BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Sections116.160and116.334,RSMo,arerepealedandtwonewsections
2enactedinlieuthereof,tobeknownassections116.160and116.334,toreadasfollows:
116.160.1.Ifthegeneralassemblyadoptsajointresolutionproposinga
2constitutionalamendmentorabillwithoutafiscalnotesummary,whichistobereferredtoa
3voteofthepeople,afterreceiptofsuchresolutionorbillthesecretaryofstateshallpromptly
4forwardtheresolutionorbilltothestateauditor.Ifthegeneralassemblyadoptsajoint
5resolutionproposingaconstitutionalamendmentorabillwithoutanofficialsummary
6statement,whichistobereferredtoavoteofthepeople,withintwentydaysafterreceiptof
7theresolutionorbill,thesecretaryofstateshallprepareandtransmittotheattorneygenerala
8summarystatementofthemeasureastheproposedsummarystatement.Thesecretaryof
9state[may] shallseektheadviceofthelegislatorwhointroducedtheconstitutional
10amendmentorbillandthespeakerofthehouseorthepresidentprotemofthelegislative
11chamberthatoriginatedthemeasure.Thesummarystatementmaybedistinctfromthe
12legislativetitleoftheproposedconstitutionalamendmentorbill.Theattorneygeneralshall
13withintendaysapprovethelegalcontentandformoftheproposedstatement.
14 2.Ifthegeneralassemblyadoptsajointresolutionproposingaconstitutional
15amendmentorstatutorymeasurethatincludesanofficialsummarystatement,the
16statementshallappearontheballot,andnocourtshallhavetheauthoritytorewriteor
17editthesummarystatementorballotlanguage.Ifsuchsummarystatementorballot
18languageischallengedincourtandthecourtfindsthesummarystatementorballot
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 19languagetobelegallyflawed,thegeneralassemblyshallrewriteoreditthestatementor
20languageifthegeneralassemblyisinsessionatthetimeofthecourt'sruling.Ifsucha
21court'srulingismadeatatimewhenthegeneralassemblyisnotinsession,the
22secretaryofstateshallrewriteoreditthestatementorlanguage.
23 [2.]3.Theofficialsummarystatementshallcontainnomorethan[fifty] one
24hundredwords,excludingarticles.Thetitleshallbeatrueandimpartialstatementofthe
25purposesoftheproposedmeasureinlanguageneitherintentionallyargumentativenorlikely
26tocreateprejudiceeitherfororagainsttheproposedmeasure.
116.334.1.Ifthepetitionformisapproved,thesecretaryofstateshallmakeacopy
2ofthesamplepetitionavailableonthesecretaryofstate'swebsite.Foraperiodoffifteen
3daysafterthepetitionisapprovedastoform,thesecretaryofstateshallacceptpublic
4commentsregardingtheproposedmeasureandprovidecopiesofsuchcommentsupon
5request.Withintwenty-threedaysofreceiptofsuchapproval,thesecretaryofstateshall
6prepareandtransmittotheattorneygeneralasummarystatementofthemeasurewhichshall
7beaconcisestatementnotexceedingonehundredwords, excludingarticles. Thisstatement
8shallbeintheformofaquestionusinglanguageneitherintentionallyargumentativenor
9likelytocreateprejudiceeitherfororagainsttheproposedmeasure.Theattorneygeneral
10shallwithintendaysapprovethelegalcontentandformoftheproposedstatement.
11 2.Signaturesobtainedpriortothedatetheofficialballottitleiscertifiedbythe
12secretaryofstateshallnotbecounted.
13 3.Signaturesforstatutoryinitiativepetitionsshallbefilednotlaterthansixmonths
14priortothegeneralelectionduringwhichthepetition'sballotmeasureissubmittedforavote,
15andshallalsobecollectednotearlierthanthedayafterthedayuponwhichtheprevious
