timewheretheneedisnotforeseeableshallprovideawrittenpolicythat 46 containsproceduresfortheemployeetoprovidenotice.Anemployerthathas 47 notprovidedtotheemployeeacopyofitswrittenpolicyforprovidingsuch 48 noticeshallnotdenyearnedpaidsicktimetotheemployeebasedon 49 noncompliancewithsuchapolicy. 50 5.Anemployermaynotrequire,asaconditionofanemployee's 51 takingearnedpaidsicktime,thattheemployeesearchfororfinda 52 replacementworkertocoverthehoursduringwhichtheemployeeisusing 53 earnedpaidsicktime. 54 6.Earnedpaidsicktimemaybeusedinthesmallerofhourly 55 incrementsorthesmallestincrementthattheemployer'spayrollsystemusesto 56 accountforabsencesoruseofothertime. 57 7.Forearnedpaidsicktimeofthreeormoreconsecutiveworkdays, 58 anemployermayrequirereasonabledocumentationthattheearnedpaidsick 59 timehasbeenusedforapurposecoveredbysubsection1ofthissection. 60 (1)Documentationsignedbyaheathcareprofessionalindicatingthat 61 earnedpaidsicktimeisnecessaryshallbeconsideredreasonable 62 documentationforpurposesofthissection. 63 (2)Incasesofdomesticviolence,sexualassault,orstalking,ifthe 64 employerrequests,oneofthefollowingtypesofdocumentationselectedby 65 theemployeeshallbeconsideredreasonabledocumentation:(i)apolice 66 reportindicatingthattheemployeeortheemployee'sfamilymemberwasa 67 victimofdomesticviolence,sexualassault,orstalking;(ii)awrittenstatement 68 fromanemployeeoragentofavictimserviceprovideraffirmingthatthe 69 employeeoremployee'sfamilymemberisorwasreceivingservicesfroma 70 victimserviceprovider;(iii)documentationsignedbyahealthcare 71 professionalfromwhomtheemployeeoremployee'sfamilymembersought 72 20 otherhealthcareprovidersinMissouri. 21 3.Amunicipality,county,city,town,orvillagemayadoptordinances, 22 rules,andregulationstoinvestigateandascertaincompliancewithsections 23 290.600through290.642,establishandimplementasystemtoreceive 24 complaintsregardingnoncompliancewithsections290.600through290.642 25 andtoinvestigateandattempttoresolvecomplaintsbetweenthecomplainant 26 andthesubjectofthecomplaint,andestablishadditionalmeansof 27 enforcement,withrespecttoemployerswithin,oremployeesperforming 28 workwhilephysicallypresentin,thegeographicboundariesofthe 29 municipality,county,city,town,orvillage.Anysuchordinance,rule,or 30 regulationshallbeconsistentwiththislawandanydepartmentrulesor 31 regulationsandsystemforcomplianceandenforcement.Themunicipality, 32 county,city,town,orvillagemayexercisesuchpowersasallowedbyany 33 applicablecharterorordinance,includingrequiringbysubpoenathetestimony 34
