HB566 8 15 3.Thechairpersonshallbetheadministrativeandexecutiveofficeroftheboard,and 16itshallbehisorherdutytosuperviseandexpeditetheworkoftheboardanditsdivisions, 17and,athisorherelection,whenatieexistsbetweenthedivisionsoftheboard,tobreakthetie 18byrecordinghisorhervotefororagainsttheactionuponwhichthedivisionsarein 19disagreement.Eachmemberofthearchitecturaldivisionshallhaveonevotewhenvotingon 20anactionpendingbeforetheboard;eachmemberoftheprofessionalengineeringdivision 21shallhaveonevotewhenvotingonanactionpendingbeforetheboard;eachmemberofthe 22professionallandsurveyingdivisionshallhaveonevotewhenvotingonanactionpending 23beforetheboard;[and]eachmemberoftheprofessionallandscapearchitecturaldivisionshall 24haveonevotewhenvotingonanactionpendingbeforetheboard; andeachmemberofthe 25licensedinteriordesigndivisionshallhaveonevotewhenvotingonanactionpending 26beforetheboard. 79practiceoflicensedinteriordesignforthepurposesofthischapter,providedthatno 80facultymemberofanaccreditedschoolofinteriordesignshallbeeligiblefor 81appointmenttotheboardunlesssuchpersonhashadatleastthreeyearsofexperience 82intheactivepracticeoflicensedinteriordesignotherthaninteaching. 83 (3)Thepublicmembershallbe,atthetimeofappointment,acitizenoftheUnited 84States;aresidentofthisstateforaperiodofoneyearandaregisteredvoter;apersonwhois 85notandneverwasamemberofanyprofessionlicensedorregulatedpursuanttothischapter 86orthespouseofsuchperson;andapersonwhodoesnothaveandneverhashadamaterial, 87financialinterestineithertheprovidingoftheprofessionalservicesregulatedbythischapter, 88oranactivityororganizationdirectlyrelatedtoanyprofessionlicensedorregulatedpursuant HB566 10 89tothischapter.Allmembers,includingpublicmembers,shallbechosenfromlistssubmitted 90bythedirectorofthedivisionofprofessionalregistration.Thedutiesofthepublicmember 91shallnotincludethedeterminationofthetechnicalrequirementstobemetforlicensureor 92whetheranypersonmeetssuchtechnicalrequirementsorofthetechnicalcompetenceor 93technicaljudgmentofalicenseeoracandidateforlicensure. 94 6.Thegovernorshallappointthechairpersonandtheothermembersoftheboard 95whenavacancyoccurseitherbytheexpirationofatermorotherwise,andeachboard 96membershallserveuntilsuchmember'ssuccessorisappointedandhasqualified.The 97positionofchairpersonshallrotatesequentiallywithanarchitect,thenprofessionalengineer, 98thenprofessionallandsurveyor,thenprofessionallandscapearchitect,andthenlicensed 99interiordesignerandshallbealicenseewhohaspreviouslyservedasamemberofthe 100board.Theappointmentofthechairpersonshallbeforatermoffouryearswhichshallbe 101deemedtohavebegunonthedateofhisorherappointmentandshallenduponthe 102appointmentofthechairperson'ssuccessor.Thechairpersonshallnotservemorethanone 103term.Allotherappointments,excepttofillanunexpiredterm,shallbefortermsoffour 104years;butnopersonshallserveontheboardformorethantwoconsecutivefour-yearterms, 105andeachfour-yeartermshallbedeemedtohavebegunonthedateoftheexpirationofthe 106termoftheboardmemberwhoisbeingreplacedorreappointed,asthecasemaybe.Any 107appointmenttotheboardwhichismadewhenthesenateisnotinsessionshallbesubmitted 108tothesenateforitsadviceandconsentatitsnextsessionfollowingthedateofthe 109appointment. 