HCSHB593 2 36 3.Hemp,industrialhemp,hemp-derivedconsumablebeverageproducts,and 37hemp-derivedproductsthatdonotcontainintoxicatingcannabinoidsshallnotbe 38consideredmarijuanaandshallnotbesubjecttothelegalframeworkcontainedin 39ArticleXIVoftheConstitutionofMissouri.Nothinginthissectionshallbeinterpreted 40toregulatehemp,industrialhemp,hemp-derivedconsumablebeverageproducts,or 41productsthatdonotcontainintoxicatingcannabinoids,andtheprovisionsofthis 42sectionshallnotbeinterpretedinamannerthatwouldconflictwithorotherwise 43preempttheAgricultureImprovementActof2018,Pub.L.115-334. 44 4.Nothinginthissectionprohibitstheinterstatecommerceofhemporthe 45transportationorshipmentofhempthroughthisstate. 46 5.Notwithstandinganyprovisionoflawtothecontrary,allintoxicating 47cannabinoidproductsaremarijuanaandshallberegulatedbythedepartmentinthe 48samemannerasthedepartmentregulatesmarijuanaunderArticleXIVofthe 49ConstitutionofMissouriincluding,butnotlimitedto,requiringintoxicating 50cannabinoidproductstobesubjecttothesamegrowing,manufacturing,dispensing, 51transportation,advertising,marketing,testing,packaging,andlabelingrequirementsas 52marijuanaandrequiringallintoxicatingcannabinoidproductstobecultivated, 53manufactured,andsoldonlyatalicensedcomprehensivefacility,medicalfacility,or 54marijuanamicrobusinessfacility,assuchtermsaredefinedinArticleXIVofthe 55ConstitutionofMissouri.Thedepartmentshallregulateallintoxicatingcannabinoid 56productsconsistentwith,andinadditionto,othernaturalmarijuanaproductsin 57accordancewithitsconstitutionallymandatedrequirementtoregulatemarijuana 58withintheframeworkofArticleXIVoftheConstitutionofMissouri. 59 6.NopersonorentityengagedinthesaleofproductsthatcontainCBD,hemp, 60marijuana,cannabinoids,orintoxicatingcannabinoidsorinthesaleofparaphernaliato 61aidinthehumanconsumptionofsuchproducts,otherthanacomprehensivemarijuana 62dispensaryfacility,medicalmarijuanadispensaryfacility,ormicrobusinessdispensary 63facility,assuchtermsaredefinedinArticleXIVoftheConstitutionofMissouri,shall 64carryon,conduct,ortransactbusinessunderanamethatcontainsaspartofthename 65theword"dispensary"oranywordofsimilarimport. 66 7.Thedepartmentshallcollaboratewiththedepartmentofpublicsafetyandall 67otherpertinentlawenforcementagenciesinthisstatetoensuretheprovisionsofthis 68sectionareenforced. 69 8.Thedepartmentofhealthandseniorservicesshallpromulgateallrulesand 70regulationsnecessarytoimplementtheprovisionsofthissection.Thedepartmentand 71thedepartmentofpublicsafetyshallactivelyandaggressivelyenforcetheprovisionsof 72thissectionandalldepartmentrulesandregulationspromulgatedunderthissection. 9 (4)Knowinglydistributefreesamplesofahemp-derivedconsumablebeverage 10productinoronapublicstreet,sidewalk,orpark; 11 (5)Knowinglysellhemp-derivedconsumablebeverageproductsinorona 12publicstreet,sidewalk,orparkwithoutobtainingatemporaryeventpermitfromthe 13division;or 14 (6)Knowinglysellordistributeahemp-derivedconsumablebeverageproduct 15withouthavingfirstobtainedproofofagefromtheprospectivepurchaserorrecipient 16unlessanordinarypersonwouldconcludeonthebasisofappearancethatthe 17prospectivepurchaserorrecipientisnotundertwenty-oneyearsofage. 