97 (c)Thepersonandmotorvehiclearein[hisorher]theperson'sdwellingunitor 98uponpremisesoverwhichthe[actor] personhaspossession,authority, orcontrol[,]; or 99 (d)Thepersonistraveling[in]onacontinuousjourneypeaceablythroughthisstate. 100 101Subdivision(10)ofsubsection1ofthissectiondoesnotapplyifthefirearmisotherwise 102lawfullypossessedbyapersonwhiletraversingschoolpremisesforthepurposesof 103transportingastudenttoorfromschool,orpossessedbyanadultforthepurposesof 104facilitationofaschool-sanctionedfirearm-relatedeventorclubevent. 105 4.Subdivisions(1),(8),and(10)ofsubsection1ofthissectionshallnotapplytoany 106personwhohasavalidconcealedcarrypermitissuedpursuanttosections571.101to 107571.121,avalidconcealedcarryendorsementissuedbeforeAugust28,2013,oravalid 108permitorendorsementtocarryconcealedfirearmsissuedbyanotherstateorpolitical 109subdivisionofanotherstate. 110 5.Subdivisions(3),(4),(5),(6),(7),(8),(9),and(10)ofsubsection1ofthissection 111shallnotapplytopersonswhoareengagedinalawfulactofdefensepursuanttosection 112563.031. 113 6.Notwithstandinganyprovisionofthissectiontothecontrary,thestateshallnot 114prohibitanystateemployeefromhavingafirearmintheemployee'svehicleonthestate's 115propertyprovidedthatthevehicleislockedandthefirearmisnotvisible.Thissubsection 116shallonlyapplytothestateasanemployerwhenthestateemployee'svehicleisonproperty 117ownedorleasedbythestateandthestateemployeeisconductingactivitieswithinthescope 118ofhisorheremployment.Forthepurposesofthissubsection,"stateemployee"meansan 119employeeoftheexecutive,legislative,orjudicialbranchofthegovernmentofthestateof 120Missouri. 121 7.(1)Subdivision(10)ofsubsection1ofthissectionshallnotapplytoapersonwho 122isaschoolofficercommissionedbythedistrictschoolboardundersection162.215orwhois 123aschoolprotectionofficer,asdescribedundersection160.665. 124 (2)Nothinginthissectionshallmakeitunlawfulforastudenttoactuallyparticipate 125inschool-sanctionedgunsafetycourses,studentmilitaryorROTCcourses,orotherschool- 126sponsoredorclub-sponsoredfirearm-relatedevents,providedthestudentdoesnotcarrya HB693 4 127firearmorotherweaponreadilycapableoflethaluseintoanyschool,ontoanyschoolbus,or 128ontothepremisesofanyotherfunctionoractivitysponsoredorsanctionedbyschoolofficials 129orthedistrictschoolboard. 130 8.Apersonwhocommitsthe[crime] offenseofunlawfuluseofweaponsunder: 131 (1)Subdivision(2),(3),(4),or(11)ofsubsection1ofthissectionshallbeguiltyofa 132classEfelony; 133 (2)Subdivision(1),(6),(7),[or](8),or(12)ofsubsection1ofthissectionshallbe 134guiltyofaclassBmisdemeanor,exceptwhenaconcealedweaponistransportedorcarried 135ontoanyprivatepropertywhoseownerhaspostedthepremisesasbeingoff-limitsto 136concealedfirearmsbymeansofoneormoresignsdisplayedinaconspicuousplaceofa 137minimumsizeofeleveninchesbyfourteenincheswiththewritingthereoninlettersofnot 138lessthanoneinch,inwhichcasethepenaltiesofsubsection2ofsection571.107shallapply; 139 (3)Subdivision(5)or(10)ofsubsection1ofthissectionshallbeguiltyofaclassA 140misdemeanorifthefirearmisunloadedandaclassEfelonyifthefirearmisloaded; 141 (4)Subdivision(9)ofsubsection1ofthissectionshallbeguiltyofaclassBfelony, 142exceptthatiftheviolationofsubdivision(9)ofsubsection1ofthissectionresultsininjuryor 143deathtoanotherperson,itisaclassAfelony. 144 9.Violationsofsubdivision(9)ofsubsection1ofthissectionshallbepunishedas 145follows: 146 (1)Forthefirstviolationapersonshallbesentencedtothemaximumauthorizedterm 147ofimprisonmentforaclassBfelony; 148 (2)Foranyviolationbyaprioroffenderasdefinedinsection558.016,apersonshall 149besentencedtothemaximumauthorizedtermofimprisonmentforaclassBfelonywithout 150thepossibilityofparole,probationorconditionalreleaseforatermoftenyears; 151 (3)Foranyviolationbyapersistentoffenderasdefinedinsection558.016,aperson 152shallbesentencedtothemaximumauthorizedtermofimprisonmentforaclassBfelony 153withoutthepossibilityofparole,probation,orconditionalrelease; 166 (2)Beforesuchretirement,wasauthorizedbylawtoengageinorsupervisethe 167prevention,detection,investigation,orprosecutionof,ortheincarcerationofanypersonfor, 168anyviolationoflaw,andhadstatutorypowersofarrest; 169 (3)Beforesuchretirement,wasregularlyemployedasapeaceofficerforan 170aggregateoffifteenyearsormore,orretiredfromservicewithsuchagency,aftercompleting 171anyapplicableprobationaryperiodofsuchservice,duetoaservice-connecteddisability,as 172determinedbysuchagency; 173 (4)Hasanonforfeitablerighttobenefitsundertheretirementplanoftheagencyif 174suchaplanisavailable; 175 (5)Duringthemostrecenttwelve-monthperiod,hasmet,attheexpenseofthe 176individual,thestandardsfortrainingandqualificationforactivepeaceofficerstocarry 177firearms; 178 (6)Isnotundertheinfluenceofalcoholoranotherintoxicatingorhallucinatorydrug 179orsubstance;and 180 (7)Isnotprohibitedbyfederallawfromreceivingafirearm. 181 13.Theidentificationrequiredbysubdivision(1)ofsubsection2ofthissectionis: 182 (1)Aphotographicidentificationissuedbytheagencyfromwhichtheindividual 183retiredfromserviceasapeaceofficerthatindicatesthattheindividualhas,notlessrecently 184thanoneyearbeforethedatetheindividualiscarryingtheconcealedfirearm,beentestedor 185otherwisefoundbytheagencytomeetthestandardsestablishedbytheagencyfortraining 186andqualificationforactivepeaceofficerstocarryafirearmofthesametypeastheconcealed 187firearm;or 188 (2)Aphotographicidentificationissuedbytheagencyfromwhichtheindividual 189retiredfromserviceasapeaceofficer;and 190 (3)Acertificationissuedbythestateinwhichtheindividualresidesthatindicates 191thattheindividualhas,notlessrecentlythanoneyearbeforethedatetheindividualis 192carryingtheconcealedfirearm,beentestedorotherwisefoundbythestatetomeetthe 193standardsestablishedbythestatefortrainingandqualificationforactivepeaceofficersto 194carryafirearmofthesametypeastheconcealedfirearm. ✔ HB693 6
