10 (4)"Utilitycontractor",aperson,includinganindividual,corporation,firm, 11incorporatedorunincorporatedassociationorotherbusinessorlegalentity,thatcontracts, 12whetherinwritingornotinwriting,withautilitytoengageinorassistanyentityinengaging 13inHVACservices,butdoesnotincludeemployeesofautility. 386.756.1.[Exceptbyanaffiliate,]AutilitymaynotengageinHVACservices, 2unlessotherwiseprovidedinsubsection[7or]8ofthissection. 3 2.Noaffiliateorutilitycontractormayuseanyvehicles,servicetools,instruments, 4employees,oranyotherutilityassets,thecostofwhicharerecoverableintheregulatedrates 5forutilityservice,toengageinHVACservicesunlesstheutilityiscompensatedfortheuseof 6suchassetsatcosttotheutility. 7 3.Autilitymaynotuseorallowanyaffiliateorutilitycontractortousethenameof 8suchutilitytoengageinHVACservicesunlesstheutility,affiliateorutilitycontractor 9discloses,inplainviewandinboldtypeonthesamepageasthenameisusedonall 10advertisementsorinplainaudiblelanguageduringallsolicitationsofsuchservices,a 11disclaimerthatstatestheservicesprovidedarenotregulatedbythepublicservice 12commission. 13 4.Autilitymaynotengageinorassistanyaffiliateorutilitycontractorinengagingin 14HVACservicesinamannerwhichsubsidizestheactivitiesofsuchutility,affiliateorutility 15contractortotheextentofchangingtheratesorchargesfortheutility'sregulatedservices 16aboveorbelowtheratesorchargesthatwouldbeineffectiftheutilitywerenotengagedinor 17assistinganyaffiliateorutilitycontractorinengaginginsuchactivities. 18 5.AnyaffiliatesorutilitycontractorsengagedinHVACservicesshallmaintain 19accounts,booksandrecordsseparateanddistinctfromtheutility. 20 6.Theprovisionsofthissectionshallapplytoanyaffiliateorutilitycontractor 21engagedinHVACservicesthatisowned,controlledorundercommoncontrolwithautility 22providingregulatedutilityserviceinthisstateoranyotherstate. 23 7.[AutilityengaginginHVACservicesinthisstatefiveyearspriortoAugust28, 241998,maycontinueproviding,toexistingaswellasnewcustomers,thesametypeofservices HB560 2 25asthoseprovidedbytheutilityfiveyearspriortoAugust28,1998.Theprovisionsofthis 26sectiononlyapplytotheareaofservicewhichtheutilitywasactuallysupplyingservicetoon 27aregularbasispriortoAugust28,1993.Theprovisionsofthissectionshallnotapplytoany 28subsequentlyexpandedareasofservicemadebyautilitythrougheitherexistingaffiliatesor 29subsidiariesorthroughaffiliatesorsubsidiariespurchasedafterAugust28,1993,unlesssuch 30serviceswerebeingprovidedintheexpandedareapriortoAugust28,1993. 31 8.]Theprovisionsofthissectionshallnotbeconstruedtoprohibitautilityfrom 32providingemergencyservice,providinganyservicerequiredbylaworprovidingaprogram 33pursuanttoanexistingtariff,ruleororderofthepublicservicecommissionthatisconsistent 34withthissection. 35 [9.]8.Autilitythatviolatesanyprovisionofthissectionisguiltyofaciviloffense 36andmaybesubjecttoacivilpenaltyofuptotwelvethousandfivehundreddollarsforeach 37violation.Theattorneygeneralmayenforcetheprovisionsofthissectionpursuanttoany 38powersgrantedtohimorherpursuanttoanyrelevantprovisionsprovidedbyMissouri 39statutesortheMissouriConstitution. 40 9.Uponreceivinginformationthatraisesareasonableinferencethatany 41provisionofsections386.754to386.764hasbeenviolated,thecommissionshall 42investigateanduponfindingreasonablecausetobelieveaviolationhasoccurred, 43promptlyacttoabatetheviolationandimposeanyrequiredpenalties.Anyperson 44informingthecommissionofanapparentoractualviolationoftheprovisionsofsections 45386.754to386.764shallnotbemadeapartytoanactionofthecommissionbutmaybe 46allowedtointervenewithoutbeingsubjecttoanyburdenofproof.Theperson 47informingthecommissionofanapparentoractualviolationoftheprovisionsofsections 48386.754to386.764,andanyotherinterestedperson,shallbeprovidedacopyofany 49investigation,settlement,order,orotherdispositionofthecomplaint,butnotthework- 50productofthecommission’sgeneralcounsel. 51 10.Anyutilityclaiminganexemptionasprovidedinsubsection7ofthissectionshall 52complywithallapplicablestateandlocallaws,ordinancesorregulationsrelatingtothe 53installationormaintenanceofHVACsystemsincludingallpermitrequirements.A 54continuingpatternoffailuretocomplywithsaidrequirementsshallprovidethebasisfora 55findingbyanycourtofcompetentjurisdictionorthepublicservicecommissionthatthe 56utilityhaswaiveditsclaimofexemptionpursuanttosubsection7ofthissection. 386.760.1.Thepublicservicecommissionshallhavefullauthoritytoadministerand 2ensurecompliancewithsections386.754to386.764,providedthatthecommissionshallnot 3impose,byruleorotherwise,requirementsregardingHVACservicesthatareinconsistent 4withorinadditiontothosesetforthinsections386.754to386.764orwithrequirementsset 5forthinsection386.315.