18 2.Apersonundertwenty-oneyearsofageshallnot: 19 (1)Knowinglypurchase,possess,oracceptreceiptofahemp-derived 20consumablebeverageproduct;or 21 (2)Knowinglypresentpurportedproofofagethatisfalseorfraudulentorthat 22doesnotactuallyidentifythepersonforthepurposeofpurchasingorreceivingahemp- 23derivedconsumablebeverageproduct. 24 3.Anyhemp-derivedconsumablebeverageproduct,includingthoseincasesor 25boxes,offeredforretailsaleshallbemerchandisedinsuchamanner,whichmay 26include,butshallnotbelimitedto,signage,shelf-talkers,andstickersoncoolerdoors, 27soastoclearlyindicatetoconsumerstheproductscontainhemp-derivedcannabinoids 28andareforsaleonlytopersonstwenty-oneyearsofageorolder. 29 4.Anypersonwhoviolatesanyprovisionofthissectionshallbesubjecttoafine 30nottoexceedtwohundredfiftydollarsforafirstviolationtobepaidintothestate 31schoolmoneysfundestablishedundersection166.051asprovidedbylawforotherfines 32andpenalties.ThepenaltyforanysecondorsubsequentviolationshallbeaclassD 33misdemeanor. 34 5.Thedivisionshallenforcesections195.2540to195.2620inamannerthatmay 35reasonablybeexpectedtoreducetheextenttowhichhemp-derivedconsumable 36beverageproductsaresoldordistributedtopersonsundertwenty-oneyearsofageand 37shallconductinspectionsatlocationswheresuchproductsaresoldordistributedto 38ensurecompliancewithsections195.2540to195.2620. HCSHB593 7 39 6.Nothinginthissectionshallprohibitlawenforcementfromusingthe 40followingpersonstoenforcetheprovisionsofthissection: 41 (1)Anyminorundereighteenyearsofageiftheminor'sparentorlegal 42guardianhasconsentedtotheminor'sinvolvementintheenforcementeffort;and 43 (2)Anypersoneighteenyearsofageorolderandundertwenty-oneyearsofage 44ifthepersonhasconsentedtohisorherinvolvementintheenforcementeffort. 45 7.Notwithstandingtheprovisionsofthischapterorchapter579oranyother 46provisionoflawtothecontraryotherthantheprovisionsofsubsection8ofthissection, 47anypurchase,possession,consumption,use,manufacture,transportation,or 48distributionofanyhemp-derivedconsumablebeverageproductthatcomplieswith 49theprovisionsofsections195.2540to195.2620shallbelawful. 50 8.Ifthesaleofhemp-derivedconsumablebeverageproductsbecomesillegal 51underfederallaw,thefollowingprovisionsshallapply: 52 (1)Thesaleofhemp-derivedconsumablebeverageproductsinthisstateshallbe 53prohibited; 54 (2)Anylicenseissuedbythedivisionundersections195.2540to195.2620shall 55berevoked;and 56 (3)Thedivisionshallnotbegin,orshallstop,issuinganylicensesundersections 57195.2540to195.2620. 195.2560.1.Apersonorentitythatisinthebusinessofhemp-derived 2consumablebeverageproductsinthisstate,includinganymanufacturer,distributor,or 3retailer,shallobtainalicensefromthedivisionauthorizingthepersonorentityto 4engageinthatbusinesspriortothecommencementofthebusinessor,forabusiness 5operatingbeforetheeffectivedateoftherulespromulgatedundersections195.2540to 6195.2620,withinatimeperiodspecifiedbythedivisionbyrule. 7 2.Anypersonorentityengaginginthebusinessofmanufacturingorselling 8hemp-derivedconsumablebeverageproductsinthisstatewithoutavalidlicense 9requiredundersections195.2540to195.2620shallbesubjecttoafinenottoexceedtwo 10hundredfiftydollars. 11 3.