HB555 2 53 (2)Thetotalprojectcostshallbebasedupontheentireprojectandnotindividual 54projectswithinalargerproject. 55 (3)Thetotalprojectcostshallincludethevalueofworkperformedontheprojectby 56everypersonpaidbyacontractororsubcontractorforthatperson'sworkontheproject.The 57totalprojectcostshalladditionallyincludeallmaterialsandsuppliespurchasedforthe 58project. 59 6.Apublicbodyshallnotdivideaprojectintomultiplecontractsforthepurposeof 60loweringthetotalprojectcostbelowthethresholddescribedinsubsection5ofthissection. 61 7.Foranypublicworksprojectforwhicheithertheengineer'sestimateorthebid 62acceptedbythepublicbodyforthetotalprojectcostisintheamountof[seventy-five] one 63hundredfiftythousanddollarsorlessthatbecomessubjecttoachangeorderthatincreases 64thetotalprojectcostinexcessof[seventy-five] onehundredfiftythousanddollars,the 65provisionsofsections290.210to290.340shallapplyonlytothatportionoftheprojectthat 66wasinexcessof[seventy-five] onehundredfiftythousanddollars. 67 8.Notwithstandinganyprovisionoflawtothecontrary,forthepurposesof 68constructionofpublicworksforwhicheithertheengineer'sestimateorthebidacceptedby 69thepublicbodyforthetotalprojectcostisintheamountoftenthousanddollarsorlessforall 70occupationaltitles,publicbodiesshallbeexemptfromanylawrequiringtheuseof 71competitivebids. 290.502.1.Exceptasmaybeotherwiseprovidedpursuanttosections290.500to 2290.530,effectiveJanuary1,2007,everyemployershallpaytoeachemployeewagesatthe 3rateof$6.50perhour,orwagesatthesamerateorratessetundertheprovisionsoffederal 4lawastheprevailingfederalminimumwageapplicabletothosecoveredjobsininterstate 5commerce,whicheverrateperhourishigher. 6 2.TheminimumwageshallbeincreasedordecreasedonJanuary1,2008,andon 7January1ofsuccessiveyears,bytheincreaseordecreaseinthecostofliving.OnSeptember 830,2007,andoneachSeptember30ofeachsuccessiveyear,thedirectorshallmeasurethe 9increaseordecreaseinthecostoflivingbythepercentageincreaseordecreaseasofthe 10precedingJulyoverthelevelasofJulyoftheimmediatelyprecedingyearoftheConsumer 11PriceIndexforUrbanWageEarnersandClericalWorkers(CPI-W)orsuccessorindexas 12publishedbytheU.S.DepartmentofLabororitssuccessoragency,withtheamountofthe 13minimumwageincreaseordecreaseroundedtothenearestfivecents. 14 3.Exceptasmaybeotherwiseprovidedpursuanttosections290.500to290.530,and 15notwithstandingsubsection1ofthissection,effectiveJanuary1,2025,everyemployershall 16paytoeachemployeewagesattherateofnotlessthan$13.75perhour,orwagesatthesame 17rateorratessetundertheprovisionsoffederallawastheprevailingfederalminimumwage 18applicabletothosecoveredjobsininterstatecommerce,whicheverrateperhourishigher. HB555 3 19Thereafter,theminimumwageestablishedbythissubsectionshallbeincreasedby$1.25per 20hour,to$15.00perhour,effectiveJanuary1,[2026] 2028. Thereafter,theminimumwage 21establishedbythissubsectionshallbeincreasedordecreasedonJanuary1,[2027] 2030, and 22onJanuary1ofsuccessiveyears,perthemethodsetforthinsubsection2ofthissection.Ifat 23anytimethefederalminimumwagerateisaboveoristhereafterincreasedabovethe 24minimumwagethenineffectunderthissubsection,theminimumwagerequiredbythis 25subsectionshallcontinuetobeincreasedpursuanttothissubsection,butthehigherfederal 26rateshallimmediatelybecometheminimumwagerequiredbythissubsectionandshallbe 27increasedordecreasedperthemethodsetforthinsubsection2forsolongasitremains 28higherthanthestateminimumwagerequiredandincreasedpursuanttothissubsection. 