Torepealsections198.022,198.525,and198.526,RSMo,andtoenactinlieuthereofthree
newsectionsrelatingtoinspectionsoffacilitieslicensedbythedepartmentofhealth
andseniorservices.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Sections198.022,198.525,and198.526,RSMo,arerepealedandthree
2newsectionsenactedinlieuthereof,tobeknownassections198.022,198.525,and198.526,
3toreadasfollows:
198.022.1.Uponreceiptofanapplicationforalicensetooperateafacility,the
2departmentshallreviewtheapplication,investigatetheapplicantandthestatementsswornto
3intheapplicationforlicenseandconductanynecessaryinspections.Alicenseshallbeissued
4ifthefollowingrequirementsaremet:
5 (1)Thestatementsintheapplicationaretrueandcorrect;
6 (2)Thefacilityandtheoperatorareinsubstantialcompliancewiththeprovisionsof
7sections198.003to198.096andthestandardsestablishedthereunder;
8 (3)Theapplicanthasthefinancialcapacitytooperatethefacility;
9 (4)Theadministratorofanassistedlivingfacility,askillednursingfacility,oran
10intermediatecarefacilityiscurrentlylicensedundertheprovisionsofchapter344;
11 (5)Neithertheoperatornoranyprincipalsintheoperationofthefacilityhaveever
12beenconvictedofafelonyoffenseconcerningtheoperationofalong-termhealthcarefacility
13orotherhealthcarefacilityoreverknowinglyactedorknowinglyfailedtoperformanyduty
14whichmateriallyandadverselyaffectedthehealth,safety,welfareorpropertyofaresident,
15whileactinginamanagementcapacity.Theoperatorofthefacilityoranyprincipalinthe

17(Medicare)orTitleXIX(Medicaid)programofanystateorterritory;
18 (6)Neithertheoperatornoranyprincipalsinvolvedintheoperationofthefacility
19haveeverbeenconvictedofafelonyinanystateorfederalcourtarisingoutofconduct
20involvingeithermanagementofalong-termcarefacilityortheprovisionorreceiptofhealth
21care;and
22 (7)Allfeesduetothestatehavebeenpaid.
23 2.Upondenialofanyapplicationforalicense,thedepartmentshallsonotifythe
24applicantinwriting,settingforththereinthereasonsandgroundsfordenial.
25 3.Thedepartmentmayinspectanyfacilityandanyrecordsandmaymakecopiesof
26records,atthefacility,atthedepartment'sownexpense,requiredtobemaintainedbysections
27198.003to198.096orbytherulesandregulationspromulgatedthereunderatanytimeifa
28licensehasbeenissuedtooranapplicationforalicensehasbeenfiledbytheoperatorofsuch
29facility.Copiesofanyrecordsrequestedbythedepartmentshallbepreparedbythestaffof
30suchfacilitywithintwobusinessdaysorasdeterminedbythedepartment.Thedepartment
31shallnotremoveordisassembleanymedicalrecordduringanyinspectionofthefacility,but
32mayobservethephotocopyingormaymakeitsowncopiesifthefacilitydoesnothavethe
33technologytomakethecopies.Inaccordancewiththeprovisionsofsection198.525,the
34departmentshallmakeatleast[oneinspection] twoinspectionsperyear,whichshallbe
35unannouncedtotheoperator.Thedepartmentmaymakesuchotherinspections,announced
36orunannounced,asitdeemsnecessarytocarryouttheprovisionsofsections198.003to
37198.136.
38 4.Wheneverthedepartmenthasreasonablegroundstobelievethatafacilityrequired
39tobelicensedundersections198.003to198.096isoperatingwithoutalicense,andthe
40departmentisnotpermittedaccesstoinspectthefacility,orwhenalicensedoperatorrefuses
41topermitaccesstothedepartmenttoinspectthefacility,thedepartmentshallapplytothe
42circuitcourtofthecountyinwhichthepremisesislocatedforanorderauthorizingentryfor
43suchinspection,andthecourtshallissuetheorderifitfindsreasonablegroundsfor
44inspectionorifitfindsthatalicensedoperatorhasrefusedtopermitthedepartmentaccessto
45inspectthefacility.