(1)Anylicensegrantedtoaretailershallbelocation-specific.Thedivision 12shallrequirearetailertoobtainaseparatelicenseforeachlocationatwhichtheretailer 13sellshemp-derivedconsumablebeverageproductsforconsumption. 14 (2)Anylicensegrantedtoamanufacturerordistributorshallnotbelocation- 15specific.Thedivisionshallnotrequireamanufacturerordistributortoobtaina 16separatelicenseforeachlocationatwhichthemanufacturerordistributoroperates. 17 4.Toobtainandmaintainamanufacturer,distributor,orretailerlicenseunder 18thissection,apersonorentityshall: HCSHB593 8 19 (1)Submittothedivisioninformationthedivisionprescribesasnecessaryfor 20theefficientenforcementofsections195.2540to195.2620; 21 (2)Forinitiallicensing,paytothedivisionafeeof: 22 (a)Formanufacturersanddistributors,fivehundreddollars;and 23 (b)Forretailers,twohundredfiftydollarsperlocation,nottoexceedtwo 24thousandfivehundreddollarsforaretailerwithmultiplelocations;and 25 (3)Consenttoreasonableinspectionandsamplingbythedivisionoftheperson's 26orentity'sinventoryofhemp-derivedconsumablebeverageproducts. 27 5.Alicenseissuedunderthissectionshallbevalidforaperiodofoneyearand 28mayberenewedannually.Thedivisionshallchargeanannualrenewalfeeof: 29 (1)Formanufacturersanddistributors,twohundredfiftydollars;and 30 (2)Forretailers,onehundreddollarsperlocation,nottoexceedtwothousand 31fivehundreddollarsforaretailerwithmultiplelocations. 32 6.Thedivisionmaydenyorrevokealicenseforanyviolationofsections 33195.2540to195.2620ortherulespromulgatedundersections195.2540to195.2620. 34 7.Nomorethanninetydaysafterthepromulgationofrulesundersections 35195.2540to195.2620,thedivisionshallissuelicensesforthemanufacture,distribution, 36andsaleofhemp-derivedconsumablebeverageproductsinthisstate. 37 8.Notwithstandinganyotherprovisionofthissection,anyapplicantthatmeets 38therequirementssetforthinsections195.2540to195.2620shallbeissuedalicenseby 39thedivision.Alicenseapplicationshallbeautomaticallydeemedapproved,anda 40licenseshallbeissued,ifthedivisionfailstoapproveordenytheapplicationwithin 41thirtydaysofthedateofthesubmissionoftheapplication. 42 9.Allfeespayableunderthissectionshallbecollectedbythedivisionand 43transmittedtothedepartmentofrevenuefordepositinthestatetreasurytothecreditof 44thehempbusinessfundestablishedundersection195.2563. 195.2563.1.Thereisherebycreatedinthestatetreasurythe"HempBusiness 2Fund".Allfeesauthorizedtobechargedbythedivisionundersection195.2560shallbe 3collectedbythedirectorofthedivisionandshallbetransmittedtothedepartmentof 4revenuefordepositinthestatetreasuryforcredittothisfund.Thestatetreasurershall 5becustodianofthefund.Inaccordancewithsections30.170and30.180,thestate 6treasurermayapprovedisbursements.Thefundshallbeadedicatedfundand,upon 7appropriation,moneysinthisfundshallbeusedsolelyfortheadministrationofsections 8195.2540to195.2620. 9 2.Notwithstandingtheprovisionsofsection33.080tothecontrary,anymoneys 10remaininginthefundattheendofthebienniumshallnotreverttothecreditofthe 11generalrevenuefund. 6 (2)Specifythedatebywhichhemp-derivedconsumablebeverageproduct 7businessesoperatingbeforetheeffectivedateoftherulespromulgatedunderthis 8sectionshallobtainalicensetocontinueoperating;and 9 (3)Setforthrequirementsforbusinessoperationsinaccordancewithsections 10195.2540to195.2620. 