110 7.Intheeventthatavacancyistooccurontheboardbecauseoftheexpirationofa 113filledrequirestheappointmentofanarchitect,thepresidentoftheMissouriSocietyof 114ProfessionalEngineersifthevacancytobefilledrequirestheappointmentofaprofessional 115engineer,thepresidentoftheMissouriSocietyofProfessionalSurveyorsifthevacancytobe 116filledrequirestheappointmentofaprofessionallandsurveyor,[and] thepresidentofthe 117MissouriAssociationofLandscapeArchitectsifthevacancytobefilledrequiresthe 118appointmentofaprofessionallandscapearchitect,andthepresidentsorotherchief 119executivesofanyMissourichapterofanationalcouncilforinteriordesign 120qualificationsifthevacancytobefilledrequirestheappointmentofalicensed 121interiordesigner,shallsubmittothedirectorofthedivisionofprofessionalregistrationalist 122offivearchitects[or],fiveprofessionalengineers,[or]fiveprofessionallandsurveyors,[or] 123fiveprofessionallandscapearchitects, orfivelicensedinteriordesigners,asthecasemay 124require,qualifiedandwillingtofillthevacancyinquestion,withtherecommendationthatthe 125governorappointoneofthefivepersonssolisted;andwiththelistofnamessosubmitted,the HB566 11 126presidentorotherchiefexecutiveoftheappropriateorganizationshallincludeinaletterof 127transmittaladescriptionofthemethodbywhichthenameswerechosen.Thissubsection 128shallnotapplytopublicmembervacancies. 129 8.TheboardmaysueandbesuedastheMissouriboardforarchitects,professional 130engineers,professionallandsurveyors[and],professionallandscapearchitects, andlicensed 131interiordesigners, anditsmembersneednotbenamedasparties.Membersoftheboard 132shallnotbepersonallyliableeitherjointlyorseverallyforanyactoractscommittedinthe 133performanceoftheirofficialdutiesasboardmembers,norshallanyboardmemberbe 134personallyliableforanycourtcostswhichaccrueinanyactionbyoragainsttheboard. 327.041.1.Theboardshallhavethedutyandthepowertocarryoutthepurposes 2andtoenforceandadministertheprovisionsofthischapter,torequire,bysummonsor 3subpoena,withthevoteoftwo-thirdsofthevotingboardmembers,theattendanceand 4testimonyofwitnesses,andtheproductionofdrawings,plans,plats,specifications,books, 5papersoranydocumentrepresentinganymatterunderhearingorinvestigation,pertainingto 6theissuance,probation,suspensionorrevocationofcertificatesofregistrationorcertificates 7ofauthorityprovidedforinthischapter,orpertainingtotheunlawfulpracticeofarchitecture, 8professionalengineering,professionallandsurveying[or],professionallandscape 9architecture, orlicensedinteriordesign. 10 2.Theboardshall,withinthescopeandpurviewoftheprovisionsofthischapter, 11prescribethedutiesofitsofficersandemployeesandadopt,publishandenforcetherulesand 12regulationsofprofessionalconductwhichshallestablishandmaintainappropriatestandards 13ofcompetenceandintegrityintheprofessionsofarchitecture,professionalengineering, 14professionallandsurveying[and],professionallandscapearchitecture, andlicensedinterior 15design, andadopt,publishandenforceproceduralrulesandregulationsasmaybeconsidered 16bytheboardtobenecessaryorproperfortheconductoftheboard'sbusinessandthe 17managementofitsaffairs,andfortheeffectiveadministrationandinterpretationofthe 18provisionsofthischapter.Anyruleorportionofarule,asthattermisdefinedinsection 19536.010,thatiscreatedundertheauthoritydelegatedinthischaptershallbecomeeffective 20onlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter536and,ifapplicable, 21section536.028.Thissectionandchapter536arenonseverableandifanyofthepowers 22vestedwiththegeneralassemblypursuanttochapter536toreview,todelaytheeffectivedate 23ortodisapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof 24rulemakingauthorityandanyruleproposedoradoptedafterAugust28,2001,shallbeinvalid 25andvoid. 