1212 210.221.1.Thedepartmentofelementaryandsecondaryeducationshallhavethe
1313 2followingpowersandduties:
1414 3 (1)Afterinspection,tograntlicensestopersonstooperatechild-carefacilitiesif
1515 4satisfiedastothegoodcharacterandintentoftheapplicantandthatsuchapplicantis
1616 5qualifiedandequippedtorendercareorserviceconducivetothewelfareofchildren.Each
1717 6licenseshallspecifytheeffectivedateandwhetherthelicenseistemporary,thekindof
1818 7child-careservicesthelicenseeisauthorizedtoperform,thenumberofchildrenthatcanbe
1919 8receivedormaintained,andtheirages;
2020 9 (2)Toinspecttheconditionsofthehomesandotherplacesinwhichtheapplicant
2121 10operatesachild-carefacility,inspecttheirbooksandrecords,premisesandchildrenbeing
2222 11served,examinetheirofficersandagents,deny,suspend,placeonprobationorrevokethe
2323 12licenseofsuchpersonsasfailtoobeytheprovisionsofsections210.201to210.245orthe
2424 13rulesandregulationsmadebythedepartmentofelementaryandsecondaryeducation.The
2525 14commissioneralsomayrevokeorsuspendalicensewhenthelicenseesurrendersthelicense;

4141 29existingsiteortoaddanewlocation,providedthatthechildcareprovidercompletes
4242 30anybackgroundcheckrequiredforlicensureandalsosubmitsanapprovedfiresafety
4343 31andsanitationinspectionapprovedforthesitebeingexpandedoradded.Temporary
4444 32licensesshallbevalidforadurationofnolongerthantwelvemonthsfromthedateof
4545 33issuanceoruntilthedepartmentmakesafinaldeterminationonfulllicensure.
4646 34 2.Anychild-carefacilitymayrequestavariancefromaruleorregulation
4747 35promulgatedpursuanttothissection.Therequestforavarianceshallbemadeinwritingto
4848 36thedepartmentofelementaryandsecondaryeducationandshallincludethereasonsthe
4949 37facilityisrequestingthevariance.Thedepartmentshallapproveanyvariancerequestthat
5050 38doesnotendangerthehealthorsafetyofthechildrenservedbythefacility.Theburdenof
5151 39proofatanyappealofadisapprovalofavarianceapplicationshallbewiththedepartmentof
5252 40elementaryandsecondaryeducation.Localinspectorsmaygrantavariance,subjectto
5353 41approvalbythedepartmentofelementaryandsecondaryeducation.
5454 42 3.Thedepartmentshalldeny,suspend,placeonprobationorrevokealicenseifit
5555 43receivesofficialwrittennoticethatthelocalgoverningbodyhasfoundthatlicenseis
5656 44prohibitedbyanylocallawrelatedtothehealthandsafetyofchildren.Thedepartmentmay
5757 45denyanapplicationforalicenseifthedepartmentdeterminesthatahomeorotherplacein
5858 46whichanapplicantwouldoperateachild-carefacilityislocatedwithinonethousandfeetof
5959 47anylocationwhereapersonrequiredtoregisterundersections589.400to589.425either
6060 48resides,asthattermisdefinedinsubsection3ofsection566.147,orregularlyreceives
6161 49treatmentorservices,excludinganytreatmentorservicesdeliveredinahospital,asthatterm
6262 50isdefinedinsection197.020,orinfacilitiesownedoroperatedbyahospitalsystem.The
6363 51departmentmay,afterinspection,findthelicensure,denialoflicensure,suspensionor
6464 52revocationtobeinthebestinterestofthestate.
6565 53 4.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis
6666 54createdundertheauthoritydelegatedinsections210.201to210.245shallbecomeeffective
6767 HB482 2 55onlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,
6868 56section536.028.AllrulemakingauthoritydelegatedpriortoAugust28,1999,isofnoforce
6969 57andeffectandrepealed.Nothinginthissectionshallbeinterpretedtorepealoraffectthe
7070 58validityofanyrulefiledoradoptedpriortoAugust28,1999,ifitfullycompliedwithall
7171 59applicableprovisionsoflaw.Thissectionandchapter536arenonseverableandifanyofthe
7272 60powersvestedwiththegeneralassemblypursuanttochapter536toreview,todelaythe
7373 61effectivedate,ortodisapproveandannularulearesubsequentlyheldunconstitutional,then
7474 62thegrantofrulemakingauthorityandanyruleproposedoradoptedafterAugust28,1999,
7575 63shallbeinvalidandvoid.
