schoolemployeeretirementsystems.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section169.596,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection169.596,toreadasfollows:
169.596.1.Notwithstandinganyotherprovisionofthischaptertothecontrary,a
2retiredcertificatedteacherreceivingaretirementbenefitfromtheretirementsystem
3establishedpursuanttosections169.010to169.141may,withoutlosinghisorherretirement
4benefit,teachfulltimeforuptofouryearsforaschooldistrictcoveredbysuchretirement
5system;providedthattheschooldistricthasashortageofcertifiedteachers,asdeterminedby
6theschooldistrict,andprovidedthatnosuchretiredcertificatedteachershallbeemployedas
7asuperintendent.Thetotalnumberofsuchretiredcertificatedteachersshallnotexceed,at
8anyonetime,thegreaterofonepercentofthetotalcertificatedteachersandnoncertificated
9staffforthatschooldistrict,orfivecertificatedteachers.
10 2.Notwithstandinganyotherprovisionofthischaptertothecontrary,aperson
11receivingaretirementbenefitfromtheretirementsystemestablishedpursuanttosections
12169.600to169.715may,withoutlosinghisorherretirementbenefit,beemployedfulltime
13foruptofouryearsforaschooldistrictcoveredbysuchretirementsystem;providedthatthe
14schooldistricthasashortageofnoncertificatedemployees,asdeterminedbytheschool
15district.Thetotalnumberofsuchretirednoncertificatedemployeesshallnotexceed,atany
16onetime,the[lesseroften]greaterofonepercentofthetotalcertificatedteachersand
17noncertificatedstaffforthatschooldistrict,orfiveemployees.

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18 3.Theemployer'scontributionrateshallbepaidbythehiringschooldistrict.
19 4.Inordertohireteachersandnoncertificatedemployeespursuanttotheprovisions
20ofthissection,theschooldistrictshall:
21 (1)Showagoodfaithefforttofillpositionswithnonretiredcertificatedteachersor
22nonretirednoncertificatedemployees;
23 (2)Postthevacancyforatleastonemonth;
24 (3)Havenotofferedearlyretirementincentivesforeitheroftheprevioustwoyears;
25 (4)Solicitapplicationsthroughthelocalnewspaper,othermedia,orteacher
26educationprograms;
27 (5)Determinethereisaninsufficientnumberofeligibleapplicantsfortheadvertised
28position;and
29 (6)Declareacriticalshortageofcertificatedteachersornoncertificatedemployees
30thatisactiveforoneyear.
31 5.AnypersonhiredpursuanttothissectionshallbeincludedintheStateDirectoryof
32NewHiresforpurposesofincomeandeligibilityverificationpursuantto42U.S.C.Section