26 3.Rulespromulgatedbytheboardpursuanttosections327.272to327.635shallbe 27consistentwithandshallnotsupersedetherulespromulgatedbythedepartmentofnatural 28resourcespursuanttochapter60. HB566 12 327.081.1.Allfundsreceivedpursuanttotheprovisionsofthischaptershallbe 2depositedinthestatetreasurytothecreditofthe"StateBoardforArchitects,Professional 3Engineers,ProfessionalLandSurveyors[and],ProfessionalLandscapeArchitects, and 4LicensedInteriorDesignersFund"whichisherebyestablished.Allexpendituresauthorized 5bythischaptershallbepaidfromfundsappropriatedtotheboardbythegeneralassembly 6fromthisfund. 7 2.Theprovisionsofsection33.080tothecontrarynotwithstanding,moneyinthis 8fundshallnotbetransferredandplacedtothecreditofgeneralrevenueuntiltheamountin 9thefundattheendofthebienniumexceedstwotimestheamountoftheappropriationfrom 10theboard'sfundsfortheprecedingfiscalyearor,iftheboardrequiresbyrulepermitrenewal 11lessfrequentlythanyearly,thenthreetimestheappropriationfromtheboard'sfundsforthe 12precedingfiscalyear.Theamount,ifany,inthefundwhichshalllapseisthatamountinthe 13fundwhichexceedstheappropriatemultipleoftheappropriationsfromtheboard'sfundsfor 14theprecedingfiscalyear. 327.381.Theboardmaylicense,initsdiscretion,anyarchitect,professionalengineer, 2professionallandsurveyor,[or]professionallandscapearchitect, orinteriordesigner 3licensed, certified,orregisteredinanotherstateorterritoryoftheUnitedStates,provinceof 4Canada,orinanothercountry,whensuchapplicanthasqualificationswhichareatleast 5equivalenttotherequirementsforlicensureasanarchitect,professionalengineer, 6professionallandsurveyor,[or]professionallandscapearchitect, orlicensedinterior 7designerinthisstate,andprovidedfurtherthattheboardmayestablishbyruletheconditions 8underwhichitshallrequireanysuchapplicanttotakeanyexaminationitconsidersnecessary, 9andprovidedfurtherthatanysuchapplicationisaccompaniedbytherequiredfee. 327.411.1.Eacharchitectandeachprofessionalengineerandeachprofessionalland 2surveyorandeachprofessionallandscapearchitectandeachlicensedinteriordesignershall 3haveapersonalsealinaformprescribedbytheboard,andheorsheshallaffixthesealtoall 4finaltechnicalsubmissions.Thepersonalsealforeachprofessionshallbedistinctfrom 5thepersonalsealforanyotherprofession.Technicalsubmissionsshallinclude,butarenot 6limitedto,drawings,specifications,plats,surveys,exhibits,reports,andcertificationsof 7constructionpreparedbythelicensee,orundersuchlicensee'simmediatepersonal 8supervision.Suchlicenseeshalleitherprepareorpersonallysupervisethepreparationof 9alldocumentssealedbythelicensee,andsuchlicenseeshallbeheldpersonallyresponsible 10forthecontentsofallsuchdocumentssealedbysuchlicensee,whetherpreparedordraftedby 11anotherlicenseeornot. 12 2.Thepersonalsealofanarchitectorprofessionalengineerorprofessionalland 13surveyororprofessionallandscapearchitectorlicensedinteriordesignershallbethelegal 14equivalentofthelicensee'ssignaturewheneverandwhereverused,andtheowneroftheseal HB566 13 15shallberesponsibleforthearchitectural,engineering,landsurveying,[or]landscape 16architectural, orinteriordesigndocuments,asthecasemaybe,whenthelicenseeplaceshis 17orherpersonalsealonsuchtechnicalsubmissionstobeusedinconnectionwith,any 18architecturalorengineeringproject,survey,[or]landscapearchitecturalproject, orinterior 19alterationorconstructionproject. Licenseesshallundertaketoperformarchitectural, 20professionalengineering,professionallandsurveying[and], professionallandscape 21architectural, andinteriordesignservicesonlywhentheyarequalifiedbyeducation, 22training,andexperienceinthespecifictechnicalareasinvolved. 