11 2.BeforeApril1,2026,thedepartmentshallpromulgaterulesonthetestingof 12hemp-derivedconsumablebeverageproducts. 13 3.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis 14createdundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifit 15complieswithandissubjecttoalloftheprovisionsofchapter536and,ifapplicable, 16section536.028.Thissectionandchapter536arenonseverableandifanyofthepowers 17vestedwiththegeneralassemblypursuanttochapter536toreview,todelaythe 18effectivedate,ortodisapproveandannularulearesubsequentlyheldunconstitutional, 19thenthegrantofrulemakingauthorityandanyruleproposedoradoptedafterthe 20effectivedateofthissectionshallbeinvalidandvoid. 195.2575.1.Thelabelofahemp-derivedconsumablebeverageproductoffered 2fordistributionorsaleinthisstateshallcontainthefollowinginformationinnotless 3thanthree-pointfont: 4 (1)Productnameorcommonnameonthefrontofthelabel; 5 (2)Brandnameonthefrontofthelabel; 6 (3)Sizeofthecontainerornetcountofindividualitemsonthefrontofthelabel; 7 (4)Netweightorvolume; 8 (5)Suggestedproductuse,includingservingsizesiftheproductisintendedfor 9ingestion; 10 (6)Listofingredients,including: 11 (a)Theamountofanyadvertisedcannabinoidinmilligrams;and 12 (b)Theamountofanyprimarycannabinoidinmilligrams; 13 (7)Listofpotentialallergens; 14 (8)Thenameandaddressofthemanufacturerordistributor; 20 (12)Astatementtokeepoutofthereachofchildren; 21 (13)Astatementthattheproductisonlyforpersonstwenty-oneyearsofageor 22older; 23 (14)Astatementtoconsultaphysicianbeforeuse; 24 (15)Astatementthatconsuminghemp-derivedconsumablebeverageproducts 25mayresultinafaileddrugtest;and 26 (16)Abest-bydateinaccordancewithrulespromulgatedbythedepartment. 27 2.Thelabelofeachhemp-derivedconsumablebeverageproductshallinclude: 28 (1)Thefollowingtext:"ThisproducthasnotbeenevaluatedbytheFoodand 29DrugAdministration.Thisproductisnotintendedtodiagnose,treat,cure,mitigate,or 30preventanydisease.";and 31 (2)Thefollowingtext:"Warning–Thesafetyofthisproducthasnotbeen 32determined.". 33 3.Hemp-derivedconsumablebeverageproductlabelsshallnot: 34 (1)Haveanylikenessorbearanyreasonableresemblancetoahuman,animal, 35cartooncharacter,orfictionalcharacter; 36 (2)Appeartoimitateafood,candy,orothercommonlyavailablesnackproduct 37thatistypicallymarketedtowardorappealingtochildren;or 38 (3)InfringeuponanytrademarksprotectedbytheUnitedStatesPatentand 39TrademarkOfficeortheMissouriofficeofthesecretaryofstate. 195.2580.1.Ahemp-derivedconsumablebeverageproductthatissoldinthis 2stateshallbelabeledinaccordancewithsection195.2575andincludeaquickresponse 3codethatdirectsconsumerstoalllabelinformationrequiredbysection195.2575andall 4informationonproducttestingrequiredbydepartmentrules. 5 2.(1)Ahemp-derivedconsumablebeverageproductthatissoldinthisstate 6shallbemanufacturedintheUnitedStatesunderallapplicablelawsgoverningthe 7manufactureofhemp-derivedproductsinitsjurisdictionoforiginincluding,butnot 8limitedto,abidingbyCurrentGoodManufacturingPractices(CGMP)andGenerally 9RecognizedasSafe(GRAS)standards. 