29 4.Forpurposesofthissection,theterm"publicemployer"meansanemployerthatis 30thestateorapoliticalsubdivisionofthestate,includingadepartment,agency,officer,bureau, 31division,board,commission,orinstrumentalityofthestate,oracity,county,town,village, 32schooldistrict,orotherpoliticalsubdivisionofthestate.Subsection3ofthissectionshallnot 33applytoapublicemployerwithrespecttoitsemployees.Anypublicemployerthatissubject 34tosubsections1and2ofthissectionshallcontinuetobesubjecttothosesubsections. 290.603.1.Employeesofanemployerwithfifteenormoreemployeesshallaccruea 2minimumofonehourofearnedpaidsicktimeforeverythirty-two hoursworked,butsuch 3employeesshallnotbeentitledtousemorethanfifty-sixhoursofearnedpaidsicktimeper 4year,unlesstheemployerselectsahigherlimit. 5 2.Employeesofanemployerwithfewerthanfifteenemployeesshallaccruea 6minimumofonehourofearnedpaidsicktimeforeverythirty-two hoursworked,butsuch 7employeesshallnotbeentitledtousemorethanfortyhoursofearnedpaidsicktimeperyear, 8unlesstheemployerselectsahigherlimit. 9 3.Indeterminingthenumberofemployeesofanemployer,allemployeesperforming 10workinthestateforanemployerforcompensationonafull-time,part-time,ortemporary 11basisshallbecounted.Insituationsinwhichthenumberofemployeesperformingworkin 12thestateforanemployerforcompensationperweekfluctuatesaboveandbelowfifteen 13employeesperweekoverthecourseofayear,anemployerisrequiredtoprovideearnedpaid 14sicktimepursuanttosubsection1ofthissectionifitmaintainedfifteenormoreemployeesin 15thestateonthepayrollforsomeportionofaworkingdayineachoftwentyormoredifferent 16calendarweeks,includinganyperiodsofleave,andwhetherornottheweekswere 17consecutive,ineitherthecurrentortheprecedingyear(irrespectiveofwhetherthesame 18individualswereinemploymentineachworkingday). 19 4.Allemployeesshallaccrueearnedpaidsicktimeasfollows: 20 (1)Earnedpaidsicktimeasprovidedinthissectionshallbegintoaccrueatthe 21commencementofemploymentorMay1,2025,whicheverislater.Anemployeeshallbe HB555 4 22entitledtouseearnedpaidsicktimeasitisaccrued.Anemployermayprovideallearned 23paidsicktimethatanemployeeisexpectedtoaccrueinayearatthebeginningoftheyear; 24 (2)Employeeswhoareexemptfromovertimerequirementsunder29U.S.C.§213(a) 25(1)oftheFederalFairLaborStandardsActwillbeassumedtoworkfortyhoursineachwork 26weekforpurposesofearnedpaidsicktimeaccrualunlesstheirnormalworkweekislessthan 27fortyhours,inwhichcaseearnedpaidsicktimeaccruesbaseduponthatnormalworkweek; 28 (3)Uptoeightyhoursofearnedpaidsicktimeshallbecarriedovertothefollowing 29yeariftheemployeehasanyunusedaccruedearnedpaidsicktimeattheendoftheyear,but 30thislawdoesnotrequireanemployertopermitanemployeetousemorethantheapplicable 31numberofhoursofearnedpaidsicktimeperyearassetforthinsubsections1and2ofthis 32section.Alternatively,inlieuofcarryoverofunusedearnedpaidsicktimefromoneyearto 33thenext,anemployermaypayanemployeeforunusedearnedpaidsicktimeattheendofa 34yearwhichcouldbecarriedoverandprovidetheemployeewithanamountofpaidsicktime 35thatmeetsorexceedstherequirementsofsections290.600through290.642thatisavailable 36fortheemployee'simmediateuseatthebeginningofthesubsequentyear; 37 (4)Ifanemployeeistransferredtoaseparatedivision,entity,orlocation,butremains 38employedbythesameemployer,theemployeeisentitledtoallearnedpaidsicktimeaccrued 39atthepriordivision,entity,orlocationandisentitledtouseallearnedpaidsicktimeas 40providedinthissection.Whenthereisaseparationfromemploymentandtheemployeeis 