23 3.Notwithstandinganyprovisionofthissection,anyarchitect,professionalengineer, 24professionallandsurveyor,[or]professionallandscapearchitect, orlicensedinterior 25designermay,butisnotrequiredto,attachastatementoverhisorhersignature, 26authenticatedbyhisorherpersonalseal,specifyingtheparticulartechnicalsubmissions,or 27portionsthereof,intendedtobeauthenticatedbytheseal,anddisclaiminganyresponsibility 28forallothertechnicalsubmissionsrelatingtoorintendedtobeusedforanypartorpartsof 29thearchitecturalorengineeringproject[or],survey[or],landscapearchitecturalproject, or 30interioralterationorconstructionproject. 31 4.Nothinginthissection,oranyruleorregulationoftheboardshallrequireany 32professionaltosealpreliminaryorincompletedocuments. 327.441.1.Theboardmayrefusetoissueanylicenseorcertificateofauthority 2requiredpursuanttothischapterforoneoranycombinationofcausesstatedinsubsection2 3ofthissection.Theboardshallnotifytheapplicantinwritingofthereasonsfortherefusal 4andshalladvisetheapplicantoftheapplicant'srighttofileacomplaintwiththe 5administrativehearingcommissionasprovidedbychapter621. 6 2.Theboardmaycauseacomplainttobefiledwiththeadministrativehearing 7commissionasprovidedbychapter621againstanyholderofanylicenseorcertificateof 8authorityrequiredbythischapteroranypersonwhohasfailedtoreneworhassurrendered 9suchperson'slicenseorcertificateofauthority,foranyoneoranycombinationofthe 10followingcauses: 11 (1)Useofanycontrolledsubstance,asdefinedinchapter195,oralcoholicbeverage 12toanextentthatsuchuseimpairsaperson'sabilitytoperformtheworkofanyprofession 13licensedorregulatedbythischapter; 14 (2)Thepersonhasbeenfinallyadjudicatedandfoundguilty,orenteredapleaof 15guiltyornolocontendere,inacriminalprosecutionunderthelawsofanystate,oftheUnited 16States,orofanycountry,foranyoffensedirectlyrelatedtothedutiesandresponsibilitiesof 17theoccupation,assetforthinsection324.012,regardlessofwhetherornotsentenceis 18imposed; HB566 14 19 (3)Useoffraud,deception,misrepresentationorbriberyinsecuringanylicenseor 20certificateofauthorityissuedpursuanttothischapterorinobtainingpermissiontotakeany 21examinationgivenorrequiredpursuanttothischapter; 22 (4)Obtainingorattemptingtoobtainanyfee,charge,tuitionorothercompensation 23byfraud,deceptionormisrepresentation; 24 (5)Incompetency,misconduct,grossnegligence,fraud,misrepresentationor 25dishonestyintheperformanceofthefunctionsordutiesofanyprofessionlicensedor 26regulatedbythischapter; 27 (6)Violationof,orassistingorenablinganypersontoviolate,anyprovisionofthis 28chapter,orofanylawfulruleorregulationadoptedpursuanttothischapter; 29 (7)Impersonationofanypersonholdingalicenseorcertificateofauthority,or 30allowinganypersontousehisorherlicenseorcertificateofauthority,ordiplomafromany 31school; 32 (8)Disciplinaryactionagainsttheholderofalicenseoracertificateofauthority,or 33otherrighttopracticeanyprofessionregulatedbythischaptergrantedbyanotherstate, 34territory,federalagencyorcountryupongroundsforwhichrevocationorsuspensionis 35authorizedinthisstate; 36 (9)Apersonisfinallyadjudgedincapacitatedordisabledbyacourtofcompetent 37jurisdiction; 38 (10)Assistingorenablinganypersontopracticeoroffertopracticeanyprofession 39licensedorregulatedbythischapterwhoisnotlicensedandcurrentlyeligibletopractice 40pursuanttothischapter. Theprovisionsofthissubdivisionshallnotapplytoprohibit 41assistingorenablinganypersontoperformoroffertoperforminteriordesignservices 42whoisnotlicensedunderthischapter; 43 (11)Issuanceofaprofessionallicenseoracertificateofauthoritybasedupona 44materialmistakeoffact; 45 (12)Failuretodisplayavalidlicenseorcertificateofauthorityifsorequiredbythis 46chapteroranyrulepromulgatedpursuanttothischapter; 47 (13)Violationofanyprofessionaltrustorconfidence; 48 (14)Useofanyadvertisementorsolicitationwhichisfalse,misleadingordeceptive 49tothegeneralpublicorpersonstowhomtheadvertisementorsolicitationisprimarily 50directed. 