10 (2)Notwithstandingtheprovisionsofsubdivision(1)ofthissubsection, 11cannabinoidsareallowedinahemp-derivedconsumablebeverageproductdespitenot HCSHB593 11 12havingGRASstatus.Allingredientsotherthancannabinoidsinthefinalhemp-derived 13consumablebeverageproductshallhaveGRASstatus. 14 3.Anyhemp-derivedconsumablebeverageproductthatissoldinthisstateshall 15notbesoldwithoutavalidlyissuedcertificateofanalysisissuedbyanindependent 16testinglaboratorywithintheprevioustwenty-fourmonths. 17 4.Ahemp-derivedconsumablebeverageproductthatissoldorofferedforsale 18inviolationofsections195.2540to195.2620shallbesubjecttoseizureandforfeiture. 195.2585.1.Aretailerormanufacturerofahemp-derivedconsumablebeverage 2productshallnotadvertise,market,orofferforsaleahemp-derivedconsumable 3beverageproductbyusinganytradedress,trademark,branding,orrelatedimageryor 4scenerythatisprohibitedunderthissectioninthelabelingordesignoftheproductor 5productpackagingorinadvertisingormarketingmaterialsfortheproduct. 6 2.Anytradedress,trademark,branding,orrelatedimageryorsceneryshallbe 7prohibitedunderthissectionifthetradedress,trademark,branding,orrelated 8imageryorscenerydepictsorsignifiescharactersorsymbolsknowntoappealprimarily 9topersonsundertwenty-oneyearsofageormimicscommonlyavailablecandyorsnack 10products. 11 3.Nothinginthissectionprohibitstheuseofdrawings,illustrations,orartwork 12depictingnonmythicalcreatures,inanimateobjects,scenery,humanoidcharacters, 13fruit-orflavor-focusedimages,oranyotheritemsnotknowntoappealprimarilyto 14personsundertwenty-oneyearsofage. 195.2590.1.Sections195.2540to195.2620shallnotbeconstruedtopermita 2persontoundertakeanytaskwhileimpairedbytheuseofahemp-derivedconsumable 3beverageproductifdoingsowouldconstitutenegligenceorprofessionalmalpractice. 4 2.(1)Apersonshallnotoperate,navigate,orbeinactualphysicalcontrolofa 5motorvehicle,aircraft,motorizedwatercraft,oranyothervehiclewhileimpairedbythe 6useofahemp-derivedconsumablebeverageproduct. 7 (2)Conductwhileintoxicatedfromtheuseofahemp-derivedconsumable 8beverageproductshallbesubjecttothepenaltiesfordrivingwhileintoxicatedunder 9section577.010inthesamemannerthatconductwhileintoxicatedfromtheuseofany 10otherdrugissubjecttosuchpenalties. 11 3.(1)Apersonshallnotdriveamotorvehicleonapublicroadwhileconsuming 12ahemp-derivedconsumablebeverageproduct. 13 (2)Apersonshallnotpossessanopencontainerofahemp-derivedconsumable 14beverageproductwhiledrivingamotorvehicleonapublicroad. 15 (3)Aviolationofsubdivision(1)or(2)ofthissubsectionisaninfractionfor 16whichfourpointsshallbeassessedtotheperson'sdrivingrecord. HCSHB593 12 17 4.Sections195.2540to195.2620shallnotrequireanemployertoaccommodate 18theuseofahemp-derivedconsumablebeverageproductintheworkplaceoran 19employeeworkingwhileimpairedbytheuseofahemp-derivedconsumablebeverage 20product. 21 5.Sections195.2540to195.2620shallnotexemptapersonfromprosecutionfor 22acriminaloffenserelatedtoimpairmentorintoxicationresultingfromtheuseofa 23hemp-derivedconsumablebeverageproductorrelieveapersonfromanyrequirement 24underthelawtosubmittoabreath,blood,urine,orothertesttodetectthepresenceofa 25controlledsubstance. 195.2595.1.Nothinginsections195.2540to195.2620shallprohibithemp- 2derivedconsumablebeverageproductmanufacturersfromassigningexclusive 3territoriesfordistributionofhemp-derivedconsumablebeverageproducts. 