BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows: SectionA.Section170.029,RSMo,isrepealedandonenewsectionenactedinlieu 2thereof,tobeknownassection170.029,toreadasfollows: 170.029.1.Thestateboardofeducationshalldevelopastatewideplanforcareerand 2technicaleducation(CTE)thatensuressustainability,viability,andrelevancebymatching 3workforceneedswithappropriateeducationalresources. 4 2.Thestateboardofeducation,inconsultationwiththecareerandtechnical 5educationadvisorycouncilasestablishedinsection178.550,shallestablishminimum 6requirementsforaCTEcertificatethatastudentcanearninadditiontothestudent'shigh 7schoolgraduationdiploma.Studentsenteringhighschoolinschoolyear2017-18and 8thereaftershallbeeligibletoearnaCTEcertificate. 9 3.ThestatewideplanshallestablishCTErequirementsintendedtoprovidestudents 10withthenecessarytechnicalemployabilityskillstobepreparedforanentry-levelcareerina 11technicalfieldoradditionaltraininginatechnicalfield.Theprovisionsofthissectionshall 12notbeconsideredameansfortrackingstudentsinordertoimpelstudentstoparticular 13vocational,career,orcollegepaths.Thestateboardofeducationshallworkwithlocalschool 14districtstoensurethattrackingdoesnotoccur.Forpurposesofthissection,"tracking"means 15separatingpupilsbyacademicabilityintogroupsforallsubjectsorcertainclassesand 16curriculum. EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17 4.Eachlocalschooldistrictshalldeterminethecurriculum,programsofstudy,and 18courseofferingsbasedontheneedsandinterestsofthestudentsinthedistrictandmeetingthe 19requirementsofthestatewideplan.AsrequiredbyMissouri'sstateplanforcareereducation 20andtheMissourischoolimprovementprogram,thestateboardofeducationshallworkin 21cooperationwithindividualschooldistrictstostipulatetheminimumnumberofCTE 22offerings.Eachlocalschooldistrictshallstrivetoofferprogramsofstudythatare 23economicallyfeasibleforstudentsinthedistrict.InestablishingCTEofferings,thedistrict 24mayrelyonstandards,technicalcoursework,andskillsassessmentsdevelopedforindustry- 25recognizedcertificatesorcredentials. 26 5.ToenableschooldistrictstoofferCTEprogramsofstudythatarecurrentwith 27businessandindustrystandards,thedepartmentofelementaryandsecondaryeducationshall 28conveneworkgroupsfromeachprogramareatodevelopandrecommendrigorousand 29relevantperformancestandardsorcoursecompetenciesforeachprogramofstudy.Thework 30groupsshallinclude,butnotbelimitedto,educatorsprovidinginstructionineachCTE 31programarea,advisorsfromeachCTEprogramareafromthedepartmentofelementaryand 32secondaryeducation,thedepartmentofhighereducationandworkforcedevelopment, 33businessandindustry,andinstitutionsofhighereducation.Thedepartmentofelementary 34andsecondaryeducationshalldevelopwrittenmodelcurriculumframeworksrelatingtoCTE 35programareasthatmaybeusedbyschooldistricts.Therequirementsofsection160.514 36shallnotapplytothissection. 37 6.NolaterthanJanuary1,2017,thedepartmentofelementaryandsecondary 38educationshalldevelopaprocessforrecognitionofaschooldistrict'scareerandtechnical 39educationprogramthatoffersacareerandtechnicaleducationcertificate. 40 7.(1)Asusedinthissubsection,thefollowingtermsmean: 41 (a)"CIP",thefederaltaxonomiccodingschemeofinstructionalprograms, 42knownastheClassificationofInstructionalPrograms,thatwasdevelopedandis 43periodicallyupdatedbytheUnitedStatesDepartmentofEducation'sNationalCenter 44forEducationStatisticstosupporttheaccuratetrackingandreportingoffieldsofstudy 45andprogramcompletionsactivity; 46 (b)"CIPcode",thestandardstatisticalcodingtoolthatreflectsthecurrent 47practiceofgenerallycategorizingprogramcompletionsdatawithintheCIPtitlesand 48programs. 49 (2)Forthe2025-26schoolyearandallsubsequentschoolyears,thestateboard 50ofeducation,inconsultationwiththecareerandtechnicaleducationadvisorycouncil 51establishedinsection178.550,shallevaluatethemostrecenteditionofandanyupdates 52totheCIPtodeterminethetypesofinstructionalprogramsthatmaymeettheminimum HB512 2 53requirementsleadingtorecognitionaspartofaCTEprogramthatoffersaCTE 54certificateunderthissection. 55 (3)Duringtheevaluationrequiredundersubdivision(2)ofthissubsection,ifthe 56boardandcouncildeterminethat: 57 (a)AnexistingteachercertificationcanbeassignedtoaparticularCIPcode,the 58programrepresentedbysuchCIPcodeshallbeapprovedasaCTEprogramunderthis 59section;or 60 (b)NoexistingteachercertificationcanbeassignedtoaparticularCIPcode,the 61programrepresentedbysuchCIPcodemaybeapprovedasaCTEprogramandshall 62bedesignatedasaprogramwithinappropriateteachercertificationuntilan 63appropriateteachercertificationisadded.Upontheadditionofanappropriate 64teachercertification,theprogramrepresentedbysuchCIPcodeshallbeapprovedasa 65CTEprogramunderthissection. 66 8.Thedepartmentofelementaryandsecondaryeducationshallpromulgateall 67necessaryrulesandregulationsfortheadministrationofthissection.Anyruleorportionofa 68rule,asthattermisdefinedinsection536.010,thatiscreatedundertheauthoritydelegatedin 69thissectionshallbecomeeffectiveonlyifitcomplieswithandissubjecttoallofthe 70provisionsofchapter536and,ifapplicable,section536.028.Thissectionandchapter536 71arenonseverableandifanyofthepowersvestedwiththegeneralassemblypursuantto 72chapter536toreview,todelaytheeffectivedate,ortodisapproveandannularuleare 73subsequentlyheldunconstitutional,thenthegrantofrulemakingauthorityandanyrule 74proposedoradoptedafterAugust28,2016,shallbeinvalidandvoid. ✔ HB512 3
