Torepealsection116.160,RSMo,andtoenactinlieuthereofonenewsectionrelatingto
constitutionalamendments.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section116.160,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection116.160,toreadasfollows:
116.160.1.Ifthegeneralassemblyadoptsajointresolutionproposinga
2constitutionalamendmentorabillwithoutafiscalnotesummary,whichistobereferredtoa
3voteofthepeople,afterreceiptofsuchresolutionorbillthesecretaryofstateshallpromptly
4forwardtheresolutionorbilltothestateauditor.Ifthegeneralassemblyadoptsajoint
5resolutionproposingaconstitutionalamendmentorabillwithoutanofficialsummary
6statement,whichistobereferredtoavoteofthepeople,withintwentydaysafterreceiptof
7theresolutionorbill,thesecretaryofstateshallprepareandtransmittotheattorneygenerala
8summarystatementofthemeasureastheproposedsummarystatement.Thesecretaryof
9state[may] shallseektheadviceofthelegislatorwhointroducedtheconstitutional
10amendmentorbillandthespeakerofthehouseorthepresidentprotemofthelegislative
11chamberthatoriginatedthemeasure.Thesummarystatementmaybedistinctfromthe
12legislativetitleoftheproposedconstitutionalamendmentorbill.Theattorneygeneralshall
13withintendaysapprovethelegalcontentandformoftheproposedstatement.
14 2.Ifthegeneralassemblyadoptsajointresolutionproposingaconstitutional
15amendmentorstatutorymeasurethatincludesanofficialsummarystatement,the
16statementshallappearontheballot,andnocourtshallhavetheauthoritytorewriteor
17editthesummarystatementorballotlanguage.Ifsuchsummarystatementorballot
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18languageischallengedincourtandthecourtfindsthesummarystatementorballot
19languagetobelegallyflawed,thegeneralassemblyshallrewriteoreditthestatementor
20languageifthegeneralassemblyisinsessionatthetimeofthecourt'sruling.Ifsucha
21court'srulingismadeatatimewhenthegeneralassemblyisnotinsession,the
22secretaryofstateshallrewriteoreditthestatementorlanguage.

24words[, excludingarticles]. Thetitleshallbeatrueandimpartialstatementofthepurposesof
25theproposedmeasureinlanguageneitherintentionallyargumentativenorlikelytocreate