4 2.(1)Anyperson,cooperative,orbusinessholdinganyoneofthethreetypesof 5hemp-derivedconsumablebeverageproductlicenseswhoisengagedintheproduction, 6manufacturing,distribution,orsaleofhemp-derivedconsumablebeverageproducts 7shallnotholdeitheroftheothertwotypesofhemp-derivedconsumablebeverage 8productlicensesandshallnothaveafinancialinterest,eitherdirectorindirect,ina 9person,cooperative,orbusinessholdinganyoftheothertwotypesofhemp-derived 10consumablebeverageproductlicenses. 11 (2)Ahemp-derivedconsumablebeverageproductmanufacturershallnot 12directlysolicit,sell,orotherwiseconveyhemp-derivedconsumablebeverageproductsto 13retailers.Hemp-derivedconsumablebeverageproductmanufacturersareauthorizedto 14solicitandsellhemp-derivedconsumablebeverageproductstohemp-derived 15consumablebeverageproductdistributors.Hemp-derivedconsumablebeverage 16productdistributorsareauthorizedtosolicitandsellhemp-derivedconsumable 17beverageproductstohemp-derivedconsumablebeverageproductretailers. 18 (3)Theprohibitionsofthissubsectionshallnotapplytoanyhemp-derived 19consumablebeverageproductmanufacturerwhosellslessthanonethousandgallonsof 20theproducteachyear. 21 3.Nopersonorentityshalldeliver,ship,orcausetobedeliveredorshippedany 22hemp-derivedconsumablebeverageproductdirectlytoanyresidentofthisstate. 195.2600.1.Eachhemp-derivedconsumablebeverageproductdistributedor 2availablefordistributioninthisstateshallbeofficiallyregisteredwiththedivisionand 3shallcomplywiththerequirementsofthissection. 4 2.Applicationforregistrationshallbemadetothedivisiononaformprovided 5bythedivisionandshallincludethefollowinginformation: 6 (1)Thenameandaddressoftheapplicant; HCSHB593 13 7 (2)Thenameandaddressofthepersonwhosenamewillappearonthelabelif 8suchpersonisnottheapplicant; 9 (3)Thenameoftheproduct; 10 (4)Thetypeanduseoftheproduct; 11 (5)Acompletecopyofthelabelasitwillappearontheproductinalegible 12format; 13 (6)IftheproducthasbeenassignedaNationalDrugCodeinaccordancewith21 14CFR207.33,theNationalDrugCodenumber;and 15 (7)Theapplicant'sproofofusingCurrentGoodManufacturingPractices 16(CGMP)andGenerallyRecognizedasSafe(GRAS)standardsasrequiredunder 17sections195.2540to195.2620. 18 3.Theapplicationforregistrationshallincludeacertificateofanalysisforthe 19hemp-derivedconsumablebeverageproductthatisfromanindependenttesting 20laboratoryandthatmeetsrequirementssetforthinrulespromulgatedbythe 21department. 22 4.Thedivisionmaydenyregistrationforanincompleteapplication. 23 5.Anewregistrationisrequiredforanyofthefollowing: 24 (1)Anychangeinahemp-derivedconsumablebeverageproduct'singredients; 25 (2)Anychangetothedirectionsforuse;and 26 (3)Anychangeofnamefortheproduct. 27 6.Anychangenotdescribedinsubsection5ofthissectionshallnotrequirea 28newregistration,buttheregistrantshallsubmitcopiesofeachlabelchangetothe 29divisionassoonasthechangeiseffective. 30 7.Theregistrantisresponsiblefortheaccuracyandcompletenessofthe 31informationsubmitted. 32 8.Ahemp-derivedconsumablebeverageproductthathasbeendiscontinued 33shallcontinuetoberegisteredinthestateuntiltheproductisnolongeravailablefor 34distribution. 