51 3.Afterthefilingofsuchcomplaint,theproceedingsshallbeconductedin 52accordancewiththeprovisionsofchapter621.Uponafindingbytheadministrativehearing 53commissionthatthegrounds,providedinsubsection2ofthissection,fordisciplinaryaction 54aremet,theboardmay,singlyorincombination,censureorplacethepersonnamedinthe 55complaintonprobationonsuchtermsandconditionsastheboarddeemsappropriatefora HB566 15 56periodnottoexceedfiveyears,ormaysuspend,foraperiodnottoexceedthreeyears,or 57orderacivilpenaltyundersection327.077,orrevokethelicenseorcertificateofauthorityof 58thepersonnamedinthecomplaint. 327.442.1.Atsuchtimeasthefinaltrialproceedingsareconcludedwherebya 2licensee,oranypersonwhohasfailedtoreneworhassurrenderedhisorhercertificateof 3licensureorauthority,hasbeenfinallyadjudicatedandfoundguilty,orhasenteredapleaof 4guiltyornolocontendere,ina[felony] criminalprosecutionpursuanttothelawsof[this] 5anystate,[thelawsofanyotherstate,territory,orthelaws]oftheUnitedStates[ofAmerica], 6orofanycountryforanyoffense[reasonably] directlyrelatedtothe[qualifications, 7functions,or]duties[ofalicenseepursuanttothischapteroranyfelonyoffense,anessential 8elementofwhichisfraud,dishonesty,oranactofviolence,orforanyfelonyoffense 9involvingmoralturpitude,] andresponsibilitiesoftheoccupation,assetforthinsection 10324.012,regardlessofwhetherornotsentenceisimposed,theboardforarchitects, 11professionalengineers,professionallandsurveyors[and],professionallandscapearchitects, 12andlicensedinteriordesignersmayholdadisciplinaryhearingtosinglyorincombination 13censureorplacethelicenseenamedinthecomplaintonprobationonsuchtermsand 14conditionsastheboarddeemsappropriateforaperiodnottoexceedfiveyears,ormay 15suspend,foraperiodnottoexceedthreeyears,orrevokethelicenseorcertificate. 16 2.Anyonewhohasbeenrevokedordeniedalicenseorcertificatetopracticein 17anotherstatemayautomaticallybedeniedalicenseorcertificatetopracticeinthisstate. 18However,theboardforarchitects,professionalengineers,professionallandsurveyors[and], 19professionallandscapearchitects, andlicensedinteriordesignersmayestablishother 20qualificationsbywhichapersonmayultimatelybequalifiedandlicensedtopracticein 21Missouri. 327.451.1.Anypersonwhobelievesthatanarchitectoraprofessionalengineerora 2professionallandsurveyororaprofessionallandscapearchitectoralicensedinterior 3designerhasactedorfailedtoactsothathisorherlicenseorcertificateofauthorityshould, 4pursuanttotheprovisionsofthischapter,besuspendedorrevoked,orwhobelievesthatany 5applicantforalicenseorcertificateofauthoritypursuanttotheprovisionsofthischapteris 6notentitledtoalicenseoracertificateofauthority,mayfileawrittenaffidavitwiththe 7executivedirectoroftheboardwhichtheaffiantshallsignandsweartoandinwhichthe 8affiantshallclearlysetforththereasonsfortheaffiant'schargeorchargesthatthelicenseor 9certificateofauthorityofanarchitectorprofessionalengineerorprofessionallandsurveyor 10orprofessionallandscapearchitectorlicensedinteriordesignershouldbesuspendedor 11revokedornotrenewedorthatalicenseorcertificateofauthorityshouldnotbeissuedtoan 12applicant. 41 4.Thissectiondoesnotprovideimmunitytoanyin-housepeerreviewerwhen 42performedbyemployees,coworkers,orpartnersofthedesignprofessionalwhopreparesthe 43design,norareanysuchdocumentsorpeerreviewcomments,otherthanlessonslearned, 44inadmissibleintoevidenceinanyjudicialoradministrativeaction. 