15	15	4 (1)"Dealer",apersonwhosells,prepares,ormaintainskratomoradvertises,
16	16	5represents,orholdsoneselfoutasselling,preparing,ormaintainingkratom.Such
17	17	6personmayinclude,butnotbelimitedto,amanufacturer,wholesaler,store,restaurant,
18	18	7hotel,cateringfacility,camp,bakery,delicatessen,supermarket,grocerystore,
19	19	8conveniencestore,nursinghome,orfoodordrinkcompany;
20	20	9 (2)"Kratom",anygoodplacedinthemarketplacecontaininganypartofthe
21	21	10leafoftheplantMitragynaspeciosa.
22	22	11 3.Thegeneralassemblyherebyoccupiesandpreemptstheentirefieldof
23	23	12regulatingkratomtothecompleteexclusionofanyorder,ordinance,orregulationof
24	24	13anypoliticalsubdivisionofthisstate.Anypoliticalsubdivision'sexistingorfuture
25	25	14orders,ordinances,orregulationsrelatingtokratomareherebyvoid.
26	26	15 4.Adealerwhoprepares,distributes,sells,orexposesforsalekratomincluding,
27	27	16butnotlimitedto,kratomintendedforhumanconsumption,shalldisclosethefactual
28	28	17basisuponwhichthatrepresentationismade.
29	29	EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
30	30	intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18 5.Adealershallnotprepare,distribute,sell,orexposeforsaleanyofthe

32	32	20 (1)Kratomthatisadulteratedwithadangerousnonkratomsubstance.Kratom
33	33	21shallbeconsideredtobeadulteratedwithadangerousnonkratomsubstanceifthe
34	34	22kratomismixedorpackedwithanonkratomsubstanceandthatsubstanceaffectsthe
35	35	23qualityorstrengthofthekratomtosuchadegreeastorenderthekratominjurioustoa
36	36	24consumer;
37	37	25 (2)Kratomthatiscontaminatedwithadangerousnonkratomsubstance.
38	38	26Kratomshallbeconsideredtobecontaminatedwithadangerousnonkratomsubstance
39	39	27ifthekratomcontainsapoisonousorotherwisedeleteriousnonkratomingredient
40	40	28including,butnotlimitedto,anysubstancelistedinsection195.017;
41	41	29 (3)Kratomcontainingalevelof7-hydroxymitragynineinthealkaloidfraction
42	42	30thatisgreaterthantwopercentofthealkaloidcompositioncontainedtherein;
43	43	31 (4)Kratomcontaininganysyntheticalkaloids,includingsyntheticmitragynine,

52	52	40 (2)Adealerwhoviolatessubsection5or6ofthissectionshallbeguiltyofaclass
53	53	41Dmisdemeanor.
54	54	42 (3)Apersonaggrievedbyaviolationofsubsection4or5ofthissectionmay,in
55	55	43additiontoanddistinctfromanyotherremedyatlaworinequity,bringaprivatecause
