestablishedaphysician-patientrelationship,as 44describedinsubdivision(1)ofsubsection1ofsection191.1146,withtheprotocolphysician. 45Thewrittenprotocolauthorizedbythissectionshallcomeonlyfromthephysicianandshall 46notcomefromanurseengagedinacollaborativepracticearrangementundersection 47334.104,orfromaphysicianassistantengagedinacollaborativepracticearrangementunder 48section334.735. 49 6.Nothinginthissectionshallbeconstruedastopreventanyperson,firmor 50corporationfromowningapharmacyregulatedbysections338.210to338.315,providedthat 51alicensedpharmacistisinchargeofsuchpharmacy. 52 7.Nothinginthissectionshallbeconstruedtoapplytoorinterferewiththesaleof 53nonprescriptiondrugsandtheordinaryhouseholdremediesandsuchdrugsormedicinesas 54arenormallysoldbythoseengagedinthesaleofgeneralmerchandise. 55 8.Nohealthcarrierasdefinedinchapter376shallrequireanyphysicianwithwhich 56theycontracttoenterintoawrittenprotocolwithapharmacistformedicationtherapeutic 57services. 58 9.Thissectionshallnotbeconstruedtoallowapharmacisttodiagnoseor 59independentlyprescribepharmaceuticals. HB478 33 60 10.Thestateboardofregistrationforthehealingarts,undersection334.125,andthe 61stateboardofpharmacy,undersection338.140,shalljointlypromulgaterulesregulatingthe 62useofprotocolsformedicationtherapyservices.Suchrulesshallrequireprotocolstoinclude 63provisionsallowingfortimelycommunicationbetweenthepharmacistandtheprotocol 64physicianorsimilarbodyauthorizedbythissection,andanyotherpatientprotection 65provisionsdeemedappropriatebybothboards.Inordertotakeeffect,suchrulesshallbe 66approvedbyamajorityvoteofaquorumofeachboard.Neitherboardshallseparately 67promulgaterulesregulatingtheuseofprotocolsformedicationtherapyservices.Anyruleor 68portionofarule,asthattermisdefinedinsection536.010,thatiscreatedundertheauthority 69delegatedinthissectionshallbecomeeffectiveonlyifitcomplieswithandissubjecttoallof 70theprovisionsofchapter536and,ifapplicable,section536.028.Thissectionandchapter 71536arenonseverableandifanyofthepowersvestedwiththegeneralassemblypursuantto 72chapter536toreview,todelaytheeffectivedate,ortodisapproveandannularuleare 73subsequentlyheldunconstitutional,thenthegrantofrulemakingauthorityandanyrule 74proposedoradoptedafterAugust28,2007,shallbeinvalidandvoid. 75 11.Thestateboardofpharmacymaygrantacertificateofmedicationtherapeutic 76planauthoritytoalicensedpharmacistwhosubmitsproofofsuccessfulcompletionofa 77board-approvedcourseofacademicclinicalstudybeyondabachelorofscienceinpharmacy, 78includingbutnotlimitedtoclinicalassessmentskills,fromanationallyaccreditedcollegeor 79university,oracertificationofequivalenceissuedbyanationallyrecognizedprofessional 80organizationandapprovedbytheboardofpharmacy. 81 12.Anypharmacistwhohasreceivedacertificateofmedicationtherapeuticplan 82authoritymayengageinthedesigning,initiating,implementing,andmonitoringofa 83medicationtherapeuticplanasdefinedbyawrittenprotocolfromaphysicianthatmaybe 84specifictoeachpatientforcarebyapharmacist. 85 13.Nothinginthissectionshallbeconstruedtoallowapharmacisttomakea 86therapeuticsubstitutionofapharmaceuticalprescribedbyaphysicianunlessauthorizedby 87thewrittenprotocolorthephysician'sprescriptionorder. 88 14."Veterinarian","doctorofveterinarymedicine","practitionerofveterinary 89medicine","DVM","VMD","BVSe","BVMS","BSe(VetScience)","VMB","MRCVS",or 90anequivalenttitlemeansapersonwhohasreceivedadoctor'sdegreeinveterinarymedicine 91fromanaccreditedschoolofveterinarymedicineorholdsanEducationalCommissionfor 92ForeignVeterinaryGraduates(EDFVG)certificateissuedbytheAmericanVeterinary 93MedicalAssociation(AVMA). 94 15.Inadditiontootherrequirementsestablishedbythejointpromulgationofrulesby 95theboardofpharmacyandthestateboardofregistrationforthehealingarts: HB478 34 96 (1)Apharmacistshalladministervaccinesbyprotocolinaccordancewithtreatment 97guidelinesestablishedbytheCentersforDiseaseControlandPrevention(CDC); 98 (2)Apharmacistwhoisadministeringavaccineshallrequestapatienttoremainin 99thepharmacyasafeamountoftimeafteradministeringthevaccinetoobserveanyadverse 100reactions.Suchpharmacistshallhaveadoptedemergencytreatmentprotocols. 101 16.Inadditiontootherrequirementsbytheboard,apharmacistshallreceive 102additionaltrainingasrequiredbytheboardandevidencedbyreceivingacertificatefromthe 103boarduponcompletion,andshalldisplaythecertificationinhisorherpharmacywhere 104vaccinesaredelivered. 105 17.Apharmacistshallinformthepatientthattheadministrationofavaccinewillbe 106enteredintotheShowMeVaxsystem,asadministeredbythedepartmentofhealthandsenior 107services.Thepatientshallattesttotheinclusionofsuchinformationinthesystembysigning 108aformprovidedbythepharmacist.Ifthepatientindicatesthatheorshedoesnotwantsuch 109informationenteredintotheShowMeVaxsystem,thepharmacistshallprovideawritten 110reportwithinfourteendaysofadministrationofavaccinetothepatient'shealthcareprovider, 111ifprovidedbythepatient,containing: 112 (1)Theidentityofthepatient; 113 (2)Theidentityofthevaccineorvaccinesadministered; 114 (3)Therouteofadministration; 115 (4)Theanatomicsiteoftheadministration; 116 (5)Thedoseadministered;and 117 (6)Thedateofadministration. 118 18.Apharmacistlicensedunderthischaptermayorderandadministervaccines 119approvedorauthorizedbytheU.S.FoodandDrugAdministrationtoaddressapublichealth 120need,aslawfullyauthorizedbythestateorfederalgovernment,oradepartmentoragency 121thereof,duringastateorfederallydeclaredpublichealthemergency. 338.710.1.ThereisherebycreatedintheMissouriboardofpharmacythe"RXCares 2forMissouriProgram".Thegoaloftheprogramshallbetopromotemedicationsafetyandto 3preventprescriptiondrugabuse,misuse,anddiversioninMissouri. 4 2.Theboard,inconsultationwiththedepartment,shallbeauthorizedtoexpend, 5allocate,orawardfundsappropriatedtotheboardtoprivateorpublicentitiestodevelopor 6provideprogramsoreducationtopromotemedicationsafetyortosuppressorprevent 7prescriptiondrugabuse,misuse,anddiversioninthestateofMissouri.Innocaseshallthe 8authorizationinclude,northefundsbeexpendedfor,anystateprescriptiondrugmonitoring 9programincluding,butnotlimitedto,suchasaredefinedin38CFR1.515.Fundsdisbursed 10toastateagencyunderthissectionmayenhance,butshallnotsupplant,fundsotherwise 11appropriatedtosuchstateagency.