45 5.Exceptfordocumentsrelatedtolessonslearned,theinterviews,memoranda, 46proceedings,findings,deliberations,reports,andminutesofthepeerreviewprocess,orthe 47existenceofthesame,concerningtheprofessionalservicesprovidedtoaclientormemberof 48thepublicaresubjecttodiscovery,subpoena,orothermeansoflegalcompulsionfortheir 49releasetoanypersonorentityandshallbeadmissibleintoevidenceinanyjudicialor 50administrativeactionforfailuretoprovideappropriatearchitectural,landscapearchitectural, HB566 25 51landsurveying,[or]engineering, orinteriordesignservices,subjecttoapplicablerulesof 52thecourtortribunal.Exceptasotherwiseprovidedinthissection,nopersonwhowasin 71subpoenaorotherauthorizedprocessfromapeerreviewerortorequiredisclosureof 72otherwiseconfidentialinformationrelatingtomattersandinvestigationswithinthe 73jurisdictionofsuchlicensingboard. 621.045.1.Theadministrativehearingcommissionshallconducthearingsandmake 2findingsoffactandconclusionsoflawinthosecaseswhen,underthelaw,alicenseissuedby 3anyofthefollowingagenciesmayberevokedorsuspendedorwhenthelicenseemaybe 4placedonprobationorwhenanagencyrefusestopermitanapplicanttobeexaminedupon 2.Ifinthefuturetherearecreatedbylawanyneworadditionaladministrative 29agencieswhichhavethepowertoissue,revoke,suspend,orplaceonprobationanylicense, 30thenthoseagenciesareundertheprovisionsofthislaw. 31 3.Theadministrativehearingcommissionisauthorizedtoconducthearingsandmake 32findingsoffactandconclusionsoflawinthosecasesbroughtbytheMissouristateboardfor 33architects,professionalengineers,professionallandsurveyors[and],professionallandscape 34architects, andlicensedinteriordesignersagainstunlicensedpersonsundersection327.076. 35 4.Notwithstandinganyotherprovisionofthissectiontothecontrary,afterAugust 3628,1995,inordertoencouragesettlementofdisputesbetweenanyagencydescribedin 37subsection1or2ofthissectionanditslicensees,anysuchagencyshall: 38 (1)Providethelicenseewithawrittendescriptionofthespecificconductforwhich 39disciplineissoughtandacitationtothelawandrulesallegedlyviolated,togetherwithcopies 40ofanydocumentswhicharethebasisthereofandtheagency'sinitialsettlementoffer,orfilea 41contestedcaseagainstthelicensee; 42 (2)Ifnocontestedcasehasbeenfiledagainstthelicensee,allowthelicenseeatleast 43sixtydays,fromthedateofmailing,toconsidertheagency'sinitialsettlementofferandto 44contacttheagencytodiscussthetermsofsuchsettlementoffer; 45 (3)Ifnocontestedcasehasbeenfiledagainstthelicensee,advisethelicenseethatthe 46licenseemay,eitheratthetimethesettlementagreementissignedbyallparties,orwithin 47fifteendaysthereafter,submittheagreementtotheadministrativehearingcommissionfor 5.Ifthelicenseedesiresreviewbytheadministrativehearingcommissionunder 54subdivision(3)ofsubsection4ofthissectionatanytimepriortothesettlementbecoming 55final,thelicenseemayrescindandwithdrawfromthesettlementandanyadmissionsoffact 56orlawintheagreementshallbedeemedwithdrawnandnotadmissibleforanypurposes 57underthelawagainstthelicensee.Anysettlementsubmittedtotheadministrativehearing 58commissionshallnotbeeffectiveandfinalunlessanduntilfindingsoffactandconclusions 59oflawareenteredbytheadministrativehearingcommissionthatthefactsagreedtobythe 60partiestothesettlementconstitutegroundsfordenyingordiscipliningthelicenseofthe 61licensee. 