195.2605.1.Testingofanyhemp-derivedconsumablebeverageproductfor 2purposesofsections195.2540to195.2620shallbeconductedonthehemp-derived 3consumablebeverageproductinitsfinalforminaccordancewiththerulespromulgated 4bythedepartment. 5 2.Thecertificateofanalysisforahemp-derivedconsumablebeverageproduct 6shallreportthetestresultsrequiredbydepartmentrulesinspecifiedunitsofmeasure 7andinaccordancewiththerequirementsforahemp-derivedconsumablebeverage 8productinsection195.2580. HCSHB593 14 195.2607.1.Thedivisionshallconductrandomizedinspectionsofhemp-derived 2consumablebeverageproductsdistributedoravailablefordistributioninthisstatefor 3compliancewiththerequirementsofsections195.2540to195.2620. 4 2.Thedivisionshallperiodicallysample,analyze,andtesthemp-derived 5consumablebeverageproductsdistributedwithinthisstateforcompliancewith 6registrationandlabelingrequirementsandthecertificateofanalysis. 7 3.Thedivisionmayconductinspectionsofhemp-derivedconsumablebeverage 8productsdistributedoravailablefordistributionforanyreasonthedivisiondeems 9necessary. 195.2610.1.Allretailestablishmentsandfoodserviceestablishmentsoffering 2hemp-derivedconsumablebeverageproductsshallbelicensedbythedivisionin 3accordancewithsections195.2540to195.2620. 4 2.Ahemp-derivedconsumablebeverageproductmaybesoldbyon-premises 5retailersorinfoodserviceestablishmentsifthehemp-derivedconsumablebeverage 6producthasbeenregisteredinaccordancewithsection195.2600.Anyotherhemp- 7derivedconsumablebeverageproductorclassofproductsshallnotbesoldbyon- 8premisesretailersorinfoodserviceestablishments. 9 3.Aretailestablishment,on-premisesretailer,orfoodserviceestablishment 10shallnotofferhemp-derivedconsumablebeverageproductsatatemporaryeventor 11festivalunlesstheretailestablishment,on-premisesretailer,orfoodservice 12establishmentislicensedbythedivisioninaccordancewithsections195.2540to 13195.2620andobtainsatemporaryeventpermitfromthedivision. 14 4.Abusinessthatdistributes,sells,orserveshemp-derivedconsumable 15beverageproductsshallnotpermitanypersonwhoisundertwenty-oneyearsofageto 16servehemp-derivedconsumablebeverageproductsunlessthepersonisanemployeeof 17thebusinesswhoiseighteenyearsofageorolderandunderthedirectsupervisionofa 18persontwenty-oneyearsofageorolder. 19 5.Ahemp-derivedconsumablebeverageproductshallnotbesoldforon-site 20consumptionunlesstheprospectivepurchaserorrecipienthaspresentedproofofageor 21anordinarypersonwouldconcludeonthebasisofappearancethattheprospective 22purchaserorrecipientisnotundertwenty-oneyearsofage. 23 6.Exceptassetforthinthissection,onlyprepackagedregisteredhemp-derived 24consumablebeverageproductsshallbeofferedfordirectconsumptionaton-premises 25retailersorfoodserviceestablishments. 26 7.Hemp-derivedconsumablebeverageproductsshallnotbeaddedtoan 27ingestiblefoodproductatafoodserviceestablishment. HCSHB593 15 28 8.Hemp-derivedconsumablebeverageproductsmaybecombinedwith 29nonalcoholicingestiblebeverageproductsatanon-premisesretailerorfoodservice 30establishment. 31 9.On-premisesretailersandfoodserviceestablishmentsservinghemp-derived 32consumablebeverageproductsshallnotprovidehemp-derivedconsumablebeverage 33productstoindividualswhoarebelievedtobeintoxicated. 