329.010.Asusedinthischapter,unlessthecontextclearlyindicatesotherwise,the
2followingwordsandtermsmean:
3 (1)"Accreditedschoolofcosmetologyorschoolofmanicuring",anestablishment
4operatedforthepurposeofteachingcosmetologyasdefinedinthissectionandmeetingthe
5criteriasetforthunder34C.F.R.Part600,Sections600.1and600.2;
6 (2)"Apprentice"or"student",apersonwhoisengagedintrainingwithina
7cosmetologyestablishmentorschool,andwhilesotrainingperformsanyofthepracticesof
8theclassifiedoccupationswithinthischapterundertheimmediatedirectionandsupervision
9ofalicensedcosmetologistorinstructor;
10 (3)"Board",thestateboardofcosmetologyandbarberexaminers;
11 (4)"Cosmetologist",anypersonwho,forcompensation,engagesinthepracticeof
12cosmetology,asdefinedinsubdivision(5)ofthissection;
13 (5)"Cosmetology"includesperformingorofferingtoengageinanyactsofthe
14classifiedoccupationsofcosmetologyforcompensation,whichshallinclude:
15 (a)"ClassCH-hairdresser"includesarranging,dressing,curling,singeing,waving,
16permanentwaving,cleansing,cutting,bleaching,tinting,coloringorsimilarworkuponthe
17hairofanypersonbyanymeans;orremovingsuperfluoushairfromthebodyofanyperson

24 (b)"ClassMO-manicurist"includescutting,trimming,polishing,coloring,tinting,
25cleaningorotherwisebeautifyingaperson'sfingernails,applyingartificialfingernails,
26massaging,cleaningaperson'shandsandarms;pedicuring,whichincludescutting,trimming,
27polishing,coloring,tinting,cleaningorotherwisebeautifyingaperson'stoenails,applying
28artificialtoenails,massagingandcleaningaperson'slegsandfeet;
29 (c)"ClassCA-hairdressingandmanicuring"includesallpracticesofcosmetology,
30asdefinedinparagraphs(a)and(b)ofthissubdivision;
31 (d)"ClassE-estheticians"includestheuseofmechanical,electricalapparatusesor
32appliances,orbytheuseofcosmeticpreparations,antiseptics,tonics,lotionsorcreams,not
33toexceedtenpercentphenol,engagesforcompensation,eitherdirectlyorindirectly,inany
34one,oranycombination,ofthefollowingpractices:massaging,cleansing,stimulating,
35manipulating,exercising,beautifyingorsimilarworkuponthescalp,face,neck,ears,arms,
36hands,bust,torso,legsorfeetandremovingsuperfluoushairbymeansotherthanelectric
37needleoranyothermeansofarchingortintingeyebrowsortintingeyelashes,ofanyperson;

39 (e)"Personalserviceregistration",aregistrationobtainedfromtheboardto
40provideservicestoplaceboundclients;
41 (6)"Cosmetologyestablishment",thatpartofanybuildingwhereinorwhereuponany
42oftheclassifiedoccupationsarepracticedincludinganyspacerentedwithinalicensed
43establishmentbyapersonlicensedunderthischapter,forthepurposeofrendering
44cosmetologyservices;
45 (7)"Cross-overlicense",alicensethatisissuedtoanypersonwhohasmetthe
46licensureandexaminationrequirementsforbothbarberingandcosmetology;
47 (8)"Hairbraider",anypersonwho,forcompensation,engagesinthepracticeofhair
48braiding;
49 (9)"Hairbraiding",inaccordancewiththerequirementsofsection329.275,theuse
50oftechniquesthatresultintensiononhairstrandsorrootsbytwisting,wrapping,waving,
51extending,locking,orbraidingofthehairbyhandormechanicaldevice,butdoesnotinclude
52theapplicationofdyes,reactivechemicals,orotherpreparationstoalterthecolorofthehair
53ortostraighten,curl,oralterthestructureofthehair;

329.280.1.Anycosmetologistholdingacurrentandactivelicensetopractice
2thecategoriesofcosmetologydescribedinparagraphs(a)to(d)ofsubdivision(5)of
3section329.010mayregisterwiththeboardforapersonalserviceregistrationto
4provideservicestoplaceboundclientsoutsideofacosmetologyestablishment.An
5applicantforapersonalserviceregistrationshallsubmittotheboardanapplication,a
6feeassetbytheboard,andacopyoftheapplicant'scurrentandactivelicense.An
7applicantforapersonalserviceregistrationmaybedeniedsuchregistrationifthe
8applicanthaspledguiltyto,enteredapleaofnolocontendereto,orbeenfoundguiltyof
9anyoftheoffensessetforthinsubsection5ofsection329.050.
10 2.Apersonalserviceregistrantshallkeephisorherinformationthattheboard
11requiresintheinitialregistrationcurrentanduptodatewiththeboard.
12 3.Apersonalserviceregistrantshallprovidetotheclientorcustomeracopyof
13thepersonalserviceregistrationandlicenseuponrequest.
14 4.Theboardmay:
15 (1)Inspectthetools,equipment,andimplementsofanypersonalservice
16registrantonetimeeachyeartoensurethattheregistrantisfollowingallsanitation
17standardssetbytheboardbyrule;
18 (2)Inspectthetools,equipment,andimplementsofanypersonalservice
19registrantifacustomerorclientsubmitsacomplainttotheboardabouttheregistrant;
20and
21 (3)Followingallrequirementssetforthinsection329.140,revokethepersonal
22serviceregistrationofaregistrant,disciplinearegistrant'slicense,orrevokethe
23registrationanddisciplinethelicenseofaregistrantforanyviolationsetforthinsection
24329.140orforfailuretofollowtherequirementsofthissection.
HB52 3 25 5.Theboardmaypromulgateregulationsnecessaryfortheadministrationof
26thissection.Anyruleorportionofarule,asthattermisdefinedinsection536.010,that
27iscreatedundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifit
28complieswithandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,
29section536.028.Thissectionandchapter536arenonseverableandifanyofthepowers
30vestedwiththegeneralassemblypursuanttochapter536toreview,todelaythe
31effectivedate,ortodisapproveandannularulearesubsequentlyheldunconstitutional,
32thenthegrantofrulemakingauthorityandanyruleproposedoradoptedafterAugust
3328,2025,shallbeinvalidandvoid.
