Torepealsection210.221,RSMo,andtoenactinlieuthereofonenewsectionrelatingto
licensingofchildcarefacilities.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section210.221,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection210.221,toreadasfollows:
210.221.1.Thedepartmentofelementaryandsecondaryeducationshallhavethe
2followingpowersandduties:
3 (1)Afterinspection,tograntlicensestopersonstooperatechild-carefacilitiesif
4satisfiedastothegoodcharacterandintentoftheapplicantandthatsuchapplicantis
5qualifiedandequippedtorendercareorserviceconducivetothewelfareofchildren.Each
6licenseshallspecifytheeffectivedateandwhetherthelicenseistemporary,thekindof
7child-careservicesthelicenseeisauthorizedtoperform,thenumberofchildrenthatcanbe
8receivedormaintained,andtheirages;
9 (2)Toinspecttheconditionsofthehomesandotherplacesinwhichtheapplicant
10operatesachild-carefacility,inspecttheirbooksandrecords,premisesandchildrenbeing
11served,examinetheirofficersandagents,deny,suspend,placeonprobationorrevokethe
12licenseofsuchpersonsasfailtoobeytheprovisionsofsections210.201to210.245orthe
13rulesandregulationsmadebythedepartmentofelementaryandsecondaryeducation.The
14commissioneralsomayrevokeorsuspendalicensewhenthelicenseesurrendersthelicense;
15 (3)Topromulgateandissuerulesandregulationsthedepartmentdeemsnecessaryor
16properinordertoestablishstandardsofserviceandcaretoberenderedbysuchlicenseesto
17children.Noruleorregulationpromulgatedbythedepartmentshallinanymannerrestrictor
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18interferewithanyreligiousinstruction,philosophiesorministriesprovidedbythefacilityand
19shallnotapplytofacilitiesoperatedbyreligiousorganizationswhicharenotrequiredtobe
20licensed;
21 (4)ToapprovetrainingconcerningthesafesleeprecommendationsoftheAmerican
22AcademyofPediatricsinaccordancewithsection210.223;[and]
23 (5)Todeterminewhatrecordsshallbekeptbysuchpersonsandtheformthereof,and
24themethodstobeusedinkeepingsuchrecords,andtorequirereportstobemadetothe
25departmentatregularintervals; and
26 (6)Tograntatemporarychildcarelicensetoachildcareproviderwhoisnoton
27probationorhasacurrentletterofcensure,uponsubmittalofacompletelicense
28applicationtothedepartmentofelementaryandsecondaryeducation,toexpandan
29existingsiteortoaddanewlocation,providedthatthechildcareprovidercompletes
30anybackgroundcheckrequiredforlicensureandalsosubmitsanapprovedfiresafety
31andsanitationinspectionapprovedforthesitebeingexpandedoradded.Temporary
32licensesshallbevalidforadurationofnolongerthantwelvemonthsfromthedateof
33issuanceoruntilthedepartmentmakesafinaldeterminationonfulllicensure.
34 2.Anychild-carefacilitymayrequestavariancefromaruleorregulation
35promulgatedpursuanttothissection.Therequestforavarianceshallbemadeinwritingto
36thedepartmentofelementaryandsecondaryeducationandshallincludethereasonsthe
37facilityisrequestingthevariance.Thedepartmentshallapproveanyvariancerequestthat
38doesnotendangerthehealthorsafetyofthechildrenservedbythefacility.Theburdenof
39proofatanyappealofadisapprovalofavarianceapplicationshallbewiththedepartmentof
40elementaryandsecondaryeducation.Localinspectorsmaygrantavariance,subjectto
41approvalbythedepartmentofelementaryandsecondaryeducation.
42 3.Thedepartmentshalldeny,suspend,placeonprobationorrevokealicenseifit
43receivesofficialwrittennoticethatthelocalgoverningbodyhasfoundthatlicenseis
44prohibitedbyanylocallawrelatedtothehealthandsafetyofchildren.Thedepartmentmay
45denyanapplicationforalicenseifthedepartmentdeterminesthatahomeorotherplacein
46whichanapplicantwouldoperateachild-carefacilityislocatedwithinonethousandfeetof
47anylocationwhereapersonrequiredtoregisterundersections589.400to589.425either
48resides,asthattermisdefinedinsubsection3ofsection566.147,orregularlyreceives
49treatmentorservices,excludinganytreatmentorservicesdeliveredinahospital,asthatterm
50isdefinedinsection197.020,orinfacilitiesownedoroperatedbyahospitalsystem.The
51departmentmay,afterinspection,findthelicensure,denialoflicensure,suspensionor
52revocationtobeinthebestinterestofthestate.
53 4.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis
54createdundertheauthoritydelegatedinsections210.201to210.245shallbecomeeffective
HB53	2 55onlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,
56section536.028.AllrulemakingauthoritydelegatedpriortoAugust28,1999,isofnoforce
57andeffectandrepealed.Nothinginthissectionshallbeinterpretedtorepealoraffectthe
58validityofanyrulefiledoradoptedpriortoAugust28,1999,ifitfullycompliedwithall
59applicableprovisionsoflaw.Thissectionandchapter536arenonseverableandifanyofthe
60powersvestedwiththegeneralassemblypursuanttochapter536toreview,todelaythe
61effectivedate,ortodisapproveandannularulearesubsequentlyheldunconstitutional,then
62thegrantofrulemakingauthorityandanyruleproposedoradoptedafterAugust28,1999,
63shallbeinvalidandvoid.
