Toamendchapter558,RSMo,byaddingtheretoonenewsectionrelatingtoanenhanced
sentenceforwearingfaceorbodycoveringsduringthecommissionofanoffense,
withpenaltyprovisions.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Chapter558,RSMo,isamendedbyaddingtheretoonenewsection,tobe
2knownassection558.022,toreadasfollows:
558.022.1.Ifapersonisconvictedofamisdemeanororfelonyanditisfoundas
2providedinthissectionthatthepersonworeamask,hood,disguise,orotherclothingor
3adevicethatconcealedorattemptedtoconcealtheperson'sidentityatthetimeofthe
4offense,thepersonshallbeguiltyofamisdemeanororfelonythatisoneclasshigher
5thantheunderlyingmisdemeanororfelonyforwhichthepersonwasconvicted.
6Notwithstandinganyprovisionoflaw,thecourtshallimposeasentenceof
7imprisonmentforapersonconvictedofanoffenseenhancedunderthissectionif,
8afterenhancement,theclassofoffenseandpriorrecordlevelpermitactivepunishment
9asasentencedisposition.
10 2.Anindictmentorinformationfortheoffenseshallallegeinthatindictmentor
11informationorinaseparateindictmentorinformationthefactsthatqualifytheoffense
12foranenhancementundersubsection1ofthissection.Onepleadingshallbesufficient
13foralloffensesthataretriedatasingletrial.
14 3.Thestateshallprovetheissuessetoutinsubsection1ofthissectionbeyonda
15reasonabledoubtduringthesametrialinwhichthedefendantistriedfortheoffense
16unlessthedefendantpleadsguiltyornocontesttotheissues.Ifthedefendantpleads
