Torepealsection68.080,RSMo,andtoenactinlieuthereofonenewsectionrelatingtothe
waterwaysandportstrustfund.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section68.080,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection68.080,toreadasfollows:
68.080.1.Thereisherebyestablishedinthestatetreasurythe"WaterwaysandPorts
2TrustFund".Thefundshallconsistofrevenuesappropriatedtoitbythegeneralassembly.
3 2.Thefundmayalsoreceiveanygifts,contributions,grants,orbequestsreceived
4fromfederal,private,orothersources.
5 3.Thefundshallbearevolvingtrustfundexemptfromtheprovisionsofsection
633.080relatingtothetransferofunexpendedbalancesbythestatetreasurertothegeneral
7revenuefundofthestate.Allinterestearneduponthebalanceinthefundshallbedeposited
8tothecreditofthefund.
9 4.MoneysinthefundshallbewithdrawnonlyattherequestofaMissouriport
10authorityforstatutorilypermittedportpurposesanduponappropriationbythegeneral
11assembly,tobeadministeredbythestatehighwaysandtransportationcommissionandthe
12departmentoftransportation,inconsultationwithMissouripublicports,forthepurposesin
13subsection2ofsection68.035andfornootherpurpose.Tobeeligibletoreceivean
14appropriationfromthefund,aprojectshallbe:
15 (1)Acapitalimprovementprojectimplementingphysicalimprovementsdesignedto
16improvecommerceorterminalandtransportationfacilitiesonoradjacenttothenavigable
17riversofthisstate;

19onlandownedbyacitynotwithinacountyandmanagedbyaMissouriportauthority,
20orwithinanavigableriveradjacenttosuchland,andwithintheboundariesofaport
21authority;
22 (3)Fundedbyalternatesourcessothatmoneysfromthefundcomprisenomorethan
23eightypercentofthecostoftheproject;
24 (4)Selectedandapprovedbythehighwaysandtransportationcommission,in
25consultationwithMissouripublicports,tosupportastatewideplanforwaterborne
26commerce,inaccordancewithsubdivision(1)ofsection68.065;and
27 (5)Capableofcompletionwithintwoyearsofapprovalbythehighwaysand
28transportationcommission.
29 5.Appropriationsmadefromthefundestablishedinthissectionmaybeusedasa
30localshareinapplyingforothergrantprograms.
31 6.TheprovisionsofthissectionshallterminateonAugust28,2033,pendingthe
32dischargeofallwarrants.OnDecember31,2033,thefundshallbedissolvedandthe
33unencumberedbalanceshallbetransferredtothegeneralrevenuefund.