46 5.Wheneverthedepartmentisinspectingafacilityinresponsetoanapplicationfrom
47anoperatorlocatedoutsideofMissourinotpreviouslylicensedbythedepartment,the
48departmentmayrequestfromtheapplicantthepastfiveyearsofcompliancehistoryofall
49facilitiesownedbytheapplicantlocatedoutsideofthisstate.
198.525.1.Inordertocomplywithsections198.012and198.022,thedepartmentof
2healthandseniorservicesshallinspectresidentialcarefacilities,assistedlivingfacilities,
HB598	2 3intermediatecarefacilities,andskillednursingfacilities,includingthosefacilitiesattachedto
4acutecarehospitalsatleast[once] twiceayear.
5 2.Thedepartmentshallnotassignanindividualtoinspectorsurveyalong-termcare
6facilitylicensedunderthischapter,foranypurpose,inwhichtheinspectororsurveyorwasan
7employeeofsuchfacilitywithintheprecedingtwoyears.
8 3.Foranyinspectionorsurveyofafacilitylicensedunderthischapter,regardlessof
9thepurpose,thedepartmentshallrequireeverynewlyhiredinspectororsurveyoratthetime
10ofhiringor,withrespecttoanycurrentlyemployedinspectororsurveyorasofAugust28,
112009,todisclose:
12 (1)ThenameofeveryMissourilicensedlong-termcarefacilityinwhichheorshe
13hasbeenemployed;and
14 (2)Thenameofanymemberofhisorherimmediatefamilywhohasbeenemployed
15oriscurrentlyemployedataMissourilicensedlong-termcarefacility.

17Thedisclosuresunderthissubsectionshallbedisclosedtothedepartmentwhenevertheevent
18givingrisetodisclosurefirstoccurs.
19 4.Forpurposesofthissection,thephrase"immediatefamilymember"shallmean
20husband,wife,naturaloradoptiveparent,child,sibling,stepparent,stepchild,stepbrother,
21stepsister,father-in-law,mother-in-law,son-in-law,daughter-in-law,brother-in-law,sister-in-
22law,grandparentorgrandchild.
23 5.Theinformationcalledforinthissectionshallbeapublicrecordunderthe
24provisionsofsubdivision(6)ofsection610.010.
25 6.Anypersonmaynotifythedepartmentiffactsexistthatwouldleadareasonable
26persontoconcludethatanyinspectororsurveyorhasanypersonalorbusinessaffiliationthat
27wouldresultinaconflictofinterestinconductinganinspectionorsurveyforafacility.Upon
28receivingthatnotice,thedepartment,whenassigninganinspectororsurveyortoinspector
29surveyafacility,foranypurpose,shalltakestepstoverifytheinformationand,ifthe
30departmenthasprobablecausetobelievethatitiscorrect,shallnotassigntheinspectoror
31surveyortothefacilityoranyfacilitywithinitsorganizationsoastoavoidanappearanceof
32prejudiceorfavortothefacilityorbiasonthepartoftheinspectororsurveyor.
198.526.1.Thedepartmentofhealthandseniorservicesshallinspectallfacilities
2licensedbythedepartmentatleast[once] twiceeachyear.Suchinspectionsshallbe
3conducted:
4 (1)Withoutthepriornotificationofthefacility;and
5 (2)Attimesoftheday,ondatesandatintervalswhichdonotpermitfacilitiesto
6anticipatesuchinspections.
HB598	3 7 2.Thedepartmentshallannuallyreevaluatetheinspectionprocesstoensurethe
8requirementsofsubsection1ofthissectionaremet.
9 3.Informationregardingunannouncedinspectionsshallbedisclosedtoemployeesof
10thedepartmentonaneed-to-knowbasisonly.Anyemployeeofthedepartmentwho
11knowinglydisclosesthetimeofanunannouncedinspectioninviolationofthissectionis
12guiltyofaclassAmisdemeanorandshallhavehisorheremploymentimmediately
13terminated.