34 10.Anon-premisesretailerorfoodserviceestablishmentofferinganyhemp- 35derivedconsumablebeverageproductshallprovidetoconsumersuponrequest: 36 (1)Thecommonnameoftheproduct;and 37 (2)Thedistributorormanufactureroftheproduct. 38 11.On-sitesamplingofhemp-derivedconsumablebeverageproductsprovided 39byamanufactureratthemanufacturer'splaceofbusinessispermittedprovidedthat 40thepersonssamplingaretwenty-oneyearsofageorolderandthesamplingisconducted 41inamannerthatreflectsresponsibleservingpractices. 195.2615.Thedivisionmayregulatetheadvertisingandpromotionofhemp- 2derivedconsumablebeverageproductsales,butanysuchregulationshallbenomore 3stringentthancomparablestateregulationsontheadvertisingandpromotionofalcohol 4sales. 195.2617.ForalltaxyearsbeginningonorafterJanuary1,2026,anexcisetaxis 2leviedandimposedupontheretailsaleofhemp-derivedconsumablebeverageproducts 3toconsumerswithinthisstateattherateandinthemannersetforthinsection144.028. 195.2620.1.Asusedinthissection,thefollowingtermsmean: 2 (1)"Goodcause": 3 (a)Failurebythehemp-derivedconsumablebeverageproductdistributorto 4complysubstantiallywiththeprovisionsofanagreementorunderstandingwiththe 5hemp-derivedconsumablebeverageproductmanufactureriftheprovisionsareboth 6essentialandreasonable; 7 (b)Useofbadfaithorfailuretoobservereasonablecommercialstandardsof 8fairdealinginthetrade;or 9 (c)Revocationorsuspensionformorethanthirtydaysofthehemp-derived 10consumablebeverageproductdistributor'sstateorlocallicenserequiredforthenormal 11operationsofitsbusiness; 12 (2)"Goodfaith",thedutyofeachpartytoanyfranchiseandallofficers, 13employees,oragentsthereoftoactinafairandequitablemannertowardeachother. 14 2.Ifmorethanonefranchiseforthesamebrandorbrandsofhemp-derived 15consumablebeverageproductsisgrantedtodifferenthemp-derivedconsumable 16beverageproductdistributorsinthisstate,itshallbeunlawfulforanyhemp-derived HCSHB593 16 17consumablebeverageproductmanufacturertodiscriminatebetweenthedistributors 18withrespecttoanyoftheterms,provisions,andconditionsofthesefranchises. 19 3.Notwithstandingtheterms,provisions,andconditionsofanyfranchise,no 20hemp-derivedconsumablebeverageproductmanufacturershallunilaterallyterminate 21orrefusetocontinueorchangesubstantiallytheconditionofanyfranchisewiththe 22hemp-derivedconsumablebeverageproductdistributorunlessthemanufacturerhas 23firstestablishedgoodcauseforsuchtermination,noncontinuance,orchange. 24 4.Anyhemp-derivedconsumablebeverageproductdistributormaybringan 25actioninacourtofcompetentjurisdictionagainstahemp-derivedconsumablebeverage 26productmanufacturerforviolationofanyoftheprovisionsofthissectionandmay 27recoverdamagessustainedbysuchdistributortogetherwiththecostsoftheactionand 28reasonableattorney'sfees. 29 5.Inanyactionbroughtbyahemp-derivedconsumablebeverageproduct 30distributoragainstahemp-derivedconsumablebeverageproductmanufacturerfor 31termination,noncontinuance,orsubstantialchangeinviolationoftheprovisionsofthis 32section,itisacompletedefenseforthehemp-derivedconsumablebeverageproduct 33manufacturertoprovethatthetermination,noncontinuance,orsubstantialchangewas 34doneingoodfaithandforgoodcause. ✔ HCSHB593 17
