minimumwageexemptionforcertainemployees.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section290.502,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection290.502,toreadasfollows:
290.502.1.Exceptasmaybeotherwiseprovidedpursuanttosections290.500to
2290.530,effectiveJanuary1,2007,everyemployershallpaytoeachemployeewagesatthe
3rateof$6.50perhour,orwagesatthesamerateorratessetundertheprovisionsoffederal
4lawastheprevailingfederalminimumwageapplicabletothosecoveredjobsininterstate
5commerce,whicheverrateperhourishigher.
6 2.TheminimumwageshallbeincreasedordecreasedonJanuary1,2008,andon
7January1ofsuccessiveyears,bytheincreaseordecreaseinthecostofliving.OnSeptember
830,2007,andoneachSeptember30ofeachsuccessiveyear,thedirectorshallmeasurethe
9increaseordecreaseinthecostoflivingbythepercentageincreaseordecreaseasofthe
10precedingJulyoverthelevelasofJulyoftheimmediatelyprecedingyearoftheConsumer
11PriceIndexforUrbanWageEarnersandClericalWorkers(CPI-W)orsuccessorindexas
12publishedbytheU.S.DepartmentofLabororitssuccessoragency,withtheamountofthe
13minimumwageincreaseordecreaseroundedtothenearestfivecents.
14 3.(1)Exceptasmaybeotherwiseprovidedpursuanttosections290.500to290.530
15andundersubdivision(2)ofthissubsection, andnotwithstandingsubsection1ofthis
16section,effectiveJanuary1,2025,everyemployershallpaytoeachemployeewagesatthe
17rateofnotlessthan$13.75perhour,orwagesatthesamerateorratessetunderthe

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18provisionsoffederallawastheprevailingfederalminimumwageapplicabletothosecovered
19jobsininterstatecommerce,whicheverrateperhourishigher.Thereafter,theminimum
20wageestablishedbythissubsectionshallbeincreasedby$1.25perhour,to$15.00perhour,
21effectiveJanuary1,2026.Thereafter,theminimumwageestablishedbythissubsectionshall
22beincreasedordecreasedonJanuary1,2027,andonJanuary1ofsuccessiveyears,perthe
23methodsetforthinsubsection2ofthissection.Ifatanytimethefederalminimumwagerate
24isaboveoristhereafterincreasedabovetheminimumwagethenineffectunderthis
25subsection,theminimumwagerequiredbythissubsectionshallcontinuetobeincreased
26pursuanttothissubsection,butthehigherfederalrateshallimmediatelybecomethe
27minimumwagerequiredbythissubsectionandshallbeincreasedordecreasedperthe
28methodsetforthinsubsection2forsolongasitremainshigherthanthestateminimumwage
29requiredandincreasedpursuanttothissubsection.
30 (2)(a)Exceptwhereotherwiserequiredbyfederallaw,beginningonandafter
31theeffectivedateofthissection,anyincreaseintheminimumwageunderthissection
32beginningonorafterJanuary1,2025,shallnotapplytoanyemployeewhoisunder
33twentyyearsofage.
34 (b)TheminimumwagerateineffectonDecember31,2024,shallbethe
35applicablerateforemployeesundertwentyyearsofage,notwithstandinganyother
36exemptions,lowerwagerates,prevailingwagerates,orotherexceptionsorpreemptions
37ofthestateminimumwagelawthatareallowedunderthischapter,generallaw,or
38federallaw.
39 (c)Employersemployingemployeesundertwentyyearsofagewhoareexempt
40underthissubdivisionshallstillbesubjecttotheremainingapplicableprovisionsof
41sections290.500to290.530asappliedtotheminimumwagerateineffectonDecember
4231,2024.
43 (d)Theexemptionprovidedunderthissubdivisionshallapplyonlyto
44employmentcompensationpaidoraccruedonoraftertheeffectivedateofthis
45sectionandshallnotberetroactiveineffect.
46 (e)Thedepartmentmaypromulgateallnecessaryrulesandregulationsforthe
47administrationofthissection.Anyruleorportionofarule,asthattermisdefinedin
48section536.010,thatiscreatedundertheauthoritydelegatedinthissectionshall
49becomeeffectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter
50536and,ifapplicable,section536.028.Thissectionandchapter536arenonseverable
51andifanyofthepowersvestedwiththegeneralassemblypursuanttochapter536to
52review,todelaytheeffectivedate,ortodisapproveandannularulearesubsequently
53heldunconstitutional,thenthegrantofrulemakingauthorityandanyruleproposedor
54adoptedafterAugust28,2025,shallbeinvalidandvoid.
HB625	2 55 4.Forpurposesofthissection,theterm"publicemployer"meansanemployerthatis
56thestateorapoliticalsubdivisionofthestate,includingadepartment,agency,officer,bureau,
57division,board,commission,orinstrumentalityofthestate,oracity,county,town,village,
58schooldistrict,orotherpoliticalsubdivisionofthestate.Subsection3ofthissectionshallnot
59applytoapublicemployerwithrespecttoitsemployees.Anypublicemployerthatissubject
60tosubsections1and2ofthissectionshallcontinuetobesubjecttothosesubsections.