62 6.Whenaholderofalicense,registration,permit,orcertificateofauthorityissuedby 63thedivisionofprofessionalregistrationoraboard,commission,orcommitteeofthedivision 64ofprofessionalregistrationagainstwhomanaffirmativedecisionissoughthasfailedtoplead 65orotherwiserespondinthecontestedcaseandadequatenoticehasbeengivenundersections 66536.067and621.100uponaproperlypledwritingfiledtoinitiatethecontestedcaseunder 67thischapterorchapter536,adefaultdecisionshallbeenteredagainstthelicenseewithout 68furtherproceedings.Thedefaultdecisionshallgrantsuchreliefasrequestedbythedivision 69ofprofessionalregistration,board,committee,commission,orofficeinthewritinginitiating 70thecontestedcaseasallowedbylaw.Uponmotionstatingfactsconstitutingameritorious 71defenseandforgoodcauseshown,adefaultdecisionmaybesetaside.Themotionshallbe 72madewithinareasonabletime,nottoexceedthirtydaysafterentryofthedefaultdecision. 73"Goodcause"includesamistakeorconductthatisnotintentionallyorrecklesslydesignedto 74impedetheadministrativeprocess. [324.406.1.Thereisherebycreatedwithinthedivisionof 2 professionalregistrationacounciltobeknownasthe"InteriorDesign 3 Council".Thecouncilshallconsistoffourinteriordesignersandonepublic 4 memberappointedbythedirectorofthedivision.Thedirectorshallgivedue 5 considerationtotherecommendationsbystateorganizationsoftheinterior 6 designprofessionfortheappointmentoftheinteriordesignmemberstothe 7 council.Councilmembersshallbeappointedtoserveatermoffouryears; 8 exceptthatofthemembersfirstappointed,oneinteriordesignmemberandthe 9 publicmembershallbeappointedfortermsoffouryears,onemembershallbe 10 appointedforatermofthreeyears,onemembershallbeappointedforaterm 11 oftwoyearsandonemembershallbeappointedforatermofoneyear.No 12 memberofthecouncilshallservemorethantwoterms. 13 2.Eachcouncilmember,otherthanthepublicmember,shallbea 14 citizenoftheUnitedStates,aresidentofthestateofMissouriforatleastone 15 year,meetthequalificationsforprofessionalregistration,practiceinterior HB566 28 16 designastheperson'sprincipallivelihoodand,exceptforthefirstmembers 17 appointed,beregisteredpursuanttosections324.400to324.439asaninterior 18 designer. 19 3.Thepublicmembershallbe,atthetimeofsuchperson's 20 appointment,acitizenoftheUnitedStates,aregisteredvoter,apersonwhois 21 notandneverwasamemberoftheprofessionregulatedbysections324.400to 22 324.439orthespouseofsuchapersonandapersonwhodoesnothaveand 23 neverhashadamaterialfinancialinterestintheprovidingoftheprofessional 24 servicesregulatedbysections324.400to324.439.Thedutiesofthepublic 25 membershallnotincludethedeterminationofthetechnicalrequirementsfor 26 theregistrationofpersonsasinteriordesigners. 27 4.Theprovisionsofsection324.028pertainingtomembersofcertain 28 stateboardsandcommissionsshallapplytoallmembersofthecouncil. 29 5.Membersofthecouncilmayberemovedfromofficeforcause. 30 Uponthedeath,resignationorremovalfromofficeofanymemberofthe 31 council,theappointmenttofillthevacancyshallbefortheunexpiredportion 32 ofthetermsovacatedandshallbefilledinthesamemannerasthefirst 33 appointmentandduenoticebegiventothestateorganizationsoftheinterior 34 designprofessionpriortotheappointment. 35 6.Eachmemberofthecouncilmayreceiveascompensationan 36 amountsetbythedivisionnottoexceedfiftydollarsperdayandshallbe 37 reimbursedforthemember'sreasonableandnecessaryexpensesincurredin 38 theofficialperformanceofthemember'sdutiesasamemberofthecouncil. 39 Thedirectorshallestablishbyruleguidelinesforpayment. 40 7.Thecouncilshallmeetatleasttwiceeachyearandguide,advise, 41 andmakerecommendationstothedivisiononmatterswithinthescopeof 42 sections324.400to324.439.Theorganizationofthecouncilshallbe 43 establishedbythemembersofthecouncil.] [324.412.Thedivisionshall: 2 (1)Employ,withinthelimitsoftheappropriationsforthatpurpose, 3 suchemployeesasarenecessarytocarryouttheprovisionsofsections 4 324.400to324.439;