41rehiredwithinninemonthsofseparationbythesameemployer,previouslyaccruedearned 42paidsicktimethathadnotbeenusedshallbereinstated.Further,theemployeeshallbe 43entitledtouseaccruedearnedpaidsicktimeandaccrueadditionalearnedpaidsicktimeatthe 44recommencementofemployment; 45 (5)Whenadifferentemployersucceedsortakestheplaceofanexistingemployer,all 46employeesoftheoriginalemployerwhoremainemployedbythesuccessoremployerare 47entitledtoallearnedpaidsicktimetheyaccruedwhenemployedbytheoriginalemployer, 48andareentitledtouseearnedpaidsicktimepreviouslyaccrued; 49 (6)Atitsdiscretion,anemployermayloanearnedpaidsicktimetoanemployeein 50advanceofaccrualbysuchemployee. 51 5.Anyemployerwithapaidleavepolicy,suchasapaidtimeoffpolicy,whomakes 52availableanamountofpaidleavesufficienttomeettheaccrualrequirementsofthissection 53thatmaybeusedforthesamepurposesandunderthesameconditionsasearnedpaidsick 54timeundersections290.600through290.642isnotrequiredtoprovideadditionalpaidsick 55timeunderthissection. 56 6.Exceptasspecificallyprovidedinthissection,nothinginthissectionshallbe 57construedasrequiringfinancialorotherreimbursementtoanemployeefromanemployer HB555 5 58upontheemployee'stermination,resignation,retirement,orotherseparationfrom 59employmentforaccruedearnedpaidsicktimethathasnotbeenused. 60 7.EmployeesshallnotaccrueearnedpaidsicktimebeforeMay1,2025.Employees 61whoareemployedorwhocommenceemploymentonorafterMay1,2025shallaccrue 62earnedpaidsicktimeandbeentitledtouseearnedpaidsicktimeasitisaccruedin 63accordancewithsections290.600through290.642.Thedepartmentmaydevelopmodel 64postersandnotices,engageinrulemaking,initiateoutreachprograms,andengageinother 65activitiesforimplementationoftheprovisionsofsections290.600through290.642as 66authorizedbythosesectionsbeforeMay1,2025. 290.612.1.Employersshallgiveemployeesawrittennoticeaboutearnedpaidsick 2timewithinfourteencalendardaysofthecommencementofemploymentoronApril15, 32025,whicheverislater,whichmustincludethefollowinginformation:(1)beginningMay 41,2025,employeesaccrueandareentitledtoearnedpaidsicktimeattherateofonehourof 5earnedpaidsicktimeforeverythirty-two hoursofwork,andmayuseearnedpaidsicktime, 6subjecttothelimitsandtermsundersections290.600through290.642ofMissourilaw,(2)it 7isprohibitedforanemployertotakeretaliatorypersonnelactionagainstemployeeswho 8requestoruseearnedpaidsicktimeasallowedbylaw,(3)eachemployeehastherightto 9bringacivilactionifearnedpaidsicktimeasrequiredbysections290.600through290.642 10isdeniedbytheemployerortheemployeeissubjectedtoretaliatorypersonnelactionbythe 11employerforexercisingtheemployee'srightsundersections290.600through290.642;and, 12(4)thecontactinformationforthedepartment.Noticeshallbeprovidedbytheemployerto 13theemployeeonasinglepieceofpaper,atleast8.5x11,innolessthan14-pointfont. 14 2.BeginningApril15,2025,employersshalldisplayaposterthatcontainsthe 15informationrequiredinsubsection1ofthissectioninaconspicuousandaccessibleplacein 16eachestablishmentwheresuchemployeesareemployed,providedthatsuchposterhasbeen 17madeavailablebythedepartment. 18 3.Thedepartmentmaycreateandmakeavailabletoemployers,modelnoticesand 19postersthatcontaintheinformationrequiredundersubsection1ofthissectionforemployers' 20useincomplyingwithsubsections1and2ofthissection.Nothinginthissubsectionshallbe 21interpretedorapplied,eitherexpresslyorthroughpracticalnecessity,torequirethe 22departmenttocreateormakeavailablenoticesorpostersifitrequirestheappropriationof 23fundstocoverthecostsofsuchacts.
